I. DECISION Decision on Substantive Permit: The City Community Development Director has determined that the application for a minor modification to design review does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision. Prior to issuance of the building permit revisions, the following conditions shall be met: Revise D10-159 to show the following: o The building permit drawings should be revised to include the latest S4 sheet (attached) and show the recycle and trash compactor areas. Washington 98188 • Phone 206-431-3670 • Fax: 206-431-3665 o The proposed addition shall be CMU faced and shall reflect the pattern and colors that are used on the adjacent wall section. o The roof over the proposed addition shall be standing seam metal in burgundy color that matches existing awnings. o Paint the roll -up door and entrance door in a burgundy color that matches existing awnings. o Remove the canvas awnings from the area above the new addition. o Maintain a clear path of travel on the remaining sidewalk. Relocate or remove the parking signs if necessary. o Contact Allied Waste to determine their trash collection needs. If changes need to be made to the sidewalk (ramps or designated space), code compliance will be reviewed at the building permit stage. o Revise the building permit set to show the entrance design submitted with the minor modification application. o Label the awning color and material in the building permit set. o Include a landscape plan for this area showing the current landscaping, the path, and the plants that will be relocated and where they will be moved to. The landscape plan shall include tree protection measures for the existing mature vegetation during construction and transplanting instructions for the relocated vegetation. Future Sign Permit shall reflect: o The red used in the sign shall be the same burgundy used in the awnings. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the -issuance of this Decision (August 24, 2010). The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. Appeal fee of $515 (retainer). V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Stacy MacGregor, who may be contacted at 206-431-7166 for further information. Location: 17950 Southcenter Parkway Associated Files: PL10-045-Project file, D10 -159 -Building Permit, PRE10-006 Preapplication file, L97- 0063 Design Review for Theater and two pad restaurants Comprehensive Plan Tukwila Urban Center (TUC) Designation/Zoning District: SEPA Determination: Exempt Background In 1998, the Board of Architectural Review (BAR) approved an addition to the Parkway Super Center. Plans called for remodeling the facade of a theater and creating two restaurant pad sites. Subsequently, in 1999, one of the pad sites was constructed as a retail store. The applicant plans to remodel this location from a retail use to a restaurant. This application represents changes to the facade of the building and the site and ensures the requested changes comply with the BAR review criteria. Request The following changes to the exterior are subject to BAR Design Review criteria: 1. Add an attached, enclosed storage area to contain walk-in refrigerators, trash compactor, recycling area, and means of egress. 2. Add a decorative awning above the entrance door. 3. Create a new means of emergency egress and path through the landscaping. 4. New signage is proposed for the building. Review Criteria For the proposed modifications to the BAR approved design, the following criteria have been highlighted due to their relationship to the proposed changes. Comments regarding the current submittal have been made as they relate to the relevant criteria. Add an attached, enclosed storage area to contain walk-in refrigerators, trash compactor, recycling area, and means of egress. Relationship of Structure to Site (b) Parking and service areas should be located, designed and screened to moderate the visual impact of large paved areas. Landscape and Site Treatment (f) Screening of service yards, and other places that tend to be unsightly, should be accomplished by use of walls, fencing, planting or combination. Building Design (a) Architectural style is not restricted; evaluation of a project should be based on quality of its design and relationship to its surroundings; (c) Building components such as windows, doors, eaves, and parapets should have good proportions and relationship to one another. Building components and ancillary parts shall.be consistent with anticipated life of the structure; (d) Colors should be harmonious, with bright or brilliant colors used only for accent. The applicant is proposing to create an addition to the north side of the building. The addition will house trash and recycling as well as walk-in refrigerators and provide another means of egress. The addition will extend ten feet deep onto an existing fifteen foot sidewalk. The siding materials are not described on the plan but renderings imply the addition will be made of CMU block like the rest of the building. The roof over the addition is a standing seam metal roof in a burgundy color that matches the color of the existing canvas awnings on the building. Discussion The proposed service addition extends from a recess in the existing building ten feet onto an existing fifteen foot sidewalk. Five feet of sidewalk will remain after the addition which will maintain ADA standards. However, a clear path of travel on the remaining sidewalk may be compromised by parking signs shown in the adjacent photograph. These signs may need to be moved or relocated if the path of travel is not clear. A rendering indicates the addition will be made of CMU while one of the drawings implies it will be faced in plaster or stucco. To meet the criteria for design review, CMU block should be used to maintain a harmonious design and ensure the addition integrates and relates to the existing structure. The existing CMU walls use three colors in a horizontal pattern. The addition should preserve this pattern. The doors and roof color are shown in a burgundy color that will match the new and existing awnings and help the addition relate to the existing building. The existing canvas awnings are depicted in some of the renderings and are absent in others. The awnings above the addition should be removed; they become redundant with the addition being fully enclosed. The trash and recycling contained within the new structure will need to be accessible to the waste management company. No curb cut or access point is shown on the plans. The applicant will need to verify with Allied Waste that the proposed design will meet their needs or make changes to the sidewalk that will meet code in addition to meeting trash collection requirements. Landscape and Site Treatment (b) Grades of walks, parking spaces, terraces and other paved areas should promote safety and provide an inviting and stable appearance; (d) In locations where plants will be susceptible to injury by pedestrian or motor traffic, mitigating steps should be taken. A new exit door is being added to the south side of the building. This is a code -required additional means of egress from the building. The emergency exit door opens onto an existing landscape area and a paved path will curve through the landscaping and connect to an existing path. Discussion The proposed path will go through existing, mature landscaping. At least two shrubs and an area of ground cover will be impacted by this path. The existing mature plants can be relocated within this landscape area. Steps should be taken to protect the existing irrigation system and the mature small trees from construction work in this area. Conditions: Revise D10-159 o Include a landscape plan for this area showing the current landscaping, the path, and the plants that will be relocated and where they will be moved to. The landscape plan shall include tree protection measures for the existing mature vegetation during construction and transplanting instructions for the relocated vegetation. 4. New signage is proposed for the building. Miscellaneous Structures and Street Furniture (a) Miscellaneous structures ad street future should be designed to be part of the architect component of design and landscape. Materials should be compatible with buildings, scale should be appropriate, colors should be in harmony with buildings and surroundings and proportions should be to scale. The plans submitted for minor modification show three wall signs. Under the current code, only two wall signs are permitted per business. The City is in the process of adopting a new sign code with adoption anticipated for September. A sign permit application will be vested to the code that is in effect at the time that a complete sign permit application is received by the City. A sign permit has not yet been submitted. For design review, signs will be reviewed according to the stated criteria but are not reviewed for code compliance. Discussion The plans show three identical signs with channel cut letters in white, red, and yellow. Signs are shown on the east and west facades with a third sign over the entrance. To maintain harmonious colors, the red color used in the word "Buffet" should be a similar color as the burgundy in the awning material. While not shown in the photograph, the former use had a projecting awning over the front entrance. The awning had the business name printed on it; it was removed when the business closed. This application proposes to place a burgundy, half -dome awning over the entrance door. A sample of the awning material was included. The development permit submitted with this project showed an enclosed addition to the front entrance. This application makes no mention of an addition. Discussion The new awning replaces a previous awning and helps to delineate the front entrance. The new canopy is covered with a vinyl fabric while the existing canopies are covered in canvas but the colors are the same. The front entrance is visually and functionally enhanced with the proposed awning. Conditions: Revise D10-159 o Revise the building permit set to show the entrance design submitted with the minor modification application. o Label the awning color and material in the building permit set. Conclusion The conditions listed above and summarized below need to be incorporated into the Mizuki Japanese Buffet in keeping with the BAR design criteria. The changes to the design will trigger a minor modification to design review. An application is necessary and approval is needed prior to issuance of your building permit. Provide the following items. When I review the plans, I will be looking for: • How the trash enclosure area interacts with the awning and connects to the walls. • Recycling is not shown in the dumpster area. Recycling storage space shall be provided at 3 sf for every 1,000 sf of gross floor area. • How the metal roof works as a new element. It may be appropriate to change the existing fabric awnings to metal awnings to pull these features together. • How the addition of the front entrance interacts with the existing facade. Provide elevations and renderings of the front addition and the trash edition. • Provide the materials and colors used for the 2 additions. Use colors and finishes that relate to the existing surfaces and colors so the building appears as one integrated structure. • The new exit door on the south side does not have a paved path to provide exiting. Show the path and the impacts to the existing mature vegetation. Every effort should be made to preserve the existing landscaping. Show tree protection measures to protect the mature trees. Provide a landscape plan if there are any impacts to the existing vegetation. Review the design review criteria at TMC 18.60. From the changes proposed, it appears that the following shall be submitted to address the changes in the approved design: 1. One set of all plans reduced to 8 1/2" by 11" or 11" by 17". 2.
