YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by 5:00 p.m. on Thursday, October 21, 2010. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. Two of the existing concrete columns will be extended in height from four feet to twelve feet to match the existing twelve foot tall column. The wireless panel antenna will be mounted inside the column shroud with the one Yagi antenna mounted on the top of one of the columns. Exposed antennas, feed lines, coaxial cables and associated mounting hardware will be painted to match the proposed additional screening. The proposed antenna screening will be painted to match existing parking light shroud. Existing Development The applicant will be placing the antennas on the top floor of an existing parking structure located at Westfield Southcenter Mall. Surrounding Land Uses The property is zoned Tukwila Urban Center and is developed as a shopping mall. The site is surrounded by other retail development. Southcenter Parkway borders the site on the west, Tukwila Parkway on the north, Andover Park West on the east and Strander Blvd. on the south. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. Location Selection Tukwila Municipal Code (TMC 18.58.050 B and C) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The applicant provided the following information on the location of the proposed equipment: The coverage objective for this site is to provide expanded in -building services to Southcenter Mall and the surrounding area. The Mall has an existing distributed antenna system (DAS) internal to the mall to provide wireless coverage throughout the mall. In order to expand coverage at the mall, Verizon Wireless proposed to connect to the existing mall infrastructure. The location of the antennas was the least intrusive solution to provide expanded services in the area with minimal amount of antennas. Within the immediate vicinity of Southcenter mall, there are no existing towers and/or utility poles that would provide the additional coverage needed within the mall. In order to provide the necessary services within the mall, Verizon Wireless needs to use the existing distributed antenna system. The exterior antennas on the parking garage are needed in addition to the distributed antenna system connection in order to bring Verizon wireless's signal to the distributed antenna system. The applicant has chosen to install the WCF on the top floor of a parking garage, internal to a large shopping complex, a non -concealed building attachment. Most of the other antenna and supporting cables will be either screened from view or painted to match the existing color scheme at the parking garage and therefore not very obtrusive to the casual viewer. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with the required standards. Nonflush-mounted antennas may be used when the visual impact will be negated by the scale of the antennas to the building. The proposal to install antennas on the top floor of the Southcenter Mall western parking garage will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in Table 1 and Table 2, the project meets all applicable development standards for a Type II wireless cellular facility. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The traffic generated from the facility will be minimal and will not have an impact on surrounding properties. 4. No noise will be generated from the new antennas or ground equipment associated with this application. 5. The wireless communications facility has been designed in a way to minimize any visual impact from the project. 6. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATION Staff recommends approval of this Type II wireless cellular facility with no conditions. Verizon is licensed to operate in the United States by the Federal Communications Commission (FCC). This proposal describes the scope of the proposed project by providing specific information regarding the project location, zoning, specifications, and required services. It is Verizon's desire to work with the City of Tukwila to ensure that this project is consistent with local ordinances and zoning regulations while providing wireless coverage to Verizon's customers and provide critical communication services for emergency, business, and personal use. Project Goals The goal of the Verizon SEA Southcenter DAS Site is to provide expanded in -building services to Southcenter Mall and surrounding area. Verizon intends to achieve these network goals consistent with all policies and ordinances of the City of Tukwila. Verizon will secure a lease with the owners that will allow for construction and maintenance of this facility, necessary utility connections, and provisions for access to the site. Facility Specifications ■ Antennas - Verizon is proposing to attach three (3) antennas to the parking garage. The antennas will be predominantly screened from view by matching existing antenna screening on the parking garage roof. Business license requfremeut - Any person, corporation or entity that operates a wireless communication facility within the City shall have a valid business license issued annually by the City. Any person, corporation or other business entity which owns a tower also is required to obtain a business license on an annual basis. Verizon has filed for a business license for this site location. Signage According to TMC 18.58.070: 3. Signage - Only safety signs or those mandated by other government entities may be located on wireless communication facilities. No other types of signs are permitted on wireless communication facilities. No signs will be on-site unless required by either the FCC and/or FAA. Parking According to TMC 18.58.070: 4. Puking- Any application must demonstrate that there is sufficient space for temporary parking for regular maintenance of time proposed facility. BACKGROUND Site plan, elevation and antenna -mounting drawings fumished by RealCom representatives show that the proposed wireless facility will have antennas atop existing concrete columns on the top level of the parkade at 2800 Southcenter Mall, City of Tukwila, King County, Washington 98188. The antenna -mounting drawings show the proposed antennas in the following configuration: one (1) 850MHz-band Yagi-type directional antenna and one (1) shrouded 700MHz-band panel antenna mounted above the same concrete column, and one (1) PCS -band diamond-shaped planar antenna mounted on a shroud above an adjacent concrete column. All three proposed antennas will be mounted and centered at least eight feet above the top parkade deck, and at least 38 feet above ground level. Thus all of the antennas will be centered above head height for persons on the top parkade deck, or standing anywhere at ground level. All of the proposed antennas will be associated with a low -powered Distributed Antenna System (DAS). The combined total power from all three antennas will be less than 165 watts according to Verizon RF engineers. Therefore it is unlikely that anyone other than authorized: workers could approach near enough to any of the Verizon antennas to cause that person's RF exposure to exceed FCC limits. Hatfield & Dawson Consulting Engineers • • 2 All of the proposed antennas are highly directional, and they will project the majority of the transmitted RF energy horizontally and well above all nearby habitable areas. Thus RF exposure conditions adjacent to the antennas, within nearby buildings, and on adjacent properties, due to the combined contributions from all of the proposed antennas, will be well below the FCC public exposure limit as per King County K.C.C. 21A.26.110 and 21A.26.160, as applicable. To verify that the proposed Verizon facility will be in compliance with FCC and local rules regarding public exposure to RF fields, I have calculated the maximum exposure condition that is likely to exist near the antennas. The following theoretical calculations predict the maximum exposure condition for a person standing at the nearest approach to the Verizon antennas. A six-foot tall person standing adjacent to the antennas may be exposed to the lowest foot of the shrouded six-foot antenna aperture. The Yagi and planar antennas will be above head -height. CALCULATIONS OF RF POWER DENSITIES AND EXPOSURE LEVELS RF power densities are computed in accordance with methods described in Evaluating Compliance with FCC Guidelines for Human Exposure to Radiofrequency Electromagnetic Fields, OET Bulletin 65, August 1997. Broadcast facilities are required to comply with the FCC "Rules & Regulations" CFR 47 §1.1310, Radiofrequency radiation exposure limits. The OET Bulletin 65, including Supplement A, describes the methods established by the FCC for predicting compliance with the FCC -specified exposure limits. Compliance is determined by comparing RF field predictions with the uncontrolled environment (i.e., "Public") Maximum Permissible Exposure limits (MPEs) allowed by the FCC rules, as specified in CFR 47 §1.1310. The proposed Verizon facility will transmit within the frequency band of 746 — 1945 MHz. The lowest Public MPE limit for this band is at the lowest transmit frequency: 746 / 1500 = 0.50 mW/cm2. Hatfield & Dawson Consulting Engineers • • 3 Note that this FCC limit, when converted to microwatts/cm2, is the same as the equivalent plane -wave power density limit for 746 MHz as determined from the "NIER Exposure Standards (1) (6)" table presented in K.C.C. 21A.26.100. The "Tell Cylindrical Model" presented on pages 30-32 of OET Bulletin 65 can be used to calculate worst-case near -field RF power densities and exposure conditions due to the proposed Verizon panel antenna. A recent version of Richard Tell's own cylindrical model program RoofView® was used to perform the necessary power density calculations to determine the Public exposure conditions for a six-foot person standing next to the shrouded panel antenna atop the parkade. The input parameters used in the RoofView® program are based on the electrical and mechanical characteristics of the proposed panel antenna: 1) A maximum antenna input power of 4.14 watts. This antenna input power will produce an ERP of approximately 165 watts from the 16 dBd gain antenna, 2) The antenna aperture is approximately six feet long, and the antenna is centered approximately eight feet above the parkade deck. Therefore a six foot tall person standing next to the antenna would be within the lowest foot of the antenna aperture, 3) The panel antenna has a 40 -degree horizontal beamwidth. CALCULATION OF NEAR -FIELD PUBLIC EXPOSURE CONDITIONS The following calculation predicts the Public exposure condition due to the Verizon facility for persons standing on the top parkade deck at the closest approach to the Verizon panel antenna. The Tell Cylindrical Model indicates that an individual standing on the roof deck would be subjected to 100% of the Public exposure limit at a horizontal distance of approximately 0.35 feet, or 4.2 inches from the Verizon panel antenna. However, the shroud that conceals the: panel, antenna will prevent persons from approaching that close to the active front portion of the antenna. Therefore members of the public can stand arbitrarily close to the Verizon antennas without experiencing excessive RF exposure conditions. Hatfield & Dawson Consulting Engineers • • 5 All other publicly accessible areas below the top parkade deck level,, and all areas within adjacent buildings, and at ground level, are expected to have exposure conditions well below the FCC Public MPE limit due to the proposed Verizon antennas. COMPLIANCE WITH LOCAL REGULATIONS Because the proposed Verizon Wireless facility is in compliance with federal rules, it is also in compliance with local regulations conceming RF emissions. The following is the complete text of 47 U.S.C. § 332(c)(7)(8)(iv): "No State or local government or instrumentality thereof may regulate the placement, construction, and modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions." CONCLUSIONS BASED ON CALCULATIONS, AND CITY AND FEDERAL REGULATIONS The proposed Verizon wireless facility will be in compliance with current FCC and City rules regarding public exposure to radiofrequency electromagnetic fields, and all other FCC and local regulations regarding RF emissions. In particular, the proposed Verizon facility will comply with FCC regulations regarding susceptibility to Radio Frequency Interference (RFI), frequency coordination requirements, general technical standards for power, antenna and bandwidth limitations, frequency stability, transmitter measurements, and operating requirements. Furthermore the applicant will conform to "Good Engineering Practices" to comply with any and all other federal statutory and regulatory requirements related to RFI.
