This notice is approved subject to the decision criteria and conclusions that follow. I. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on application: The proposed mini -mart shall provide four parking stalls and continue to provide the informal parking at the eight re- fueling bays for 2,266 square feet of useable floor area, Parking for the mini -mart, should the final floor plan be different that the submitted draft plan, shall preserve the existing parking quantity with 8 re -fueling bays and two parking stalls for the first 2,220 gross square feet and a parking ratio of one stall for every 300 gross square feet of increased area. The learning center shall provide eleven parking stalls. A total of fifteen parking stalls and eight re -fueling bays shall be provided between the site and the Seattle City Light site. Applicant shall record "Acknowledgement of Continued Compliance with City of Tukwila Parking Requirements" agreement against the title of the PacWest Energy, LLC property. 2. When a building permit is submitted, the plans shall reflect adequate turning radii and parking stall dimensions per Tukwila Municipal Code in order to be approved. 3. Applicant shall provide a copy of the temporary permit signed by both Seattle City Light and the property owner, PacWest Energy, LLC. 4. Any changes in the function or development of the site will require approval from the City and may require a new parking determination which shall identify additional parking mitigation measures. HI. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, which is by December 30, 2010. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $515 retainer (plus hourly fee). V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner's decision on the appeal is the City's fmal decision. Any party wishing to challenge the Director's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the decision is properly filed within such time limit, the Decision on this permit will be final. Copy of Temporary Permit from SCL granting parking by Jacksons on SCL property PROJECT DESCRIPTION This application is for a parking determination for a "Regional Learning Center" and mini-mart/re-fueling station. The proposal modifies a site that was used as a re -fueling station, carwash, and mini -mart. The mini -mart requests parking credit for some of the re -fueling bays. A "Regional Learning Center" is a use not specified in the Tukwila Municipal Code (TMC). According to TMC 18.56.100, when a use is not specified, the requirements for off-street parking shall be determined by the Director. The redevelopment of the mini -mart and the addition of the learning center trigger the need for a parking determination. EXISTING DEVELOPMENT The site is currently in use as a 2,220 square foot mini -mart and refueling station. A carwash is on the site but it is used as a storeroom for the mini -mart. The site currently includes one standard parking stall and one accessible stall. Eight refueling bays are provided that also serve as parking for re -fueling customers who also use the mini -mart. Fourteen off- site stalls are located adjacent to the parcel to the southwest. They are located on a parcel owned by Seattle City Light (SCL) with no visual or functional barrier between the stalls and the project site. A map showing the parcels is attached to this document. SURROUNDING LAND USES The surround land uses are all zones C/LI. Interstate 5, State Route 599, and Interurban Avenue South define the southeast and southwest sides of the parcel. Automobile -dominated land uses (fast food, re -fueling, restaurant, and auto sales) are located to the northeast and northwest of the site. BACKGROUND The existing 2,220 square foot mini -mart and carwash with 16 parking stalls and 8 fueling bays is being redeveloped into a 2,706 square foot mini -mart and 1,035 square foot training center with 211 parking stalls and 8 fueling bays. This is an increase of approximately 1,500 square feet and 5 parking stalls over the previous use. The training center is a classroom and conference center for regional training events. According to the project narrative, the training center will host from 12-18 people at a time in a 1,056 square foot area. The useable floor area for the mini - mart is 2,266 square feet based on the floor plan and narrative submitted with this application. Usable floor area is gross area less the coolers, restrooms, backroom, office and hallway. Parking consists of 8 fueling bays, 7 on-site parking stalls, and 14 adjacent, off-site parking stalls. Fueling bays, while not parking stalls in the traditional sense, are used as de -facto parking stalls for fueling customers who also use the mini -mart. The property owner has had a "temporary permit" with Seattle City Light for use of the parking area since at least 1979. The permit allows access to the area directly west of the mini -mart site. This area is served by the same ingress and egress and is visually and functionally contiguous with the mini -mart site. This parking determination is to determine the parking needs for the training center, the amount of fueling bay stalls that can be applied to the mini -mart parking requirement, and the number of stalls needed for the entire site. DECISION CRITERIA - PARKING DETERMINATION Off -Street Parking and Loading Regulations are found in Chapter 18.56 of the Tukwila Municipal Code (TMC). The chapter includes a table that lists the required number of parking spaces for automobiles and bicycles (Table 18-7). The table provides specific parking requirements for a number of common land uses. For example, food stores and markets are required to have one parking stall for every 300 square feet of usable floor area; bulk retail stalls require 2.5 sales for every 1,000 square feet of usable floor area; and warehouses requires one parking stall for every 2,000 square feet of usable floor area. The submitted site plan shows 22 new stalls, five of which stalls are proposed in front of the fueling bays. One of those stalls does not allow for adequate turning movements and needs to be eliminated; therefore, in the current site plan 21 parking stalls are counted. There are eight stalls on the site and eight fueling bays which provide short-term parking for fuel customers. Of the eight proposed stalls, the two accessible stalls need to be increased to 20' in length. There appears to be adequate space to make this change. The eight fueling bays are serving the principal use of the site (gas station) and provide short-term parking for the mini -mart. SM Page 2 of 5 12/16/2010 H:\A Jackson Food Store\L10-070 SP Parking SR.doc • • Grocery stores and markets require a parking ratio of one stall for every 300 square feet of useable floor area. The mini - mart, as proposed, has a useable floor area of 2,266 square feet after the backroom, office, hall, coolers and restrooms are subtracted from the floor area as allowed by code. 2,266 square feet of floor area will require eight parking stalls for the use as described. The site currently provides two parking stalls and eight re -fueling bays for the existing 2,220 gross square foot mini -mart. The applicant did not provide a floor plan of the existing mini -mart so useable floor area cannot be determined. However, the existing mini -mart is 486 gross square feet smaller than the proposed mini -mart. If the entire increase in floor area is useable, the proposed increase requires two additional parking stalls. There is no change to the re- fueling bays and they will continue to function as short-term parking for re -fueling customers who access the mini -mart. There is no history of complaints or code violations regarding parking at the min -mart The required number of parking stalls for a learning center is not specified under the City's parking regulations. Under TMC 18.56.100 "Uses Not Specified" the Director shall determine the required number of parking stalls for uses not specified in the City's parking regulations. The Director's determination shall be based upon the requirements for the most comparable uses specified in the Parking chapter. Comparable Uses The following uses listed in table 18-7 of TMC 18.56 are comparable to a learning center: 1. Places of public assembly, including auditoriums, exhibition halls, community clubs, community centers, and private clubs are listed in table 18-7, but no specific parking ratio is provided. Instead, that the Director shall determine the minimum number of parking stalls, however in no case shall the minimum number be less than one stall for every 100 square feet of assembly area. The Director may require that a parking study be provided in order to determine the minimum parking requirements. In the code, parking is typically related to useable floor area or area of assembly. The learning center has 1,056 square feet of area. If this standard is applied to the learning center, Tukwila Municipal Code requires a minimum of 11 parking stalls. According to the application, the learning center is "to train...new employees and current employees or to hold conferences with Regional Managers." Employees would come from all over Western Washington and are expected to "participate in car/vanpool and/or other public transportation, such as Metro Bus or The Sounder." The learning center provides seating for up to eighteen employees or twelve seats when used as a conference center. Conferences and training will not occur simultaneously. As a comparison, the application provides information about a similar site in Portland, Oregon. Eighteen seats are also provided at the Portland location for training but, typically, only five to ten people attend any given training session. Nine parking stalls are provided but public transportation use results in utilization of only three to four stalls. The Portland site has a MAX light rail and a bus stop adjacent to the site. The Tukwila site is two and a half miles from the Sounder train station, over four miles from the LINK light rail station, and has seven bus routes with stops within 1/4 mile the site. The Tukwila site is also adjacent to an exit from Interstate 5. The applicant states that fifteen parking stalls, including the eight re -fueling bays, are sufficient for the entire site. POTENTIAL IMPACTS Negative impacts associated with providing too little parking to meet demand are most often spill-over to nearby residents and businesses. There are no surrounding residential uses. There is potential for off-site spillover parking, likely to additional Seattle City Light right-of-way parking to the north of the site and adjacent to a fast food restaurant. The fast food restaurant already has a parking problem related to spill-over parking from the retail strip located to its north. There are also negative impacts associated with providing too much parking for a given use. Surface parking areas with substantial unused portions may take up land better suited to a more productive or aesthetically pleasing use. However, this project is not increasing the area of paving on the site; it is configuring an existing paved area. If inadequate parking is provided for the mini -mart, spill-over parking will occupy the learning center's parking allotment or drivers will experience increased queuing time for access to a re -fueling bay. These impacts will not be felt off-site. Inadequate parking for the learning center could spill-over onto the adjacent property. The temporary permit which allows parking on the Seattle City Light parcel can be terminated with ninety days written notice. City code requires a covenant parking agreement, recorded against the title of the sending property, when parking is provided off-site. According to the applicant, Seattle City Light is not willing to guarantee access to the parking area indefmitely but has entered into a "temporary permit" to provide parking for the mini -mart property. City code further requires an applicant to obtain sufficient parking, subject to conditions, if a covenant parking agreement is terminated. The applicant has provided a draft of such an agreement. CONCLUSIONS 1. With no history of code violations or complaints regarding parking at this site, it is assumed that the current parking provided, including the use of re -fueling bays, provides adequate parking for the current mini -mart use. 2. The site can provide parking via eight re -fueling bays, seven on-site stalls, and fourteen off-site stalls. 3. The useable floor area of the mini -mart requires a total of eight parking stalls. This is an increase of 486 gross square feet and two parking stalls from the current mini -mart use. The current mini -mart provides two parking stalls and eight re -fueling bays for informal parking. 4. While parking is based on useable, not gross, square footage, it is assumed that increasing the size of the mini - mart is exclusively increasing the useable area. 5. The most comparable use to a learning center is a place of public assembly, including auditoriums, exhibition halls, community clubs, community centers, and private clubs. Using the parking standard for a place of public assembly, the learning center requires a minimum of eleven parking stalls. 6. Eighteen seats are provided at both the Tukwila and Portland learning centers. 7. The Portland learning center provides nine stalls and only utilizes three to four parking stalls for trainings. However, the Portland center is adjacent to light rail and bus service. 8. Using the Link or Sounder to get to the site requires the use of a vehicle to complete the trip. The site is served by seven King County Metro bus routes and is adjacent to a freeway ramp. 9. The applicant believes that seven parking stalls and the eight re -fueling bays are sufficient for the combined uses on the site. 10. The applicant has entered into a temporary agreement with Seattle City Light for use of the fourteen off-site stalls. The applicant has provided a draft "Acknowledgment of Continued Compliance" that demonstrates the applicant is aware of the need for parking compliance is the temporary agreement is revoked in the future. 11. Final plans submitted for this tenant improvement may result in a different useable floor area and could affect the parking total. Retainer is loaded as 300 minutes for the Special Permission parking, and it looks like review time has been 1390 minutes. I just want to make sure that all that review time truly was billable because I also see the part of this project is Administrative Design Review which does not carry a set retainer amount of time. Stacy: your entries total 385 minutes -if you are the only one who did review time for the Special Permission Parking, I would assume that the rest of the entries fall under Admin DR and are therefore not billable""" So, before I send them an invoice for 1600 bucks, I just wanted to double check on this. This permit is only for permission to use the City's land and shall not be construed to replace or to be used in lieu of any permits, licenses or consent which may be required, granted or regulated by any other agency or subdivision of government with authority to license, regulate or supervise the Permittee's operations or land use. 12. The Permittee agrees that use of the .permit area must be consistent with applicable zoning laws and regulations; where the proposed use is not consistent with said laws, said use is made conditional upon the Permittee obtaining conditional zoning or a zoning variance. 13. The Permittee agrees to maintain the premises occupied or used in an orderly, fit and sanitary condition, and at the expiration of the term of this permit, or upon an earlier termination thereof, to restore the property to as good condition or better than that which existed prior to issuance of this permit. The permittee agrees that regular maintenance of the grassy areas by mowing shall be its responsibility. 14. No building or structure shall be constructed or placed upon the City's property. 15. No paving, grading, cut or fill operation, or excavation of any kind shall be conducted on the City's property without the express written approval of the Superintendent of City Light, or his representative. 16. The permittee agree to submit plans furnishing details of any blacktopping, grading, cuts, or fills for the approval by the Superintendent of City Light, or his representatives, prior to the undertaking of any such blacktopping, grading, cut or fill operation on the herein described property. 17. No ponds, ditches or open water retention facilities of any kind shall be constructed or created on the City's property. 18. The Permittee agrees not to allow vehicles or other equipment within five (5) feet of any pole or within ten (10) feet of any tower. Permittee further agrees not to place any material or objects whatsoever against any transmission line pole or tower. 19. Permittee agrees to install and maintain protection such as guard posts and/or curbing for the protection of electrical transmission line poles/tower or shall protect the poles/tower located on said property in a manner approved by the Superintendent of City Light or his/her representative. Page 2 of 5 • • 27, The Superintendent of City Light, or his representatives, shall have the right at all times to inspect said premises for the purpose of observing the conditions thereof, and the manner of compliance by the Permittee with the terms and conditions of this permit. 28. The Superintendent of City Light shall have the right at all times to suspend any or all operations on the above property which he deems to be detrimental to the best interest of the City of Seattle. 29. Permittee covenants and agrees that neither he, nor his employees, contractors or agents, will store, dump, bury or transfer any hazardous substances, flammable materials, inoperable vehicles, chemicals, oils, fuels, or containers for said substances, chemicals, oils, fuels, etc., on the premises; and further agrees to observe all Federal, State and local environmental laws and regulations. PERMIT TERMINATION OR CANCELLATION 30. This permit is subject to cancellation at any time upon 90 days written notice by City Light, mailed to Permittee's last known address, and the return of unearned, prepaid rental, if any. 31. Permittee understands and agrees that Permittee's status under this permit is only that of temporary tenant, with term of tenancy limited by the terms of this permit and the City's need for the subject property; that cancellation or non-renewai of this permit for any reason whatsoever shall not place any obligation on the City to provide Permittee any alternative rental property or facilities. This permit vests no permanent property rights in the Permittee and cancellation or non -renewal thereof does not render Permittee a "displaced person" as defined under RCW 8.26.020 or Chapter 20.84 Seattle Municipal Code. 32. Should the Permittee violate, breach or fail to keep or perform any covenant, agreement, term or condition of this permit, Permittee shall forfeit any and all rights herein permitted, and the City shall have the right to immediately cancel and terminate said permit and all of the Permittee's rights hereunder without liability for loss or damage that the Permittee may thereby sustain; and upon termination of this permit, the Permittee will vacate said premises and remove his personal property therefrom. 33. The Permittee shall remove all his personal property from said premises on or before the termination date of this permit. If Permittee shall fail to remove such personal property on or before the termination date of this permit, the same shall, at the City's option, become a part of the realty and the property of the City of Seattle; or the City may, at its election, remove the same without liability to the -Permittee for loss, injury or damage thereto, and the cost of such removal and restoration of said premises to their former condition shall be paid by the Permittee to the City upon demand. 34. All of the licensing, permitting, tax and other legal requirements or obligations incurred by the Permittee hereunder shall survive the cancellation or termination date of this permit. 35. All of the indemnification and hold harmless provisions, as well as the hazardous substance covenant, of this permit shall survive the cancellation or termination date hereof. 36. This permit is not transferable or assignable, in whole or in part, nor may any portion of the rented premises be sublet, without the express written approval of the Superintendent of City Light, or his representative. Pan 4 of 5 • 20. The City reserves the right to require the Permittee to place signs or other warning devices of hazards as any governmental agency or City Light determines such hazards to exist. 21. The Permittee agrees to comply with all Federal, State and local electrical safety laws and regulations. 22. There shall be no parking under the transmission line tower. 23. Plantings will be limited to and maintained to a height below twelve (12) feet. INDEMNIFICATION AND INSURANCE PROVISIONS 24. The Permittee agrees to indemnify and hold harmless the City of Seattle from all claims, actions or damages of every kind and description, including all claims, actions, or damages brought by Permittee's employees, contractors, agents, representatives or tenants, which may accrue from or be suffered by reason of Pernuttee's use of the City's property, or the performance of any work in connection with such use. In case of any suit or action brought against the City arising out of or by reason of any of the above causes, the Permittee shall, upon notice to Permittee of the commencement of such action, defend the same at no cost or expense to the City, and Permittee will fully satisfy any judgment rendered in said action adversely to the City. Permittee's obligations under this Section 24 shall not, however, apply to the extent of the negligence or willful misconduct of the City of Seattle, its agents or representatives. By this indemnity provision, the Permittee expressly waives any immunity he or his businesses may have from claims by his or his businesses' employees under any workers' compensation or industrial insurance law arising out of workplace injuries, as defined under RCW 51.24.030, in connection with Permittee's use of the City's property. Said express waiver was mutually negotiated between the City and the Permittee. 25. The Permittee assumes responsibility for all potential risks, actions or damages related to exposure to EMF, and/or radio frequency radiation, connected with the Permittee's use of the City's property. The indemnity, and hold harmless provisions of this agreement apply to all claims, actions or damages related to EMF, and/or radio frequency radiation, in the same manner and to the same extent as they apply to all claims, actions or damages of every other kind and description. 26. The Permittee shall obtain and maintain continuously for the term of this permit, at no expense to the City, an occurrence form Commercial General Liability policy, insuring against personal injury, death, loss or damage of any kind arising or resulting from the use of the property by the Permittee: Minimum limit of coverage shall be ONE MILLION DOLLAR$ ($1,000,000) each occurrence. Such insurance shall be endorsed to include the City of Seattle as additional insured, and shall not be reduced or canceled without giving forty-five (45) days prior written notice to the City. Such insurance shall include a provision (whether by endorsement or otherwise) indicating that, except with respect to the limits of insurance and any rights or duties specifically assigned to the first named insured, such insurance shall apply (a) as if each party insured thereunder (whether as named insured or additional insured) were the only party insured by such policy, and (b) separately to each party that is insured thereunder and against whom a claim is made or suit is brought. The Permittee shall provide the City a duplicate photocopy of the insurance policy with its endorsements as evidence of coverage. The policy shall be subject to the approval of the City as to carrier, form, coverage and limits. Written Description of Project: The proposal consists of replacing the existing 2,220sf mini - mart and car wash bay with a new structure consisting of a 2,706sf mini -mart and a 1,056sf Learning Center for a total structure size of 3,762sf (gross increase of 1,542sf). The "Jacksons Regional Learning Center" (hereinafter referred to Learning Center) is for the training of new and current Jacksons' employees; this is not a public facility and attendance is by invitation only. The Learning Center will have a conference room, providing twelve (12) chairs, however, conferences and training will not occur simultaneously. Parking for the new mini -market will result in the need for six (6) parking stalls (see next section); the Learning Center portion provides seating for up to 18 employees/trainees. The proposed site plan provides eight (8) on- site parking stalls and fourteen (14) off-site parking stalls. Additional landscaping will be added and improvements to the existing on-site water collection. Existing ingress/egress easement and curb cuts are to remain. Proposed Construction Relative to Parking Areas: As mentioned above, the Learning Center is by invitation only to attend and is for the sole use of Jacksons' to train their new and current employees or to hold conferences with Regional Managers. The location of the Learning Center is ideal to its close proximity to Sea -Tac International Airport, which is why Jacksons chose Tukwila. It is anticipated that employees/managers from the western Washington area may be asked to attend meetings/training at the Tukwila location and that the • • employees/managers will fly into Sea -Tac and/or participate in a car/vanpool and/or other public transportation, such as the Metro Bus or The Sounder. As an example; Jacksons' Portland, Oregon Learning Center provides 18 seats and on an average 5-10 employees/managers attend at any given training session. These employee/managers arrive via public transportation (the MAX or Bus) and utilize 3-4 stalls out of the nine (9) provided. (Please reference letter dated October 25, 2010 from Jacksons). Under TMC 18, Figure 18-7 the project is required to provide parking sufficient for the uses. The mini -market store has been classified by city staff as "Retail Stores, Bulk" which requires "2.5 stalls for each 1,000 square feet of usable floor area." TMC 18.06.863 Usable Floor Area "means that part of the floor area of any structure which is actually used from time to time for any commercial purposes, such as a sales area, display area, walkways or storage area. Parking calculation shall not include common corridors designed for the circulation of people at non -retail establishments, restrooms, elevator shafts and stairwells at each floor, mechanical equipment rooms or attic spaces and exterior covered loading docks." Based on this code section it is our opinion that we may deduct the "non -retail" portions of the convenience store which would include the "Backroom," "Office" and the common "hallway" for customers to use the restrooms. The Backroom and Office are non -retail portions of the building as customers are not allowed in these areas and the hallway is a common corridor. Proposed gross square footage of the convenience store is 2,706gsf minus 300gsf (area of Backroom, Office and hallway) = 2,406gsf / 1,000sf x 2.5 = 6 parking stalls. As an additional note, the eight (8) refueling stations act as parking for the mini -market as customers leave their vehicles at the pump and utilize the mini -market. Consideration for these eight (8) stalls is requested as part of this parking determination. There is no specific use listed for the proposed Learning Center. One could say this use be classified as "Office, commercial and professional buildings, banks, dental and medical clinics;" which requires three (3) stalls for each 1,000sf of usable floor area thus requiring three (3) parking stalls. However, given there are eighteen (18) seats provided within the Learning Center; the closest use being "Colleges, Universities, Vocational Schools and other post- secondary educational institutions" which "Shall be determined by Planning Commission, based on an evaluation of information concerning traffic generated by proposed use." The worst case scenario would be that all attendees would provide their own personal transportation and that all eighteen (18) seats be utilized at the same time. This then would equate to eighteen (18) parking stalls for the Learning Center Use and (6) for the convenience store; 24 parking stalls total. It is our opinion that the required number of parking stalls required would be less than half of this amount resulting in nine (9), or less, parking stalls; given employees/managers will utilize another form of public transportation. Summary of Parking Stalls: It is our opinion that the total required parking stalls for the new mini -market and Learning Center will be fifteen (15). If the eight (8) stalls at the refueling station is considered, plus the nine (9) parking stalls depicted on the site plan; this gives a total of seventeen (17) parking stalls provided on-site. One (1) stall is van accessible and a part of the total. Additional Off -Site Parking Stalls: If, in the Director's opinion, the eight (8) stalls at the refueling station are not viable; there are fourteen (14) additional off-site parking stalls available for this project's use. Pacwest Energy, LLC dba Jacksons Food Stores has secured a Temporary Permit from the City of Seattle -City Light Department (P.M. #230415-1-423, granted September 8, 2010).
