Dear Mr. Pruin:
There is a fee due on your permit application in the amount of $103.00 to cover mailing the attached
public notice.
The number of required notices sent for your application was 103 which included property owners and
tenants within 500 feet of your project site as well as interested parties and agencies with jurisdiction.
The cost is based on the land use fee schedule adopted by Resolution Number 1718 covering Public

PROJECT INFORMATION
A demolition permit for one building within Hillcrest Apartments (14903 Interurban
Avenue S., ) a multi -building apartment complex, is requested by David Pruin for
Hillcrest Apartments Tukwila, LLC. The subject building, 14891 Interurban Avenue S,
contains 18 apartment units that have been vacant for approximately 15 years due to a
past landslide. The subject building, labeled #2, has a footprint of 6,240 square feet which
will be graded and hydroseeded. The subject property is a mapped sensitive area for
landslide hazards.

REVIEW
INFORMATION
The State Environmental Policy Act (SEPA) requires all agencies to consider the environmental impacts
of a development before making decisions (43.21C RCW). The purpose of environmental review is to
identify a proposal's significant adverse impacts, measures to minimize or avoid such impacts, and
allow wide public review for a wide range of projects.
REQUIREMENTS: SEPA review is required for any action associated with the following types of
decisions:
1. Developing 10 or more dwelling units.
2. Developing agricultural structures over 10,000 s.f.
3. Developing office, school, commercial, recreational, service or storage buildings over 12,000 s.f.
and 40 parking spaces (certain utility lines, personal wireless communication facilities, and normal
maintenance/replacement activities are fully exempt).
4. Developing parking lots with over 40 spaces.
5. Landfills and excavations over 500 cubic yards.
6. Installation of impervious underground tanks with a capacity over 10,000 gallons.
The accompanying application must be completed for any new SEPA application or request to issue an
addendum to any previous SEPA determination. If a question does not apply, "Does not apply" or
"NA" may be entered. Complete answers to the checklist may avoid unnecessary delays later. City
staff may also be able to help about governmental designations (e.g., zoning, shoreline, and landmark
status).
PROCEDURES: At the time you submit your application you must have all of the items listed on
the attached "Complete Application Checklist" as well as the submittal for the underlying action
(building permit, subdivision etc.). You may request a waiver from items on the checklist that are not
applicable to your project. Please discuss this waiver request with City staff either at a pre -application
meeting or at the time of application submittal. Within 28 days of receiving your application, City staff
will determine if it is complete based on the attached checklist. If not complete City staff will mail you
a letter outlining what additional information is needed. If you do not submit requested materials within 90
days from the City's request for additional information the City may cancel your application.
Once the application is "complete," substantive review will begin and a "Notice of Application" must
be posted/mailed to begin a public comment period. After completing the environmental analysis and
considering public comments, the Director will issue a determination for the project. A Determination
of Non -Significance (DNS) says that the project as proposed will not have probable, significant,
negative environmental impacts. A mitigated DNS will be issued if the project must be modified to
mitigate its negative impacts. An Environmental Impact Statement (EIS) must be prepared if the
probable negative impacts are unavoidable.

In accordance with our proposal, P-3603, dated June 7, 1995, Geotech Consultants, Inc.
has conducted a geotechnical engineering study of a landslide that has occurred
immediately adjacent to the Hillcrest Apartments on Interurban Avenue South in Tukwila.
The main portion of the slide is 10 to 20 feet east of the southern portion of the complex's
northernmost building (Building 14891). We understand that the slide happened during a
recent period of heavy rainfall. We also understand from our discussions with you that
some fill was placed east of this building when the apartments were originally constructed
approximately 25 years ago. This filling was conducted under an agreement with the owner
of the neighboring property. Some creep has occurred on the eastern fill slopes, but no
large-scale slope movement had occurred until the recent landslide. It appears that some
creep is presently continuing to occur just north of the recent slide. The general location of
the site is illustrated on the Vicinity Map, Plate 1. The approximate configuration of the slide
scarp is indicated on the Site Exploration Sketch, Plate 2.
SITE CONDITIONS
Subsurface Conditions
The subsurface conditions were explored by drilling two test borings at the approximate
locations shown on Plate 2. The field exploration program was based upon the site
conditions and access limitations, the scope of work outlined in our proposal, and the time
and budget constraints.

We understand that your property does not extend to the toe of the slope and that
permission cannot be obtained to work on the adjacent property. It is thus our opinion that
the most appropriate remedial measure to stabilize the eastern side of Building 14891 would
involve the installation of a soldier pile wall near the top of the scarp. It is recommended
that the soldier pile wall consist of drilled, concrete -filled, reinforced piers. The piers should
have a minimum diameter of 24 inches and be spaced a maximum of 3 feet apart,
edge -to -edge. No lagging is required between the piers, except where it is necessary to
backfill between the piers or to retain the soil between the piers if continued sloughing
occurs. The soldier pile wall will not stabilize the soil in front, or downslope, of the piers,
and it can be expected that some continued soil movement may occur on the adjacent
eastern property. The wall should extend north from the slide to the northern edge of
Building 14891, as slope movement has been observed in this area also.
We recommend designing the piers to resist an active earth pressure equal to that pressure
exerted by fluid with an equivalent density of 50 pounds per cubic foot (pcf) to a depth of 15
feet below the existing ground surface. The active earth pressure can be resisted by a
passive earth pressure equal to 250 pcf starting at a depth of 15 feet below the ground
surface. This passive resistance acts' on twice the pier diameter. The piers may be
considered to be fixed at a depth of 25 feet below the ground surface, but we recommend
setting the minimum pier length at 30 feet. We also recommend extending the piers a
minimum of 5 feet into the hard clay or bedrock. We anticipate that the holes can be drilled
with conventional auger drills, although some areas may require the coring of the hard clays
or bedrock. We anticipate that the holes can be drilled with open hole equipment.
However, the contractor should be prepared to case the holes if groundwater or caving is
encountered.
It is recommended that you obtain a topographic survey of the site to aid in the preparation
of the plans for the retaining structure. A structural engineer will need to design the soldier
pile wall. We recommend placing the wall at a minimum distance of 10 feet from the
existing building. If the wall is placed closer than 10 feet, a surcharge will need to be added
to the wall to account for the foundation loads on the wall. The amount of surcharge will
depend on the wall geometry and the building foundation loads.
Any backfill placed behind the wall should consist of crushed angular rock. The lagging,
where required, can consist of treated wood or concrete. We recommend placing the
lagging in front of the wall rather than behind it. This could be accomplished by bolting
metal angles to the face of the piers to hold the lagging.

SENSITIVE AREA COVENANT AND HOLD HARMLESS AGREEMENT
This covenant and hold harmless agreement is entered into between Hillcrest
Apartments Tukwila, LLC, a Washington limited liability company, ("Grantor), and the City
of Tukwila, a Washington municipal corporation ("Grantee").
RECITALS
WHEREAS, Grantor owns and has applied for necessary permits to develop
certain real property (the "Property") legally described in Exhibit A, which is attached and
incorporated by reference.
WHEREAS, a portion of the Property contains sensitive areas of potential geologic
instability (potential slide areas) as depicted in Exhibit B, which is attached and
incorporated by reference.
WHEREAS, as a condition of the issuance of subdivision plat approval, land use
permits, and/or construction permits for the Property, the Grantee required the Grantor to
execute and record this "Sensitive Area Covenant and Hold Harmless Agreement" to hold
the City of Tukwila harmless from all loss incurred as a result of any landslide or seismic
activity, or soil disturbance.
WHEREAS, Grantor assumed this obligation in order to obtain said subdivision
plat approval, land use permits, and/or construction permits for the Property.
WHEREAS, the parties agree that this agreement constitutes an arms length,
bargained -for agreement, which includes a waiver of liability that runs with the land for
risks created by the proposed use of property because of the shape, composition, location
or other characteristic unique to the Property sought to be developed.
NOW, THEREFORE, the parties agree as follows:
AGREEMENT
1. In consideration of Grantee issuing subdivision plat approval and/or other
development permits, which constitutes good and valuable consideration, the receipt of
which and the sufficiency of which the Grantor hereby acknowledges, the Grantor shall
defend, indemnify, and hold the Grantee, its officers, officials, employees, agents, and
assigns harmless from any and all claims, injuries, damages, losses, or suits, whether
brought by grantor or third parties, including all legal costs and reasonable attorney fees,
arising out of or in connection with any injuries or damages to persons or property caused
in whole or in part by any landslide or seismic activity or soil disturbance on the Property,
legally described in Exhibit A, which is attached and incorporated by reference.
2. Grantor on its own behalf and on behalf of its heirs, successors and assigns
hereby waives any right to assert any claim against the Grantee, its officers, officials,

employees, agents, and assigns for any loss, or damage to people or property either on or
off the site resulting from any landslide or seismic activity or soil disturbance on said
Property by reason of or arising out of the issuance of the permit(s) by the City for
development on said Property except only for such losses that may directly result from the
sole negligence of the City.
3. Grantor will inform its successors and assigns of said Property that the Property
is in an area of potential geologic instability (potential slide area), of the risks associated
with development thereon, of any conditions or prohibitions on development imposed by
the City of Tukwila, and of any features in this design which will require maintenance or
modification to address anticipated soils changes.
4. Grantor will maintain continuous insurance coverage as required by the permit
authorizing the development.
5. Grantee's inspection or acceptance of any of the Grantor's construction or other
work either during construction or when completed shall not be grounds to avoid any of
these covenants of indemnification.
6. This covenant and hold harmless agreement shall be a covenant running with
the land and the rights and obligations contained herein shall run with and burden the
Property, including each parcel comprising the Property and shall inure to the benefit of
and be binding upon the Grantor and Grantee, their successors and assigns.
