I. PROJECT INFORMATION Project File Number: L11-009 (Tree Permit) Applicant: Mark Clement, Boeing Company Type of Permit Applied for: Tree Clearing Permit Project Description: The project proposal is to obtain a tree clearing permit to remove 107 Poplars from the shoreline zone of the Duwamish River, and to obtain approval for a tree replacement planting plan. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Follow the attached "Native Plant Wetland, Stream, and Slope Planting Guidelines" for best practices in site preparation and planting, to ensure the replacement plantings' long-term health and survival. 3. The applicant, property owner, and tree removal contractor shall comply with the International Migratory Bird Treaty Act. Every tree removed after February 28, 2011shall be inspected for any type of nest of any migratory bird. If the presence of any nest is detected, the particular tree in which the nest is located shall be taped off and a later date for tree removal shall be determined and coordinated with the City of Tukwila. The Davey Tree Expert Company shall submit a written statement which details the presence or absence of nests observed during tree removal which occurs after February 28, 2011 III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is by March 16, 2011. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $515. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director, who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. Boeing staff expressed concern that the trees are hazardous due to several incidents in which branches on the trees failed and broke off, landing in the Duwamish Towers parking lot. Pictures submitted by the applicant showed damage to a vehicle in the parking lot due to a branch failure, clearly demonstrating how that the Poplar trees met the definition of a Hazardous Tree in Tukwila Municipal Code (TMC) section 18.06.395. This definition states that a "Hazardous tree" means a tree with a structural defect or disease, or which impedes safe vision or traffic flow, or otherwise currently poses a threat to life or property." In light of the recent branch failures, the applicant requested permission to remove the hazardous trees prior to applying for a tree clearing permit. The Davey Tree Expert Company explained that the trees on the site have had to be pruned repeatedly to remove dead branches in an effort to abate the potential for failure. Due to the structural damage consistent with Poplars of this age, including retention of an excessive amount of moisture, presence of a large number of nesting holes, and tip of crown dieback combined with poor taper, pruning is no longer a reasonable abatement action to remedy the potential threat posed by failures. City staff agreed that any trees which posed a threat to life and/or property should be removed as soon as possible. The Boeing Company proposed to complete the tree removal and replanting in two phases. A Tree Clearing Permit was issued for Phase I on January 20, 2011. Phase I included removal of 33 Poplars, and a replanting plan that includes 196 replacement trees and shrubs native to the Pacific Northwest. A Tree Clearing Permit was submitted for Phase II on February 9, 2011. Phase II proposes removal of 107 Poplars, for which a total of 740 replacement plantings are required. The replanting plan includes 1,040 replacement plantings, most of which will consist of willow stakes to be planted along the shoreline of the Duwamish River on the west side of the Duwamish River Trail. Other plantings proposed on the east side of the trail include 50 Shore Pines, and 60 plantings each of Red Currant, Pacific Ninebark, Serviceberry, and Vine Maples. Pacific Ninebark plantings will not tend to thrive unless they receive a lot of watering. Mock Orange plantings were suggested as a substitution by the applicant, and are a native species to the Pacific Northwest which staff deemed an appropriate substitute which will require less water. This substitution, replacing the 60 Pacific Ninebark plantings with 60 Mock Orange plantings, is added as a condition of approval of this permit to help encourage long term survival of the replacement plantings (see attached redlined copy of replanting plan). The replacement plantings proposed are native to the Pacific Northwest, and are therefore appropriate for planting within the 200 -foot shoreline zone from the Duwamish River. Note that, per TMC 18.54.130, section c. According to TMC 18.54.130, section c.(3), "Planting and maintenance of required replacement vegetation shall be in accordance with best management practices for landscaping which ensure the vegetation's long-term health and survival." As a condition of approval, site preparation and planting shall follow best practices as outlined on the attached "Native Plant Wetland, Stream, and Slope Planting Guidelines" handout to ensure the replacement plantings' long-term health and survival. Staff received one public comment by email during review of this project. The comment was primarily related to concerns about the timing of tree removal, considering that nesting season is rapidly approaching. Additionally, the comments included questions about when replanting would occur, the types and quantities of plantings that are proposed for Phases I and II, and a request for clarification about the location of the tree removal to ensure that the trees to be removed are located entirely on the Duwamish Towers site and not on the Boeing Oxbow site. Staff provided information on the types and quantities of plantings proposed for phases I and II, and that planting will most likely begin in March. Staff also clarified that all tree removal associated with the permits for phases I and II is located on the Boeing Duwamish Towers site. The person who submitted comments forwarded the following information, which he received from the Audubon Society: "With that said nesting season early March through late July is the critical time not to remove trees. Tree cutters during this time are supposed to ensure there are no nesting birds present. The removal of a nest with young or eggs is technically against Federal Law (the international migratory bird treaty act). However, as you might guess this law is almost never enforced. " Originally, staff responded that a condition of approval could be added to the permit, to require that all tree removal for phases I and II be completed by February 28, 2011. However, after discussing this condition with the applicant on February 18, 2011, staff discovered that it would be unlikely that Boeing would be able to comply with such a condition of approval. The applicant agreed to remove as many trees as possible prior to the end of February, and stated that the arborist, Davey Tree Expert Company, could ensure that every tree will be inspected for any type of nest of any migratory bird beginning March 1, 2011. That applicant stated if the presence of any nest is detected, the particular tree in which the nest is located will be taped off and a later date for tree removal would be determined and coordinated with the City of Tukwila. As a condition of approval, the Davey Tree Expert Company shall submit a written statement which details the presence or absence of nests observed during tree removal which occurs after February 28, 2011. RECOMMENDATION: Approve removal of all 107 Poplars, with the following conditions: 1. The 60 Pacific Ninebark plantings proposed in the replanting plan shall be substituted with Mock Orange plantings to help encourage long term survival of replacement plantings. 2. Follow the attached "Native Plant Wetland, Stream, and Slope Planting Guidelines" for best practices in site preparation and planting, to ensure the replacement plantings' long-term health and survival. 3. A Tree Clearing Permit was submitted to the City of Tukwila on December 13, 2010 for removal of 33 Poplars. Application materials included an arborist's report with pictures illustrating the poor condition of the Poplar trees which were removed and a planting plan for proposed replacement trees. For the 33 Poplars removed, 196 replacement trees are required because the trees are within the shoreline jurisdiction. The planting plan includes 105 Shore Pines (Pinus contorta) and 95 Red Osier Dogwoods (Cornus sericea). These plants are native to the Pacific Northwest, and are therefore appropriate for planting within the 200 -foot shoreline zone from the Duwamish River. However, given the large number of replacement trees required, and lack of space to accommodate all of them, it would be beneficial to provide a greater variety of species of plantings within the replacement planting area to add more diversity. As a condition of approval, the number of Red Osier Dogwoods planted should be reduced to a third of what is proposed (33 plantings), with the remaining 62 plants to include 31 Vine Maples (Acer circinatum) and 31 Serviceberry (Amelanchier alnifolia). If freezing weather is forecast right after plants are installed, they should be mulched right away to protect the roots. Site preparation: 1. If installing individual plants in an existing landscape: • Dig/pull out any invasive plants or groundcover for about 3 feet around each planting site • Loosen soil in the planting area prior to planting and remove any roots prior to planting 2. If doing a larger enhancement/restoration planting • Remove all invasive species by hand pulling/digging, mowing and/or covering with sheets of cardboard topped with about 3 inches of wood chips (called sheet mulching). Care must be taken not to disturb roots of trees and shrubs that are being retained. • Till to a depth of at least 18 inches, taking care not to disturb roots of existing trees or shrubs that are being retained. • Till in three inches of compost or approved organic amendment across all areas to be planted. How to Plant: 1. Dig a hole that is the same depth as the root ball and 2 times wider than the size of the root ball. Planting pits must be only the depth of the existing root ball or else the bottom of the planting pits must be compacted prior to planting to insure there is no settling. If planting on a slope, dig a shelf that is two to three times the size of the plant root ball (see diagram at right). 2. Root balls of potted and balled and burlapped (B&B) plants must be loosened and pruned as necessary to ensure there are no encircling roots prior to planting. Any wire straps and at least the top 2/3 of burlap are to be removed from B&B plants prior to planting. The plant should be completely vertical. The top of the root flare, where the roots and the trunk begins, should be about one inch from the surrounding soil. 3. Fill the hole with the original soil, watering to remove air pockets. If planting on a slope, create a soil berm at the front of the plant. Water the tree or shrub again after the transplant is complete. 4. Spread a minimum of one inch Cedar Grove compost or equivalent over the entire planting area, topped with up to two inches of arborist wood chip mulch. Please refer to the attached site photo which indicates the Phase I location and the site sketch for individual tree locations. Over the years we have had to repeatedly prune these trees to remove dead branches/tops in an effort to abate failure potential. The recent widespread failure of branches causes me to recommend more drastic measures to safeguard Boeing employees, trail users and property. As we have discussed the age class of these poplars (as well as those along the west side of the trail) is mature to over-mature/senescent. This age class exacerbates the already inherent failure patterns of the species which, according to the Evaluation of Hazard Trees in Urban Areas by Nelda Matheny and James Clark includes: trunk failure in high winds, often associated with Hypoxylon cankers (cause of the failure onto the truck); root failure due to susceptibility to Armillaria root rot; branch failure due to poor taper and/or crown dieback (as with the extensive branch failures during the moderate winds of Nov. 15th) The amount and extensiveness of the branch failures during the Nov. 15 wind event was severe and it is fortunate nobody was injured. Attached please find the Tree Risk Assessment Form which, for each tree details the defects, assigns a Risk Rating and provides a treatment recommendation. You will see the treatment recommendation is to removal all 33 trees in the Phase I area. Even though some of the smaller, suppressed trees may not pose as serious a threat as the majority of the trees I felt that it would be wise to remove them to allow a much better long term plan for replacement plantings. Risk reduction is a clearly defined issue and although the owner may wish to inform the public of the planned work, he/she should get on with it to avoid clearly foreseeable liabilities. 12 Extreme This tree, or a part of it, is in the process of failing. Immediate action is required. All other, less significant tree work should be suspended, and roads or work areas should be closed off, until the risk issues have been mitigated. This might be as simple as removing the critical part, drastically reducing overall tree height, or taking the tree down and cordoning off the area until final clean up, or complete removal can be accomplished. The immediate action required is to ensure that the clearly identified risk of harm is eliminated. For areas hit by severe storms, where many extreme risk trees can occur, drastic pruning and/or partial tree removals, followed by barriers to contain traffic, would be an acceptable first stage of risk reduction. There is no time to inform people or worry about public concerns. Clearly defined safety issues preclude further discussion. The Table shown above outlines the interpretation and implications of the risk ratings and associated risk categories. This table is provided to inform the reader about these risk categories so that they can better understand any risk abatement recommendations made in the risk assessment report. Recent root breakage, or soil mounding, or cracks, or extensive decay evident • Standing dead tree, has very few fine twigs, and no other significant defects* Multiple high or extreme risk defects present. • Shell wall is already cracked and failing • Major cracks already open, such as hazard beams or split trunks • More than 30% of circumference defective and cracks or decay obvious • Dead crown limbs, no fine twigs, no bark, decay present. • Weak branch union has crack(s) and decay • Leaning tree with recent root failure, soil mounding, and cracks or extensive decay • Dead branches hung up or partly failed • Visual obstruction of traffic signs / lights at intersections • Any partly failed component or whole tree • Standing dead trees that have been dead for more than one season with multiple defects such as cracks, decay, damaged roots, shedding bark* * Standing dead trees pose their own set of risk assessment difficulties since it is often impossible to determine when the tree died and what caused its death. Tree mortality caused by insects such as defoliaters, drought, or low intensity fires will usually be structurally sound, and may remain safely standing for several years. In some cases, where the target rating is 'occasional' and the wildlife value of the dead tree is high, the assessor should consider an additional assessment step to determine the feasibility of retaining the tree as a wildlife tree. Appendix Two provides a simple graphic to assist with creation of wildlife habitat There is a standard set of decay classes used by the US Forest Service, and other North American agencies, which when matched with wildlife value provide a wildlife tree habitat rating. On June 25, 2009, SCL responded to for a power outage created by a row of Tulip Poplar trees (Liriodendron tulipifera) planted directly under the three-phase high voltage powerlines on S. 112 Street. These particular species trees have rapid growth and attain mature heights of 80-120 feet. This inappropriate species planted directly under powerline is un -maintainable on our 4 year cyclical maintenance program. Soon after this outage, the Boeing Corporation was notified that these hazard trees would be removed as per our franchise agreement; WA RCW 64.12.035 and A-300 Utility Arboriculture — Best Management Practices. The cost to immediately trim these trees to re-energize the power to Boeing Corporate headquarters was over $700 not to consider the lost time and cost of doing business at Boeing for several hours of a weekday. A Pre -Notification of Violation of the TMC 18:54 Tree Regulations, File # RF10-042 was then sent to me by Assistant Planner, Jaimie Reavis. SCL is not in violation of tree removal and is an exempt status per your TMC 18.54.050 Permit — Exempt Activities -2.c Removal of hazardous trees and f. Construction and maintenance of street and utilities within city -approved rights of way and easements. Our goals are straightforward and very important. Reduce the risk of electrical contact by public; Improve reliability of our electric system; control the cost of maintenance to cooperatively pursue a more sustainable urban forest. This effort is in the best interest of Seattle City Light and affected cities to promote and maintain a safe urban forest, as well as providing a reliable energy source for our customers.
