A vehicle is being stored on the grass and dirt, an unapproved surface. The parking area must be a durable uniform surface such as two inches of gravel, concrete, or blacktop. Corrective Action: Discontinue storing or parking -vehicles on an unapproved surface. Any new parking surface must be approved by the City -of Tukwila Planning department to make sure it complies with the Tukwila Municipal Code. Compliance Date: 10/12/2016 Violation # 2 Code Reference: Corrective Action: Compliance Date: ACCUMULATION OF RUBBISH OR GARBAGE IPMC 308.1 All exterior property and premises shall be free from any accumulation of rubbish or garbage. Garbage is defined as the animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food. Rubbish is defined as combustible and noncombustible waste materials, except garbage; the term shall include the residue from the burning of wood, coal, coke and other combustible materials, paper, rags, cartons, boxes, wood excelsior, rubber, leather tree branches yard trimmings, tin cans, metals, mineral matter, glass crockery and dust and other similar materials. The garbage container is overflowing with garbage bags. There is tree debris on both sides of the creek and various building materials on the property. Remove all rubbish and garbage:from the property. 10/12/2016 Violation # 3 Code Reference: BUSINESS LICENSE REQUIRED (5.04) TMC 5.04.015 No person shall conduct, maintain, operate or engage in any business within the City without first obtaining a business license. Eritrean Kidisti Mariam Orthodox Tewando Church requires a business license. } Corrective Action: Obtain a City of Tukwila business license for Eritrean Kidisti Mariam Orthodox Tewando Church. Compliance Date: 10/12/2016 Violation # 4 Code Reference: Corrective Action: Compliance Date: C OF 0: USE AND OCCUPANCY IBC 111.1 No building or structure shall be used or occupied, and no change in the existing occupancy classification of a bulding or structure or portion thereof shall be made, until the bulding official has issued a certificate of occupancy therefor as provided herein. Issuance of a certificate of occupancy shall not be construed as an approval of a violation of the provisions of this code or of other ordinances of the jurisdiction. The change of use from an office building to a church requires a change of use permit. In 2011 it was to be used as an office only. Contact City of Tukwila Planning Department to determine permitted use of structure. 10/12/2016 Violation # 6 Code Reference: Corrective Action: SENSITIVE AREAS VIOLATIONS TMC 18.45.195 The following actions shall be considered violations of this chapter: 1. To use, construct or demolish any structure, or to conduct clearing, earth -moving, construction or other development not authorized under a Special Permission, Reasonable Use or other permit where such permit is required by this chapter; 2. Any work that is not conducted in accordance with the plans, conditions or other requirements in a permit approved pursuant to this chapter, provided the terms or conditions are stated in the permit or the approved plans; 3. To remove or deface any sign, notice, complaint or order required by or posted in accordance with this chapter; 4. To misrepresent any material fact in any application, plans or other information submitted to obtain any sensitive area use, buffer reduction or development authorization; 5. To fail to comply with the requirements of this chapter. Riverton Creek, which is classified as a Type 2 watercourse, crosses the subject property to the west of the structure. You have disturbed the restoration project that had been completed in 2011 under L09-011. Fill was placed to form a parking lot and then pushed into the stream buffer. There are downed tree debris on both sides of the creek. Restore the approved 50 foot buffer to its previous condition by: • Removal of invasive species, with particular attention to the knotweed • Removal of all debris placed in the stream/buffer — this does not include trees that have naturally fallen; those should remain in place • • Replanting of trees, shrubs, ferns and other native plants that have been removed/damaged due to grading and debris • Removal of fill that is within the buffer • Construction of a split rail fence at the buffer line, with approved sensitive area sign mounted on fence • Preparation of a monitoring/maintenance plan • Submit an annual report for a period of five years documenting maintenance and condition of the buffer Contact Andrea Cummins, Urban Environmental Specialist (206-431-3663)with any questions or concerns. Compliance Date: 10/12/2016 Violation # 7 ZONING CHANGE OF USE Code Reference: TMC 18.96.060 Whenever a change in use of land or structures takes place the owner of such land or structures shall be required to submit an application for an occupancy permit for the new use or structures within 15 days of the date of such change in use. Failure to do so shall be a violation of this title. This structure is permitted for office use only. Corrective Action: If this structure is being used for any other purpose than an office obtain a change of use permit. Compliance Date: 10/12/2016 If you have received this Notice, the City has determined that a violation exists on the above property. In order to bring the property into compliance, you must complete the corrective action(s) above by the compliance date indicated. If you fail to take the corrective action above, the City may issue a civil infraction or a Violation Notice and Order, pursuant to Tukwila Municipal Code 8.45.050. You may be fined penalties of up to $500 per day per violation for each day that the violation exists, under the provisions set forth in Tukwila Municipal Code 8.45.100(A)(1).
