She suggested that someone from the City attend the meeting scheduled in Renton. Mayor Bauch introduced Mr. Dwight Gardner who attended the meeting and reported back on the discussion. The Federal Department of Agriculture is conducting a field study to see if there were Gypsy Moths in the area. There were egg masses located in Bryn Mawr, in a 2 block section east of the school, so helicopters were scheduled to spray the area. The Environmentalists objected to this method so it has been changed and will be done by hand. The Gypsy Moth can be destructive to ornamental shrubs and trees. Council President Bohrer read a letter written to the City Council by John Segel, 5651 South 144th. John, a Tukwila youth, is asking the Council to consider building a bus shelter at the intersection of 53rd Avenue South and South 144th. Council President Bohrer said he would call John and discuss his letter. MOVED BY BOHRER, SECONDED BY TRAYNOR, THAT THE PROPOSED MOTION BE READ. MOTION CARRIED. City Attorney Hard read: "A motion of the City Council of the City of Tukwila authorizing a citizen participation plan for the Community Development Block Grant Program. Notice of Appeal 858689: King County Fiorito, a partnership vs. City of Tukwila (LID #25) NEW BUSINESS Intent to annex 2.1 acres of property, owned by M.A. Segale (west of 57th and adja- cent to South City limits ORDINANCES Ordinance #1103 Extending the loan period on LID #28 Ordinance #1104 Amending Ord. #400 to correct an error in legal description Mayor Bauch recognized for the record receipt of Notice of Appeal No. 858689, King County and Fiorito, a partnership, vs. City of Tukwila. The appeal involves the matter of assessments for Local Improvement District No. 25. MOVED BY BOHRER, SECONDED BY SAUL, THAT PURSUANT TO R.C.W. 35A.14.120: '1) The City accept the proposed annexation. .2) The City require simultaneous adoption of a proposed zoning regulation as requested. (3) The City require assumption of existing city indebtedness by the area to be annexed.* Mayor Bauch noted that under the direct petition method Council must say they will accept the petition before the petition is submitted to the City. There will have to be two public hearings on zoning and one on the annexation held before Council considers the final annexation ordinance. The first public hearing has been set for February 26. The petitioner is asking for M -1 zoning on their property but this item still has to go before the Planning Commission and they send their recommendation back to Council. *MOTION CARRIED. City Attorney Hard read an ordinance of the City of Tukwila Washington, extending the loan period on L.I.D. #28 and amending section 2 of Ordinance No. 1086. MOVED BY BOHRER, SECONDED BY SAUL, THAT ORDINANCE NO. 1103 BE ADOPTED AS READ.* City Attorney Hard said that the lawsuit on L.I.D. #28 came before the Supreme Court last week. They determined this is an issue of significant importance and they want to hear the arguments. *MOTION CARRIED. MOVED BY BOHRER, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read an Ordinance amending Ordinance No. 400 to correct an error in legal description of certain real property. MOVED BY BOHRER, SECONDED BY SAUL, THAT ORDINANCE NO. 1104 BE ADOPTED AS READ.* Councilman Harris said the ordinance earmarks the error as clerical or typographical and she stated that the purpose behind the correction was not to state who made the error. MOVED BY HARRIS, SECONDED BY SAUL, THAT THE ORDINANCE BE AMENDED TO STRIKE THE WORD "CLERICAL" IN THE TITLE AND STRIKE THE WORDS "CLERICAL AND TYPOGRAPHICAL" IN THE SECOND WHEREAS AND CHANGE THE "A" TO "AN MOTION CARRIED. Ordinance #1104 Amending Ord. #400 to correct an error in legal description RESOLUTIONS Resolution #672 Fixing the time when the petition will be heard on the vacation of a street. (Portion of 65th Ave. So.) Resolution #673 Authorizing the Mayor to pursue the takeover of Interurban Ave. DEPARTMENT REPORTS Mayor's Report Riverton Annexation Hearing Duwamish /Allentown Annexation Council Retreat Mayor Bauch called attention to excerpts of minutes recorded in 1964 that show the City Council approved the vacation of this street except for the portion which lies in the path of the freeway. *MOTION CARRIED TO ADOPT ORDINANCE AS AMENDED. MOVED BY BOHRER, SECONDED BY SAUL, THAT THE PROPOSED RESOLUTION BY READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read a resolution of the City of Tukwila, Washington, fixing the time when the petition will be heard on the vacation of a street. MOVED BY BOHRER, SECONDED BY SAUL, THAT RESOLUTION NO. 672 BE ADOPTED AS READ. MOTION CARRIED. x39 Mayor Bauch noted that investigation shows that Ordinance #671, passed in 1971, did not vacate this section of street. Mayor Bauch stated that it takes State Legislature action to implement the takeover of a street within State jurisdiction, therefore, time is important in this proposed Resolution. MOVED BY BOHRER, SECONDED BY SAUL, THAT THE PROPOSED RESOLUTION BE READ. MOTION CARRIED. City Attorney Hard read a resolution of the City Council of the City of Tukwila authorizing the Mayor to pursue the take- over of Interurban Avenue from the State of Washington. MOVED BY BOHRER, SECONDED BY HARRIS, THAT RESOLUTION NO. 673 BE ADOPTED AS READ.* Councilman Van Dusen said he is in favor of this but feels the City needs to look at the cost very closely. Councilman Saul said he would hate to take it over and then find we couldn't afford the cost. Councilman Traynor said the plans are to make this street a part of Tukwila -make it something we are proud of. Mayor Bauch noted that the only thing the State has is the roadway. The City is already responsible for street cleaning and snow removal. The City has the resources to do at least the amount the State is doing. Attorney Hard called attention to the wording of Section 1 and recommended that the word "between" be stricken. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE WORD "BETWEEN" BE OMITTED FROM SECTION 1, LINE 2. MOTION CARRIED. *MOTION CARRIED, AS AMENDED. Mayor Bauch reported on the Public Hearing held before the Boundary Review Board on February 15. The Board will make their decision at their March 8th meeting. The City has received annexation petitions from the Duwamish/ Allentown area. They have been certified as to the sufficiency of number of signatures. Councilman Bohrer reminded Council of their scheduled retreat to be held at 1:00 P.M., Saturday, the 25th at the Doubletree Inn. TUKWILA CITY COUNCIL, REGULAR MEETING February 20, 1979 Page 4 DEPARTMENT REPORTS Finance Director's Monthly Report of Investments MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS Report From Finance Committee Memorial Trees ADJOURNMENT 8:05 P.M. Cont. Councilman Harris read the monthly report of investments submitted by Ron Swanson, Finance Director. Interest income for the month of January amounted to $16,866. Investments Sold $1,350,000 Investments Purchased $1,140,000 Councilman Traynor reported for the Finance Committee. He asked Council to read the Data Processing Feasibility Study so it can be discussed at the next meeting of the Committee of the Whole. Councilman Saul asked about the plans for memorial trees to be incorporated in the landscaping. Mayor Bauch said the landscape plan identifies the location and suggests the type of tree to be planted there.
