Mullet, Mayor June 30, 2000 Department of Community Development Steve Lancaster, Director Christine Harvey Insignia Sign Company 5805 Lakemont Blvd SE Bellevue, 98006 RE: Tesoro Permanent Sign Permit Applications S2000-038 and 039 Dear Ms Harvey: In our most recent phone conversation on Thursday June 29, I told you that the above mentioned permanent sign applications for Tesoro needed to be revised to bring these proposals into conformance with the standards of TMC Title 19, Tukwila's sign regulations. Since then further exploration of the sign code relative to these applications gives an interpretation that would allow the canopy sign in the given size. The application for a pole sign, although in conformance for square footage of the sign face, height and setback must follow a different application process. The initial denial of these applications was based on interpretation of TMC 19.32.160 "Service Stations Surrounded by commercial or industrial zones". As this property is not surrounded by these zones but by a combination of commercial and residential zones (there is a HDR residential zone along the east and southeast property lines) the standard sign code seemed to apply. However in this (TMC 19.32.130, "Where signs will face or abut multiple family zones or public facilities") it only refers to signs which will "face or abut" these zones, not the property facing or abutting these zones. This proposal shows the canopy sign faces away from the HDR zone so the only reasonable reading is that it would be covered by language in 19.32.160. Wall Sign Application S2000-038 The application is for a canopy sign of 37.5 SF on an exposed building face of 192.5 SF. Provided this sign is not moved to another canopy face and thereby "face" of "abut" the HDR zone it falls under the 20% if EBF requirement of 19.32.160 2. Freestanding Sign Application S2000-39 The application is for a pole sign 21 feet in height and 132 SF in overall size (66 SF per side). If it does it must be applied for as a Special Permission Sign. This is a type II decision that is approved by the Director of the Department of Community Development. The purpose of this criteria is to insure that any negative effects on a residential area from a large sign will be minimized to the fullest extend possible. This original business (Chevron) on this site was approved under the city's design review process. In order to change any part of this original approval requires either a resubmittal of a design review application, or in the case of a "minor modification", the application of a Special Permission Sign Application. I have determined that the change of the design of the pole sign is only a "minor modification". Both of these special permission issues may be combined in one Special Permission Application. An application is enclosed. The site plan submitted with these applications noted: "Existing 20"x10' Food Mart Ch. Ltrs. To Remain as Sign for Food Mart Store Tenant; not part of Tesoro". This sign is an illegal sign and must be removed before another wall sign (the canopy sign) can be permitted. TMC 19.32.140 allows a commercial business either two wall signs or a wall sign and a freestanding sign. Contrary to the information given by your office, our records indicate that there is only one business license for this address. The existing business did not obtain a permit for the "Food Mart" sign. It would not have been permitted given the permits it did receive for the existing canopy and freestanding signs. Retention of this sign requires application for a sign permit and would preclude the addition of the "Tesoro" canopy sign. My apologies for any confusion with this matter. The freestanding sign being replaced was 141.6 SF for two sides and 20' in height. Additionally, a project that has been approved through design review and is now seeking a minor change in one aspect of the originally approved design may be considered as a Type 2 Minor Modification of the Design Review (TMC 18.60.030 D). CONCLUSIONS 1. The proposed sign is 100 SF in size (50 SF per side) and 15.5' in height. This falls within the limits of TMC 19.32.160. The height is determined by the setback of the pole from the side property line. This conforms to the setback requirements of TMC 19.32.070. 2. The proposed size is not a significant departure from the original design review conditions. The current sign being replaced was substantially different in shape from that shown in the design review file. (The design review signwas a "double flag" pole sign, while the existing sign is a full ground to top monument sign.) The proposed sign is similar to the sign shown in the design review file. DECISION The request, as presented in Attachments to this report, is hereby approved.
