MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THE MINUTES OF THE FEBRUARY 13, 1979 COMMITTEE OF THE WHOLE MEETING BE APPROVED AS PUBLISHED. CARRIED. Council President Bohrer said there would be a Public Hearing on the proposed annexation request of M. A. Segale, Inc. Fred Satter strom, OCD, reviewed the proposed action request by Mr. Sagale. He indicated on a map the area that would be affected. Kjell Stoknes, Director of OCD, reviewed the Planning Commission staff report, stating the property is presently located in King County and is zoned MLP (Manufacturing Park). Present City zoning of adjacent land on the north is M -1. Present zoning of the Segale Business Park located to the north and east of the proposed annexation area is M -2, subject to the site plan review by the Board of Archi- tectural Review (a C -M requirement). Councilman Hill arrived at the Committee of the Whole Meeting at 7:05 p.m. Mr. Stoknes reported that the existing County zoning of the site is most similar to Tukwila's C -M district (Industrial Park). Setbacks, permitted uses, and design review requirements are similar. At the present time there is a watchman's residence and trailer offering banking services (temporary) on the site. The Planning Commission recommended that the proposed annexation area be zoned C -M (Indus- trial Park) upon annexation to the City of Tukwila. Council President Bohrer declared the Public Hearing open to hear comments for or against the zoning classification on the proposed annexation. Chris Crumbaugh, legal counsel for M. A. Segale, briefly reported for the property owner on the proposed annexation. He said the banking service located in the trailer was a temporary location until permanent quarters are available. He said there was a watchman's residence located on the property. Mr. Crumbaugh said the adjacent property used for machinery storage would have a fence built on top of the median that is presently in front of the property. The fence would screen the site from public view. City Council members requested information regarding the temporary nature of the trailer housing the banking services, the watchman's residence, and the fence that would be erected. Mr. Stoknes said the City's C -M district would allow both the watchman's residence and the banking uses presently on the site. Mr. Crumbaugh assured the Council that the fence would be erected. Mr. Stoknes suggested if the Council has reservations about the trailer they might put a condition in the rezone ordinance that says the trailer has to be taken down within 90 days after the zoning goes through. Mr. Crumbaugh said Mr. Segale plans to use the property for a shop facility. He continued they had requested the zoning be M -1. Councilman Traynor asked the difference in the C -M and M -1 zoning. Mr. Stoknes said there is a 50 foot setback requirement in the C -M that is not required in the M -1 zoning. The C -M requires a Board of Architectural Review and none is required in the M -l. Council President Bohrer asked if there were further comments for or against zoning classification on the proposed annexation. There were no further comments and the Public Hearing was declared closed at 7:30 p.m. Council President Bohrer said the City Council would hold one more Public Hearing at least 30 days from the date of this Public Hearing. He added it would be in order for the Council to set the annexation hearing to be held concurrently with the second Public Hearing. Kjell Stoknes, OCD Director, reported the survey conducted by his Department showed there are 718 units in the City with just ten children. He reported 1,565 of the population of Tukwila live in apartments. He discussed the matter with the City Attorney and he was not sure about the legality of an ordinance preventing apart- ment owners from discriminating against children. The City of Mountlake Terrace, San Francisco and Berkeley have passed such ord- inances. Berkeley's ordinance has never been challenged; San Francisco's ordinance was challenged and found constitutional. Liti- gation is pending on the ordinance passed by Mountlake Terrace. The City is not responsible for enforcement, it is between the land- lord and tenant. Councilman Saul said he could see where a one bedroom apartment would not be adequate for people with children, but where there is more than one bedroom children should be considered. Mr. Stoknes said over 50% of the apartments in Tukwila are two bedroom or more. Councilman Hill said he had worked with children for many years and had found most of them well behaved. He said it is a shame that all of the children are judged by about 10% of the children who cause the trouble. He said he would like to hear from the apartment owners as to why they did not want children in the apartments. He said he realized any proposed ordinance would have to requirements for both tenant and landlord. Council members expressed concern and care for children in general, the fine schools and recreation program the City has to offer, but they were also aware that information should be obtained from land- lords. MOVED BY TRAYNOR, SECONDED BY SAUL, THAT THIS MATTER BE PUT IN THE COMMUNITY AFFAIRS COMMITTEE TO DEVELOP AN ORDINANCE AND IT BE CONSIDERED AT THE APRIL 9, 1979 COMMITTEE OF THE WHOLE MEETING. Councilman Traynor recommended the Committee send out letters to apartment owners for their input and attendance at the Committee of the Whole Meeting. *CARRIED. Kjell Stoknes, OCD Director, reported the proposed annexation popu- lation count on the area was 910 to 951. He said the required number of registered voters had signed the petition for annexation. He said they had verbal request from the area to come into the City zoned. George Gomez, President of Duwamish Improvement Club, said the area would like to have zoning done prior to annexation. He said regis- tered voters in the Murray precinct were not contacted because they had enough signatures on the petition. Mayor Bauch said the annexation policy of the City says if the petitioner comes in and asks for zoning prior to the election then the City should establish the zoning which would become effective at the time of annexation. In the Riverton annexation they asked to come in unclassified. He suggested the zoning be referred to the Planning Commission for recommendation. He said the Planning Commission would hold a Public Hearing on the matter. CARRIED. a3g7 The Committee of the Whole Meeting was called back to order by City Council President Bohrer with Council Members present as previoulsy listed. Councilman Harris reported Ron Swanson, Finance Director, could not be in attendance and had asked John McFarland, Administrative Assistant to be present. Councilman Van Dusen reported Niemi, Holland and Scott had furnished Phase I of their study to the City. They have recommended that Phase II be conducted to determine services available. Council Members expressed their desire to have the studies continuec on the program and get the computer services into the system. It was noted the court system has to be done separately, as it is available through only one company. Tom Burrow, consultant, reported Phase I as completed. Phase II will include preparation of specifications and RFP's, Phase III will be analysis and recommendation for best proposal. Councilman Traynor expressed desire to obtain computer services that will fill the needs of the City in the future and in order to do this it will be necessary to spend money. Council President Bohrer commented the City will be gaining additional capabilities, there may not be reduction in personnel, but it will slow down the need for additional personnel. Councilman Harris remarked that the Burroughs machine presently used in the Finance Department is no longer being manufactured and will have to be replaced in the future. It was her thought to have prices and equipment available if this happens. MOVED BY HARRIS, SECONDED BY SAUL, THAT NIEMI, HOLLAND, AND SCOTT (CONSULTANTS) BE AUTHORIZED TO PROCEED WITH PHASE II OF THE DATA PROCESSING STUDY. MOVED BY HARRIS, SECONDED BY HILL, TO AMEND THE MOTION AND ADD PHASE III TO THE AUTHORIZATION TO PROCEED WITH DATA PROCESSING STUDY. CARRIED. *CARRIED, AS AMENDED. Mayor Bauch requested this item be removed from the agenda. Mayor Bauch said there was $2,400 in the budget that had been dona- ted by people and it was in land acquisition. He recommended the City Council allow the City to use it to plant trees. MOVED BY HARRIS, SECONDED BY SAUL, THAT $2,400 BE SPENT TO PLANT TREES ON THE CHRISTENSON GREEN BELT. CARRIED. MOVED BY HILL, SECONDED BY SAUL, THAT THE PROPOSED RESOLUTION FIXING THE TIME WHEN A PETITION WILL BE HEARD ON THE VACATION OF A STREET (APRIL 2, 1979) BE ON THE AGENDA OF THE MARCH 5, 1979 REGULAR COUNCIL MEETING. CARRIED. The Council began the one hour review of the zoning ordinance with Section 18.12.020. Section 18.12.020. Fred Satterstrom, OCD, said Staff had calculatec heights of various homes in Tukwila and they could not find any single family homes over 25 foot height. Council President Bohrer stated the record should reflect that the Council intends to come back to this Section when they see the wording on Conditional Uses. MOVED BY JOHANSON, SECONDED BY SAUL, THAT THE WORDING BE SUPPLE- MENTED TO ADD ACCESSORY BUILDINGS TO THIS SECTION. CARRIED, WITH VAN DUSEN VOTING NO. The Council concluded the review with Section 18.14.070. Sections 18.12 through 18.14 were approved as amended. Councilman Harris reported the Finance Committee discussed the Data Processing Feasibility study in their meeting on February 21, 1979. The other two items on the agenda have been rescheduled for the meeting to be held March 6, 1979. The Community Affairs Committee will meet on March 7, 1979. Councilman Traynor reported the Public Safety Committee will meet on February 28, 1979. Council President Bohrer reported a meeting of the Rules Committee of the Metro Council has been scheduled for 7:30 p.m. on Wednesday, February 28, in the Kent City Council Chambers. The purpose of the meeting is to consider various ways of restruc- turing the Council to improve its "one person /one vote" represen- tation. The Tukwila City Council has been invited to attend.
