The language as printed on the permit indicates or reads as if you are pointing out what the sign code says. You are not doing this and you are printing out partly what the sign says, and partly "your" opinion or interpretation of the code, which is incorrect. The language as printed on the permit that relates directly to the code is of course lawful, but the other part is really opinion. We have had many conversations with yourselves over this with your people mostly seemingly conducting a stalling tactic, not wishing to issue a permit based on,what the code says, indicated on the permit something that is not in the code itself. This is included to avoid any confusion regarding what is considered animation under the sign code. As per your letter: 1. Please find enclosed the application fee in the amount of $100.00. 2. Enclosed please find a copy of the comprehensive sign plan as originally provided in relation to the installation of the freestanding sign showing the sign location. 3. Enclosed please find a complete elevation of the proposed sign showing where the electronic portion of the sign is. a. It also shows the existing sign that was approved under the previous sign permit #S02-034. In your second paragraph you note the City sign code (TMC 19.28.010) prohibits animated signs. In my opinion you are mistaken in your interpretation of the code as animated sign is "any sign or portion which physically moves, including rotation or on which lettering or figures appear to move due to flashing lights. " This is an animated sign as set out in your code as your code says, "However changes in background or border lighting which occur at a rate of no more than ten times per minute and which utilize lamps of no more than 15 watts are classified as non -animated portions of a sign. " The sign applied for meets the code as it has changes of background or border lighting, which occur at a rate of no more than ten times per minutes and utilizes lamps of no more than 15 watt (in fact are 5 watts). "With this in mind this should be classified as a non -animated sign. Your last sentence says "however if the sign image appears to move it is considered animation and such changer are prohibited" that is not what your code says. Your code says "any portion which physically moves" and no portion of this sign physically moves and the code does not say or use the word "appears to move", perhaps if it does say this maybe you could point it out for me where it does. As your letter says "a border lighting/background change is allowed as long as it meets the rate of change and illumination requirements listed above." Based on the above criteria and our manufacturing criteria the sign meets the requirements listed above and I would ask that you issue the permit requested by return. As you know your letter further states the original cover letter from Carlson Signs says that "if the sign permit for animation message center is approved it shall replace the reader board", the only error in this is the word "animation" as this is not an animation sign. May we hear from you by return and I do point out to you that there are, I understand, a number of electronic signs with permits in Tukwila, one being the Silver Dollar directly across the street and we do have a valid permit for this. I point out further in your letter of May 29, 2002 to Mr. Wells of Carlson Sign Company a note in your second paragraph of #1 you state "However any changes of the sign display are considered animation and such changes are prohibited" The opinion from our attorneys is the code says what it says and it is not open for change by one other than elected officials in the City of Tukwila. You cannot use the word "considered" because that constitute a change in what the code says. Further above in the same paragraph you say "please note that the definition of animated signs draws a distinction between a change of a sign display and a border lighting /background change." The correct definition refers to "any sign or portion, which physically moves, including rotation or on which lettering or figures appear to move due to flashing lights." Dear Mr. McLean: This is in response to your sign permit application for Grand Central Casino that was received in mail on October 17, 2002. The following information is required to further process your application: 1. Application fee in the amount of $100. 2. A Site Plan that shows the location of the sign in relation to the property lines. 3. A complete elevation of the proposed sign. The elevation submitted with the application shows only the electronic portion of the sign. The portion of the existing sign that was approved under the previous sign permit (S02-034) must be shown on the elevation. This is required to verify that the entire sign meets the maximum sign area requirements. The sign area is calculated by drawing one box around the entire sign (the portion approved under S02-034 and the new proposed electronic sign.) Further, please note that the City's sign code (TMC 19.28.010) prohibits animated signs. Per TMC 19.08.030, an animated sign is defined as "any sign or portion which physically moves, including rotation or on which lettering or figures appear to move due to flashing lights. However changes in background or border lighting which occur at a rate of no more than ten times per minute and which utilize lamps of no more than 15 watts are classified as non -animated portions of a sign". Also, the city has received an application from Carlson sign to install a reader board on the existing freestanding sign at Grand Central Casino. We are in the process of reviewing their application. They have asked us to submit the needed permit form and would like you to approve it so that the sign can be completed and used as originally, intended to promote their business. As we discussed, Evergreen Entertainment is aware that Sign -O -Lite has submitted a sign permit application to the Clty of Tukwila requesting approval of a full -animation message center to be inserted into the existing street sign. Evergreen Entertainment would like our permit application to be processed first so that they can proceed immediately with advertisement of their business. We currently have no pending sign permits for the above location. The sign permit for Grand Central Casino was originally applied on May 20, 2002. A letter requesting additional information was sent on May 29, 2002. The applicant submitted revisions on July 23, 2002. The sign design was revised by the applicant to not include an electronic changeable copy sign. The revised sign design was approved and the sign permit issued on July 25, 2002. Your letter also questions the city code requirements regarding animated signs. Tukwila Municipal Code (TMC) 19.08.030 defines animated sign as "any sign or portion which physically moves, including rotation or on which lettering or figures appear to move due to flashing lights. However changes in background or border lighting which occur at a rate of no more than ten times per minute and which utilize lamps of no more than 15 watts are classified as non -animated portions of a sign". Your letter also expresses concern as to why an operating manual for the electronic sign was requested by the city. This application has met resistance at every step of the permit process. We were told that we had to submit an owner's manual on the operation of the electronic sign and failure to provide would stop the permit process. This documentation is not noted as a requirement in your sign codes, so why is it being requested? I was advised by the owner of the Grand Central Casino that he had been informed by Ms. Minnie Dhaliwal of the planning department that we were required to advise the City of Tuckwila in writing notarized by a lawyer what permanent message was going to appear on the electronic sign as it was illegal to change the message once it had been put up. As you can imagine we are very concerned on how application is being handled. I was able to have a conversation with Ms. Dhaliwal on July 23 2002. I was very confused as to why were where such difficulty for such a straightforward application. Ms. Dhaliwal told me that this was an animated sign and that it was not legal for it have a changing message. Again I must say I am very confused as your definition of an animated sign is very clear. The definition states " Animated sign, means any sign or portion of which physically moves, including rotation or on which lettering or figures appear to move due to flashing lights. However, changes in background and or border lighting which occur at a rate of no more than ten times per minute and which utilize lamps of no more than 15 watts are classified as non -animated portions of signs". This definition is correct, as it is the old style Vegas style cowboy with the waving arm this definition was written for. The city did not wish to have those type of animated signs installed. I asked Ms. Dhaliwal since she felt that the term "changes in background and or boarder lights" was not referring to a electronic changeable copy sign what style sign does it referrer to? Ms. Dhaliwal did not know. The display that we have made application for permit is an electronic changeable copy sign that utilized 5 watt lamps. According to your code as long as the wattage is less than 15 watts and that the messages are regulated to no more than 10 times per minute the display would be classified as non -animated sign. So why are we being denied a permit? We request that a permit be issued within the next 10 working days or we will have no alternative but to start a legal action against the City of Tukwila for unreasonable with holding a permit. The amount of the suit will exceed one hundred thousand dollars due under our agreement with the Grand Casino as well as that ever they consider their loss due to their inability to advertise their business in the same manner as other Casinos do in the City of Tukwila. A portion of the freestanding sign is proposed as an LED reader board. The LED reader board must comply with Tukwila Municipal Code (TMC) 19.08.030 regulations regarding animation signage. TMC 19.08.030 defines animated sign as "any sign or portion which physically moves, including rotation or on which lettering or figures appear to move due to flashing lights. However changes in background or border lighting which occur at a rate of no more than ten times per minute and which utilize lamps of no more than 15 watts are classified as non -animated portions of a sign". Please note that the definition of animated signs draws a distinction between a change of a sign display and a border lighting/background change. A border lighting/background change is allowed as long as it meets the rate of change and illumination requirements listed above.
