Electronic message center insert in the existing freestanding sign.
Please note that the City's sign code (TMC 19.28.010) prohibits animated signs. Per TMC 19.08.030,
an animated sign is defined as "any sign or portion which physically moves, including rotation or
on which lettering or figures appear to move due to flashing lights. However changes in background
orr border lighting which occur at a rate of no more than ten times per minute and which utilize
lamps of no more than 15 watts are classified as non -animated portions of a sign". The definition
of an animated sign draws a distinction between a change of a sign display and a border

In response to your letter of June 17th, 2003.
The language as printed on the permit indicates or reads as if you are pointing
out what the sign code says.
You are not doing this and you are printing out partly what the sign says, and
partly "your" opinion or interpretation of the code, which is incorrect.
The language as printed on the permit that relates directly to the code is of
course lawful, but the other part is really opinion.
We have had many conversations with yourselves over this with your people
mostly seemingly conducting a stalling tactic, not wishing to issue a permit based
on,what the code says, indicated on the permit something that is not in the code
itself.
As we said, we will be following the code in relation to this.

Dear Mr. Armitage:
This is in response to your letter regarding sign permit number S02-061 issued on March 4,
2003.
The language printed on your permit is an explanation of the sign code (TMC 19.28.010 and
TMC 19.08.030). This is included to avoid any confusion regarding what is considered
animation under the sign code. Based on our numerous conversations with representatives of
your company it was our understanding that it was clear to you what is allowed under our city's
code provisions.
Your letter states that the language printed on the permit is not lawful and correct under the city
code. This is not the case. The language printed on the permit is directly from the sign code and
an explanation of the sign code.

Attached is a copy of the permit issued for Silver Dollar at 14027 Interurban
Avenue S, Tukwila, and this was issued in the normal manner without going
through the hoops that your department has seemingly used to try to deny the
.Grand Central Casino permit.
Further, the City did not write in this permit anything whatsoever as you have
under description of work. It describes something that is neither lawful nor
correct under the City code.
It would appear to me that the portion that starts in line 4, "the definition of an
animated sign, etc." is not part of your code so why would you put it as part of the
permit?

All of the questions you are asking have been answered to you before.
I have provided you my letter of December 16th.
You are simply repeating yourself and I ask that you issue the permit forthwith as we are
prepared to put up a sign that meets the City of Tukwila code.
If we put,up a sign that does not meet the City of Tukwila code then naturally you may take
action, but we plan to conform to the code and we simply request that you issue the permit as
applied for.
With everything that has gone on and looking over the background information it appears that
this whole thing is some kind of a stall tactic for some reason or another.
Regardless, if you are not prepared to issue the permit within 48 hours of the date of this letter, it
will be in our intention to commence legal action against the City of Tukwila both to require the
issuance of the permit and: for damages for loss of income due to the City's intransigence.
I trust the above is in order and that we will receive our permit as we should have received
previously.

the sign are background and border lighting? This sign is 100% programmable. Your City
code states what the provision is in order for and electronic sign to be considered "non -
animated sign". We are applying for a sign permit as our sign meets the criteria as set out
in that code.
Please issue the sign permit in order that we may fulfill our contractual agreement with
this customer, as this has been delay since July 18th 2002 when I first made calls to your
office trying to have this permit granted.

I am writing in relations to your letter of November 6, 2002 to our General Manager, Mr.
Tim McLean.
As per your letter:
1. Please find enclosed the application fee in the amount of $100.00.
2. Enclosed please find a copy of the comprehensive sign plan as originally provided
in relation to the installation of the freestanding sign showing the sign location.
3. Enclosed please find a complete elevation of the proposed sign showing where the
electronic portion of the sign is.
a. It also shows the existing sign that was approved under the previous sign
permit #S02-034.
In your second paragraph you note the City sign code (TMC 19.28.010) prohibits
animated signs.
In my opinion you are mistaken in your interpretation of the code as animated sign is
"any sign or portion which physically moves, including rotation or on which lettering or
figures appear to move due to flashing lights. " This is an animated sign as set out in
your code as your code says, "However changes in background or border lighting which
occur at a rate of no more than ten times per minute and which utilize lamps of no more
than 15 watts are classified as non -animated portions of a sign. " The sign applied for
meets the code as it has changes of background or border lighting, which occur at a rate
of no more than ten times per minutes and utilizes lamps of no more than 15 watt (in fact
are 5 watts). "With this in mind this should be classified as a non -animated sign.
Your last sentence says "however if the sign image appears to move it is considered
animation and such changer are prohibited" that is not what your code says. Your code
says "any portion which physically moves" and no portion of this sign physically moves
and the code does not say or use the word "appears to move", perhaps if it does say this
maybe you could point it out for me where it does. As your letter says "a border
lighting/background change is allowed as long as it meets the rate of change and
illumination requirements listed above."
Based on the above criteria and our manufacturing criteria the sign meets the
requirements listed above and I would ask that you issue the permit requested by return.
As you know your letter further states the original cover letter from Carlson Signs says
that "if the sign permit for animation message center is approved it shall replace the
reader board", the only error in this is the word "animation" as this is not an animation
sign.
May we hear from you by return and I do point out to you that there are, I understand, a
number of electronic signs with permits in Tukwila, one being the Silver Dollar directly
across the street and we do have a valid permit for this.
I point out further in your letter of May 29, 2002 to Mr. Wells of Carlson Sign Company
a note in your second paragraph of #1 you state "However any changes of the sign
display are considered animation and such changes are prohibited" The opinion from
our attorneys is the code says what it says and it is not open for change by one other than
elected officials in the City of Tukwila. You cannot use the word "considered" because
that constitute a change in what the code says.
Further above in the same paragraph you say "please note that the definition of animated
signs draws a distinction between a change of a sign display and a border lighting
/background change." The correct definition refers to "any sign or portion, which
physically moves, including rotation or on which lettering or figures appear to move due
to flashing lights."

Re: Notice of incomplete sign permit application for Grand Central Casino.
Dear Mr. McLean:
This is in response to your sign permit application for Grand Central Casino that was received in mail on
October 17, 2002. The following information is required to further process your application:
1. Application fee in the amount of $100.
2. A Site Plan that shows the location of the sign in relation to the property lines.
3. A complete elevation of the proposed sign. The elevation submitted with the application shows
only the electronic portion of the sign. The portion of the existing sign that was approved under
the previous sign permit (S02-034) must be shown on the elevation. This is required to verify that
the entire sign meets the maximum sign area requirements. The sign area is calculated by drawing
one box around the entire sign (the portion approved under S02-034 and the new proposed
electronic sign.)
Further, please note that the City's sign code (TMC 19.28.010) prohibits animated signs. Per TMC
19.08.030, an animated sign is defined as "any sign or portion which physically moves, including rotation
or on which lettering or figures appear to move due to flashing lights. However changes in background
or border lighting which occur at a rate of no more than ten times per minute and which utilize lamps of

Also, the city has received an application from Carlson sign to install a reader board on the existing
freestanding sign at Grand Central Casino. We are in the process of reviewing their application. See
attached cover letter from Carlson sign requesting that the city issue the reader board sign first and that if
the sign permit for animation message center is approved it shall replace the reader board.

Per our conversation, Evergreen Entertainment, owners of the Grand Central Casino at 14040
Interurban Ave, South in Tukwila, has contracted with us to manufacture and install an internally
lit readerboard cabinet @ 26 sq. ft. to insert into the existing opening in their freestanding sign.
They have asked us to submit the needed permit form and would like you to approve it so
that the sign can be completed and used as originally, intended to promote their business.
As we discussed, Evergreen Entertainment is aware that Sign -O -Lite has submitted a sign permit
application to the Clty of Tukwila requesting approval of a full -animation message center to be
inserted into the existing street sign.
Evergreen Entertainment would like our permit application to be processed first so that they can
proceed immediately with advertisement of their business. Then, in the event that the permit
for the full animation message center is ultimately approved, it will replace the standard
readerboard that we are installing presently,

currently have no pending sign permits for the above location. While it appears that the City
believes that we withdrew our sign application as it related to the electronic portion of the sign,
this was not our intention. Instead, we meant only to defer this portion of the application so you
could continue to process the remainder of the application and it would not hold up the permit.

This is in response to your letter regarding sign permit for Grand Central Casino and the request to issue
the permit within 10 working days of the date of your letter. We currently have no pending sign permits
for the above location.
The sign permit for Grand Central Casino was originally applied on May 20, 2002. A letter requesting
additional information was sent on May 29, 2002. The applicant submitted revisions on July 23, 2002.
The sign design was revised by the applicant to not include an electronic changeable copy sign. The
revised sign design was approved and the sign permit issued on July 25, 2002.
Your letter also questions the city code requirements regarding animated signs. Tukwila Municipal Code
(TMC) 19.08.030 defines animated sign as "any sign or portion which physically moves, including
rotation or on which lettering or figures appear to move due to flashing lights. However changes in
background or border lighting which occur at a rate of no more than ten times per minute and which
utilize lamps of no more than 15 watts are classified as non -animated portions of a sign". Please note
that the definition of animated signs draws a distinction between a change of a sign display and a border
lighting/background change. A border lighting/background change is allowed as long as it meets the rate
of change and illumination requirements listed above. However any changes of the sign display are
considered animation and such changes are prohibited per TMC 19.28.010(3).
Your letter also expresses concern as to why an operating manual for the electronic sign was requested
by the city. It was requested to verify that the illumination and brightness of the proposed sign met the
sign code requirements.

There has been an application made for the installation of an electronic sign for the above-
mentioned site. This application has met resistance at every step of the permit process. We were
told that we had to submit an owner's manual on the operation of the electronic sign and failure
to provide would stop the permit process. This documentation is not noted as a requirement in
your sign codes, so why is it being requested?
I was advised by the owner of the Grand Central Casino that he had been informed by Ms.
Minnie Dhaliwal of the planning department that we were required to advise the City of
Tuckwila in writing notarized by a lawyer what permanent message was going to appear on the
electronic sign as it was illegal to change the message once it had been put up. As you can
imagine we are very concerned on how application is being handled.
I was able to have a conversation with Ms. Dhaliwal on July 23 2002. I was very confused as to
why were where such difficulty for such a straightforward application. Ms. Dhaliwal told me that
this was an animated sign and that it was not legal for it have a changing message. Again I must
say I am very confused as your definition of an animated sign is very clear. The definition states
" Animated sign, means any sign or portion of which physically moves, including rotation
or on which lettering or figures appear to move due to flashing lights. However, changes in
background and or border lighting which occur at a rate of no more than ten times per
minute and which utilize lamps of no more than 15 watts are classified as non -animated
portions of signs".
This definition is correct, as it is the old style Vegas style cowboy with the waving arm this
definition was written for. The city did not wish to have those type of animated signs installed.

The phrase " changes in background and or border lights clearly separates the electronic
changeable copy sign from that of the Las Vegas waving cowboy style sign.
I asked Ms. Dhaliwal since she felt that the term "changes in background and or boarder lights"
was not referring to a electronic changeable copy sign what style sign does it referrer to? Ms.
Dhaliwal did not know.
The display that we have made application for permit is an electronic changeable copy sign that
utilized 5 watt lamps. According to your code as long as the wattage is less than 15 watts and

We request that a permit be issued within the next 10 working days or we will have no
alternative but to start a legal action against the City of Tukwila for unreasonable with holding a
permit. The amount of the suit will exceed one hundred thousand dollars due under our
agreement with the Grand Casino as well as that ever they consider their loss due to their
inability to advertise their business in the same manner as other Casinos do in the City of
Tukwila.

The city's letter dated January 23, 2003, had requested additional information from you
regarding your proposed sign. Your response letter was received on February 4, 2003, but it did
not provide any additional information regarding the proposed sign.
You have been requested to please explain your proposed sign and how you plan on operating it.
Specifically it is not clear from your letters or drawings what portions of the sign you consider as
background and border lighting since the graphic submitted showed rolling dice. In your
response you indicate that the sign is 100% programmable. However it is not clear in your
response as to how it will be programmed. Please explain. If you plan on changing the graphic
and text of the sign display, please indicate the following:
1. Which portions of the sign will be background and border lighting?
2. How often will you change the sign display?
3. Will it appear to move?
Please note that animated sign is defined as "any sign or portion which physically moves,
including rotation or on which lettering or figures appear to move due to flashing lights..." If
the sign is operated such that the dice or any other image appears to move it shall be considered
an animated sign.
You have been informed earlier that the City's sign code (TMC 19.28.010) prohibits animated
signs. Per TMC 19.08.030, an animated sign is defined as "any sign or portion which physically
moves, including rotation or on which lettering or figures appear to move due to flashing lights.
However changes in background or border lighting which occur at a rate of no more than ten

Based on the review of the materials submitted by you on December 26, 2002, your sign permit
application is determined complete.
Further in your resubmittal you question the city's code requirements related to animated signs. The
letter dated November 6, 2002 informed you that the City's sign code (TMC 19.28.010) prohibits
animated signs. Per TMC 19.08.030, an animated sign is defined as "any sign or portion which physically
moves, including rotation or on which lettering or figures appear to move due to flashing lights. However
changes in background or border lighting which occur at a rate of no more than ten times per minute and
which utilize lamps of no more than 15 watts are classified as non -animated portions of a sign". The
definition of an animated sign draws a distinction between a change of a sign display and a border
lighting/background change. A border lighting/background change is allowed as long as it meets the rate
of change and illumination requirements listed above. However if the sign image appears to move, it is

In your response you point out that the sign applied for meets the code as it has changes of background or
border lighting, which occur at a rate of no more than ten times per minute and utilizes lamps of no more
than 15 watt. Please explain what portions of the sign are background and border lighting in your
proposal. The graphic submitted shows rolling dice.
Also, you asked where does it say in our code that "appears to move" is not allowed. Please note that
animated sign is defined as "any sign or portion which physically moves, including rotation or on which
lettering or figures appear to move due to flashing lights... " If the sign is operated such that the dice
appear to move it shall be considered an animated sign.
You also point out that the Silver Dollar Casino has a permit for an electronic sign. Please note that the
approval of their sign permit was for an electronic sign that could not be operated as an animated sign,

Per our conversation, Evergreen Entertainment, owners of the Grand Central Casino at 14040
Interurban Ave, South in Tukwila, has contracted with us to manufacture and install an internally
lit readerboard cabinet @ 26 sq. ft to insert into the existing opening in their freestanding sign.
They have asked us to submit the needed permit form and would like you to approve it so
that the sign can be completed and used as originally intended to promote their business.
As we discussed, Evergreen Entertainment is aware that Sign -O -Lite has submitted a sign permit
application to the City of Tukwila requesting approval of a full -animation message center to be
inserted into the existing street sign.
Evergreen Entertainment would like our permit application to be processed first so that they can
proceed immediately with advertisement of their business. Then, in the event that the permit
for the full animation message center is ultimately approved, it will replace the standard
readerboard that we are installing presently.

Based on review of your sign permit application for the above referenced site the following
information is required:
1. A portion of the freestanding sign is proposed as an LED reader board. The LED reader
board must comply with Tukwila Municipal Code (TMC) 19.08.030 regulations
regarding animation signage.
TMC 19.08.030 defines animated sign as "any sign or portion which physically moves,
including rotation or on which lettering or figures appear to move due to flashing lights.
However changes in background or border lighting which occur at a rate of no more
than ten times per minute and which utilize lamps of no more than 15 watts are classified
as non -animated portions of a sign". Please note that the definition of animated signs
draws a distinction between a change of a sign display and a border lighting/background
change. A border lighting/background change is allowed as long as it meets the rate of
change and illumination requirements listed above. However anv chanes of the sign
display are considered animation and such changes are prohibited per TMC 19.28.010(3).
Pursuant to TMC 19.28.010(3), animated signs are prohibited in the City of Tukwila
unless specifically approved as Type 2 decision (see attached application) and subject to
criteria listed under TMC 19.28.010(3). The criteria limits the message content of such
signage to time, date, temperature and business hours.
Please provide additional information regarding the type of changes the LED reader
board will be used for. If you are proposing to use the LED reader board for just border
lighting and background changes, please note the rate of change and illumination
requirements noted above. Also, provide a certification from the owner or operator of the
sign stating that the sign shall be operated in accordance with the City codes and the

owner or operator shall provide proof of such conformance upon request of the City.
Also, provide a copy of the manufacturer's operating manual, which includes
illumination and brightness information of the proposed sign.
If any changes to the sign display are proposed, a Type 2 Special Permission permit is
required and it must meet the criteria listed under TMC 19.28.010(3), which limits sign
display changes to time, date, temperature and business hours.
2. Wall sign: Per TMC 19.32.140, the maximum sign area of any sign mounted on a wall
with an exposed building face of 3,440 is 118 square feet. Based on the dimensions
provided, the proposed sign area is 128.6 square feet. Please clarify the dimensions and
the area calculation for the proposed sign and revise the drawings to meet the maximum
size requirements.
