The existing sign was a non -conforming sign due to the fact that the sign was too high. Freestanding signs are not permitted to be taller than the buildings they are associated with. No changes can be made to a non -conforming sign without bringing the entire sign into conformance with City code. The application that was first submitted to the City called for the existing sign to remain and a new face installed. The City noted to the applicants that this was not allowed and new drawings were submitted that showed that the sign would meet the height requirements. The City reviewed and approved these revised drawings. The proposed sign was to be 22 feet in height, the same height of the building. On Friday, June 13, 2003 City staff conducted an inspection of the sign on the property and found that the non -conforming sign was not removed and that the sign face was replaced. This was done in violation of the Tukwila Municipal Code and the approved sign permit. Enclosed you will find copies of the photos on record with the City, the drawings submitted to the City, and the permit. The City would ask in your cooperation in remedying this situation. The sign that is placed on the property must be the same sign that the City reviewed and approved. Failure to abide by the permit that was issued will result in the violation being referred to the City's Code Enforcement Division. The Code Enforcement Division will begin enforcement procedures against the property owner, which may result in citations being issued of up to $500 per day per violation.
