After conducting a review of the signage on the property, six signs were installed that did not match the approved plans that the City has for the project. The internal informational signs, those signs saying, Thank You, Enter/Exit, Exit Only, and Enter have the KFC name and logo placed on them. This was not part of the approved plans. Tukwila Municipal Code (TMC) 19.22.020 notes: The information or copy displayed by or on any internal information sign shall be limited to only those letters and/or symbols necessary to convey the required message, in as brief a manner as reasonably possible, and shall not advertise in any manner the facility occupying the premises nor goods or services available nor hours of operation. City staff noted that names and logos could not be placed on the internal information signs in a fax to Jean Morgan dated 9/26/2003. Revised plans were than submitted. The menu boards also do not match the plans that were approved by the City. Menu boards are limited to 40 square feet in area. In order to meet the square footage requirements the KFC/Taco Bell signs were removed from the menu board (Please refer to the fax to Jean Morgan dated 9/26/2003). Yet, on inspection these signs are present on the boards. All signs on the property must match the approved plans that the City issued as part of S03-059 and S03-060. The maximum allowable height for menu boards will be 7 feet and the maximum allowable size of the menu board face will be 40 square feet. Menu boards will be a permitted use so -long as they are not oriented to the public right-of-way and their primary function is not advertisement. Why was this interpretation developed? Restaurants with drive-through components, by their nature, require the presence of menu boards. These boards are single faced and are oriented only to the cars stacked in the drive-through lane. Fast food restaurants (particularly drive-through restaurants) need one freestanding sign to attract traffic. However, TMC 19.32.140(D) allows only one freestanding sign per lot if there is less than 400 linear feet of street frontage. This precludes classifying a menu board as a freestanding sign. In past years, menu boards were considered by Tukwila DCD to be an "Internal Information Sign". These menu boards were not considered to be advertisements or freestanding signs. As a result they were allowed at the major fast food restaurants in Tukwila due to their function and orientation away from the right-of-way. However, the current sign code is silent on this subject and there is no approved code interpretation on file. The only avenue available to a fast food restaurant is a Special Permission Sign Permit, which involves a $200 fee. It does not seem equitable to require a permitted use (a drive-through restaurant) to obtain a special permit for a component of that use. This code interpretation standardizes the interpretation that has been informally applied by Tukwila DCD in similar situations over the past decade. What is the justification of the interpretation? Menu boards are not typically visible from the right-of-way. Their function requires a listing of goods available as well as a greater height and surface area than that allowed by Tukwila Municipal Code. TMC 19.08.120 defines "Intemal - Information Sign" as a sign which "gives directional information or identifies specifrcuse area's and which is necessary to maintain the orderly internal use of the premises .." Menu boards give drivers the opportunity to review menu options prior to placing an order at the drive- through window. This increases the efficiency and orderly traffic flow through the premises. Per TMC 19.22.020, the content of freestanding signs "shall be limited to only those letters and/or symbols necessary to convey the required message . . . and shall not advertise in any manner the facility occupying the premises nor good or services available nor hours of operation." Additionally, TMC 19.22.040 restricts freestanding internal information signs to 5 feet in height and a sign face of 4 square feet. Signature of Interpreter.
