NOTICE OF DECISION
This letter serves as a Notice of Decision and is issued pursuant to Tukwila Municipal Code (TMC)
18.401.170.
The request for an increase, from 9.3 sq. ft. to 11.16 -sq. ft. for Espresso at the Park at 6840 Fort
Dent Way.
This decision is based on the Findings and Conclusions listed below.
BACKGROUND

Request: Approval for a Special Permission Sign, increasing the allowed
sign area. The maximum allowed sign is proposed to be
increased from 9.3 to 11.16- sq. ft.

FINDINGS
Vicinity/Site Information
The sign being proposed will be located on the south wall of 6840 Fort Dent Way and will face directly
towards Fort Dent Way. The zoning on the property is RCM and surrounding land uses are commercial.
The exposed building face (EBF) is 186.14 square feet. With the approval of the Special Permission
Application, the wall sign would be 11.16 square feet (5.999% of EBF) versus the normal maximum of
9.3 square feet (4.99% of EBF).

TMC 19.32.140(A) allows permitted sign area to be increased by 50% for each doubling of the required
minimum setback...but in no case shall the sign area exceed that permitted in TMC 19.32.150. Pursuant
to TMC 19.32.150, the maximum allowed sign area could be 6% of the exposed building face (EBF) up
to maximum of 500 sq. ft.
The required front setback in the RCM is 20 feet. The building has a setback of about 55 feet, 2.75 times
the required distance.
Per Table 1 of TMC 19.32.140, the standard allowed sign area would normally be 9.3- sq. ft. for an EBF
of 186.14 square feet. Since the building is setback 2.75 times the minimum setback required for the
underlying zone, the maximum sign area is allowed to be increased 50% for each doubling of the
required minimum setback up to 6% of EBF or 500 sq. ft., whichever is less. Six percent of EBF (186.14 -
sq. ft.) is 11.1684 -sq. ft; thus the maximum allowed sign area on facade is 11.1684 -sq. ft. The applicant
is requesting a sign size that is smaller than the six percent allowed for the wall.
CONCLUSIONS
1. The building is setback a sufficient distance to allow an increase in the wall sign area.
2 The proposed sign area is 11.16 -sq. ft., which less than maximum permitted for that facade
(6% of EBF -11.1684 sq. ft.).
APPEAL PROCESS
This decision may be appealed to the Planning Commission within 14 days from the issuance of this
Notice of Decision. All appeal material must be submitted to the Department of Community
Development. If you wish to appeal this decision, please call the Department of Community
Development at 206-431-3670 to obtain a copy of appeal procedures.

Dear Mr. Scalzo:
The Department of Community Development received your sign permit application on September 29,
2003. Based upon a review of the application it cannot be approved as submitted.
The size of wall signs is regulated under section 19.32.130 of the Tukwila Municipal Code. The exposed
wall area where the sign will be placed is 186 square feet. The maximum permitted size of the sign is
only allowed to be 9.3 square feet. The proposed sign is 53 square feet, 5.6 times the allowed area.
The size of the all sign can be increased by 50 percent of the maximum size permitted for each doubling
of the required setback. The required setback for the property is ten feet, thus the espresso stand must be
setback at least 20 feet to qualify. This will require Special Permission from the Director of Community
Development. A permit fee of $300 applies to obtaining Special Permission.
New drawings must be submitted with a sign that meets the City's size requirements. The chart that
regulates wall sign size has been included with this letter.
On another note, do you plan on having any type of menu boards advertising the good at the espresso
stand? The City considers menu boards as internal informational signs. Internal Informational signs are
limited to only those letters and/or symbols necessary to convey the required message, logos and the
stands name cannot be on the menu board.
If you plan on having a menu board a permit will be required. You can work under the permit that was
just applied for, but an additional permit fee of $100 will be required.

A structural inspection is required for all signs when installation is complete. The applicant or installer is required to call the Planning
Division at 431-3670 for a final inspection.
It is the responsibility of the installer to obtain the electrical permit and inspections from the Washington State Department of Labor
and Industries at (206) 248-6630.
