MOVED BY TRAYNOR, SECONDED BY HARRIS, THAT THE MINUTES OF THE
REGULAR MEETING OF MARCH 5, 1979, BE APPROVED AS PUBLISHED.
MOTION CARRIED.
Councilman Traynor said he had questions on several vouchers and
would like to know about them before their approval. He asked
about the vouchers for the installation of a sewer stub and
wondered why the City Crew did not do the work. Mayor Bauch
said it was for Patton's sewer stub and the excavation was
deep. A voucher for the installation of a utility line under
Andover Park West was discussed. Councilman Traynor questioned
why the City should pay for the attempt to bore under the
street when it was not successful so the street was dug up.
Mayor Bauch said this amount will be reimbursed by the developer.
Discussion continued on other vouchers in question.

BY THE FINANCE COMMITTEE, BE ACCEPTED AND WARRANTS BE DRAWN IN

The Public Hearing, set by Resolution #672, is being held at the
request of Gerald E. Schneider for the vacation of a section of
street known as Macadam Road. Mayor Bauch declared the Public
Hearing open.
Mr. Merril Simonds, 15460 65th Ave. South, asked if it was the
plan of the City to vacate the whole section of street. Mayor
Bauch explained that it is not the plan. The request has been
made for a street vacation so the City is required to hold a
public hearing to hear all testimony on the request. Mr. Simonds
said he is against the vacation. He said he felt there has
already been too much vacated in front of his driveway. There
is supposed to be a forty foot road right -of -way and there is
only about twenty feet left. So far, there has been nothing
done about the garbage can and this made it narrower yet.
Kjell Stoknes, OCD Director, said he has talked to the owners
of the property but it now looks like it is time to take some
action on this. Councilman Bohrer asked if the public right -of-
way is being used as a parking lot. Mr. Stoknes said he has

observed cars parked on the right -of -way but he did not know
whether the dumpster is on it or not. Councilman Traynor asked
if the developer has cut away part of the right -of -way. Mr.
Stoknes said the construction drawings show they are working
entirely on their own land.
Mr. Carl Bloss, representing Schneider Homes, said all of their
structures are on their right -of -way. They are using the street
right -of -way to park some vehicles. He said they have talked
to Mr. Simonds several times and wanted to work out his problem.
Also, they will move the dumpster. When their site plan was
approved they were given access to the property off of Bluff
Street (Old 65th). They have purchased the adjacent property
and intend to use this as access to that property. The portion
they have requested vacated will be used for access and landscaping.
Mr. Simonds again questioned the width of the right -of -way.
Councilman Traynor asked if there really is forty feet there
or is this one of the places on this hill where the surveys
don't meet. Mayor Bauch reminded Council that this public
hearing is to discuss a street vacation request. Councilman
Bohrer asked Mr. Bloss why they are asking for a street
vacation. Mr. Bloss said they own the property on both sides
and want to use that area for landscaping and access. Councilman
Bohrer said the Planning Commission denied the request for a
rezone on the property to the east and asked if the street
vacation is now unnecessary. Mr. Bloss said they will try again
for a rezone. They still do not understand why the rezone was
rejected.
Councilman Hill said the concern is that where the blacktop is
isn't necessarily the center of the street. The question we have
to settle is where is the center of the street. Mayor Bauch said
he stepped the street off and there isn't 40 feet of street, but
we are not discussing that section here.
There being no further comments, Mayor Bauch closed the Public
Hearing.
MOVED BY HILL, SECONDED BY HARRIS, THAT THIS ITEM BE REFERRED
TO THE COMMITTEE OF THE WHOLE MEETING ON MARCH 26TH. MOTION
CARRIED.
Mrs. Joanne Davis, 5906 South 144th, thanked Councilman Van Dusen
for installing a stop sign that had been knocked down. She
asked if anything is being done about Metro and bus transportation
on the hill. She said she notices a bus come up Macadam Road and
turn west on to South 144th to go in front of Foster High School.
She said it would seem they could pick up more passengers if
they came up 65th Street. Also, she asked about the plans for
sidewalks on Interurban. There are quite a lot of joggers and
walkers that use it and it is an unsafe area. If we don't have
it done soon we might not have it. She said this concerns her.
Mayor Bauch told Mrs. Davis that he has met with the Director
of Transportation from Metro to explain the problems of the
City. They are looking at it. Second, the Council has passed
a Resolution of intent for the City to try and acquire control
of Interurban. It has to go to the State Legislature, and now
that they are back in session, there is a possibility.

Claim for Damages: Claim for Damages was filed with the City by Jim B. Rogers. A
Jim B. Rogers City truck, carrying heavy equipment, backed into his vehicle
while it was stalled. The staff report from John McFarland,
Administrative Assistant states that the facts and circumstances

City Attorney Hard read an ordinance designating a lending
institution and setting the interim financing rate for LID
29 revenue warrants.

Councilman Harris commented that this is a very good and reasonable
interest rate.

City Attorney Hard read an ordinance of the City of Tukwila,
Washington, relating to animal control and amending ordinance
No. 979.

City Attorney Hard read a resolution of the City of Tukwila,
Washington, accepting and approving a petition for annexation
and authorizing the commencement of an annexation, proceeding by
the election method of a portion of the unincorporated planning
area known as "Allentown," and referring the question of a
proposed zoning regulation to the planning commission.

Attorney Hard reported on the question raised by Council as to the
affect of an annexation on the Fire Districts. If the annexation
is completed, it will change the boundaries of the Fire District.
Any Fire Commissioners residing in the annexation area, once it
is completed, are no longer eligible to serve as a Commissioner.
If all of the Commissioners of a District live in the annexed
area it may be that the Governor would have to appoint new
Commissioners. Once an annexation is complete, it is possible
for the City to contract for fire service of the area with the
local Fire District.
Councilman Harris noted Section 5 and asked if, prior to the
election, the Planning Commission will do the zoning on this
area. Mayor Bauch said yes, the ordinance setting the zoning
will be adopted prior to the election and it will be filed with
King County to become effective upon annexation.
Councilman Traynor stated that Fire District No. 1 has been in
existance for a very long time and it would be a shame to lose
the District entirely. He said he believes it is the oldest
in the State. Mayor Bauch said there is no danger; the proposed

Mr. Gomez, audience, said that all three Commissioners live
in the annexation area and this matter would have to be faced.
Councilman Bohrer asked Mr. Gomez if they want to proceed with
the Resolution as written and have the zoning defined first.
Mr. Gomez said they do not want to change their position. Most
of the residents would like to see the zoning first, but if
this is going to defeat the annexation, then they would change
to unclassified. Mayor Bauch said it was his feeling, after
attending a meeting of the Duwamish Improvement Club, the
people would like to see the zoning before annexation.
Mayor Bauch said he met with the Chief of Fire District No.
1 and they are willing to start negotiating a contract for
fire service to the Riverton area. He asked Council for
permission to negotiate with the Fire District and bring back
a contract for Council approval.

City Attorney Hard read a resolution of the City Council of
the City of Tukwila granting approval, subject to certain
conditions, of the preliminary plat of the Bel Crest Heights
Subdivision being Planning Division File No. rIF 78 -37 -SUB.

Councilman Bohrer said there were two questions raised at the
Committee of the Whole meeting, the first on the blacktop sluffing
and the second on the position of the property line relative to
54th.
Mayor Bauch said it has been determined that the east property
line of the right -of -way is essentially the east edge of the
pavement of the existing road. There is a 60 foot right -of -way.
There has been no movement of the earth since they installed
the water barrier and the corrugated tile.

Councilman Saul asked if the/ were contacted about sidewalks.
Mr. Stoknes said they have not been contacted but this is a
standard of the Public Works Department.
Councilman Saul asked how the remaining 40 feet will be developed.
Mr. Stoknes said it would be excavated level by the developer,
a rockery put in and left undeveloped or grass seeded until
a new street is constructed.
Councilman Harris questioned the size of the lots for the somewhat
difficult terrain. Mayor Bauch said 9,600 is the size of the
larger lots in Tukwila.

City Attorney Hard read a resolution of the City of Tukwila

City Attorney Hard read a resolution of the City of Tukwila,
Washington, stating its intent to adopt noise regulations in
conformance with the currently adopted noise regulations of
the State of Washington.

Mayor Bauch announced that he has been elected President of
the Suburban Mayor's Association and also Chairman of the
Valley Communication Administrative Board.
At one time, Council declared the old Finance Trailer surplus
and advertised for the sale. There were no bids received.
Mayor Bauch said he has received an offer of $50 for it
and has stipulated that it must be removed from the City
within 30 days.
MOVED BY HARRIS, SECONDED BY SAUL, THAT COUNCIL ACCEPT THE OFFER
OF $50 FOR THE FINANCE TRAILER. MOTION CARRIED.
Councilman Harris read the report submitted by Ron Swanson,
Finance Director. Interest income for the month of February
amounted to $31,260. Interest rates ranged from 9.67% to
10.65%. Investments Sold: $1,250,000
Investments Purchased: $1,470,000
Councilman Traynor, on behalf of his family and Councilman Saul
and his family,presented a large framed aerial photograph to
the City. The picture is of the Southcenter /Andover area taken
prior to the start of the industrial development.

PHOTOGRAPH ON BEHALF OF THE CITY. MOTION CARRIED.
Council President Bohrer noted receipt of the "Resolution and
Hearing Decision -File No. 816" from the Boundary Review Board.
This hearing concerned the proposed annexation of the Riverton,
et al area.
