On April 12, 2004, Michael Springer submitted a sign permit application to install a freestanding sign at 17600 West Valley Highway. 2. The sign permit application was deemed complete on April 27, 2004. 3. There is one large multi -tenant building located on the subject property. 4. The sign would have had a height of three feet, double faced, with each face having a sign area of 15.33 square feet. The sign would have been 12 feet from the nearest property line. (Attachment A) 6. The sign meets all design standards set forth in Title 19 of the Tukwila Municipal Code. 7. There is currently a large freestanding sign on the property. Roma Furniture is using the sign for advertising purposes (Attachment B and C). 8. Tukwila Municipal Code (TMC) 19.32.140 notes, "One freestanding sign shall be permitted for each site." There are code provisions that allow for an additional freestanding sign, yet this property does not qualify for any of those provisions. 9. The City noted to the applicant, in two letters, that the proposed sign would not be allowed because there was an existing sign on the property (Attachment D and E). CONCLUSION The property in question is only permitted to have one freestanding sign. The application for an additional sign would add an additional sign on the property that would not be permitted under Title 19 of the TMC. The sign permit application is denied. APPEALS This decision may be appealed to the Planning Commission within 14 -days from issuance of this Notice of Decision (06/18/2004). All appeal material must be filed with the Department of Community Development no later than 5:00 PM on July 1, 2004. Appeal Materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party, and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or error in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. Attached to this letter was a letter from Mr. David Bromel, giving Teague permission to install a freestanding sign at 17616 W. Valley Highway. The letter from Mr. Bromel does not address the issues that were raised in the April 20, 2004 letter from the City to the property owner. Why can't Teague and Roma Furniture share one freestanding sign? How will the applicable provisions of the Tukwila Municipal Code be met? Please address these issues by May 19, 2004. When the decision to go ahead was made Iliad informed our client aware that Tukwila, Sign Code as applied to the site allows only one free standing sign. The client decided at that time to apply for the sign permit with the intention of going through the variance process. Valley Highway in the City of Tukwila. Based on a review of your application for submittal requirements for a sign permit, your application is deemed complete as of April 27, 2004. As has been noted, under Tukwila Municipal Code (TMC) 19.32.140 (D), this site is only permitted to have one freestanding sign. There is an existing freestanding sign on the property that is being utilized by Roma Furniture. Roma Furniture refaced the sign without a permit and has submitted a sign permit application for the work they have already performed. It is the responsibility of the landlord not the City to determine how signage is utilized on the site. The City only ensures that the proper City regulations are being met in regards to total number of signs, allowable sign area, location, setback, and height. Staff would suggest that the tenants and landlord find a solution that allows Teague, Roma, and any other tenants who desire a freestanding sign, to share one sign as is required under the TMC. This property would be permitted to have a large sign area, which could easily accommodate many tenant spaces. The landlord needs to inform the City, by writing, how the signage allotments for the property will be utilized. Laurelhurst Dr. NE Seattle, WA 98105 RE: Property Located at 17616 West Valley Highway Dear Mr. Bromel: City records list you as the property owner for the above address located in the City of Tukwila. Earlier this month City staff noticed that Roma had altered the freestanding sign located at the property. Additionally, Roma also installed a wall sign on the building. This work was done without a sign permit, done in violation of City Code. After receiving a pre -citation letter from the City's Code Enforcement Officer, Roma Furniture submitted for a sign permit. A few days after Roma submitted, Teague, another tenant on the property also submitted to install a freestanding sign. Under Tukwila Municipal Code (TMC) 19.32.140, your property is limited to having one freestanding sign. According to the application submitted by Teague, there is 400 feet of frontage along West Valley Highway, which would allow a freestanding sign to have up 200 square feet of sign area. Ideally both Roma and Teague could share one sign. The City has asked Roma to submit a letter from the property owner indicating that they have permission to change the face of the freestanding sign. Does Roma have exclusive rights to use the freestanding sign on your property? If so, no other freestanding sign can be installed on the property. Thus, Teague's sign permit application would have to be denied. Is it possible to allow Teague and Roma to share one freestanding sign? This would allow both businesses to address their sign needs while complying with the City's sign code.
