NOTICE OF DECISION
This letter serves as a Notice of Decision and is issued pursuant to Tukwila Municipal Code (TMC)
18.401.170.
Request for an increase, from 150 sq. ft. to 500 -sq. ft. for King County Museum of Flight located at
9404 East Marginal Way S.
This decision is based on the Findings and Conclusions listed below.
BACKGROUND

Applicant: Craig Parsons on behalf of the Museum of Flight
Request: Approval for a Special Permission Sign, increasing the allowable
sign area. The maximum allowed sign is proposed to be
increased from 150 to 500- sq. ft.

FINDINGS
Vicinity/Site Information
The sign being proposed will be located on the southwest wall of 9404 East Marginal Way South directly
towards East Marginal Way and Museum of Flight Place. The zoning on the property is MIC/H and
surrounding land uses are industrial. The exposed building face (EBF) is 15,200 square feet. With the
approval of the Special Permission Application, the wall sign would be 500 square feet (3.2% of EBF)
versus the normal maximum of 150 square feet (0.009% of EBF).

Existing Signage
The Museum of Flight currently has two small freestanding signs located along East Marginal Way.
These signs were permitted under the premise that these would qualify as the Museum's quota for signs,
thus they would not be permitted to have additional a signs, either freestanding or wall. The Museum has
now proposed to classify these small freestanding signs as internal informational signs. These signs do
not meet the area and content restrictions that can be permitted outright for internal informational signs.
However, the Planning Commission has the authority to waive certain requirements when a demonstrated
need for such signs exists. The Museum will be pursuing obtaining Special Permission from the Planning
Commission for the retention of these freestanding signs.
Decisional Criteria
TMC 19.32.140(A) allows permitted sign area to be increased by 50% for each doubling of the required
minimum setback...but in no case shall the sign area exceed that permitted in TMC 19.32.150. Pursuant
to TMC 19.32.150, the maximum allowed sign area could be 6% of the exposed building face (EBF) up
to maximum of 500 sq. ft.
There is no required side setback in the MIC/H. Thus, Museum of Flight would be permitted to have a
wall sign equal to 500 square feet of six percent of the wall area, which ever is less.
CONCLUSIONS
1. The building is setback a sufficient distance to allow an increase in the wall sign area.
2. The proposed sign area is 500 -sq. ft which is equal to the maximum permitted size for a wall
sign.
CONDTIONS
1. The Museum of Flight shall seek to have the two freestanding signs located on East Marginal
Way classified as internal informational signs by the City's Planning Commission.
Application for Special Permission from the Planning Commission shall be submitted within
90 -days from the date of this Notice of Decision. If these freestanding signs cannot be
classified as internal informational signs they must be removed.
APPEAL PROCESS
This decision may be appealed to the Planning Commission within 14 days from the issuance of this
Notice of Decision. All appeal material must be submitted to the Department of Community
Development. If you wish to appeal this decision, please call the Department of Community Development
at 206-431-3670 to obtain a copy of appeal procedures.

INSPECTIONS
If the sign needs structural review, the applicant or installer is required to call the Building Division at 431-3670 for footing or bracket

installed.
A structural inspection is required for all signs when installation is complete. The applicant or installer is required to call the Planning
Division at 431-3670 for a final inspection.
It is the responsibility of the installer to obtain the electrical permit and inspections from the Washington State Department of Labor
and Industries at (206) 248-6630.
