I have also reviewed the construction drawings for the TIB project. It was during the TIB project that the City constructed the small brick wall located at the corner of S. 144th Street and TIB. First, in our conversations you suggested that the City placed the wall on your property without permission. From the drawings I have reviewed the wall is not on your property but is located within the City's ROW. Attached with this email is a copy of the construction drawings from Public Works. The drawing shows the wall's location in relation to your sign and the street. The issue of the wall's location was also discussed with you by Stacy MacGregor, Assistant Planner in 2008. In an email from Ms. MacGregor dated September 30, 2009, she also stated that the wall was not located on your property. Now that we have resolved the issue of the wall's location, I want to discuss the history of freestanding signs on your property. At some time in the last several years, the freestanding signs were refaced without permits. The City began code enforcement procedures against the property to compel compliance with the City's sign code requirements. The large pylon sign was removed and a permit was submitted to the City for the reface of the 22 foot tall pylon sign located at the corner. Documents in the 2005 permit file show repeated emails to you about the illegal reface of the 22 foot tall pylon sign and what needed to be done in order to bring the sign into compliance. In an email dated September 30, 2008, Ms. MacGregor stated the specific issues with the sign. I have included a copy of that email with this email. Ms. MacGregor stated that the sign must be setback an equal distance in relation to the sign's height. The City's old Sign Code specifically required that signs that did not meet the City's sign code be brought up to code when a reface (like what happened) occurred. 1 I also attempted to resolve this issue with you in 2009 by offering an agreement about the status of the sign that had been illegally refaced. My email is attached. I offered to enter into an agreement so that, "...that there was clear understanding between both parties". You did not follow up with me about this offer. When the new sign code was adopted, the City created a grace period for signs that met the old sign code. Under the grace period refaces or copy changes of signs could occur until 2020. After 2020 the sign could remain but no refaces or copy changes were permitted without bringing the sign into conformance. Signs that do not meet the old sign code are permitted to remain, but refaces and copy changes are not permitted. Given that the sign on your property was never brought into compliance with the old sign code, staff cannot issue a permit to reface the sign. What staff will offer is that we will not require you to obtain a sign permit for the work that occurred to the sign several years ago. While this work was illegal, the City will permit the Union 76 freestanding logo as shown in the photos you provided me to remain. The new sign code does provide a wide range of options for signage on your property. If you feel that the only place to locate a sign on your property is at the street corner I would suggest you submit for a variance application. I had provided you a copy of the application several weeks ago. I understand that this may not be the response you were looking for. If you would like to discuss this matter with my supervisor, I have scheduled a meeting with you with Nora Gierloff, Deputy Director for Tuesday (11/22) at 10am to discuss the situation. In exchange for the City delaying code enforcement procedures; the City would want the large pylon sign removed within 60 -days of entering into an agreement. We required that you submit a sign permit application not later than March 17, 2008 in order to avoid further legal action. On April 11, 2008, we notified you that due to your failure to apply for the sign permit by the deadline, we had assessed fines in the amount of $13,000.00 (26 days x $500/day). We also told you that fines would continue to accrue at this rate until compliance had been achieved. As of today, your fines for this violation are $121,500.00 (243 days x $500/day). As of today there is no record of a sign permit application submittal for this sign. An inspection on October 29, 2008 shows that the violation continues. In order to avoid further fines, you must apply for the sign permit that meets all requirements of our sign regulations not later than November 21, 2008. You have an outstanding code enforcement action for refacing these signs without a permit. A permit was applied for in 2005 but the application was never revised as requested. In order to bring this site into compliance, the very tall pole sign needs to be removed as it does not meet code. The freestanding sign needs to meet setbacks wherein the sign is setback from the property line a distance equal or greater than its height. To do this, either the existing sign needs to be lowered or relocated. I researched the history of the easements and sidewalk creation and it does not appear, to me, to have an impact on your property lines. Please contact me so we can get this matter resolved.
