The meeting provided us with some helpful clarifications. We discussed Ms. Reavis' January 5, 2006 letter that referred to certain signs needing to be removed in order for the center to comply with the Tukwila Municipal Code. Although an incorrect code citation was included in that letter, the number of signs at the center does exceed Code standards, due to the freestanding sign permit issued by the City on May 31, 2006. As the time period for challenging or revoking that permit as long since passed, you advised us that the existing signage at the center will be considered by the City as a legally nonconforming condition. That means the existing signage can stay as is, and the City does not consider it necessary or appropriate to take any enforcement action. We do understand that new signage at the center must comply with applicable Code standards. We appreciate you advising us of the City's intent to revise its Sign Code, and we will follow up with Mr. Brandon Miles, who is working on that project. Your letter states that each of the businesses at the retail center must remove one sign from the premises because each business presently has three signs, which is in violation of the "two signs per business" limit in Tukwila Municipal Code section 19.32.140 C 3. We are informed that this same reasoning was recently applied by the City to deny the sign permits for PetsMart and JoAnn's. We have examined this situation further and ask the Department to reconsider its position. The January 5th letter, and the sign permit denials, cite a single code section (19.32.140 C 3) for the conclusion that the businesses at the retail center are limited to two signs. However, that code section applies to "Office buildings with multiple tenancies." The lead in sentence to that section is as follows: C. Office buildings with multiple tenancies shall be permitted signs as follows: 3. Each business is permitted a maximum of two signs... . A complete reading of the code section demonstrates that the standard cited by the City applies to office buildings. As you know, Parkway Plaza is a retail center, not an office building; accordingly, this code section does not apply to limit the signage to two signs per business. 14900 Interurban Avenue South, Suite 210 Seattle, Washington 98168-4654 (206) 244-2000 FAX (206) 674-4666 • • March 7, 2007 Page 2 of 3 Moreover, Parkway Plaza meets the standards for face mounted signs in code section 19.32.140 A, and the standards permitting two freestanding signs in code section 19.32.140 E. Thus, the signage at Parkway Plaza complies with all applicable code standards and cannot be required to comply with a standard that applies only to office buildings. In addition, the action that resulted in Parkway Plaza having three signs per retail establishment was the City's approval on May 31, 2006 of the new freestanding sign for the center under Sign Permit No. S06-021. As explained above, we do not believe it is correct to conclude that each business must remove a sign based on an office requirement. However, if the City continues to apply the office building standard to a retail tenant, the City is in essence saying it issued the Sign Permit in error, because approval of that permit is what caused the presently nonconforming situation. There are three points for the City to consider before it takes the position that the City's issuance of that Sign Permit caused a violation of the Tukwila Code. First, the property owner has expended over $20,000 to install the sign approved by that Sign Permit. That expenditure was made in reliance on an issued permit, and the retail tenants in the center also have relied on that permit. Second, there were unique circumstances associated with installation of the new freestanding sign authorized by the Sign Permit. As Ms. Nora Gierloff will recall, the Parkway Plaza property owner appealed the Brad Decker building to be constructed between the Plaza and Southcenter Parkway. The property owner filed a lawsuit against the City and Decker to challenge City approval of the Decker project. As part of a settlement agreement and dismissal of the lawsuit, the Decker building was re -designed and the City was aware that Parkway Plaza would be seeking a permit for a new freestanding sign. This is reflected in City permit documents associated with City approval of the re -designed Decker building, and it was specifically discussed between Ms. Gierloff and Parkway Plaza's attorney on July 28, 2005. Given these special circumstances associated with signage for Parkway Plaza, it is particularly inappropriate for the City to claim that the Sign Permit was issued in error. Third, the Sign Permit was issued nine months ago. If the City believed that permit was issued in error, it had a time limit for revoking or challenging it. That time limit has long since passed, and the Sign Permit has to be recognized as valid. We ask you to consider the points raised in this letter, so that the Parkway Plaza tenants may retain the signage that they are entitled to. We would appreciate an opportunity to meet with you and discuss this matter, so that the status of sign permits may be resolved.
