Mr. Dennis Robertson, audience, commented on Easter Egg Hunt. It was well run and everyone had a fantastic time. PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS Mayor Bauch recognized, for the record, receipt of a summons and complaint filed against the City by George Armour. The complaint involves an incident with Tukwila Police Officers. MOVED BY SAUL, SECONDED BY TRAYNOR, THAT THE TOW TRUCK RATES, SUBMITTED WITH THE BUSINESS LICENSE RENEWAL APPLICATIONS, BE APPROVED AND MADE A MATTER OF RECORD.* Councilman Bohrer noted the Private Impound rates and asked if Council could amend them. Mayor Bauch said no. Council cannot amend them, but can invite the Tow Truck Operators in to discuss them. *MOVED BY BOHRER, SECONDED BY HILL, THAT THIS ITEM BE TABLED TO THE COMMITTEE OF THE WHOLE MEETING OF APRIL 23 AND INVITE THE TOW TRUCK OPERATORS IN TO DISCUSS THEIR RATES. Resolution #684 Accepting approving a petition for annexation of a portion of the area known as "Crestview" Resolution #685 Providing for an interfund loan between sewer fund City Hall G.O. Bond Debt Service Fund Resolution #686 Requesting the Washington State Dept. of Trans- portation to conduct a regional traffic study Resolution #687 Expressing concern about usage and access to the Green Duwamish River Deputy City Attorney Carlson read a resolution of the City of Tukwila, Washington, accepting and approving a petition for annexation and authorizing the commencement of an annexation, proceeding by the election method of a portion of the unincorporated planning area known as the "Crestview Neighborhood," and referring the question of a proposed zoning regulation to the planning commission. MOVED BY BOHRER, SECONDED BY SAUL, THAT RESOLUTION NO. 684 BE ADOPTED AS READ. MOTION CARRIED WITH TRAYNOR VOTING NO. MOVED BY HARRIS, SECONDED BY SAUL, THAT THE PROPOSED RESOLUTION BE READ. MOTION CARRIED. Deputy City Attorney Carlson read a resolution providing for an interfund loan between the sewer fund and the City Hall G.O. Bond Debt Service Fund. MOVED BY HARRIS, SECONDED BY HILL, THAT RESOLUTION NO. 685 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY JOHANSON, SECONDED BY SAUL, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. Deputy City Attorney Carlson read a resolution of the City Council of the City of Tukwila, Washington, requesting the Washington State Department of Transportation to conduct a Regional Traffic Study. MOVED BY JOHANSON, SECONDED BY SAUL, THAT RESOLUTION NO. 686 BE ADOPTED AS READ.* Mayor Bauch noted that this resolution is an extension of the one adopted by the City of Kent, asking for a regional traffic study in the lower Green River Valley. The request covers the whole of the City's planning area. Councilman Bohrer noted that the last word in Section 2 should be south instead of north. MOVED BY BOHRER, SECONDED BY TRAYNOR, THAT SECTION 2 OF THE PROPOSED RESOLUTION BE AMENDED TO READ "AND SOUTH 200TH STREET TO THE SOUTH." MOTION CARRIED. Councilman Johanson said he just wants to note again that this is part of a coordinated effort. Councilman Bohrer wondered if the Department of Transportation would contact the Cities involved for input. Since the City is having a transportation study made there may be some specific information from that study that would be worthwhile input. He said he would like to have a chance to comment. *MOTION CARRIED AS AMENDED. MOVED BY JOHANSON, SECONDED BY TRAYNOR, THAT THE PROPOSED RESOLUTION BE READ. MOTION CARRIED. Deputy City Attorney Carlson read a resolution expressing concern about water usage and access to the Green /Duwamish River. MOVED BY JOHANSON, SECONDED BY SAUL, THAT RESOLUTION NO. 687 BE ADOPTED AS READ.* Councilman Bohrer recalled that this item came before Council originally because the City of Tacoma wanted to increase the amount of water they withdraw from the Green River. The amount was a substantial portion of the flow of the river. He said he opposes this action because the total quantity they wish to withdraw is excessive. Kinney Lawsuit Finance Director's Monthly Report of Investments MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS Fire Service in proposed annexation area Police Protection EXECUTIVE SESSION: 7:45 P.M. appropriate to mention. One is that at the present time the flow from the Howard Hanson Dam is controlled by Federal Statute. This is ridiculous; the local government either Kind County or the State of Washington should have the authority. The other action for concern is the potential for the expansion of the Renton Sewage Disposal Plant. Currently there are some discussions of increasing the capacity of the flow from the plant to its potential capacity of about four times the current flow. The basin served is from well south in King County to Snohomish County. He said he would like an explanation as to why all of the effluent should be brought down to the southern end of Lake Washington and pumped into the Green/ Duwamish Basin. Mayor Bauch said he has considered all three of these actions. This resolution would give him the authority to lobby and to enter testimony to protect the interest of the City. Mayor Bauch added that the flow of the river is entirely under the control of the U.S. Corp of Engineers. The flow rate is set by law. *MOTION CARRIED. Mayor Bauch displayed the first edition of the Daily Record Chronicle, Tukwila Edition. Starting today, they will be publishing 6 days a week. Mayor Bauch noted receipt of the opinion filed by the Court of Appeals in Case No. 6308 -1, Shirlee A. Kinney vs. Edgar D. Bauch, et al. The opinion states in part as follows: "Finding no error, we affirm." Councilman Harris read the monthly report of investments submitted by Ron Swanson, Finance Director. Interest income for the month of March, 1979, amounted to $28,673 resulting from interest rates ranging from 9% to 10.75% and the following activity: Investments Sold: $1,760,000 Investments Purchased: $1,490,000 Councilman Traynor asked when the City is going to meet to discuss fire protection in the proposed annexation area. Mayor Bauch said that Chief Crawley has net with Fire District No. 18 and he will be back to report on this meeting at a later date. Since the Resolution has been passed, it would be proper to hold a joint meeting with Fire District No. 23. Councilman Johanson asked if there is any additional information on police protection requirements. Mayor Bauch said that it looks like the City will need "roughly" 11/2 policemen for the Allentown area, 12 for the Duwamish area and approximately 2 policemen for the Crestview area. This is to maintain the same level of service we have in the City of Tukwila MOVED BY TRAYNOR, SECONDED BY HARRIS, THAT COUNCIL RECESS FOR 10 MINUTES THEN GO INTO EXECUTIVE SESSION.
