April 29, 2011 Property owner is sent 180 day for freestanding sign that says "the subject sign appears to comply with provisions of the previous sign code and that staff will attempt to determine if the sign was legally installed and whether all changes tot eh sign met the sign code in effect at the time. Tukwila may ask for additional sign information to confirm compliance. August 1, 2011- Staff made findings in design staff report that the freestanding sign and freeway interchange sign were legally nonconforming and could remain for the length of the grace period (and beyond without changes) October 26, 2011— property owner did not apply for nonconforming sign permit for the freestanding sign. March 21, 2012 Staff is alerted to the Sign Code section that says any property going through design review must bring all nonconforming signs into conformance. March 26, 2012 Staff met with City Attorney to discuss signage options for site and were advised that the interpretation for Non -conforming Sign Permits (TMC 19.36.040©) does not apply to "freeway interchange signs" — that they are separate from freestanding signs per the definition section of the Sign code. Regarding the freestanding sign — because we didn't condition the staff report for removal of the sign, then the property owner could get a pass and may leave the sign. March 26, 2012 Staff spoke with a sign contractor who says the property owner would like to reface the sign. Staff discussed this and found out that the nonconforming signs that did not receive the required nonconforming permits are illegal and should be removed. There appears to be a lack of clarity on how City will proceed on this issue as current path will result in a huge enforcement effort. Staff reviewed the last available permit (S09-044) for the freestanding sign on the subject site and it exceeds the building height (13 feet) - sign height of 27 feet - which does not comply with sign standard of building height for freestanding sign height maximum. This new code was developed through a lengthy process that included an advisory Committee with residents and businesses, public outreach and several public hearings. The result of this in-depth update process was the creation of a flexible sign code that permits many businesses and property owners to install more signs than were permitted under the previous sign code. Recently, City staff completed an inventory of all freestanding (pole) signs within the City. Through this inventory, the City has determined that the freestanding sign currently located on your property at 13138 INTERURBAN AVE S was made non -conforming by the adoption of the new sign code. A picture of the non -conforming sign is enclosed for your convenience. Given that it appears that the sign located on your property complied with the provisions of the previous sign code, a ten year grace period is provided to allow you to continue to use the sign. During the ten year grace period you may, with a permit, reface and complete copy changes to the sign. Please note that during the grace period the height and location of the sign cannot change. After the ten year grace period you can keep the sign indefinitely, but any proposed refaces or copy changes will require the sign to come into conformance with the City's sign regulations. In order to preserve the non -conforming status of the sign, you must obtain a free non -conforming sign permit within 180 days of this notice by completing and returning the enclosed permit application. As part of staffs review of your permit, we will attempt to determine if the sign was legally installed and whether all changes to the sign met the sign code in effect at the time. We may ask you for additional information to assist us. If you do not obtain the required permit within 180 days of this notice, the non -conforming sign must either be removed or immediately brought into compliance with the new Sign Code. So what is the City's liability for bad information? Is there a cost to the City to requiring them to bring their signs into compliance, which means removing the Freeway interchange and dropping the height etc of this freestanding sign? Below is the section of the staff report for Jackson Food Stores. 1. Miscellaneous Structures (TMC 18.60.050(6)(5)) The canopy over the gas pumps is made of materials that are different from the store building materials. There is a small coordinating accent color of red that is used between the two structures. Currently, the business has two freestanding signs that are legally nonconforming. One is a freeway interchange sign is legally nonconforming and will need to be removed by August 2020 (Definition and Removal of Legally Nonconforming Permanent Signs 19.36.020 TMC.) The City's recently adopted Sign Code eliminated the option for freeway interchange signs. The second freestanding sign (seen here to the right) requires modification on height and area in order to conform the new Sign Code. The sign is currently located on an adjacent piece of property that is owned by Seattle City Light. The sign is nonconforming as to height (27 feet versus a maximum of six feet) and size (73 square feet versus 54 square feet.) The applicant proposes to maintain sign and landscape the base. A ten year grace period exists for legally nonconforming signs that allow these types signs, including this one, to remain until 2020. (Attachment D) The colors of the sign and company logo are grey, red and white. Conclusions The proposal redevelops the site with significant improvements in building design and landscaping. City landscaping standards for the perimeter of the site and interior parking lot landscaping will be met. The trash and recycling enclosure is well designed and incorporates the materials and colors used on the building. The site improvements however lack the pedestrian connections to the surrounding streetscape improvements but it appears to not be an issue from Interurban Avenue S. as there is no worn path through the grass. The scale of the project is in keeping with the scale of the surrounding improvements. The existing site's circulation pattern is being retained. The off -set between the ingress, egress easement and the southern driveway appears to be successfully working and has the advantage of being as far removed as possible from the intersection of 48 Avenue S. and Interurban Avenue S. The proposal to use Kinnikinnick under the Hornbeams is a concern because of that groundcover's preference for sun. The existing bed on the adjacent property is currently bare of ground cover and in shade because of the low branching pattern of the Hornbeam. The landscape architect specifies holding the groundcover 16 inches from the trees and shrubs. The width of the bed is five feet and if a 16 inch separation is maintained on either side from the trees and shrubs then 12 inches remains along the edges of the bed. Per the specification, one ground cover plant would be placed every foot along the edge of the bed. It is not clear that this will meet the standard of 90% coverage, even in three years. Multiple forms of exterior lighting are used that are not only functional but decorative, supporting the design of the buildings. Building colors are a combination of cool whites and warm earth tones with red and yellow used as accents. Information on mechanical equipment has not been provided although the applicant states that it will be screened. (Attachment M) If the scale of the equipment is so large that the screening becomes a major component of the building's design, then raising the parapet walls may be a more appropriate screen. Trash cans are currently located outside the building's entrance and it is anticipated that similar furniture will be needed with the new project. Landscaping Add a landscape island in the stalls along City Light property per Interior Parking Lot Landscaping requirement (TMC 18.52.035.) The Landscape chapter requires 450 square feet of landscaping for 30 parking stalls plus 1620 square feet for the perimeter side yard and 1850 square feet for the perimeter front yard or a total of 3,920 square feet. A rough calculation on by me indicates that the site has about 2,319 square feet of landscaping. Please give some thought as to how the site can be developed with more landscaping. (as discussed, this area is not owned by PacWest/Jacksons; the parking determination was for the use of the parking stalls only. Moira will discuss this internally with Minnie and get back to BCE with their thoughts) Prunus laurocerasus (English Laurel) is not an appropriate shrub along the west elevation where there are windows. Please choose an evergreen that has a maximum height of less than four feet. (as discussed, we will have our landscape architect chose a different species) The ground cover will need to be increase and placed closer to the shrubs, prefer one foot instead of 16 inches from the edge of the shrubs. Kinnikinnick prefers sun to part shade and is therefore not a good choice for the north side of the building under shrubs and trees. Please provide an alternate plant. (as discussed, we will have our landscape architect chose a different species) Please provide the following for review: Copy of easement description for the south 24 feet easement (provide a copy of the ALTA survey) Copy of recorded parking easement (the recording number was provided to Moira 6-7-2011) Sample of split face concrete masonry or veneer (a photo will suffice that shows color) (explained and not required; 16" diameter hollow steel tube) Sample of curved aluminum or ACM fascia (color photo from Shell Design Stds will be provided) Catalogue cut sheet for canopies. (color photo from Shell Design Stds will be provided) Free standing pole Tight elevation or catalogue cut sheets/specifications (a cut sheet of the area light/pole will be provided) Parking Need to provide 2-3 bike parking spots (provide our standard bike rack; 2 bike capacity; with cut sheet) Signage Please confirm the existence of the freestanding sign on City Light property. If that is to be maintained, is it in conformance with the recently adopted sign code? (as discussed, nothing needs to be done in regards to this sign) The canopy logos for Shell do not appear to be allowed per the City's sign code and only one wall mounted sign is allowed. The new sign code allows a variety of additional types of signs. Please refer to TMC 19.20.050 for the options. (as discussed, these signs will be under a separate sign permit and can be made a condition of approval for the ADR) Address the capping of the car wash drain to sewer. (as discussed, this will be addressed with the civil site plan, which will be submitted with the building permit application; site plan notes to remove the oil/water separator serving the old car wash) Address the storm drainage problem at the NE corner of the parking Lot. Where are these located on the plan? (the new water line will be indicated on the site plan. Moira will discuss the preferred location of these items with Public Works and contact BCE with the information. The location(s) of these will then need to be added to the site plan.) Please confirm that the area under the canopy drains to the sewer via an oil/water separator. bruce I'm uncertain how much ground cover there will be in a five foot wide bed with trees and shrubs if the ground cover is kept 16 inches from all borders, trees and shrubs. Please provide a ground cover that can fill in and cover the ground under the shrubs and trees.[Cary/J this will be revised as necessary. Why is there is 16 -inch requirement? Groundcover will grow in those areas over time. 2. Parking Please note on the plan where you will locate the bike parking. [Caryl] this will be noted. 3. Signage My understanding is that although the site is allowed a freestanding sign, the existing sign may be nonconforming or illegal. The City is conducting a sign inventory and the owner of the property where the sign is located will receive a letter when a determination has been made. (19.36.040 TMC) [Caryl] the property is owned by Seattle City Light and PacWest Energy has an easement agreement with them for the location of this sign. The notice needs to go to the owner of the sign. The existing freeway interchange sign is permitted to remain for a five year grace period that starts from 8/24/2010. I'd like to respond to your summary and suggest a revised plan that incorporates the items that are mentioned. 1. Landscaping. As you have noticed, there are other businesses along Interurban Avenue that are able to use Seattle City Light right of way to meet the minimum requirements for parking. I've attached a photo that shows plantings other than grass within the Seattle City Light right of way. [Caryl] As previously mentioned, we can't plant on someone else's property. I do not know what arrangements the northern property owner's have with City Light, but planting on someone else's land is like me planting my shrubs on your property and asking you to take care of them. So I have asked the owner to inquire with the land use attorney in regard to this request. I'm sure something can be worked out; legally WE cannot prepare a landscape plan on someone else's land. A landscape plan needs to be resubmitted that moderates the affect of the large paved area and incorporates the suggestions noted in your summary. The nature of the use obviously requires the ability for vehicles to easily access and circulate through the site. Therefore the perimeter landscaping is especially important in performing that screening and softening function. I would challenge the landscape architect with the goal of inserting plant material where ever possible to mitigate and compensate for the large paved surfaces. C. Grace Period for Permanent Signs that Complied with the Previous Sign Code. Signs that were installed under the City's previous Sign Code, which was adopted by Ordinance No. 1274 and amended by Ordinance Nos. 1617, 1649, 1773, 1792, 1857, 1892, 1913, 1964, 1982, 2004, 2019, 2096 and 2126, and became non -conforming upon adoption of this code, may be issued a non -conforming sign permit that will allow them to remain for 10 years from the effective date of this ordinance. This shall be known as "the grace period." This section does not apply to signs that were classified as "freeway interchange" under the previous Sign Code. D. Sign Modifications During the Grace Period. During the grace period, the sign may be refaced and the panel or copy changed, provided the area, height and location of the sign re- main unchanged. Permanent signs and sign structures that are moved, replaced or structurally altered must be brought into conformance with the current Sign Code regula- tions. E. Sign Modifications After the Grace Period. After the grace period, the sign is permitted to remain as -is indefinitely. However, relocation, re -erection, alteration, replacement or change in any way to a legal, non -conforming sign, including the structure or sign panel/face/copy, will require the sign be brought into compliance with this code. (Ord. 2303 §10, 2010) 19.36.030 Permanent Signs that Did Not Comply with the Previous Sign Code Permanent signs that did not comply with the City's Sign Code as of August 2010, as adopted by Ordinance No. 1274 and amended by Ordinance Nos. 1617, 1649, 1773, 1792, 1857, 1892, 1913, 1964, 1982, 2004, 2019, 2096 and 2126, are permitted to remain as -is indefinitely, provided the property owner or tenant applies for a non -conforming sign permit and is able to demonstrate the signs were legally conforming at the time of installation and that any modifications made to the sign complied with the City's Sign Code regulations at the time of the modification. Any change to the structure or sign pan- el/face/copy or any relocation, re -erection, alteration, replace- ment or change in any way to a sign covered under this section will require the sign be brought into compliance with this Code (Ord. 2303§10, 2010) 19.36.040 Non -Conforming Sign Permits A. Non -conforming Sign Inventory. The Director shall, as soon as practicable, survey the City for signs that do not con- form to the requirements of this code. Upon determination that a sign is non -conforming or illegal, the Director shall use reason- able efforts to so notify in writing the sign owner, and where practicable, the owner of the property on which the sign is lo- cated. Notification shall include: 1. Whether the sign is non -conforming or illegal. 2. Whether the sign may be eligible for a non- conforming sign permit. If the identity of the sign owner cannot be determined after reasonable inquiry, the notice may be af- fixed in a conspicuous place on the sign or on the business premises with which the sign is associated. However, the fail- ure of the City to identify the sign owner shall not relieve the property owner from the requirements of this section. B. Non -conforming Sign Permits. 1. Eligibility. A non -conforming sign permit may be issued only in accordance with the standards listed in this chap- ter. 2. Permit Required. A non -conforming sign permit is required for all eligible non -conforming signs within the City. The sign owner shall obtain the permit within 180 days of notifi- cation by the City and for any panel or copy changes allowed during the grace period. Applications for a non -conforming sign permit shall contain the name and address of the sign user, the sign owner and the owner of the property upon which the sign is located, and such other pertinent information as the Director may require to ensure compliance with this chapter. The Director may waive specific submittal requirements determined to be unneces- sary for review of an application. 4. Permit Issuance. Any person submitting an applica- tion for a non -conforming sign permit shall use the forms provided by the Department. The Director shall issue nonconforming sign permits upon a determination of eligibility. The Director may re- quire the filing of plans or other pertinent information where such information is necessary to determine compliance with this chapter. Appeals shall be filed in accordance with Section 19.12.120. C. Loss of Legal Non -conforming Status. Non -conforming signs shall either be removed or immediately brought into com- pliance with this chapter upon the occurrence of one or more of the following events: 1. When a non -conforming sign permit is required but not obtained within 180 days of notice of non-conformance. 2. When an application is submitted to the City for a project that is subject to design review, on any non -conforming building -mounted signs on the premise affected by the construction and all non -conforming free-standing signs lose their non- conforming status. 3. When any panel or copy changes are proposed after the expiration of the grace period. 4. When the sign meets the definition of abandoned. 5. Damage of 25 percent or more in the value of either the non -conforming sign or the structure to which it is affixed. D. Maintenance. Ordinary maintenance and repair of a sign shall be permitted without loss of nonconforming status if the cost of all maintenance and repair over a two-year period is less than 25 percent of the cost of replacing the sign. (Ord. 2303§10, 2010) 19.36.050 Existing Freeway Interchange Signs Signs classified as freeway interchange signs under the previous Sign Code are permitted to remain for a five year grace period starting from the effective date of this ordinance. During the grace period, freeway interchange signs may have unlimited refaces and copy changes provided the area, height, and location of the sign remain unchanged. Relocation or re - erection of the sign during the grace period is not permitted. Application for a non -conforming sign permit is required for all sign face or copy changes to a freeway interchange sign. After the grace period has terminated, application for and issuance of a sign permit that complies with the Sign Code is required for any relocation, re -erection, alteration, replacement or change in any way to the structure or sign panel/face/copy. (Ord. 2303 §10, 2010) 19.36.060 Non -Conforming Temporary Signs A. Non -conforming temporary signs must be removed within 30 days of the adoption of this code or the expiration of their sign permit, whichever comes first. B. Commercial real estate signs in existence in the City prior to the adoption of this code are permitted to remain for up to three months, after which time the signs must be removed and any future signage must comply with the terms of this code. (Ord. 2303 §10, 2010) 19.36.070 Additional Signage Prohibited No additional permanent building -mounted signage is per- mitted on a tenant space that contains a non -conforming sign. No additional permanent freestanding signs are permitted on a premises that contains a non -conforming freestanding sign. (Ord. 2303 §10, 2010) 19.36.080 Financial Incentives - Tukwila International Boulevard Corridor In order to assist with the removal of non -conforming signs within the Tukwila International Boulevard Corridor, the City Council may develop a grant program to provide financial incen- tives to property owners and businesses. 1. Applications to the grant program shall be re- viewed quarterly and approved by the Director, subject to the availability of allocated funds. 2. In order to be eligible for grant funding the project must comply with the following requirements: a. Sites must be located within the Tukwila Inter- national Boulevard Redevelopment Area, Zoning Code Figure 18- 9. b. Removal of non -conforming signs listed in Sec- tion 19.36.030 shall have a higher priority than removal of non- conforming signs listed in Section 19.36.020. c. Payment of the grant award shall not occur un- til after the sign has been removed and properly disposed of. d. No applicant or business shall receive more than $2,000 from the grant. e. The Director is hereby authorized to develop written procedures for award and administration of the grant funds. One freestanding, lighted, double-faced identification sign not exceeding 150 square feet for the total of all faces with no one face exceeding 75 square feet is permitted. Such sign shall not exceed a height of 35 feet. The sign shall be lighted only during business hours. 2. One sign mounted on an exposed building face is permitted for each street frontage and shall not exceed 20% of the exposed building face area to which it is attached. Such face -mounted signs may be illuminated. 3. Two unlighted double-faced signs not exceeding 20 square feet per face are permitted. Such signs shall be non-portable and may be used for advertising copy customarily displayed in service stations. 4. In addition to the above regulations, the following signs are allowed without permit: a. Signs at each pump island denoting the type of fuel, price and service available, providing such signs are permanently mounted to pumps or pump island structures. b. Signs on roll -away type racks advertis- ing merchandise in such racks. Examples include tire racks, batteries, bulk oil sales, etc. Such signs are limited to two square feet. (Ord. 1274 §1(part), 1982) VI - INDUSTRIAL ZONES 19.32.170 Permitted Signs - Height Signs shall be as described under TMC 19.32.140, except that height of a freestanding sign permitted for the first ten acres is 45 feet. (Ord. 1274 §1(part), 1982) VII - FREEWAY INTERCHANGE BUSINESSES 19.32.180 Permitted Signs - Height and Area Allowance The maximum allowed message area for a freeway interchange business sign is 125 square feet per face or a total of 250 square feet for all faces of the sign. The minimum height allowed for a freeway interchange business sign shall be 35 feet and the maximum height shall be 125 feet. The minimum and maximum height for a freeway interchange sign includes any and all message areas attributable to the business the sign advertises. No portion of the message area, including logos, text or other advertisements, for the freeway interchange sign may be located below 35 feet on the freeway interchange business sign. (Ord. 1892 §6, 1999; Ord. 1274 §1(part), 1982) VIII - HOTELS 19.32.190 Signs Mounted on Hotel Building Faces A. Each hotel shall be permitted one building face - mounted sign on each building face of the hotel, which sign shall contain only the hotel name and/or logo. If a hotel has a restaurant operation which is located in the hotel building, then the hotel shall be permitted one additional exposed building face - mounted sign within the area as provided in Table 1 of TMC 19.32.140A; provided, that the sign is placed on the ground floor of the exposed building face and identifies only the restaurant name. C. A hotel shall be permitted freestanding and internal information signs as provided in TMC 19.32.140D and TMC Chapter 19.22, respectively. The video display may only be used between the hours of 8:OOAM and 11:OOPM. 5. The entire scoreboard with video display cannot exceed 200 square feet. 6. The scoreboard with video display must face away from the public rights-of-way, public trails, adjacent properties, and water bodies.
