The 80 square wall sign that is proposed for the front facade meets the City's Sign Code requirements, but I don't have enough information to review the entire sign permit. Please address the comments that follow. • Please submit a dimensioned and scaled site plan showing property lines, streets, buildings and locations of all existing and proposed signs. • City code allows a business to only be advertised on two signs, one of which can be freestanding. Additionally, the City is in the process of updating the Sign Code and currently has a moratorium that limits new freestanding sign height to 6 feet or less. Please revise your permit application to address the following issues that do not meet City code: o I conducted a site visit on December 7th and noticed there are already two freestanding signs on site (see enclosed photos). In a phone conversation with you today, you indicated you would be removing the existing freestanding signs in the future. However, a site cannot have more than one freestanding sign. Please revise your application to show which freestanding signs are to be removed, so there is only one on site, including the new freestanding sign. The permit will be conditioned on the removal of these signs. o It is not clear from your submittal where the proposed freestanding sign will be installed. Show the proposed location on the site plan with setbacks from the sign called out on the plan. Show the height of the freestanding sign, height of the building, and provide dimensions so the sign area can be calculated. Provide the method of anchoring, installation, or attachment. No permit will be approved for a sign height over 6 -feet. • Your site allows a freestanding sign of 100 square feet per face. • Please submit a valid Washington State contractor's license for the contractor installing the signs or fill out and return an Affidavit in Lieu of Contractor Registration form (enclosed). Please submit revisions within 90 days from the date of this letter, on March 11, 2010, or your application may be cancelled. These revisions can be accepted via PDF. The freestanding Levitz sign in a non -conforming sign. A freestanding sign can not be taller than the building, needs to be setback from the property line a distance equal to its height and has size limitations --it appears that one or more of these requirements are not met with this sign. Making any change, including changing copy or painting over, of any sign requires a sign permit and a sign permit can only be issued if the sign is legally conforming. This means that a permit is required but cannot be issued for a reface or any change to the Levitz freestanding sign. In order to get a permit and subject to a moratorium in place , a site may only have one freestanding sign, the sign may only be 6' in height and it must be setback from the property line at least 6'. Additionally, a business can only be advertised on two signs, only one of which can be freestanding. I did a site visit and noted 2 wall signs for Levitz and 2 freestanding signs. The existing freestanding sign needs to either be lowered to 6' in height and meet size and setback requirements or the sign needs to be removed to allow either a new freestanding sign or a second wall sign for your tenant. You asked about variance criteria. I am including it in this email but please understand that you need to meet all of the criteria which you do not and the City cannot support your variance request. The criteria are as follows: Tukwila Municipal Code 19.12.060 Criteria for Granting Variances A. Variance review shall be a Type 3 permit pursuant to 18.104.010. The Hearing Examiner may grant a variance to the requirements of this code only if the applicant demonstrates compliance with the following criteria: 1. That the variance as approved shall not constitute a grant of special privilege which is inconsistent with the intent of this sign code, nor which contravenes the limitation uses of property specified by the zoning classification in which this property is located. 2. That the variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. 3. That the granting of the variance will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity and in the zone in which the subject property is located. 4. That the special conditions and circumstances prompting the variance request do not result from the actions of the applicant. 5. That the variance as granted represents the least amount of deviation from prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. 6. That granting of the variance shall result in greater convenience to the public in identifying the business location for which a sign code variance is sought. 7. That the granting of the variance will not constitute a public nuisance or adversely affect the public safety. B. The proposed variance shall not interfere with the location and identification of adjacent business buildings or activities. With a permit, a business may have up to two temporary signs. As stated in that letter, revisions should have been submitted within 90 days, which was by March 11, 2010. Since I have not received additional information from you, I am cancelling your application due to inactivity. Footing inspections must take place before concrete is poured. Bracket inspections must take place before sign is installed. A structural inspection is required for all signs when installation is complete. The applicant or installer is required to call the Planning Division at 431-3670 for a final inspection.
