AN ORDINANCE regulating city employee benefits.
The City Council of the City of Tukwila do ordain as follows:
Section 1: Holidays.
A. The following are established as legal holidays in
each year for employees of the city without loss of pay:
New Years Day, Washington's Birthday, Memorial Day,
Independence Day, Labor Day, Veterans' Day, Thanksgiving
Day, and Christmas.
B. In the event the legal holiday falls upon a Sunday,
the following Monday shall be deemed to be the legal holiday.
In the event the legal holiday falls upon a Saturday, the
preceding Friday shall be deemed to be the legal holiday.
Section 2: Vacations.
A. Every officer or employee of the city who shall have
been in the service of the city for at least one year of con-
secutive employment shall be entitled to and receive two
weeks (ten working days) vacation with pay; and every such
officer and employee having five (5) years of full consecutive
employment shall be entitled to an additional day of vacation
for each ensuing year of full consecutive employment up to a
maximum of three (3) weeks vacation with pay.
B. Vacation time will not be cummulative but must be
taken in the year earned. All vacations shall be taken at
such time as shall be approved by the head of the respective
department.
C. In the event an employee terminates his employment
with the city prior to using his accumulated vacation time,
for that year, then he shall be paid for any unused vacation
time.
Section 3: Sick Leave.
A. Every officer or employee of the city who shall have
been in the service of the city for at least one year of con-
secutive employment shall be entitled to and receive two (2)
weeks sick leave with pay. Sick leave may be accumulated
from year to year in an amount not to exceed a total of Ninety
(90) days.
Section 4: Overtime Pay.
A. The City of Tukwila will not pay overtime; compen-
satory time off will be granted all employees except depart-
ment heads. Department heads are declared to be the Police
Chief, General Superintendent, and Field Superintendent.
Section 5: Retirement.
A. All employees shall be covered by Ordinance No. 441
Statewide Employees' Retirement System, and all department
heads will keep a record of employee benefits. Any disputes
arising thereunder shall be brought to the attention of the
city Personnel Director.
Section 6: In any case in which an employee shall be en-
titled to benefits or payments under the Workmen's Compensation Act
or similar legislation of the State of Washington or any other govern-
mental unit, the City of Tukwila shall pay only the difference between
the benefits and payments received under such act by such employee, and
such regular rate of compensation that he would have received from the
City of Tukwila if able to work. The foregoing payment or contribution
by the City shall be limited to the period of time that such employee
had accumulated sick leave credits as hereinabove specified. Further-
more, the sick leave benefits herein specified shall not be applicable
to any employee who is covered by any relief and pension act or similar
legislation providing for sickness and /or disability payments, of the
State of Washington or any other governmental unit granting substan-
tially equal or greater benefits than herein provided.
Section 7: All ordinances or parts of ordinances in conflict
herewith are hereby expressly repealed.
This ordinance shall be in full force and effect from and
after the passage and publication as provided by law.
PASSED by the City Council of the City of Tukwila this
day of J.anuary, 1966.
