On June 11, 2010, the applicant submitted a complete application to install a freestanding sign within City Right of Way near 6100 Southcenter Blvd. 2. The applicant was submitted under the City's previous sign code. Since the application submitted a complete application, the application is vested under the old Sign Code. 3. The sign complied with applicable standards for area and height. Since the sign was located within the City's Right of Way it did not comply with setbacks which requires that the sign be placed one foot from all property lines for every one foot in height (TMC 19.32.070) 4. Portions of the parking lot and landscaping for the office building at 6100 Southcenter Blvd are located within the City's Right of Way. Permission for these right of way encroachments was granted through various easements between the City and the previous property owner. None of the easements allows for the installation of a sign within the City's Right of Way. 5. The placement of a sign within the City's Right of Way is prohibited by TMC 19.28.020. 6. In an email dated September 16, 2010, the City noted the lack of documentation which would allow a sign within the City's Right of Way. The email specifically asked the applicant to provide additional documentation. None has been provided. The email further outlined a suggested course of action which would permit a sign within the City's Right of Way. Staff suggested that the applicant obtain a Right of Way use permit and then work with the City to amend the easement to allow for a sign to be placed within the City's Right of Way. 7. On December 23, 2010, the City emailed the applicant asking how they wished to proceed with the application. A copy of the September 16, 2010 email was provided. On January 11, 2011, the City emailed the applicant and noted that direction on how to proceed needed to be provided to the City by January 14, 2011. The applicant has not provided a substantive response. Attachments The City's Decision was based on the following documentation: A. Application form submitted by the applicant on June 11, 2010. B. Site Plan provided by Tube Art to the City on June 11, 2010 C. Private Roadway and Parking Easement between the City and property owner. D. The placement of a sign within the City's Right of Way is strictly forbidden by TMC 19.28.020. The applicant has failed to provide any additional information which provides a legal foundation which would allow the applicant to place a sign within the City's Right of Way. Additionally, the sign does not comply with the setback requirements of TMC 19.32.070. APPEALS This Notice of Decision may be appealed to the Hearing Examiner within 14 -days from issuance of this Notice of Decision (02/07/11). The Hearing Examiner shall conduct a closed -record appeal and consider only information originally presented to the Director. Appeal Materials shall include: 1. The name of the appealing party; 2. The address and phone number of the appealing party, and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf; and 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall state specific errors of fact or error in application of the law in the decision being appealed; the harm suffered or anticipated by the appellant, and the relief sought. The scope of an appeal shall be limited to matters or issues in the Notice of Appeal. 4. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed onto the appellant. All appeal materials must be submitted to the Department of Community Development no later than 5 PM on February 22, 2011. Initially, I assumed that there was some legal agreement between the City and the property that would permit the installation of a freestanding sign within the City's ROW. However, after reviewing all relevant files, it doesn't appear that any of the existing agreements between the City and the property owner can be used to relocate the sign closer to the City street (frankly, I can't find anything that allowed the existing sign to be installed within the City's ROW). If you have documentation that speaks to such an agreement, please let me know. Without said documentation, you will need to either apply for a ROW use permit, or negotiate an agreement with the City for long-term placement of the sign in the ROW. ROW use permits are only valid for one year and cannot be used to allow the sign to remain in the ROW in perpetuity. You may reapply for a ROW use permit each year, however you will incur the permit application fees each year and permit approval is not guaranteed each year. Conversely, the basic provisions of an agreement between the City and property owner for long-term placement of the sign in the City's ROW would most likely include the following: - -The City would retain the right to remove, or require the property owner to remove, the sign for any reason upon 30 -days notice. The City would not compensate the property owner for sign removal. --The property owner would be required to hold the City harmless for use of the City's ROW. - -The property owner would be required to provide proof of an insurance policy naming the City as an additional insurer. To note: This requirement is currently included in two other agreements between the City and the property owner (the landscaping and access agreements), however the City has not been provided with yearly copies of proof of insurance as required by the agreement. --The agreement would be for a term of no more than ten years. At the termination of the agreement, the property owner would be required to remove the sign. Please do note that any agreement must be approved by the City Council and signed by the Mayor. Subject, however, to the following terms, conditions and restrictions: 7902131037 (1) Permitted Uses: This easement is granted solely for the purpose of constructing, repairing and maintaining private vehicular roadway improvements and parking improvements together with neces- sary and incidental traffic control devices, storm water collection and runoff basins and drains, cuts, fills, slopes and retaining improvements. No improvements shall be undertaken in the easement area unless the same shall have first been specifically approved in advance by the City and all necessary permits and other govern- mental approvals obtained and nothing herein contained shall be deemed to waive or excuse strict compliance with all pertinent r- ordinances, regulations and laws applicable to constuction of ,ry private roadway and parking improvements. O (2) Approval Of Plans: Prior to commencing construction within the easement area, grantee shall obtain approval of detailed N plans and specifications of all improvements contemplated withir the easement area. it is specifically acknowledged that parking -. to be provided on the easement property, when completed in accor- dance with all applicable laws and regulations, shall be counter to satisfy parking requirements in connection with development on Parcel B described in paragaph 9. (3) Duration: The duration of this easement shall be perpetual unless sooner terminated or abandoned as herein provided. (4) Reserved Rights: The City specifically reserves the right to enter upon the easement property, to construct, recon- struct or re-locate its utilities as may be located thereon and to otherwise utilize the property for such other municipal purposes as may be deemed desirable from time to time; provided, however, in the event that any such activity by the City shall damage or unduly restrict the use by grantee of the roadway or parking improvements on the easement, the City shall promptly repair and restore any damage or provide suitable alternate improvements without cost to grantee. (5) Maintenance: Grantee shall complete and maintain all improvements constructed within the easement in a safe, clean and unobstructed manner and in compliance with all applicable laws and governmental regulation, all without cost to the City. (6) Indemnity: In accepting this easement, grantee covenants and agrees to indemnify and to hold the City fully harmless from any occurance, loss or damage caused by or arising as a result of grantee's construction, maintenance or use of the easement. Grantee agrees to promptly stabilize and restore any slides, failures or siltation from the easement property unless caused by actions of the City pursuant to its reserved powers in paragraph 4. (7) Insurance: Grantee covenants and agrees to carry and maintain at its sole cost and expense, public liability and property damage insurance with personal injury liability insurance limits of not less than $500,000 per person/per occurrence insuring against any and all liability of grantee or the City with respect to the easement property or arising out of the construction, maintenance, use and/or occupancy thereof, and property damage liability insurance with limits of not less than $200,000 per accident or occurrence. All such bodily injury liability insurance and property damage liability insurance shall specifically assure the performance by grantees of the indemnity agreement contained in paragraph 6 hereof. Grantee's obligation to carry the insurance provided for herein may be brought within the coverage of a so- called blanket policy or policies of insurance carried and main- tained by grantee; provided, however, that the City shall be named as an additional insured thereunder as its interest may appear. Grantee agrees to file a true and accurate original copy of said policy and renewals thereof with the City Clerk. (8) No Representations: City makes no representations or warranty as to the condition of the soil, stability of the easement property, etc. and grantee has not relied upon any such representa- tions. If it should prove practically impossible to complete the improvements in accordance with the plans and specifications as set out in paragraph 2, whether due to the weather, soils con- ditions or other geological conditions encountered on the easement NQ property, this easement shall not be terminated but grantee may submit new plans and specifications so as to resolve the problems, or., at its option, may restore part or all of the easement to its CO former condition and abandon such portions of the easement. Termination and Abandonment: In the event any material breach of any obligation imposed on grantee by its acceptance of this easement remains uncured for more than ninety (90) days following written notice of breach to grantee and to any other party claiming under or througn grantee who has requested notice in writing, the City may at its option (a) act to cure the breach and file a lien against grantee's property (Parcel 0) for the reasonable expenses incurred therefor, or (b) declare the easement terminated and all rights of grantee hereunder forfeited and abandoned. Logging, an Oregon general partnership, as nominee for an undisclosed principal, herein referred to as "Develop- ers," as owners and developers of certain property contiguous to a portion of the excess right-of-way property are willing to design, construct and install certain landscape improvements on a portion of the excess right-of-way property and to deed and dedicate those improvements to the City and to thereafter maintain and preserve them for the benefit of the City; now, therefore, It is mutually agreed as follows: 1. Developers agree to promptly and diligently undertake to complete the landscape improvements on the slope property in accordance with generally accepted horticultural practices and with the schedule and plans and specifications to be prepared by Developers at their sole expense and approved by the Public Works Director or his authorized representative and when so approved to be incorporated herein by this reference. The City shall accept a transfer and conveyance of title to all improvements from Developers when completed. The Developers may submit, at their own expense, an appraisal reflecting the fair value of the improvements so transferred and, if requested, the City shall provide Developers with reasonable written verification of the value of said improve- ments. Developers agree to keep the slope property and all improvements thereon free and clear of any and all liens or claims of lien and to provide the City lien waivers or other satisfactory evidence of compliance with this paragraph. 4. Developers agree to maintain the landscape improvements in accordance with generally accepted horticultural practices, and to donate, without cost to the City, all their labor and. costs in doing so for a term of ten years. This agreement shall be auto- matically extended for a like term of ten years unless this agree- ment is earlier terminated by mutual agreement of both parties, and subject to thirty days' notice prior to termination. 5. Developers agree to indemnify and to hold the City fully harmless from any occurrence, loss or damage caused by or arising as a result of Developers' landscape construction, maintenance or occupancy of the slope property. Developers agree to promptly stabilize and restore any slides, failures or siltation from the slope property unless caused by actions of the City pursuant to its reserved powers in Paragraph 2. 8. Developers agree to carry and maintain at their sole cost and expense, public liability and property damage insurance with personal injury liability insurance limits of not less than $500,000 per person/per occurrence insuring against any and all liability of the Developers or the City with respect to the slope property and landscaping thereon arising out of the construction, maintenance, use and/or occupancy thereof, and property damage liability insurance with a limit of not less than $200,000 per accident or occurrence. All such bodily injury liability insurance and property damage liability insurance shall specifically assure the performance by Developers of the indemnity agreement contained in Paragraph 7 hereof. Developers' obligation to carry the insur- ance provided for herein may be brought within the coverage of a so-called blanket policy or policies of insurance carried and maintained by Developers; provided, however, that the City shall be named as an additional assured thereunder as its interest may appear. Developers agree to file a true and accurate original copy of said policy and renewals thereof with the City Clerk. 9. City makes no representations or warranty as to the condition of the soil, stability of the slope property, etc. and. Developers have not relied upon any such representation. If, 3 however, it should prove to be practicably impossible to complete the improvements in accordance with the schedule, plans and specifi- cations as set out in Paragraph 3, due to the weather, soils conditions or other geological conditions encountered on the slope property, this agreement shall not be terminated but the parties shall re -negotiate, within 60 days, new schedules, plans and specifications which are not unreasonably more expensive to complete or maintain and such substitute plans shall be adhered to by Developers. During the period of re -negotiation, before the new schedule, plans and specifications are approved, Developers'• obligation to maintain, stabilize, preserve, protect and restore the slope property shall continue and if no new agreement can be reached or if it is not feasible to complete the project in any form due to adverse weather, soils condition or other geological conditions encountered, then Developers' further obligations hereunder may be relieved and discharged, but only after Developers have stabilized, preserved, protected and restored the slope property to its former natural contours, grades, ground cover and condition. Question #1: Was the existing free-standing Centerplex sign located within the city's public right-of-way (adjacent to the property addressed as 6000/6100 Southcenter Boulevard), authorized under the Private Roadway and Parking Easement dated February 13, 1979? Temporary 6000 Southcenter. Blvd. 10/17/78 10/17/79 As you can see, all of the above sign permits were for temporary signs only, rather than permanent signs. Further, it appears that all signs were located on-site. No reference was made to the Private Roadway and Parking Easement Agreement and no subsequent permits were found other than those issued earlier this year. Based on our research, no permit has been approved for the existing free-standing sign. Question #2 Is a building name and address sign considered a traffic control device under the terms of the Easement Agreement? In the Sign Code, signs are defined as: °Sign means any medium, including paint on walls, merchandise, or visual communication device, its structure and component parts, which is used or intended to be used 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 0 (206) 431-3670 • Fax (206) 431-3665 to attract attention to the subject matter for advertising or identification purposes...° Traffic Sign is defined as: a device mounted on a fixed or portable support whereby a specific message is conveyed by means of words or symbols placed or erected for the purposes of regulating, warning or guiding traffic. The city has also adopted the 1988 manual on Uniform Traffic Control Devices for Streets and Highways. The manual defines traffic control devices as all signs, signals, markings and devices placed on, over, or adjacent to a street or highway by authority of a public body or official having jurisdiction to regulate, warn or guide traffic. The manual further stipulates that °no traffic control device or its support shall bear any advertising or commercial message, or any other message that is not essential to traffic control. Traffic control devices are used to direct and assist vehicle operators in the guidance and navigation tasks required to traverse safely any facility open to public travel.° Further, engineering judgement would be required to determine whether a proposed device is essential. Based on definitions and provisions contained in the Sign Code, and the Uniform Traffic Control Devices Manual, the City has determined that the existing CENTERPLEX sign does not meet the intent of any of the above definitions. Question #3 Is the Easement Agreement no longer in force as implied by the letter from Denni Shefrin dated December 17, 1992? The intent of the letter was not to suggest the easement agreement is invalid, in fact, the City attorney concurs that the Private Roadway and Parking Easement is valid. I agree that the letter could have been more clear by stating that the CENTERPLEX free-standing sign can not be considered a necessary and incidental traffic control device given city policy and the prevailing codes and restrictions (see answer to Question #2). Question #4 Has the City treated the Easement Agreement as valid by acknowledging our landscaping obligations within the easement? As indicated in the response to question #3, the City agrees that the easement agreement is valid, and therefore, obligations under the agreement are in force. Question #5 Does the City feel there is a reasonable location for a building name and address sign within the applicable setback from our property line? The Tukwila Sign Code Guide -is enclosed which describes signs allowed for commercial and industrial zones. The City also has a process which allows the consideration of a deviation to the sign code by the Board of Adjustment providing certain variance criteria can be met. Variances are typically difficult to grant because the criteria is strictly applied and often difficult to meet, however, this is an option for your consideration. An application is enclosed. Question #6 Is the property owner authorized to remove landscaping from (within) the easement if such removal is required in order to make a building name and address sign within the applicable setback from our property line visible to traffic? The removal of landscape materials within the public right-of-way is permissible with city approval. To conclude, I would recommend you investigate all options allowed under the City's Sign Code including the consideration of seeking variance approval. The City will permit the continuation of the non- conforming sign until the variance request is approved. If a variance is denied, the sign must be removed immediately. We are notifying you so the City can object to the action if it believes the action is not in conformity with the Easement. We intend to locate on the easement property a sign identifying the street addresses of our buildings. The subject sign is the one for which you have issued Permit Number 1592-064. We intend to locate the new sign where the existing sign is located, as shown on the attached drawing. The new sign will replace the existing sign. As you can see, the location is within the easement property but outside our property line. We have investigated possible locations for the sign within and set back from the property line, but they appear to be infeasible. A location to the east of the existing sign would cause the sign to be blocked by trees and boulders. Nothing blocks the existing sign, because the property owners have relied on the permanence of the sign's location in choosing where to plant trees. (We have responsibility for landscaping on the easement property under the Landscaping and Maintenance Agreement dated 13 February 1979.) We understand that the Easement, of which a copy is enclosed, permits us to locate the sign on the easement property. The Easement permits our use of the easement property for "constructing, repairing and maintaining private vehicular roadway improvements and parking improvements together with necessary and incidental traffic control devices ...". We understand that a sign identifying our building addresses directs vehicular traffic to the private roadway and parking and thereby constitutes a roadway improvement, parking improvement, or necessary and incidental traffic control device. In addition, there is a particular circumstance that makes the sign even more necessary for traffic control than normal. Vehicular traffic with Tukwila City Hall as its destination frequently enters our private roadway and parking area by mistake, and vehicle operators frequently enter our buildings in the mistaken belief that our buildings are the site of Tukwila City Hall. We believe that the existing Tukwila City Hall sign frequently misleads vehicle operators seeking City Hall to turn onto 62nd Avenue South and then enter the first parking area. We have concluded that effective traffic control requires our address identification sign to be more prominent than the existing sign is. The new sign will make the addresses more prominent. It will also serve the City's interest by reducing the likelihood of visitors to City Hall losing their way. The new sign has been constructed and is ready to install.
