During the permit process, it was specifically noted that while the City does permit LED displays, City codes do not permit LED displays or any other electronic signs to change message more than once every 24 -hours. The approved plans by the City specifically note that the approved LED display would not change more frequently than once every 24 -hours. Additionally, prior to issuance of the permit, the City sent Acura of Seattle a letter outlining the limitations in usage of the LED display. A copy of that letter is attached. On August 2, 2011, at approximately 8:45 a.m., City staff observed that that the LED display was rotating messages, in clear violation of City Code and the permit that was issued for the sign's installation. The City hopes that this is simply an oversight and that no further violations of City code will occur in the future. You must ensure that the sign is used in a legal manner for the life of the sign. The sign message may only change once every 24 - hours per TMC 19.12.040 (8) and 19.20.070. If the sign continues to be used in an illegal manner the City will commence enforcement action to either 1) order the immediate removal of the sign and/or 2) issue civil citations of up to $500 a day per violation. The City will consider each time the sign changes message as being a separate violation. This letter will serve as your only warning before additional code enforcement action is taken. Seattle, WA 98109 RE: Acura of Seattle Correction Notice S10-066 Dear Mr. Zamberlin: In an email dated November 17, 2010 the City noted concerns with the above sign permit application. According to the application submitted by National Sign Corporation on November 11, 2010, the application is for the installation of a corner projecting sign. The application also notes that the sign will be 73.36 square feet in area. As was mentioned in the City's email dated November 11, 2010, the building does not qualify for a corner projecting sign under Tukwila Municipal Code (TMC) 19.20.050 (D) because the building does not meet the minimum setbacks of the Tukwila Urban Center (TUC) zoning. The property may qualify for a simple projecting sign under TMC 19.20.050 (C); however the size of the sign is limited to 20 square feet per face and a total of 40 square feet for all faces. As currently proposed it appears that the sign permit application cannot be approved. Please provide revised plans to meet the City's sign code or provide a response to this letter as to why you think that a corner projecting sign is permitted for the Acura Dealership. Please note that the City will cancel this sign permit application if a response is not provided to this correction letter within 90 -days from the date of this letter (TMC 19.12.100). Are you applying for a corner projecting sign under TMC 19.20.050 (D).? The Acura building does not comply with the requirement under TMC 19.20.050 (D)(2) which notes: "Signs are only permitted on the corners of buildings that are built to the minimum zoning setbacks of two public streets or a private street developed to public standards, including sidewalks and landscaping". The minimum zoning setback in the TUC is 15 feet for the front and 15 feet for the secound front. The proposed sign is 174 feet from Baker Blvd and 87 feet from Andover Park East. You may want to look at the code provisions found under TMC 19.20.050 (C), "Projecting Signs". The sign would have to be smaller, no larger than 20 square feet per side. Thanks, Brandon Brandon 3.
