TRAYNOR, GARY L. VAN DUSEN. MEMBERS OTHERS DISCUSSION Proposed Zoning Ordinance MINUTES City Hall Council Chambers Council President Bohrer stated there was not a quorum of the City Council present, therefore official action could not be taken at this meeting. The meeting would be for discussion purposes and these Minutes are provided for information only. MAYOR ED BAUCH, PLANNING COMMISSIONER GERALD JAMES, PLANNING COMMISSION CHAIRMAN RICHARD KIRSOP, PLANNING COMMISSIONER LEO SOWINSKI. Mayor Bauch stated there was some concern and confusion at Planning Staff level as to what the ordinance should contain and the develop- ment of the environmental impact statement. The only major item of contention is the cascading zoning. Mayor Bauch said the City does not want to start public hearings with an environmental impact state- ment that shows there is not cascading zoning when it has been de- termined by a majority vote of the City Council that the eventual ordinance is going to have cascading zoning. He said it is a policy decision that will have to be determined. Council President Bohrer said at a recent Committee of the Whole Meeting the decision was made to have cascading zoning. He said his recollection of the proposed zoning ordinance was that sections of it cascaded such as the residential section, the commercial zones, and the manufacturing zones, the three of them would not totally cascade. He asked if Staff could briefly summarize the ordinance that the Planning Commission has been acting on. Fred Satterstrom said it cascades in some respects and in others it does not. For example, in the commercial districts the zoning ordinance is completely cascaded. Anything allowed in the C -1 district, for example, is allowed in the C -2 district, anything in the C -2 is allowed in the C -P district so the commercial districts do cascade upward. When one gets into the residential, and the Council has reviewed the residential districts and they are more or less cascaded except for instance the single family home which the Planning Staff and Planning Commission elected to remove from the R -4 and RMH districts. With respect to the industrial districts, the M -1 and M -2, they are more selective in the uses which are allowed. The light industrial and the M -2 district allow quite a wide range of industrial uses. The light are those types of uses you would find in any manufacturing park -like situation and the heavy industry means the M -2 district, those are much heavier. The other uses like commercial uses, office, and especially multi family uses are more limited. They are allowed by conditional use permit in the light and heavy industrial districts, M -1 and M -2. The Shoreline District and the Planned Unit Development District are not really districts you would find on the zoning map. It is a superposition of certain stipulations over the underlying zoning district. Council President Bohrer asked if office and multiple residential were conditional uses in M -1 and M -2 zones. Fred Satterstrom said that was correct. Planning Commission Chairman Kirsop said a dwelling could be a conditional use in a R -4 zone. Councilman Traynor said he spoke very hard against removing the cascading effect One reason was the conditional use takes time and process to do. It is very difficult to obtain approval where it requires interpre- tation. It also eliminates the people who want to have a business and want to live by their business and at their business. If a person has a grocery store and wants to live above it, we are saying he cannot do that, he would have to have a conditional use to do it. Someone might want to build a penthouse on top of the new Firstbank. He said he thought we should not have to have an interpretation for someone to build his home on his property. Planning Commissioner Sowinski said one of the things he takes pride in when he has guests from out of town is how well we have developed the area. Proposed Zoning Ordinance contd. as district, it is good and clean. We do not have burglaries which we would have if there were homes in that area. If you allow too much building there would also be arson conditions. You can maintain control of each individual who wants a residence with his business. Councilman Traynor asked how conditional use would stop this? Once it is built how can you control who lives there? Planning Commission Chairman Kirsop said the main advantage of leaving the ordinance as proposed is that there would be a public hearing on the conditional use and you would be able to thresh out the problem people coming in for single family residences. It is not a burden in that there is only one hearing before the Planning Commission. Councilman Traynor said if someone wants to put his home next to his warehouse he would not have to drive a distance to go to work and he could watch over his business. It is his money that is buying the business. Planning Commission Chairman Kirsop said he did not think there was anything too much wrong in the Europian style of building apartments over offices and businesses that are separated by floors. Kjell Stoknes, OCD Director, said single family homes are not proposed in R -4, M -1 and M -2 zones. If that issue can be resolved it will take care of half of the problems. Only that which is complimentary will be in M -1 and M -2 zones. Councilman Traynor asked if RMH is allowed in C -1 zones? Fred Satterstrom said multiple family is allowed in C -1 zones by conditional use permit. Single family homes are allowed outright in the C -1 and C -2 zones but not in the manufacturing district. Council President Bohrer suggested a matrix be drawn that would show the allowed uses in each zone. Mr. Stoknes said the primary information they are after is the environmental impact statement. He suggested the words "compatible" and "complimentary" be used in all zones. He said this is the real issue as he sees it. Mayor Bauch said Staff wants to get started on the impact statement and needs to know what ordinance they would use as the basis for the impact statement. Councilman Traynor said there is controversy over side yards so it appears there is more than one issue. He said if a house burns down you would have to move the foundation in order to rebuild because it would be non conforming. Planning Commissioner Sowinski said in the event of a fire a person should be able to use the same foundation to rebuild. Planning Commission Chairman Kirsop said these are the things that are addressed by the Board of Adjustment and they have granted many variances. The thing they are trying to avoid is where a person can trample on his neighbor because of sloppy codes. Fred Satter- strom said he thought one of the main purposes of the EIS is to find out how many houses might be non conforming, and make the compari- sons. He said he looked at the EIS as one of the mole useable documents the City has had. Fred Satterstrom said the cascading will be addressed in the EIS. He said the matter has been discussed with the consultants and there are a number of ways to go about it. He said the Planning Commission is ready to start review of a proposed zoning map. The second week in May they could consider that. He said they have two potential consultants now and if a contract were signed in mid -May they could go to work on sections and be done very quickly. He said if the map is decided upon they could have the draft done in 60 days. Councilman Van Dusen said nothing could be changed during this meeting because of the vote taken by the Council to have cascaded zoning. There is not a quorum of the Council at the meeting. He suggested the subject be discussed at the regular meeting of the City Council on May 7, 1979. Fred Satterstrom said it was likely a supplement would have to be made to the EIS. He said Council will make changes until there is a final product. Planning Commission Chairman Kirsop said he would be happy to sit in on the next meeting and give the views of the Planning Commission. Councilman Van Dusen said he had been wanting to convey his thanks to the Planning Commission for the long hours they have worked and the good job they have done. Councilman Traynor agreed with the statement. Planning Commission Chairman Kirsop offered his thanks. Council President Bohrer said he would present Bob Richards, Council Intern, to the Council Members at the Committee of the Whole Meeting on May 14, 1979. The meeting was adjourned at 9:05 p.m. �J C.
