APPROVAL OF MINUTES MOVED BY HILL, SECONDED BY VAN DUSEN, TO APPROVE THE MINUTES OF THE JUNE 25, 1979 TUKWILA CITY COUNCIL COMMITTEE OF THE WHOLE MEETING AS PUBLISHED. CARRIED. Councilman Van Dusen read a letter from a Tukwila citizen and former Council Member thanking the Council, the Mayor, and Mr. Monaghan for the time and consideration that was shown the people on the street where she lives with respect to the improvements on upgrading the street and side- walks. She said she was pleased that City staff came and enlisted the input of the people who would be involved. Kjell Stoknes, OCD Director, said as a result of the two public hearings that have been held on the proposed annexation of Allentown he suggested the small section where the Allentown Grocery is located be zoned C -1 and the strip of land along 43rd Place South which is shown as single family should be M -1. He said he felt these two changes would take into consideration the input that was received at the public hearings and serve the best needs of the people. Councilman Harris said perhaps the area where the barrel works are located should be rezoned. Mr. Stoknes answered by keeping most of the area in single family the City will have better control over the zoning and what type of businesses might come in because they would have to apply for rezoning. Council President Bohrer said the Allentown Grocery would remain in that usage whether it is zoned single family or C -l. Councilman Van Dusen asked about possible duplexes and four plexes and he felt consideration should be given to the state of the area. At the present it is in every state of decay and deterioration, although many of the homes are kept up. He asked how the truck traffic will be controlled? This question had been asked at one of the public hearings. He thought the City should look at buffering the residential areas from the manufacturing areas by using cascading zoning. Councilman Saul said the people who live down there know that the rail- road is there and the truck traffic but they want to maintain their identity. He said people in the Allentown area think in their minds that the City will leave the property usage as it is. Councilman Van Dusen said if the area is left like it is we will be violating the zoning. Councilman Hill said the people came in and were heard and it is now up to the City Council to consider what is best for the most people. The Council cannot let one person dictate what is best for all of the area. He said he would be willing to vote for a change in zoning for the Allentown Grocery and the strip by 43rd Place South and then anyone who wants any other changes made would have to come to the City Council for a rezone. When the request for rezone is made then the City Council can consider that particular area and what use is proposed. In that way the City can maintain control over the area. All of the present use of the area can be continued under the grandfather clause anyway, so no one will be deprived of present use. Councilman Van Dusen said he was thinking of a comprehensive plan just for this area. When the comprehensive land use plan was being developed the Council went over this area rather quickly. Councilman Hill said by zoning most of the area single family that is giving the area just about as low zoning as we can get. Councilman Traynor left the meeting at 7:40 p.m. zoned before they vote on it. If someone is not happy with the zoning then they should not vote for annexation. Council President Bohrer said when he looks at the map that shows the existing land use he thinks that the people have been living there most of their lives and they are attached to it; they do not mind the railroad. Anytime in the last thirty years it could have become indus- trial but it has not. The approach that the Council has taken is proper since it will protect the people and maintain control over usage. Council President Bohrer said the question of traffic was brought up at the Planning Commission public hearing. One resident suggested that South 112th be opened up and the truck traffic routed that way in order to get the traffic out of the residential area. Councilman Van Dusen wondered if it would be legal to shut off a street and say the railroad could no longer use it. Chris Crumbaugh, audience, said he was of the opinion that the City could designate an arterial street and the type of traffic, weight, etc., that can go on the streets. Kjell Stoknes noted that part of South 112th Street north of the area designated M -1 on the map does not have a dedicated right -of -way. Councilman Hill stated that he thought that street was part of the right -of -way for the Seattle 48 -inch water main and asked that the location be checked. MOVED BY HILL, SECONDED BY SAUL, THAT THE COUNCIL ACCEPT THE PROPOSED ZONING FOR THE POTENTIAL ALLENTOWN ANNEXATION AREA EXCEPT THE STRIP ALONG 43RD PLACE SOUTH BE ZONED M -1 AND THE CORNER WHERE THE ALLENTOWN GROCERY IS LOCATED BE ZONED C -1. Kjell Stoknes, OCD Director, said the area would continue to be used as it is now, the zoning would affect new buildings or businesses that might want to come in. He said if a building is 75% destroyed it would have to be rezoned in order to have it rebuilt. If it is less than 75% destroyed the owner would have to seek permission to rebuild. Councilman Harris remarked that the proposed zoning does not allow mobile homes. Mr. Stoknes said the mobile housing would have to be in the area designated for mobile home parks. Councilman Harris said the mobile homes would stay where they are at present. Council President Bohrer said retaining the R -1 zoning for the strip along 43rd Place South would give the City more flexibility and control over what can be done in the area. *CARRIED, WITH BOHRER VOTING NO. MOVED BY HILL, SECONDED BY HARRIS, THAT THE PROPOSED ORDINANCE ADOPTING A LAND USE PLAN AND ZONING REGULATION FOR ALLENTOWN AREA UPON ANNEXATION TO THE CITY OF TUKWILA BE ON THE AGENDA OF THE JULY 16, 1979 REGULAR COUNCIL MEETING. CARRIED, WITH VAN DUSEN VOTING NO. Kjell Stoknes, OCD Director, said after the passage of this ordinance the annexation will be effective after a few formalities with the County. MOVED BY HARRIS, SECONDED BY HILL, THAT THE PROPOSED ORDINANCE ANNEXING CERTAIN TERRITORY CONTINGUOUS TO THE CITY (COMMONLY REFERRED TO AS THE SEGALE ANNEXATION), AND DECLARING THAT SAID AREA, AS OF THE EFFECTIVE DATE OF THIS ORDINANCE, SHALL BE SUBJECT TO THE ZONING REGULATIONS ADOPTED FOR IT BY ORDINANCE 1108 BE ON THE AGENDA OF THE JULY 16, 1979 REGULAR COUNCIL MEETING. CARRIED. Councilman Saul said this matter has been discussed in the Community Affairs Committee. The position paper developed by the Council Policy Analyst shows four alternatives: (1) Adopt an ordinance prohibiting house discrimination against people with minors; (2) Change the building codes so housing is conducive for children to live there; (3) Postpone the matter for further evaluation and evidence; (4) Adopt a neutral stance on the problem. Discussion on discrimination against children by apt. owners contd. 2 3 4 Councilman Van Dusen said the Council has been working on the building codes, including the open space ordinance. It has never been brought out that ordinance encourages apartment development suitable for children. Councilman Harris said Tukwila is unique in that the number of apartments exceed the number of homes so they should be made so they are attractive for people with children. Councilman Van Dusen said the Council was excited when they heard the report that there were only ten children in the apartments in Tukwila, but when the survey was made they found there were 53 children. There are three adult -only apartments in Tukwila. Councilman Harris said peoples' inability to buy homes to bring children up in has come about in the last five years because of the increase in the price of homes and interest rates. Councilman Van Dusen said we do not have any low rent apartments. Councilman Harris said she questioned the validity of the survey that was made, because it was made after the publicity about discrimination to people with children. Mr. Stoknes said the original survey was done by an interne in the office. The apartments in Tukwila were called and some of them chose not to cooperate. He said the survey represented about 60% of the units. Councilman Harris said the lady who came to the Council said she had not been able to find anything. Councilman Van Dusen said he thought there was not a vacancy in any apartment on the hill. Margaret Clifford, Terrace Apartments, said there are some who have raised their family and want to live in a quiet neighborhood without children. In the Terrace Apartments the children have no place to play because they are not built for children. The rent in apartments is high, $300 for a two bedroom apartment. At that rate they could afford to rent a house. She said if she had wanted to live in a neighborhood where there are children she would have moved into that type of neighbor- hood. She said she cannot go down to the swimming pool for the children, they are all over. She said there are two and three bedroom homes for rent and they would be better for children. Jim Slattern, Terrace Apartments, said he has raised his children and one of the conditions he looked for in an apartment was there would be no children. He said he was afraid there will be an accident at the swimming pool one of these days. The walls of the apartments are thin and you can hear people walk by and when children run along there it is almost unbearable. Councilman Hill said he thought the City Council should revise the building code and make sure some of the new apartment complexes are suitable for children. He agreed that some are not suitable for children The Verona Apartments have five children living there and there is nothing for them to play on except asphalt. Councilman Harris said low income housing where children would be allowed is nonexistent in Tukwila. Margaret Clifford, Terrace Apartments, said if a person can afford $350 for a two bedroom apartment that is not low income. If you can afford that rent you are not low income, and you should not have to listen to the screaming and yelling of parents and children and all of the jumping around. Councilman Saul said he would like to have all seven members of the City Council present when the policy decision is made, so it will reflect everyone's thought. Councilman Hill said he thought builders should be encouraged to build apartments that are appropriate for children. Apartment owners are afraid children will be hurt. *CARRIED. CARRIED. The Tukwila City Council Committee of the Whole Meeting was called back to order by Council President Bohrer, with Council Members present as previously listed. Kjell Stoknes, OCD Director, pointed out the area on a wall map. He said the requested street vacation has been reviewed by his office at an earlier date. The right -of -way lies west of 53rd Avenue South, adjacent to I -5 and does not have access to it from a public road or way. He said staff sees no reason for the City to keep this property. He said the City can require Mr. Watkins to pay one -half of the assessed valua- tion of the property. He said the property is zoned RMH but is shown as R -1 on the Comprehensive Land Use Policy Plan. Council President Bohrer stated he thought Mr. Watkins should appear before the Council to discuss his intended use of the property. MOVED BY SAUL, SECONDED BY HILL, THAT A VACATION ORDINANCE BE DRAWN UP AFTER STAFF IS ASSURED THAT ARTHUR D. WATKINS OWNS THE ADJOINING PROPERTY AND THAT MR. WATKINS PAY ONE -HALF OF THE ASSESSED VALUATION OF THE PROPERTY AND IT BE ON THE AGENDA OF THE JULY 16, 1979 REGULAR COUNCIL MEETING. CARRIED, WITH BOHRER VOTING NO. Council President Bohrer said the State had given this property to the City and any monies derived from it would go back to the State. MOVED BY HILL, SECONDED BY VAN DUSEN, THAT RECONSIDERATION OF THE PROPOSED STREET VACATION BE ON THE AGENDA OF THE JULY 16, 1979 REGULAR COUNCIL MEETING. Kjell Stoknes, OCD Director, located the property on the wall map and suggested if the Council grants the street vacation, Mr. Bowen be given the land just to the end of his property. Councilman Hill said it has always been the City Council policy not to give away any access property, they might need it. *CARRIED. Council President Bohrer said the Department of Ecology is in the process of submitting their approval on the noise ordinance. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE OF THE CITY RELATING TO NOISE CONTROL BE ON THE AGENDA OF THE JULY 16, 1979 REGULAR COUNCIL MEETING. Chris Crumbaugh, audience, said he would like to discuss some of the aspects of the ordinance with Staff. He said the enforcement of this ordinance would be by citizen complaint. Council President Bohrer said the ordinance is patterned after the State model ordinance. It is the one used by the City of Seattle and King County. It is nothing new and unique. Mr. Crumbaugh said all of the rules in the City are subject to inter- pretation. This is the first rule he has seen that gives this jurisdiction to the Staff. Councilman Harris said Section 5.02 enumerates public disturbance noises. John McFarland, Administrative Assistant, said the enforcement of the law is the responsibility of the administra- tor, the responsibility is the mayor's office. Kjell Stoknes, OCD Director, said the duties of the administrator is outlined in Section 9.02. If someone is not satisfied they should appeal. Councilman Saul stated there were two public hearings on the subject of noise control. Council President Bohrer said a questionnaire was also sent out for public input and that a noise survey was conducted by students from the University of Washington. *CARRIED. Some of the apartments are covering and filling in their swimming pools and they might turn an indoor recreation room or area into an apartment. Council President Bohrer said he thought there was no problem. The open space ordinance says they must have so much space. Kjell Stoknes, OCD Director, said 50% of the total open space can be within the principal building. Councilman Van Dusen said he did not mind the covered space, but he thought 25% of it should be adjoining the building. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE CITY COUNCIL TABLE REVISION OF THE OPEN SPACE ORDINANCE. CARRIED. AGENDA REVIEW Chairman Saul cancelled the Community Affairs Committee meeting scheduled for July 11, 1979. Chairman Van Dusen cancelled the Public Safety and Health Committee meeting scheduled for July 11, 1979. Items of interest Council President Bohrer noted that he had received a letter from to the City. Mike Lowry, Congressman, District 7, requesting he be notified of any items of special interest to the City of Tukwila. This item was referred to the Community Affairs Committee.
