Figures should be ready by next Monday. He asked Council to call a Special Meeting at 7:00 p.m., July 23, 1979 to consider the bid award. MOVED BY HARRIS, SECONDED BY SAUL, THAT COUNCIL CALL A SPECIAL MEETING TO CONSIDER THE BID AWARD. MOTION CARRIED. Mayor Bauch explained that this is the second public hearing, required by State law, on adoption of proposed zoning classifications for the unincorporated area known as Crestview. Zoning to become effective if the area is annexed to the City. He declared the Public Hearing open. Kjell Stoknes, OCD Director, read a letter dated June 21, 1979 from Marsilio Di Giovanni, 17015 53rd Avenue South, concerning the "Minutes of Public Hearing on Proposed Zoning Crestview Annexation, May 24, 1979." Mr. Di Giovanni states, "I would like to inform you that the minutes do not reflect the meaning or the intent of the statements which were made by me during that meeting." He referred to four sections in the minutes and explained his position on each. He asked to have the corrections made. Mayor Bauch reminded Council and audience that the minutes are not verbatim, all comments are made a matter of record on the tape. City Clerk read a letter for the record dated July 11, 1979 from Norman J. and Wilma W. Wise, Jr. The letter stated, "As property owners in the area in question, we believe that the present zoning, King County RM -1800, provides for better use of the land than would Tukwila single residence zoning." They explained the location of the property and why they felt the current zoning is best. They asked Council to visit the site and evaluate the situation objectively. Contd. d Mr. John Bosch, representing the estate of Peter Bosch, 3780 South 158th Street, said the property at that address has been zoned RM -1800 for more than ten years. R-3 zoning is proposed for the property, that is a medium density zoning and is inconsistent with the present high density use. There is a new development to the east and it obviously is not R -3, it is RM -1800. The zoning through this area should be consistent. It is inconsistent to downzone theirs when the next property is already high density construction. Councilman Bohrer asked the density of the new development. Mr. Stoknes said the proposed Tukwila R -3 zoning allows a maximum of four plexes and 16 units per acre. The Chalet South has more than four units per building and has a higher density in the lower twenties. To change it to R -3 makes it nonconforming. Mr. Di Giovanni asked if the City had received his letter concerning the minutes of the Planning Commission meeting. Mayor Bauch assured him it had been read for the record before he arrived. Mr. Dave Bosch, 6911 35th Street West, Tacoma, said at a previous meeting the difference in the R -3 and the RM -1300 was discussed and there is considerable difference. The property they are talking about lies west of the Chalet South development and is currently zoned RM -1800. The property has a steep hill- side facing SR 518 and does not make it feasible to develop with tri- plexes or four plexes. It will cost approximately $6,000 to hook to the sewers. He asked Council to consider their request for a R -4 zone at least but RMH would be more compatible with the current zoning. Mrs. Wilma Wise, 4039 South 158th, asked if Council has looked at the topography of the area. They are on the south side of South 158th and are in the RM -1800 zone. Behind them is a hill going up to South 160th. This is an extremely wide block. They feel that any building on their side of the street would not affect those facing the other street. South 158th is not a residential street, it is a main thoroughfare. If it is going to be multiple zoning on one side of the street it is only logical to have it on the other side also. She has talked with two of her neighbors and they are in agreement. Mr. Joe Raffeno, 29916 2nd Avenue Southwest, Federal Way, explained that he owns the property between Bosch and the theater. He asked why the zoning on the property to the west of him is not being changed when his is. The property owners have not even attended a meeting. Mr. Raffeno asked if there is any possibility that they could be left out of the annexation or, if the property west of him was also being down zoned, he would feel they were being treated equal but they sure are not being treated equal with them maintaining theirs and you want to change ours. If the single family residents want to remain single family that is fine but, I can't see why you can't turn us loose. My property can be used for multiple zoning. It is close to public transportation, the theater, drug store, and grocery store. He again asked if there was any way of being left out of the annexation. Mayor Bauch said the boundaries have already been set. The next step is to go to the Boundary Review Board. He explained that Council will consider all testimony presented at these Public Hearings. Mr. John Bosch asked again that their property be zoned according to the present use of the adjoining property. Anything less would be an injustice. Mr. Di Giovanni asked if the Planning Commission gave a reason for recommending the proposed zoning. Mayor Bauch explained that usually the Planning Commission is accepting or modifying a Staff Report. This zoning conforms with the Comprehensive Plan on which there were many Public Hearings held. CITIZEN'S COMMENTS City Hall Land- scaping. Fire Service Police Dept. Hiring. a sad Mr. Dennis Robinson, 16038 48th Avenue. South, said he is one of the sponsors of the petition to annex the Crestview area into Tukwila. If the people who signed the petition were satisfied with King County government land use being one part it is unlikely they would have signed in the first place. It is erroneous to assume that these people would like to see the zoning stay exactly as it is now. Right now there is a tremendous amount of traffic on both 42nd Avenue South and South 160th and it seems to be increasing. To the north there are more apartments going up and this will bring more traffic into the area. The vacant lots are all being developed into single family homes. Most of the people who signed the petition favor single family homes. South 158th Street makes the cleanest break between medium density and single family. The map on display represents the best planning. He urged Council to consider the proposed plan. It represents good planning. It does not make every one happy but it does represent the middle ground between two sides. Mrs. Wilma Wise commented that she and her husband signed the petition. They lived in the City of Tukwila for eleven years and are fond of the City. However, it does not change their feeling that if you are going to have multiple houses on one side of the street it is ridiculous to have single resident houses on the other side. They share the street and there is a good buffer zone between South 160th and South 158th. Mr. Dave Bosch commented on the buffering effect in good comprehen- sive planning. On the proposed zoning map this looks nice but in fact,the current use of the proposed R -3 is a brand new 78 unit condominium built under the County RM -1800 zoning. This, in his opinion, is not good comprehensive planning for this area. Mr. William Markham, 15436 42nd South, representing the estate of M. M. Markham, discussed acreage that lies between South 158th and South 154th on the east side of 42nd Avenue South. There is a total of seven acres here that is a natural buffer zone. Multiple residence here would be a natural buffer to South 158th Street. Mayor Bauch called for any more comments; there being none, he closed the Public Hearing at 7:55 P.M. This item will be discussed by Council at the next Committee of the Whole Meeting. MOVED BY BOHRER, SECONDED BY HARRIS, THAT THE CITY COUNCIL REGULAR MEETING RECESS FOR FIVE MINUTES. MOTION CARRIED. Mayor Bauch called the meeting back to order with Council Members present as previously reported. Councilman Saul commented on the City Hall landscaping and asked about the three oak trees that are dying. He wondered if they are being watered. Mayor Bauch said the City has a one year maintenance contract on the landscaping which guarantees it for that period of time. Councilman Bohrer asked if Fire Districts 18 and 23 have been contacted about fire service contracts. Mayor Bauch said that an effort has been made to contact the departments, but they have not responded. Councilman Saul asked what the administrative policy on replacing police personnel is. Mayor Bauch said that, at the present time, there is a freeze on hiring more policemen. Councilman Saul asked if the policy is affected now that they are running one man short. Mayor Bauch said he decided not to replace this person until an assessment can be made on where the money will come from. If he felt they were not adequately staffed he would be back to Council TUKWILA CITY COUNCIL REGULAR MEETING July 16, 1979 Page 4 CITIZEN'S COMMENTS Police Dept. Hiring contd. Driveway repair Glen Anderson. with a request for more money. Councilman Saul asked where the City is in signing the arbitration agreement. Councilman Bohrer said he is in the process of making an assessment of the arbitra- tion award and should have it completed during the middle of this week. After coordinating with Staff and the Attorney he will be back to Council with a recommendation. Mr. Glen Anderson, 14475 56th Avenue South. said that going to court is going to cost more than it is worth. He asked if the City would agree to him paying the $578 to complete the driveway with the option left open to him to file a claim against the City if he does decide to go to court. If he pays the money he does not want the City to say the driveway is done per the agreement. The City has reneged on their written agreement. He wants the City to realize he may still go to court. Mayor Bauch said that the recourse of going to court is always there. Mr. Anderson cited the events, involving City staff, Council and attorneys, that have taken place since he last appeared before Council. PETITIONS, COMMUNICATIONS, APPEALS, AND SIMILAR MATTERS Claim for Damages: Puget Power Wash. Nat. Gas. Claim for Damages: Colonial II Foster's Unusual Furniture. portion of street at So. 149th Macadam (A.D. Watkins). John McFarland, Administrative Assistant, explained that the City has received two claims for damages that were incurred in relation to a Public Works project. The Puget Power claim, in the amount of $90.86, is for the cost to repair underground cable damaged when a sewer was being replaced at 56th Avenue South and South 144th. Investigation by the Public Works Director indicates liability on the part of the City. The Washington Natural Gas claim, in the amount of $37.16, is for repairs to a 2 -inch gas main broken during installation of a water service at 14421 56th Avenue South. Again, investigation reveals liability on the part of the City. Mr. McFarland recommended that both claims be paid. MOVED BY BOHRER, SECONDED BY HARRIS, THAT THE TWO CLAIMS BE PAID. MOTION CARRIED. Mr. McFarland explained that on July 13, 1979 the City received a claim for damages from Colonial II, Inc. and on July 16, 1979 a claim was received from Foster's Unusual Furniture, Inc. Both claims are against a bond posted by a firm moving a house from the corner of 53rd Avenue South and Southcenter Boulevard. The City issued a permit to move the house on Friday, July 13, 1979. There were some difficulties encountered in the move which caused 53rd Avenue South to be blocked for a period of time. Both companies have filed claims for loss of business. Attorney Hard recommended that Council reject both claims. The City has no legal liability for these claims. The housemover had a lawful permit and the work was completed within the time specified on the permit. If these two companies feel they have been wronged they should seek relief from the housemover and not the City. MOVED BY BOHRER, SECONDED BY SAUL, THAT COUNCIL CONCUR WITH THE RECOMMENDATION OF THE CITY ATTORNEY AND DENY THE CLAIMS. MOTION CARRIED. Councilman Bohrer asked if there is a small triangular piece of right -of -way immediately south of the subject property that is adjacent to the next lot. Mr. Stoknes said yes, this property is Prop. Attorney Hard read a formal motion of the City Council of the City of Tukwila stating their intent to vacate a portion of 53rd Avenue South adjacent to Interstate 5 at such time as certain actions are complied with. Watkins) contd. OLD BUSINESS Discimination against children by Apt. owners. Reconsider Street Vacation South center Blvd. at 52nd (L.A. Bowen) part of the old road right -of -way. Councilman Bohrer said he had been over to look at the site. There is a strip of property between Macadam Road and the Freeway immediately north of this and he suggested it might be possible to make a mini -park at this location. *MOTION FAILED. MOVED BY BOHRER, SECONDED BY SAUL, THAT THIS SUBJECT BE REFERRED BACK TO THE PUBLIC WORKS COMMITTEE FOR INVESTIGATION. Councilman Traynor reminded the Committee that some time back an attempt was made at developing mini -parks and it did not seem to work too well. Councilman Harris said she knows of two mini -parks that are never used, but still have to be maintained. *MOTION CARRIED. c Councilman Bohrer explained that the subject of discrimination against children by apartment owners was brought forward so that Council could make a policy decision. Council held a public hearing and a number of discussions on this subject. There are not many children currently living in apartments in Tukwila and there are a variety of reasons for this. Most people would rather rear their children in single family residences. Some people say the apartments in Tukwila are not suited for children. Others say there are no children because they are discriminated against. The landlords say it is more profitable to rent to adults because children damage apartments. Or, maybe we just don't know how many children we have in our apartments. There are other facts. We have a low vacancy rate. National statistics show households are growing faster than the population. This indicates there will be more adult households created. Life expectancy is increasing birth rates are decreasing. We need to recognize the right and desire of people who want to live separate from children as well as the right and desire of people who want to raise children in apartments, if that is all they can afford. We have a variety of life styles so people can live the way they want. Councilman Bohrer proposed that Council give consideration to, what he called, a middle ground solution. This would be an ordin- ance patterned after the one from Mountlake Terrace which prohibits discrimination against tenants with children but also says it is the responsibility of the aggrieved party to take the case to court and show this is what actually happened. The law also has a sunset provision which says that after three years Council must review it and see if they still agree. The landlord should be allowed to restrict a portion of his buildings for adults only but the bulk must be open for rental to tenants with children. We cannot tell people how they should live. We should allow freedom as much as possible. MOVED BY BOHRER, SECONDED BY HARRIS, THAT THIS ITEM BE REFERRED BACK TO THE COMMUNITY AFFAIRS COMMITTEE FOR CONSIDERATION. MOTION CARRIED. Mayor Bauch received a letter from LeRoy A. Bowen, 301 Lloyd Building, Seattle, requesting that his application to vacate the surplus strip of property along Southcenter Boulevard at 52nd Avenue South be reconsidered. MOVED BY BOHRER, SECONDED BY SAUL, THAT COUNCIL CONCUR WITH MR. BOWEN'S REQUEST AND RECONSIDER THE MATTER. MOTION CARRIED. TUKWILA CITY COUNCIL REGULAR MEETING July 16, 1979 Page 6 OLD BUSINESS Contd. Reconsider Street Vacation South center Blvd. at 52nd (L.A. Bowen) contd. ORDINANCES Ord. #1118 adopting land use plan zoning regulation for Allentown area. Mr. LeRoy Bowen explained that back in April Council considered this request and it was approved for vacation by five votes. At another meeting, with only four members present, it was denied. He has recently acquired the property adjacent to 52nd from the State Highway Department. His first request was for a strip 160 feet by 20 feet but now knows he needs only 150 feet. This is a logical request, the property would be put to good use and be put back on the tax rolls. Councilman Bohrer said he is opposed to the vacation. It is counter to Council policy and the City receives no money from it since it is State turn -back property. Also, there is a possibility of use here. Councilman Traynor said it looks like it would benefit the City as a turn -out lane. Mr. Bowen said there is forty feet of property that is not being used. Councilman Johanson said he has not heard Staff express any use for this property. Staff has assured us there is ade- quate area for traffic. Councilman Hill said that the City now needs an additional twelve feet along the east side of Southcenter Parkway for a turning lane. Some day we may need this right -of -way and would have to pay considerable more to get it back. Mr. Bowen said that right now the street is more than adequate for the amount of traffic. Councilman Harris said she agreed with Councilman Johanson, there is an excess of property there. MOVED BY BOHRER, SECONDED BY SAUL, THAT COUNCIL APPROVE THE PROPOSED ORDINANCE TO VACATE THE PROPERTY AS ORIGINALLY SUBf1ITTED. City Attorney Hard read an ordinance of the City of Tukwila enacted pursuant to RCW 35A.14.330 adopting a land use plan and zoning regulatior for the area described lying outside of the City of Tukwila and commonly known as Allentown and providing that said area shall become subject to said land use plan and zoning regulation upon annexation to the City of Tukwila. MOVED BY BOHRER, SECONDED BY SAUL, THAT ORDINANCE NO. 1118 BE ADOPTED AS READ. Mayor Bauch called Council attention to a proposed change in the ordinance. The addition of a new Section 4 would make the Comprehensive Plan Map consistent with the zoning action taken by the ordinance. MOVED BY HARRIS, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE AMENDED BY ADDING NEW SECTION 4 AND RENUMBERING SECTIONS 4, 5, AND 6. MOTION CARRIED. Councilman Bohrer announced a meeting to be held next Monday at 7:30 p.m. at Fire District No. 1 headquarters to discuss the impact of the proposed Seattle annexation of the South Park area. Council will have a representative attend the meeting. The question was raised whether there would be a quorum next Monday night, so it was suggested that the meeting be changed to the 30th of July, 1979. Attorney Hard read an ordinance of the City of Tukwila, Washington annexing certain territory continguous to the City of Tukwila (commonly referred to as the Segale annexation), and further declaring that said area as of the effective date of this ordinance shall be subject to the zoning regulations adopted for it by Ordinance No. 1108. MOVED BY BOHRER, SECONDED BY HARRIS, THAT ORDINANCE NO. 1119 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY BOHRER, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE READ. MOTION CARRIED, WITH JOHANSON VOTING NO. Attorney Hard read an ordinance of the City of Tukwila fixing the amount of compensation for the position of Mayor and repealing Ordinance No. 1102. MOVED BY HARRIS, SECONDED BY SAUL, THAT SECTION 2 BE DELETED FROM THE ORDINANCE. MOTION CARRIED. 45/6 MOVED BY BOHRER, SECONDED BY TRAYNOR, THAT THE PROPOSED ORDINANCE BE ADOPTED AS READ. Councilman Hill asked the City Attorney, since this ordinance repeals the ordinance that set the Mayor's salary, what effect does it have on his current salary between now and January 1. Attorney Hard said there is a budget ordinance adopting the salary. He suggested omitting the repealer section. Councilman Johanson asked if it is predetermined that we are going to have a full -time Mayor? It must be, we certainly aren't going to pay $28,000 for part -time. He asked how this was arrived at. When he ran for office last time he did not get the opinion that the people are ready for a full -time Mayor. Councilman Bohrer said he has expressed himself in the past that the City is ready for a full -time administrator. We have more than 100 employees and an annual budget of 7 or 8 million dollars and this warrants a full -time Mayor. He said if Council wish the clause can be inserted that the Mayor shall be in the City the same as a full -time employee. Councilman Harris said she did not think Council has a right to do this. She had looked into this and an elected official serves the number of hours he wants to. Councilman Johanson asked if, along with the discussion on the full -time Mayor, there was also a discussion on restructuring the Staff as it exists today, designed for a part -time Mayor? What about the full -time AdministrativE Assistant? Are we going to continue this office? Councilman Harris reminded Council that once the salary is set, prior to the filing period, you cannot decrease it. It is set for the four year term of office. You can give him more but no less. Councilman Bohrer said Council has agreed that under the coming labor negotiations the Adminis- trative Assistant will be the negotiator with the help of the Policy Analyst. There are duties we can find for such an individual. He can expand on personnel matters to save consulting fees. This is just a suggestion. Councilman Johanson said if you go to a full -time Mayor you have eliminated a good share of the population from ever running for office. Councilman Saul said he thinks it a good move to have the Administrative Assistant do the negotiating and use the professional in an advisory capacity. Councilman Harris pointed out if Council adopts this ordinance the Mayor will be the sixth highest paid Mayor in the State. Councilman Saul explained that the wage was arrived at by taking the top salary paid to City Staff and adding 15 Councilman Traynor said we have had two administrators that have said the Mayor's job is a full -time job. This should tell us something. Mayor Bauch said there are a lot of people that have no idea of the amount of work that goes over the desk of the Mayor. Councilman Bohrer pointed out that there is concern about the City being well managed. TUKWILA CITY COUNCIL REGULAR MEETING July 16, 1979 Page 8 ORDINANCES Contd. Prop. Ord. DEPARTMENT REPORTS Mayor's Report e).si7 With the Mayor being paid for part -time there is no reason for him putting in more hours. The subject of going to a Council /Manager form of governmnet has not been pursued. It was concluded that it was easier to go to a full -time Mayor. The City needs a full -time manager. Councilman Harris said, to change the form of government, it takes a vote of the people. We must address the present method of paying the Mayor before the filing period. We can go to the people at a later date. Councilman Hill said why not have a part -time Mayor for another year. ROLL CALL VOTE: BOHRER, SAUL, TRAYNOR VOTING YES; HARRIS (the reason, $28,000 is too high), HILL, JOHANSON VOTING NO. MOTION FAILED. Councilman Bohrer said he talked with Mr. Dave Saunders of the State Department of Ecology and he agreed with the provisions of the ordinance and recommended that it be adopted. Councilman Traynor suggested that the City consider not allowing radios in the parks. They are not allowed in the parks he visited in England and they are very pleasant. *MOTION CARRIED. Attorney Hard read a resolution authorizing applications for funding assistance for an outdoor recreation project to the intragency committee for outdoor recreation as provided by the Marine Recreation Land Act. Councilman Saul reported that the Architectural Review Committee had toured the City and made their selections as follows: as F Commercial /Industrial Buildings under 20,000 sq. ft.: Foster's Unusual Furniture. Commercial /Industrial Buildings over 20,000 sq. ft.: New Seattle First National Bank. Warehouses: Seawest. Residential Construction: Schoenbachler (Southcenter Parkway, south of South 180th Street). Landscaping Design: Parke Davis site. Building of the Year: Parkway Plaza. Committee Members were: Marianne Crissy (People's National Bank); Carol Logan (Highline Times); John Richards (Planning Commission); Doris Phelps (City employee); Al Pieper (Building Department); Dan Saul (Council Member) Councilman Saul suggested that a Proclamation be written honoring each division and ask the representatives of each selected building to be present to receive it. Councilman Hill asked what Council is going to do about Mr. Anderson's driveway? Councilman Bohrer explained what has happened in the past negotiations over the driveway. As a final step, Mr. Anderson has offered to pay for the installation of the west portion of driveway with the understanding that he was not waiving his right to sue the City. A City employee has spent considerable time engineering this driveway, at no cost to the property owner, so he could get his trailer onto the property.
