TUKWILA CITY COUNCIL COMMITTEE OF THE WHOLE M I N U T E S It was agreed by Council Members present that Councilman Traynor would be the presiding officer in the absence of Council President Bohrer. MOVED BY HARRIS, SECONDED BY VAN DUSEN, THAT THE MINUTES OF THE COMMITTEE OF THE WHOLE ON AUGUST 13, 1979, AND THE ZONING ORDINANCE REVIEW MEETINGS OF AUGUST 14, 1979 AND AUGUST 28, 1979 BE APPROVED AS PUBLISHED. MOTION CARRIED. Councilman Harris explained that she has discussed this item with Ron Swanson, Finance Director. This is a case where more LID #18 Bonds were redeemed than there was money in the fund. This makes it necessary to borrow money from the L.I. Guarantee Fund. MOVED BY HARRIS, SECONDED BY SAUL, THAT THIS PROPOSED RESOLUTION BE ON THE SEPTEMBER 17TH AGENDA. MOTION CARRIED. Councilman Harris explained that she has discussed the interim financing of LID #25 with both the Finance Director and an official at the bank. This is the case where LID #25 is in litigation. The bonds can't be sold until it is settled. Since the financing was done several years ago the bank is asking for the City to refinance it at a different rate of interest. She recommended that Council approve this. MOVED BY HARRIS, SECONDED BY SAUL, THAT THE PROPOSED ORDINANCE BE ON THE SEPTEMBER 17TH AGENDA.* Councilman Van Dusen asked if construction was complete. Mayor Bauch explained that it is. This is the LID serving the Fort Dent facility. At the time of acceptance of the final assessment roll, King County protested the distribution of the assessments because of a previous lawsuit. Kjell Stoknes, OCD Director, explained that the applicant (Oak Harbor Freight Lines, 6350 So. 143rd St.) is requesting a hearing before the City Council to permit expansion of an existing truck terminal operation. The applicant wishes to use two vacant parcels of property adjacent to their westerly boundary for truck and trailer parking. The waiver is necessary because the proposed expansion area is designated for commercial, not industrial, on the Comprehensive Plan. Also, this site is designated as an area of "special development considerations." If they do get the waiver, they still need a Conditional Use Permit from the Planning Commission. Mr. Carl Jonson, Lawyer for Oak Harbor Freight Lines, 300 Center Building, Seattle, 98104, explained that the company has had a truck terminal at this address for five years. It was contemplated, at that time, that they would eventually expand the facility. They are now willing to do anything within reason. Mr. David A. Vander Pol, Secretary /Treasurer of the company, presented drawings of the proposed expansion and explained the use. He said they would be glad to plant trees and install screening. Councilman Harris said the facility generates noise day and night. She asked if this is toaccommodate more trucks. Mr. Vander Pol said it was to provide more room for the units they have and to provide more employees parking area. APPROVAL OF FINAL WAIVER FROM SPEEA AND UNIFIR Southcenter Blvd. at 52nd Ave. So. Councilman Traynor asked if there was any type of screening that would be effective. Mr. Stoknes said he doesn't believe there is effective screening unless it was evergreen trees and they would take a period of years. He said he feels the question is, do you allow Oak Harbor to grow and expand their facility. Councilman Traynor asked if this could be turned over to the Planning Commission for their opinion? Mr. Stoknes said, absolutely. Councilman Traynor said maybe the place could be made to look like it belongs there. The noise is already there. Councilman Van Dusen said he would like some insurance that there won't be a large expansion of the facility. Everybody on the hill hears the trucks. If it wasn't for the noise of the trucks gearing down and up there would be no problem. The City does want to update Interurban and this should fit into the plan. He asked if, under the new noise ordinance, this falls in the Industrial Zone and was told it does. This ordinance cites 60 DB as the maximum permissible sound level transferred from an industrial to a residential area during normal hours. At times they exceed this. Councilman Van Dusen asked if the City could have some readings taken. Councilman Saul offered to try and get a machine from the Environmental Protection Agency. Mr. Vander Pol said as they modernize their fleet, the trucks get less noisy. Councilman Hill arrived at the meeting. Mr. Jonson asked if Mr. Vander Pol could be notified when the noise readings are taken. Council felt this was a fair request. Mr. Jonson said they would welcome a study by the Planning Commission. This facility cost a lot when it was built five years ago. This is a truck terminal -that is the way it was built. If it were to be sold, it would be sold as a truck terminal. Councilman Traynor said he would like to see this sent to the Planning Commission. If they recommend approval, he would like to see a landscape plan. MOVED BY VAN DUSEN, SECONDED BY SAUL, THAT THE PROPOSAL FOR A WAIVER REQUEST BE SENT TO THE PLANNING COMMISSION.* Councilman Van Dusen said he hoped they would consider the Interurban Improvements and the noise. *MOTION CARRIED. Mr. Stoknes explained that the preliminary request for a waiver for SPEEA and UNIFIR was before Council on August 27, 1979. These final plans are basically the same as those previously presented. This is the first waiver application that has gone the full procedure route to the final approval. The requirement for a landscape plan has not been completed. The current plan shows a 5 foot strip and the requirements are for 10 feet. This will be corrected before the Building Permit is issued. Councilman Traynor asked about sidewalks and was told they will be one of the requirements under a Developers Agreement. 4s6 y Councilman Saul asked if there are plans for water retention on the property. APPROVAL OF FINAL WAIVER FROM SPEEA AND UNIFIR Southcenter Blvd. at 52nd Ave. So. (Continued) Proposed Ordinance Vacating a portion of Macadam Road at Southcenter Blvd. west of 65th. Announcement ADJOURNMENT 8:00 P.M. Mr. Stoknes recommended that Council approve the waiver with the conditions that the Board of Architectural Review review and approve the landscape plan prior to issuance of the Occupancy Permit. Second, that the landscape area be 10 feet on the front. Mayor Bauch reminded Council that a year ago they were having a problem with the waiver system. The applicants were having to submit completed drawings and it was costly, considering they didn't know if they would receive approval; So, Council started accepting preliminary plans. The ordinance says that as long as the final plan is essentially the same as that previously presented and approved, Council has to grant the waiver. Councilman Van Dusen noted that the drawings provide for retention of water on site. Mr. Stoknes said that, if this item is forwarded to next week, it will come back with the following conditions: (1) Agreement to participate in a Local Improvement District. (2) That the front landscape strip be widened to ten feet. (3) The detailed landscape plan be approved by the Board of Architectural Review prior to occupancy. Mayor Bauch said the Public Hearing on the request for a vacation of a portion of Macadam Road located north of Southcenter Boulevard and west of 65th Avenue South was held on August 27th. Council requested that an ordinance vacating the street and setting the value be placed on this agenda. The ordinance needs a Section 4 added which provides for a perpetual easement to all three property owners. The total area to be vacated is 7,920 square feet and one -half the total value of the land to be vacated amounts to $2,850.53. The City is giving up the liability of this street and any future maintenance. They will build and maintain their access street. as65 MOVED BY SAUL, SECONDED BY HARRIS, THAT THIS ITEM BE PLACED ON THE SEPTEMBER 17TH AGENDA. MOTION CARRIED. Mayor Bauch announced a public meeting to be held next Monday for citizen input on the METRO merger proposal. This is a subject on which Council cannot take official action.
