WAIVER TO U\DERGROLTNDItNG ORDINANCE
OBLIGATION FOR FL 1 LIRE UNDERGROUNDING
The proposed service line extension at 49 Avenue S and S 114 in City of Tukwila
ROW (west of Seattle City Light pole 4 315NE15) requires undergrounding per
Ordinance Nos. 486, 924 and 1321. This extension is for Puget Sound Energy's (PSE)
automated meter reading equipment; a telephone line is an integral part of the equipment
and will be extended to the SCL pole as well. In compliance with Ordinance No. 1607.
PSE and Schlumberger have demonstrated compliance with the Underground Ordinance
will create undue hardship if carried out as part of the service line extension.
PSE and Schlumberger are obligated to participate in funding future undergrounding
improvements for their proportionate share of said undergrounding of the service line
extension and telephone line referenced above. Furthermore, if the LID/ULID process is
used to carry out the construction of this undergrounding, PSE and Schlumberger waive
the right to protest LID or ULID formation for this undergrounding. PSE and
Schlumberger retain the right to contest the method of calculating assessments in such
LID or ULID and the amount thereof to be levied against PSE and Schlumberger which
would be within such LID or ULID.
This Agreement shall be recorded by the City Clerk with the King County Auditor as
required by Chapter 35.91 RCW and the cost of said recording will be paid by the City.
This Agreement shall be binding upon the parties. their respective heirs, legal
representatives, assignees, transferees and successors.
