This development meets or exceeds at least one of the conditions stated M TMC 1.1.64.020. The proposed
development property is obligated to participate in funding fuwe frontal improvements and utility uniergtuunding
within the public right -of -way for the Length of the frontage, and the ovrar waives the ribs to protest L.I.D. or
ti.L "I.D. forna ;lot. The owner wall pay a proportionate far shire based on unir construc ton tests for ke frontal
imp :o e:nens and uility undergrounding within the public right -of -way for :he length of the frontage if the City
proceeds with construction.
This agreement shat' be binding upon the parties, their respective heirs, legal represeatathes, assignees,
transferees and successors, and rev with the land.
TJis agreement chart be recorded by the City Clerk with the King County Auditor as required by RCW Chapter
35.91, and the cost of said recording will be paid by the City.
So that the owner eaz remove encumbrances from the property caused by this requirement, the Owner can pay the
City the Owner's pro-rata share for projected costs. These costs wilt be made available to the Owner upon
vetnen request to the Public Works Director.
