Mayor Bauch, presiding, led the Pledge of Allegiance and called
the Regular Meeting of the Tukwila City Council to order.

Mayor Bauch stated that the law requires cities who use Block
Grant Funds to hold a public hearing to receive citizen input
on the use of these funds.

Mayor Bauch declared the public hearing open.
Kjell Stoknes, OCD Director, explained that for the new program
year Tukwila is eligible to receive $15,991.00. In the past
the funds have been used to establish a system of footpaths,
upgrade the Southgate Elementary School for use as a Senior and
Community Center and provide underground utility service to
homes of low income residents. The latest program is to provide
smoke detectors and deadbolt locks in the homes of eligible
Tukwila residents.
Mayor Bauch asked for comments from the audience. Mrs. Doris
Phelps asked what the staff recommendations were. She was told
that purchase of the abandoned Puget Power right -of -way along
Interurban Avenue and construction of Phase III of the Christensen
Greenbelt were suggested. Mrs. Phelps asked if there are any
programs at Southgate for seniors or children that could be
augmented. Mayor Bauch said there are always programs that
could be started.
There being no further comments, the public hearing was closed.
Mayor Bauch said this item will be discussed further at a
Committee of the Whole meeting.

Councilman Hill asked to have this item published in the
Record Chronicle again to give the citizens another chance
to express their opinions.

BE READ BY TITLE ONLY. MOTION CARRIED WITH COUNCILMAN HILL VOTING

City Attorney Hard read an ordinance of the City of Tukwila,
relating to criminal attempt and prescribing penalties.

BE ADOPTED AS READ.*
Attorney Hard said a problem has occurred in the Municipal
Court where someone has been arrested for almost completing
a criminal act. Judge Payne has expressed concern because there
is no ordinance covering the attempt.
Councilman Hill expressed concern that someone could be arrested
at the wrong time and turn around and file suit for false arrest.
How do you determine when a crime is about to be committed?
Attorney Hard agreed it was a good point but you have to rely on
the experience and integrity of the law enforcement officer
involved. This will probably not be used a lot. Judge Payne
feels it is necessary. If the Judge isn't convinced a crime
was being attempted, the person will not be convicted. An
officer shouldn't have to sit and wait until the crime is
completed when it is apparent a crime is in process.
Councilman Hill said his main concern is to protect the innocent.
Attorney Hard said this is only attempt to commit a specific
crime -it has to be proven.

Mayor Bauch reported that the siren on the old City Hall site
has been reprogrammed with Valley Comm. to sound only when
there is a major emergency in the City.
Councilman Van Dusen read the investment report submitted by
Ron Swanson, Finance Director. Interest income for the month of
September amounted to $24,639 resulting from the following activity:
Investments Sold $2,869,000
Investments Purchased $2,533,000
Mayor Bauch reported that the week of October 7th a movie, to
be used for the training of police officers, was filmed in the
City of Tukwila. It had to do with bank robberies.
Councilman Hill noted that there will be no further zoning
ordinance review meetings until after the Planning Commission
has completed their review and held the public hearings.
MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE REGULAR MEETING
OF THE TUKWILA CITY COUNCIL ADJOURN. MOTION CARRIED.
