The proposed development at: 1 3 0 0 / 4( » v e , Address: Parcel No.: 000.300 - 0046 TMC 11.64.020 requires frontal improvements, including the construction of curb, gutter, sidewalks and the undergrounding of utilities for new or remodeling construction when: - floor area is increased by 20% - alterations, repairs, remodeling exceed 25% of the previous building value - 25,000 square feet is added - or building value is increased by $250,000 This development meets or exceeds at least one of the conditions stated in TMC 11.64.020. The proposed development property is obligated to participate in funding future frontal improvements and utility undergrounding within the public right -of -way for the length of the Lc" frontage, and the Owner waives the right to protest L.I.D. or U.L.I.D. formation. The Owner will pay a proportionate fair share based on unit construction costs for the frontal improvements and utility undergrounding within the public right -of -way for the length of the frontage if the City proceeds with construction. This agreement shall be binding upon the parties, their respective heirs, legal representatives, assignees, transferees and successors, and runs with the land. This agreement shall be recorded by the City Clerk with the King County Auditor as required by RCW Chapter 35.91, and the cost of said recording will be paid by the City. So that the Owner can remove encumbrances from the property caused by this requirement, the Owner can pay the City the Owner's pro -rata share for projected costs. These costs will be made available to the Owner upon written request to the Public Works Director.
