The existing development is obligated to participate in funding future frontal improvements, and the owner waives the right to protest L.I.D. or U.L.I.D. formation. The owner will pay a proportionate fair share based on unit construction costs for the frontal improvements if the City proceeds with construction. If frontal improvements occur by any method other than L.I.D or U.L.I.D., then the owner has the right to remove this .nctinbrance from the property so long as all other agreements or arrangements with the Cityrave been met. This agreement shall be binding upon the parties, their respective u 211 legal representatives, assignees, transferees and successors, and runs with the Iand. This agreement shall be recorded by the City Clerk with the King County Auditor as required by RCW Chapter 35.91, and the cost of said recording will be paid by the City. So that the Owner can remove encumbrances from the property caused by this requirement, the Owner can pay the City the Owner's pro -rata share for projected costs. These costs will be made available to the owner upon request to the Public Works Director.
