Councilman Hill asked Attorney Hard if it would be legal for
Council to pass an ordinance regulating political signs posted
on public property. All signs would be removed by City Crew
and a bill sent to the candidate. Attorney Hard said it merits
further discussion. He raised the question as to whether the
City could regulate all public property, using King County
Housing as an example. Generally, an ordinance could be con-
sidered concerning political advertising left on public rights
of -way beyond a certain time. There is a problem in holding the
candidate responsible if the signs were posted without the person's
knowledge.
Councilman Van Dusen arrived at the meeting.
Mayor Bauch displayed the Class III Safety Award of Honor for
1978 that had recently been presented to the Tukwila Public
Works Maintenance Crew by the Washington State Chapter of
the American Public Works Association. Terry Monaghan, Public
Works Director, and Ralph Trepanier, Acting Maintenance Super-
intendent, were on hand to receive the award.

City Attorney Hard read a Formal Motion of the City Council of
the City of Tukwila stating their intent to vacate a portion of
53rd Avenue South adjacent to Interstate Five at such time as
certain actions are complied with.

Terry Monaghan, Public Works Director, recommended that the
1978 Deferred Street Improvement Project be accepted. This
project was the improvement of 56th Avenue South from South
141st to South 147th. The project has been completed by the
contractor, Pacific Construction Company. There has been some
problem with the rockeries but all the problems to date have
been taken care of. Any deficiency from here on will be taken
care of under the Performance Bond. He stated that there are
two pending liens against the subcontractors for material and
recommended that, after the 30 day grace period, the City take
the action to release the retainage to the general contractor
and let the general contractor and the subcontractors settle
their problems.

THE PUBLIC WORKS DIRECTOR'S RECOMMENDATION AND ACCEPT THE 1978
DEFERRED STREET IMPROVEMENT PROJECT.*
Councilman Hill asked if release slips had been received from all
the residents. Mr. Monaghan said there were some that would not
sign the release slips but their complaints had been noted. There
are probably six that the City doesn't have and they do not represent
a major problem. This does not release the City from any obligation
with respect to design deficiencies and it doesn't release the
contractor from any obligation with respect to the workmanship.

Terry Monaghan reported that Change Order #2 has been completed.
This was the ivy plantings on the north bank. He recommended
that the project be accepted.

Councilman Hill asked if anyone knew about now long it would
take the ivy to cover the north bank. Mr. Monaghan said no,
but that the contractor added an additional 1000 plants.

Ron Swanson, Finance Director, reported that the assessed value
for 1980 is up about 16% from 1979 based mostly on new construction
amounting to 21,700,000. The actual dollar amount is $150,000.
The levy rate was $2.832 for 1979 and is $2.751 for 1980.

City Attorney Hard read an ordinance fixing the amount of tax
levies necessary to raise funds to meet the estimated expenditures
for the year 1980 as required by RCW 35A.84; authorizing the
Finance Director to certify such budget or estimate of the amount
to be raised by taxation on the assessed valuation of the property
located within the City of Tukwila, Washington, and declaring
an emergency.

Mr. Monaghan explained that under the terms of the short plat,
Southcenter Investors were required to improve Christensen Road,
install the utilities and build a cul -de -sac. They were required
to donate to the City, right -of -way for the cul -de -sac, the
portion of the dike area for the Christensen Trail System, and
the portion of the north end for park use. The street has been
completed to City standards and Southcenter Investors has met
all the requirements.

City Attorney Hard said he has been working on this and is
concerned. He asked Council not to pass the resolution to
allow additional time for investigation.
City Attorney Hard read a resolution of the City of Tukwila,
Wash., accepting a quit claim deed and bill of sale for roadway
improvements and utilities along Christensen Road.

TO THE COMMITTEE OF THE WHOLE ON NOVEMBER 13TH. MOTION CARRIED.
Mayor Bauch reported that Metro has changed Bus Route #240 back
to the original route. This was just a temporary change.
Enco Express has dropped their lawsuit against the Boundary
Review Board concerning the Riverton Annexation.
The Shirlee Kinney lawsuit went to the Supreme Court and they
denied the appeal.
Mayor Bauch said he has recommended to Metro and the King County
Executive that they allow a Park Ride facility to be installed
at Fort Dent. They think it has merit and will investigate it
further.
Terry Monaghan reported that thej.oint (Tukwila Renton) Transportation
Committee has reviewed the Grady Way Bridge replacement alternates
with the consultants. They voted to recommend to the respective
Councils that Alternate #1 be pursued. This is the direct re-
placement of the existing structure. It will be recommended
that the final design have an interlock provision to connect the
Grady Way Bridge to an extension of Southcenter Boulevard and
the T -Line Bridge. He recommended that this item be placed on
the agenda for the Committee of the Whole on November 13.
Attorney Hard reported the case involving Ann Lovell and the State
Human Rights Commission is still active.
The lawsuit involving LID #25 is still pending in Superior Court.
This is King County and Fiorito suing the City over the final
assessment roll. We hope to have this resolved before long.
The lawsuit filed by Mr. Salant (S M Investors) is still
active. It challenges the City's moratorium on South 152nd
Street. This is scheduled for a hearing before the Superior
Court on November 15.

Mayor Bauch gave a brief summary of his proposed 1980 Budget.
It is now at the printer and will be available for Council by
the weekend.
Councilman Hill suggested that the schedule for review of the
proposed 1980 budget be on the agenda for the next Committee
of the Whole meeting and Council agreed.
Sister City Visitors John McFarland, Administrative Assistant, discussed the visit
of the 11 adults and 30 students from Ikawa -Cho, Japan. Tentative
schedules were set. A Puget Sound area tour on Sunday afternoon
and banquet dinner Monday evening were two events decided upon.
Guests will arrive at the Airport Saturday, November 17, at 1:00 p.m.
