TMC 11.64.020 requires the construction of curb, gutter, and sidewalk frontal
improvements for new or remodeling construction when:
floor area is increased by 20%
alterations, repairs, remodeling exceed 25 of t e previous building value
25,000 square feet is added
or building value is increased by 8250,000
This development meets or exceeds at least one of the conditions stated in TMC 1I.64.020.
The proposed development property is obligated to participate in funding future frontal
improvements_ and the owner waives the right to protest L.I.D. or t .L3.D. formation.
The owner will pay a proportionate fair share based on unit construction costs for the
frontal improvements if the City proceeds with consuuction.
This agreement shall be binding upon the parties, their respective heirs, legal
representatives, assignees, transferees and successors, and runs with the land.
This agreement shall be recorded by the City Clerk with the King County Auditor as
required by RCW Chapter 35.91, and the cost of said recording will be paid by the City.
So that the Owner can tewove encumbrances form the property caused by this requirement,
the Owner can pay the City the Owner's pro -rata share for projected costs. These costs will
be trade available to the owner upon written request to the Public Works Director.
