1. The DLC line shown on the referenced survey re;:resents the easterly
CO extension of the north line of Colegrove's Acre Tracts, volume 11 of
Plats, Page 85, records of King County, i:ashingten, based on the north-
west corner of said plat as resat by Leonard Schroeter, L.S. 08808 LA.,
and the northeast corner of said plat as tied out by CRS Corporation
under the direction of Russell Coffel:, L.S. r8394 WA.
2. The Colcgrove plat prepared by Cardner b Cardner in 1904 clearly states
that the N.W. corner of that plat is at tht intersection of the south
line of the Stephen Foster Donation Land Claim and the line co=on to
sections 14 and 15; and that the N.E. cor-:cr of that plat is at the inter-
section of the vest line of the Joseph Foster Donation Land Clai= and the
south line of the Stephen Foster Donation Land Clain.
3. The distance between these two corners de,cribed in item 1 as measured
under my supervision in 1,111.98 feet, u- y 0.02 feet different from the
1.112 feet shown on the face of the Coleo: ve plat.
A. The angle between the south line of the Stephen Foster DLC as here defined
and the vast line of section 14 (to the S.W. corner thereof) measured in
the southesat quadrant is 90'06'3: a di of only 0'01'26" from the
angle 90'08' shown on the Colegrove plat. This angular difference, if
extended easterly to the left bank of the Duwa =iah River, would generate
a displacement of only 1.14 feet.
S. Surveys conducted under my supervision In 1965 and 1979 indicate that the
DLC line as here defined 1a in close proxi =lty to fence lines and apparent
lines occupation between 51st Avenue South and 56th Place South.
6. The plat of Hillman's Seattle Carden Tracts, Volume 11 of Plats, page 24,
records of King County, Washington, indicates that the north line of that
plat, which it states covc:a the (Joseph Footer) Donation (Land) Claim
No. 39 lase some exceptions, intersects the right -of -way of the Seattle
Tacoma Interurban Railway at an angle of 46'06' in the southeast quadrant.
7. The angle between the south line of the Stephen Foster DLC, which is also
the north line of the Joseph Foster DLC No. 39, and the mo- umented Inter-
urban right -of -way is 44'50'58" in the southeast quadrant. This differs
from the Millman Plat angle by 1'15'0: a significant deviation.
S. In order to agree with the Hillman plat angle and the northwest corner of
Colegrovc (item 1) the intersection of the DLC line with the east line of
:ntsrurban would have to shit N 44'50'58" W 61.65 feet, and the monument
set near the Duvamish River would have to shift 59.43 feet north.
9. In order to agree with the Hillman plat angle and the northeast corner of
Colcgrove (item 2), the intersection of the DLC line with the east line of
Interurban would have to shift N 44 W 27.97 feet, and the monument
set near the Duvamish Inver would have to shift 35.16 feet north.

10. The Hillman plat. by summation of interior angles. shows a directional
difference between the north and *ouch lines thereof of 34 minutes, but
the description on the plat calla for them to be parallel.
ii. The description on the Hillman plat, rather than directly calling the
Joseph Foster DLC, begins at the northeast corner of the Gilliam claim
and then apparently runs around the Foster claim by metes and bounds
recital. Except for the call along the north line ()].SO chains Hillman
vs. 33.32 chains Cilliam). this recital is exactly as shown on the 1862
notes for J. Foster's Claim.

Conjecture
1. "he Colegrove plat was prepared and staked with its north boundary con-
tiguous with the south line of the Stepher. Foster DLC as it was recognized
In 1904.
2. The Hillman plat was prepared (and perhaps scb, mod) from the southwest cor-
ner of the Joseph Foster claim according to tho dimensions of the 1862
claim papers.. Physical evidence of the line between the Joseph Foster.and
Stephen Foster claims may have been either ihnored or never observed. Over
platting and poor surveying is a characterictic of many C.D. Hillman plate
and is a familiar problem to many local surveyors.
J. The property adjoining the: portion of the Stephen Foster DLC lying east of
Interurban on the south may well have been staked at one time from the south
according to the Hillman plat and those stakes used in ;,00d faith. However.
Hillman did not have the right to plat that which he did not own.
Conclusion
The preponderance of rvldence above cited Indicates that the south line of
the Stephen Foster DLC Is at the position indicated on the referenced
survey nap. The only contrary evidence relate& to the plat of Hillman's
Seattle Carden Tracts, which plat 1� devious in description, incomplete in
dimension, and questionable In virt..e.
