Central Kent, WA 98032 This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project and permit approval. I. There are currently no signs for any of the businesses located at this site. The street frontage for this site is approximately 180 feet. Access to the site is from Midland Drive, which is a private street. DECISION CRITERIA AND CONCLUSIONS The AMB Upland Distribution Center would like to have two freestanding signs; one located within the middle of the site on Midland Drive, identifying the Distribution Center as a whole and all associated businesses, and another at the driveway entrance to the Distribution Center located on the south end of the property along Triland Drive. The second sign is needed, as indicated in the letter from applicant Jerry Downer, dated October 19, 2006, to guide customer and truck traffic along the appropriate route within the site. According to section 19.32.140 E.1 of Tukwila's Sign Code, "One freestanding sign shall be permitted for each site." The terms "site" and "premises" are used interchangeably within Tukwila's Sign Code, with a premises defined as "one or more contiguous lots of record (exclusive of any right-of-way, owned or managed by the same individual or entity" (TMC 19.08.172). Since all four lots which are the subject of this application are owned and managed by the same entity, they are considered one site/premise, and therefore qualify for only one freestanding sign. Additionally, the site does not qualify for a second freestanding sign according to the criteria outlined in TMC 19.32.140 E.1 a -c because it does not meet condition a. requiring the site to have at least 400 linear feet on a public street. However, according to the requirements for a shared directional sign, outlined in TMC 19.32.020, "In commercial and industrial areas where a demonstrated need for directional signing exists, owners or tenants of these premises may apply for review and approval of the design of a shared directional sign." Since the AMB Upland Distribution Center is located within a commercial area, the owners or tenants of this site may apply for a Shared Directional Sign as a Type 2 decision, as long as the proposed sign meets the following additional criteria outlined in TMC 19.32.020: (1) The proposed sign must not exceed ten feet in height, ten feet in width, and have a maximum of two signing surfaces which do not exceed a total of 50 square feet. (2) The proposed sign must be located on the premises of at least one of the entities identified thereon and shall be used only by geographically associated businesses. (3) The sign structure shall be located in a masonry base of decorative appearance. (4) The shared directional sign shall contain no promotional copy but shall be limited to the names and addresses of the companies or activities being identified. According to the criteria above, the sign as proposed may be allowed as a Type 2 special permission for the following reasons: (1) The proposed sign, at 5.25 feet in height, 3.5 feet in width, and 18.375 square feet in sign area, is within the size limitations for a Shared Directional Sign. (2) The proposed sign is located on the premises of the AMB Upland Distribution Center. (3) The sign structure is located in a solid panel decorative base. (4) The promotional copy on the Shared Directional Sign contains only the name of the business to which it refers. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a request for a special permission sign does comply with applicable City and state code requirements and has approved that application. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is by November 16, 2006. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Planning Commission based on the testimony and documentary evidence presented at the open record hearing. The Planning Commission decision on the appeal is the City's final decision. Any party wishing to challenge the Planning Commission decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Planning Commission decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Jaimie Reavis, who may be contacted at 206-431-3659 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King County Assessor's Office for further information regarding property tax valuation changes. On October 12, 2006, a sign permit application (S06-055) was submitted for one single - faced freestanding sign of 48 square feet, to be located in the middle of this property on Midland Drive, which is an easement, but not an official street. In addition, the owners would like to install a 9 square foot single -faced post and panel sign near the southern end of their property near Triland Drive, which is an easement, but not an official street. Upland Distribution Center is a large complex of 4 buildings totaling over 320,000 square feet. This property is unusual in the fact that the only official street frontage is the northeast corner of the complex on Upland Drive. The other two entrances to the property are easements from the adjoining properties that face Andover Parkway West. The entrances on Midland Drive and Triland Drive are the preferred access to this property by visitors and trucks delivering or picking up shipments from the tenants of Upland Distribution Center. The addition of this second sign, although small in size, will greatly help in the clarification to visitors and truckers that they have found Upland Distribution Center as they enter the property on Triland Drive.
