I. Project File Number: L06-076 Applicant: Pitney Bowes Type of Permit Applied for: Special Permission Sign Hill Investment Attn: John Pietromonaco 7900 SE 28th Street, Suite 310 Mercer Island, WA 98040 Steve Lancaster, Director November 9, 2006 and is issued pursuant to TMC 18.104.170 on the following project PROJECT INFORMATION Project Description: Request for a Special Permission Sign to increase the allowable sign area to be shared by multiple tenants for the western wall face of the building located at 116 Andover Park East, allowing Pitney Bowes to re -install their sign in its former location on the building's western face. Location: 116 Andover Park East, Tukwila, WA 98188 Associated Files: S06-045 Com. rehensivePlan Desi nation/Zonin District: Tukwila Urban Center (TUC) VICINITY/SITE INFORMATION The building located at 116 Andover Park East was formerly occupied by one tenant, Pitney Bowes. The area of the exposed building face for the western side of the building located at 116 Andover Park East is 2392.5 square feet. The setback of the western wall of the building from the property line is approximately 55 feet. DECISION CRITERIA AND CONCLUSIONS According to the provisions of Tukwila's Sign Code related to office buildings with multiple tenancies (19.32.140 section C), "The total allowed signage area for any exposed building face shall be equal to the area given in Table 1." Additionally, "No one sign shall contain more than 50% of the allowable sign area, unless approved as a Type 2 decision" (19.32.140 C, 4). According to Table 1, the maximum sign area for the western face of the building located at 116 Andover Park East is 91.76 square feet. Since this sign area must be shared by multiple tenants, the maximum sign area for any one wall sign is limited to 50% of 91.76 square feet, which is 45.88 square feet. At 70.35 square feet, the existing wall sign for Pitney Bowes is too large according to a Type 1 decision. In order to fulfill the Permit Conditions issued for permanent sign application S06-045 (ZZ Printing), which stated that "no new signage may be installed on the western face of the building located at 116 Andover Park East".... "until the Pitney Bowes sign is removed or reduced in size", Pitney Bowes removed their existing sign. The original estimates for wall and sign dimensions provided over the phone by Berry Neon were used as the basis for a letter written to ZZ Printing and the building's landlord, dated August 18, 2006. This letter stated that the Pitney Bowes sign, "at 72 square feet"..."is over the maximum allowable area, even with approval of a Type 2 Decision." The larger wall dimensions subsequently submitted with the sign application for ZZ Printing on August 29, 2006, as well as the smaller sign dimensions submitted as part of this application on October 25, 2006, suggest that the existing Pitney Bowes sign may fall within the 50% limit upon approval of an increase in sign area for the western face of the building as part as a Type 2 decision. According to TMC 19.32.140 (A), sign area may be increased 50% for each doubling of the required minimum setback up to a maximum of 500 SF or 6% of the total EBF, whichever is less (TMC 19.32.150). The setback requirement in the TUC zone in which this building is located is 15 feet. The total setback from the property lines of the western wall face is 55 feet; a total of over three times the distance of the required setback. The area of the exposed building face on the western side of the building is a total of 2,392.5 square feet. According to the provisions of TMC 19.32.140, 6% of the total EBF (2,392.5 square feet) is 143.55 square feet. With approval of a Type 2 decision, the maximum allowable area for any sign on the western face of the building located at 116 Andover Park East is equal to 50% of 143.55 square feet, or 71.77 square feet. According to the criteria above, the sign as proposed at 70.35 square feet may be allowed as a Type 2 special permission for the following reasons: (1) the building is set back from the property lines an amount that is more than double the amount required for the TUC zone; and (2) The proposed sign area, at 70.35 square feet, makes up 49% of the allowable sign area, and therefore the sign area of the proposed Pitney Bowes sign falls within the 50% limit for any one sign for the western face of the building with a Type 2 special permission decision. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for a request for a special permission sign does comply with applicable City and state code requirements and has approved that application. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Planning Commission decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is by November 23, 2006. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Planning Commission based on the testimony and documentary evidence presented at the open record hearing. The Planning Commission decision on the appeal is the City's final decision. Any party wishing to challenge the Planning Commission decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Planning Commission decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. This building currently has one 72 square foot sign for Pitney Bowes on the western building face. Up until, recently Pitney Bowes was the sole occupant needing a sign on the western face of the building. However, it is my understanding that there will be at least one additional tenant (ZZ Business Print Design), for this building that will require signs on the building's western face. According to Tukwila's Sign Code, section 1932.140.C.4, the size of the Pitney Bowes sign takes up over 50% -of the total allowable sign. area for the building's western face with either a Type 1 ox a Type 2 Decision, meaning that before any additional signs are installed, the current sign area of the Pitney Bowes sign must be reduced or replaced with a smaller sign. The allowable sign area for any of the walls of the building at 116 Andover Park East is a function of the total wall area on which the sign will be placed. The estimated area of the exposed building face on the westem side of.fihis building is 2280 square fect. For this estimated wall area, the maximum allowable area for all signage on the western face of the building located at 116 Andover Park East, according to Table 1 of Tukwila's Sign Code (TMC 19.32.140, Section B), is 88.4 square feet. The ourrent sign for Pitney Bowes, at 72 square feet, fits within, the allowable sign area with only one sign on the building. However, when there are multiple tenants within a building that require signs on this wall face, the tenants of which shale a common public entrance, "No one sign shall contain more than 50% of the allowable sign area, unless approved as a Type 2 decision" (TMC 19.32.140, section C, number 4). REAL ESTATE PAGE 09/09 • • Tukwila's sign code alloWs an increase in the allowable sign area for a building upon approval as a Type 2 Decision, According to a Type 2 decision; "the permitted sign areas provided in Table 1 may be increased no more than 50% for each doubling of the requited minimum setback distance for the wall upon which a particular sign is to be placed, but in no case shall sign area exceed" 6% of the area of the exposed building face upon which the sign is to be placed. The building at 116 Andover Park East is set back from the street 55' from the property line, which is over twice the required setback of 15' within the Tukwila Urban Center zone in which the building is located. Approval of an increase in the allowable sign area with a Type 2 Decision would allow a total allowable sign budget for all signs on the westem face of the building equal to 6% of the area of the exposed building face (EBF=2280), which is 136.8 square feet. At 72 Sr, the existing sign is over the maximum allowable.area, even with approval of a Type 2 Decision, at 52% of the total area allowed for all signage on the westem face of this building. Therefore, before any additional signs are installed, the eutxent sign area of the Pitney Bowes sign must be reduced or replaced with a smaller sign. I recommend that all tenants within the blinding at 116 Andover Park East 000rdinate .with one another to determine the area of signage they anticipate they will need, keeping in mind the total sign budget of 88.4 square feet to be shared among all tenants for all signs located on the western -face of the building according to a Type 1 decision, and a total sign budget of 136.8 square feet for all tenants upon approval of a Type 2 decision. Additionally, no individual tenant may use more than 50% of the allowable sign budget.
