DECISION This notice is to confirm the decision reached by the Planning Commission at an open record public hearing on February 22, 2007. The Commission voted to approve the conditional use permit based on the findings and conclusions in the staff report dated February 9, 2007. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 4 decision pursuant to Tukwila Municipal Code 18.104.010. PROCEDURES AND TIME FOR APPEALING Page 2 In order to appeal the Planning Commission decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by March 9, 2007. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee of $205. V. APPEAL HEARINGS PROCESS The City Council hearing regarding the appeal shall be conducted as a closed record hearing before the based on the testimony and documentary evidence presented at the open record hearing conducted by the Planning Commission. The City Council decision on the appeal is the City's final decision. Any party wishing to challenge the City Council decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the City Council decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Nora Gierloff, who may be contacted at 206-431- 3670 for further information. Site Plan 6300 Southcenter Boulevard, Suite #100 0 Tukwila, Washington 98188 0 Phone: 206-431-3670 0 Fax: 206-431-3665 • • FINDINGS BACKGROUND The Group Health building that is the subject of this application was built in 197'7 under King County jurisdiction and annexed into Tukwila in February 1989. The Manufacturing Industrial Center Light (MIC/L) zoning assigned to the area in 1995 did not allow stand alone office buildings, however since the use was already established it became legally non -conforming. Subsequently Ordinance 1954 was adopted allowing offices over 20,000 square feet in the MIC/L with a Conditional Use Permit. This purpose of this application is to convert the existing office use from a non -conforming use to a permitted conditional use. No physical changes to the building or expansion of the use is proposed. VICINITY/SITE INFORMATION A. Project Description. The applicant is requesting Planning Commission approval for a conditional use permit to recognize the existing office use in this Group Health building. No nevi construction or expansion is proposed. B. Existing Development. The site currently contains a 326,800 square foot warehouse/office building, surface parking and a parking garage. C. Surrounding Land Use. Across East Marginal Way to the west are two additional Group Health buildings, a tavern, the Intergate East technology park and a trucking facility. To the east is the Link Light Rail line and SR599. To the north is a Metro Transit facility. To the south is an undeveloped slope. D. Topography. The site is primarily flat but does have some slopes to the south. E. Vegetation. The site has existing landscaping that will not be altered. F. Access. The access to the site would not be changed by this proposal. CONDITIONAL USE PERMIT DECISION CRITERIA The applicant has chosen to pursue a conditional use permit in order to change the existing use to a permitted conditional rather than non -conforming use. In the E:\07CUP_SR.doc - 2 - 8 -Feb -07 • • following discussion, the Conditional Use Permit Review criteria per Section 18.64 of the Zoning Code are shown below in bold, followed by staff's comments. For the applicant's response to the review criteria see Attachment A. 1. The proposed use will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity of the proposed use or in the district in which the subject property is located. No changes to the exterior of the existing building are required as a result of this proposal. The office use is existing and will not be expanded. 2. The proposed use shall meet or exceed the performance standards that are required in the district it will occupy. The development currently complies with the airborne pollutant, noise and hazardous materials performance standards for the MIC/L zone. Other office uses in the City have not had difficulty complying with the City's performance standards. 3. The proposed development shall be compatible generally with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. There are no traffic capacity problems with the current level of office use. The building and site design would not be affected by the change in use. 4. The proposed use shall be in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. At the time the Council approved the ordinance allowing office into the MIC/L Comprehensive Plan designation they determined that the primary negative impact of office uses was increased traffic. In this case no existing deficiencies exist and no traffic mitigation measures are needed. 5. All measures have been taken to minimize the possible adverse impacts which the proposed use may have on the area in which it is located. No public comments were received during the notice period and staff is not aware of any perceived negative impacts of the existing use. During the approval of the two newer Group Health office buildings across East Marginal Way staff worked with the applicant to develop traffic improvements and a traffic monitoring program. This has not revealed any ongoing deficiencies. The proposed change of use will not affect these existing mitigations should not create any additional adverse impacts. E:\07CUP_SR.doc - 3 - 8 -Feb -07 • CONCLUSIONS The proposed recognition of the existing office use should have no impact on the surrounding area because no additional area is being devoted to office use and nc external change will be evident. No additional mitigation measures are required to address the impacts of the proposed office use. RECOMMENDATIONS Staff recommends approval of the conditional use permit. The office uses are conducted inside the building and have no impacts external to the building. Although office uses generate more traffic than light industrial uses, the traffic associated with the proposed office uses is existing traffic, and the surrounding transportation system operates at acceptable levels of service. 2. The office uses will meet or exceed the parking, landscaping, setback, and other development standards that are required in this district. The office uses that are the subject of this conditional use permit are occurring in an existing building that complies with applicable; Tukwila development standards. 3. The office uses will be compatible with the surrounding land uses. The surrounding land uses include office uses and light industrial uses and transportation corridors that are all compatible with the proposed office uses. The facility looks similar to other such facilities in the vicinity. 4. The office uses are consistent with the goals and policies of the Comprehensive Land Use Policy Plan. Office uses are allowed in the MIC/L zone if a conditional use permii is obtained. The office uses contemplated by this conditional use permit all support uses that are permitted in the MIC/L zone. 5. Because the office uses are all conducted indoors, the only possible adverse impact that the proposed use may have on the area in which it is located is the additional traffic associated with office uses. However, as noted above, the office uses are in existence today and have been in existence since before 1995, and the transportation system operates at acceptabke levels of service. 00449230. You provided us with a copy of a Certificate of Occupancy dated June 7, 1991 for work carried out under building permit #6278. This appears to be the first substantive building permit issued by the City for this property after its annexation in late 1989. When the property was annexed, it was zoned C-2. Office was not a stated permitted use in the C-2 district, however, the zoning code at the time was a "cascading" zoning code - i.e. uses permitted in previous chapters were permitted in the next higher chapter. Office use was an outright permitted use in the next lower zoning district, C-1, which in turn permitted office use in the C-2 district. Building permit #6278 was issued to add 14,976.5 sq. ft. of office space and 206.5 sq. ft. of mechanical space to the existing 256,054 sq. ft. building (Drawing A 0.0) for a total building square footage of 270,937. Drawing A2.IA breaks down the square footage on each floor and indicates that at the time of the building permit application, 149,683 sq. ft. of office space was located in the building: I am enclosing a copy of several of the building permit drawings for your files. At the meeting we also discussed building permit D01-384. Group Health applied for this permit December 11, 2001 to convert 11,519 sq. ft. of computer room space to additional office space. At the time of this permit, we did not try to quantify the amount of existing office square footage in the building. Rather, when this permit was issued, the applicant was told that the requirements of Ordinance 1954 applied, which limits the amount of space in the Manufacturing Industrial Center, Light that can be converted to office space to 20,000 sq. ft. before a conditional use permit would be required. Staff pulled the drawings for D01-384 and I have attached copies of Sheets AC, A1.1 and A2.4. Sheet AC contains a parking and occupancy analysis for the building. This analysis contains a different square footage total for the entire building as well as a different distribution of uses in the building when compared to the square footages noted on drawings for permit #6278. You also asked me to address nonconforming uses and structures in this letter. I am enclosing a copy of TMC 18.70, the chapter of the zoning code that addresses nonconforming lots, structures and uses. TMC 18.70.040 discusses nonconforming uses and TMC 18.70.050 addresses nonconforming structures. If a nonconforming use ceases for any reason for a period of more than six consecutive months or a total of 365 days in a three year time period, whichever occurs first, any subsequent use must conform to the permitted uses in the district within which the property is located. If a nonconforming structure is destroyed to an extent of more than 50% of its replacement cost, as determined by the City's building official, then the structure can only be rebuilt in conformity with the standards in the zoning district within which the property is located. Although office uses generate mote traffic than light industrial uses, the traffic associated with the proposed office uses is existing traffic, and the surrounding transportation system operates at acceptable levels of service. 2. The office uses that are the subject o this conditional use permit are occurring in an existing building that complies with applicable, Tukwila development standards. 3. The office uses will be compatible with the surrounding land uses. The surrounding land uses include office uses and light industrial uses and transportation corridors that are all compatible with the proposed office uses. The facility looks similar to other such facilities in the vicinity. 4. The office uses are consistent with the goals and policies of the Comprehensive Land Use Policy Plan.
