DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that the project, as proposed, does not create a probable significant environmental impact and issued a Determination of Non -Significance (DNS), or Decision on Substantive Permit: The Community Development Director has determined that the application for a TYPE II WIRELESS COMMUNICATIONS PERMIT does comply with applicable City and state code requirements and has approved that application, subject to any conditions which are set forth in the Decision based on the findings and conclusions contained in the staff report dated March 1, 2007. The following conditions have been placed on this project: 1. Prior to final approval of the wireless facility all wireless providers who locate on the replaced utility pole shall have a valid City of Tukwila business license. 2. The City shall not grant final approval of the new utility pole co -location until the existing utility pole is removed from the site. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code §18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by March 16, 2007. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee $105. V. Property owners affected by this decision may request a change in valuation for their property tax purposes. Radio Frequency Engineer Site Analysis Staff Report to the Planning Commission L05-045 NEXTEL at 44th Ave S Page 2 of 7 FINDINGS Vicinity/Site Information Project Description The applicant is requesting approval of a type II Wireless Facilities Permit to install a wireless communication facility on a replaced City Light utility pole. The applicant proposes to remove the existing 34 foot City Light utility pole and replace the pole with a 44 foot wood laminate pole. The wireless communication antennas will be flush mounted to the top of the wood laminate pole. The applicant will utilize a 176 square foot equipment compound for the placement of the associated ground equipment. The coaxial cables which will connect the ground equipment to the antennas will be concealed by located the cables underground and within the new laminate pole. Existing Development The applicant will be placing the WCF on property that is owned by City Light. This is not considered "right of way", since City Light has fee simple ownership of the property. Besides the existing utility pole on the site, the site is vacant and is dominated by weeds and invasive vegetation. Surrounding Land Uses The property is zoned LDR and there are two single family homes adjacent to the project site. The project site is bordered by the City Light Transmission right of way to the south. The site is bordered to the west by Beacon Ave S and to the east by 51 S` Ave S. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.71) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The applicant has chosen to install the WCF on a replaced utility pole, which is in the City's third tier on the matrix found in TMC 18.71.060. The applicant determined that it was not possible to locate the proposed WCF on the existing transmission tower that is located directly south of the proposed WCF location. This tower is maxed out and adding additional facilities on the tower would be difficult (See Applicants H:\Wireless Permits\Type 11\Type II staff report.doc Staff Report to the Director, L06-087 T -Mobile, Beacon and Bangor Page 3 of 7 Response p. 4). There are no existing WCF towers within the area that the applicant could utilize for co -location. Thus, the applicant has used the City's preferred option after investigating and exhausting the two favored methods of providing wireless service. Design Standards The City provides specific design standards for the placement of WCF within the City of Tukwila. The table below indicates if the applicant's proposal complies with required standards. Table 1 Specific Design Project Project Not Applicable Notes: Standards does comply does not comply 1. Ground equipment will be screened by using a six foot tall cedar fence. 7. Antennas shall have the same color scheme as the structure they are located on. V The antennas will be painted to match the new utility pole. 8. WCF poles and towers shall only have safety lights if required by a government agency. V No lighting is proposed. 9. No advertising is permitted on WCF V 10. Each service provider shall be limited to an equipment enclosure of 360 square feet. V The applicant is proposing an enclosure space of 176 square feet. 1 l . In residential zones, the height of the replaced utility pole is limited to 10 above the replaced pole and no taller than 50. V The existing pole is 33 feet and the applicant will install a new pole which will have a height of 43 feet. 12. The replaced utility pole must be used by the owner of the utility pole to support their utility lines. The replaced utility pole must have the color and general appearance of the adjacent utility pole. V The applicant will utilize a wood laminate pole which will be painted to match the other utility poles in the area. 14. Coax cables greater than one- half inch in diameter must be within the utility pole. V 15. The proposal shall not result in a significant change in the pedestrian environment or preclude the City from making pedestrian improvements. V 16. All cabinet equipment must be placed outside of the City ROW, unless and exception is granted. V 17. The WCF shall meet setbacks for the zone it is located within, unless an exception is granted. The applicant has requested an exception to the setback requirements, see narrative below. Setback Exception Request The applicant has requested to have exceptions on the required setbacks along Beacon Ave South and the north property line. Typically, the applicant would have to maintain a ten foot setback from Beacon Ave South and five foot setback from the north property line. The applicant is requesting to have a zero setback along Beacon Ave S and the north property line. Staff requested that the applicant consider alternative designs in order to allow the facility to meet H:\Wireless Permits\Type II\Type II staff report.doc Staff Report to the Director, L06-087 T -Mobile, Beacon and Bangor Page 6 of 7 setbacks along the north property line, which is bordered by a residential use. The design of this facility is limited due to the presence of both overhead and underground utilities. The design layout presented by the applicant is in response to those limitations. The applicant has proposed to replace the existing fence which will separate the residential property from the equipment enclosure. Allowing the setback waiver along Beacon Ave South would have minimal impact. Beacon Ave S is not improved right of way. The traffic on Beacon Ave South is minimal and the traffic is limited to a small drive path which is approximately 30 feet from the equipment enclosure. CONCLUSIONS 1. The proposal to install antennas on a replaced City Light Utility pole will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. Potentially dangerous cabinet equipment will be fenced and secured with an equipment enclosure. 2. As demonstrated in Table 1 the project meets all applicable development standards with the exception of setbacks. 3. Given the constraints posed by utilities within this area of the City and the irregular shape of the parcel, the granting of the setback waiver along Beacon Ave South and the north property line are warranted. The construction of a new fence along the north property line is sufficient mitigation of the setback encroachment. 4. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The traffic generated from the facility will be minimal and will not have an impact on surrounding properties. 5. No noise will be generated from the new antennas or ground equipment associated with this application. 6. The wireless communications facility has been designed in a way to minimize any visual impact from the project. 7. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. To meet customer demand, T -Mobile is constantly improving its coverage areas and expanding its network capacity to handle the growing number of customer calls and data transmissions. We are expanding services to our customers from where they have historically used mobile phones — while traveling and at their offices — to their homes where they are demanding more and more services. Wireless phones are also integral to public safety. Each day there are more than 200,000 wireless 9-1-1 calls and that number grows daily as more people use their wireless phones to call for emergency help, to save lives and to help fight crime. In the Seattle Area about 25% of emergency services calls originate from mobile phones. This proposal is designed to fill a coverage gap for T -Mobile's network and to enhance services in the northern part of the City of Tukwila. This application, along with several supporting documents, is being submitted for approval of an administrative use permit (AUP) for construction of a proposed wireless communication facility (WCF) adjacent to 10405 51st Ave South, Tukwila. The Tukwila Municipal Code (TMC) section 18.71 has been recently adopted, and provides specific standards relative to the development of wireless communication facilities (WCF). In accordance with TMC 18.71, development of a WCF on a replacement utility pole is allowed with approval of an Administrative Use Permit in all zoning districts. The top of the antennas will be flush with the top of the pole adjacent to 10405 515t Ave S in the City of Tukwila. The base transmitting system (BTS) equipment will be located within a fenced area on a vacant parcel under the ownership of Seattle City Light. The proposed site is within an area in the northeastern -most portion of the City of Tukwila. The small irregularly shaped parcel, which is under fee simple ownership of Seattle City Light, is adjoined on the east by the right of way of 51st Ave. South and the City limits of Seattle. It is adjoined on the west by a 66 -foot wide right of way under the ownership of the City of Seattle Public Utilities (SPU). This area is designated as Beacon Ave. South, but the right of way is unpaved, and three major water transmission lines for SPU are within it. The area to the south of the subject tract is developed with electric transmission lines under the ownership of SCL. The easement area immediately south is developed with electrical transmission lines and associated wood support structures associated with an SCL main feeder line that runs east -west to the substation across 51st Ave. The area further south is developed with large steel lattice support structures and SCL electric transmission lines that run in a southwesterly direction. One of the steel lattice support structures under the ownership of SCL is currently developed with Cingular wireless antennas on the northwest leg of the structure. Ground based equipment for the Cingular facility is located between the northeast and northwest legs of the lattice tower. A ClearWire Wi-Max wireless internet antenna facility is also proposed to be located on this SCL lattice structure. It is not possible for T -Mobile to locate on this structure for a couple of reasons. The only legs available for mounting T -Mobile antennas are the two east legs of the tower. However, there is another overhead power distribution line located approximately 14 feet east of the transmission tower. This distribution line runs in a northwest/southeast direction under the transmission lines on the subject structure. As a result, there is only 14-15 feet of working clearance between the easterly legs of the transmission tower. This does not provide safe working clearance for the placement of T -Mobile antennas. In addition, there is no additional room for placement of T -Mobile's ground based equipment under the base of the existing transmission tower. Nor is it possible to place T - Mobile's ground based equipment in the area east of the tower, as the SPU water Administrative Use Permit Application T -Mobile Site SE3556 Beacon & Bangor Page 2 of 12 transmission easement is just 10 feet east of the east legs of the structure—which is an inadequate clearance for placement of the equipment. Hierarchy of WCF Development Locations Within the new code for location of wireless facilities, the City of Tukwila has established a hierarchy of appropriate locations, which generally favors collocation of antennas on existing buildings or structures over the development of new WCF support structures. This hierarchy is established at TMC 18.71.060, and is included below. 18.71.060 Types of Permits/Priority/Restrictions. 1. Applications will be reviewed based on the type of wireless communication facilities requested to be permitted. Administrative Use Permit Application T -Mobile Site SE3556 Beacon & Bangor Page 3 of 12 In the event of uncertainty on the style of a wireless facility, the Director shall have the authority to determine how a proposed facility is incorporated into the matrix. 2. The priorities for the type of wireless communication facility shall be based upon the above matrix. Any application for a wireless communication facility must work down from the above matrix. For example an applicant must demonstrate by engineering evidence that using a transmission tower collocation is not possible before moving to a utility pole collocation and so forth with the last possible siting option being a new tower or waiver request. Response: The subject site is located within a utility corridor that is developed with a variety of overhead and underground utilities. These include electric transmission lines owned and operated by Seattle City Light, electric distribution lines (that run under the transmission lines) and water transmission lines owned and operated by Seattle Public Utilities. The first priority site listed in TMC 18.71.060 (2) a utility transmission tower, is located approximately 140 feet south of the proposed T -Mobile location. As noted above, the existing SCL transmission tower in this area is currently developed with Cingular antennas on the southwest leg of the tower. While SCL has indicated that an additional wireless carrier could potentially be added to this tower, it is not possible to place T -Mobile's antennas on the easterly legs of the tower due to ground space limitations due to the utility lines above these locations, and limited ground space. Three SCL transmission poles are within the utility corridor just south of the subject site. These wood transmission poles are not available for use as collocation sites for WCFs because they are major feed lines to the substation to the east of the subject site and can not be replaced due to the critical nature of the electricity supplied to the substation. (Non -emergency outages are not scheduled for these lines due to their critical nature). In addition, there is a utility vault near the central portion of this H -frame that limits the placement of T -Mobile's ground based equipment. The above -noted constraints are illustrated on Exhibit 1, which shows the various utilities and easements that are in this area. As demonstrated on this exhibit, the proposed site is the only possible location due to the spatial constraints of the transmission towers in the area. A color coded map illustrating the utility corridors and facilities follows as Exhibit 1. 3. The City's preference for locating new wireless communications facilities are as follows: a. Place antennas on existing structures, such as buildings, towers, water towers, or electrical transmission towers. b. Place wireless communication facilities in non -residentially zoned districts and non-residential property. c. Place antennas and towers on public property and on appropriate rights of ways if practical; provided that, no obligation is created Administrative Use Permit Application T -Mobile Site SE3556 Beacon & Bangor Page 4of12 herein for the City to allow the use of city property or public right of way for this purpose. Response According to the siting criteria specified in TMC 18.71.060.(3), T -Mobile's proposal conforms with the first in the list of City preferences, as the proposed antennas will be placed on a replacement utility service pole. 4. City Property/Public Rights of Way. The placement of personal wireless communication facilities on City -owned property and public rights of way will be subject to other applicable sections of the Tukwila Municipal Code and review by other Departments (i.e, Public Works and Parks and Recreation). Response: As noted above, the proposed antennas will be placed on a replacement utility service pole, which will be relocated slightly so that it is not located on City or SPU right-of- way. The replacement pole will be placed on a tract owned by Seattle City Light. Therefore, the regulations applicable to public rights of way do not apply. 5. Wireless communication facilities shall not be permitted on property designated as landmark or as part of a historic district. Response: The subject site is not within a designated landmark or part of an historic district, and thus conforms with the regulation. 6. Applicants shall submit all of the information required pursuant to Section 18.104.060 TMC and the following: a. Type I. I. A completed application form provided by the Department of Community Development. II. Four sets of plans prepared by a design professional. The plans shall include a vicinity map, site map, architectural elevations, method of attachment, proposed screening, location of proposed antennas, and all other information which accurately depicts the proposed project. Minimum size is 8.5 by 11. Plans shall be no greater than 24" x 36" III. A letter from the applicant outlining the proposed project and an evaluation from the applicant with regard to the City's code requirements. IV. If an outdoor generator is proposed, a report prepared by an acoustical engineer demonstrating compliance with Chapter 8.22 TMC "Noise". VI. SEPA Application with mailing labels. (If Required). b. Type II. Applicant shall submit all information required for a type I application and the following: I. Four sets of photo simulations that depict the existing and proposed view of the proposed facility. II. Materials board for the screening material. III. Landscaping plan. IV. Letter from a licensed Radio Frequency Engineer that demonstrates that the facility meets Federal requirements for allowed emissions. V. If the facility is located within a residential zone a report from an RF Engineer explaining the need for the proposed wireless communication facility. Additionally the applicant shall provided detailed discussion on why the wireless communication facility cannot be located within a commercial or industrial zone. VI. If landscaping is proposed, four sets of a landscaping plan prepared by a Washington State licensed landscaping architect. Response: With a couple of exceptions, all of the items required for submittal of a type II application are included in the submitted application materials. The items that have not been included with this submittal are listed below. • Sensitive Area Studies—the subject site is not located in an area designated as sensitive by the City of Tukwila, therefore, no sensitive area studies are included. • Report prepared by an acoustical expert—no generator is proposed with this application, so no acoustics information is submitted. • Landscaping plan—a waiver of the landscaping requirement is being requested with this application due to a lack of water for irrigation purposes in this area. Provisions of TMC 18.71.070 applicable to new towers are not applicable to this request. 18.71.090 General Requirements. The following apply to all wireless communication facilities regardless of type of facility: Administrative Use Permit Application T -Mobile Site SE3556 Beacon & Bangor Page 6 of 12 1. Noise. Any facility that requires a generator or other device, which will create noise, must demonstrate compliance with Chapter 8.22 TMC "Noise". A noise report, prepared by an Acoustical Engineer shall be submitted with any application to construct and operate a wireless communication facility that will have a generator or similar device. The City may require that the report be reviewed by a third party expert at the expense of the applicant. Response: As noted above, the proposed site will rely on backup batteries for emergency power. No generator is proposed at this site and there are no other noise generating activities on the site. 2. Business License Requirement. Any person, corporation, or entity that operates a wireless communication facility within the City shall have a valid business license issued by the City annually. Any person, corporation, or other business entity which owns a tower also is required to obtain a business license on an annual basis. Response: T -Mobile understands and will conform with this requirement. 3. Signage. Only safety signs may be located on wireless communication facilities. No other types of signs are permitted on wireless communication facilities. Response: As shown on submitted plans, only FCC required signage will be placed on the subject site. 4. Parking. Any application must demonstrate that there is sufficient space for temporary parking for regular maintenance of the proposed facility. Response: As shown on submitted plans, one off street parking space is being provided on the site. 5. Towers shall either maintain a galvanized steel fmish or, subject to any applicable standards of the FAA or FCC, be painted a neutral color, so as to reduce its visual obtrusiveness. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. Response: The surrounding area is developed with above ground appurtenances within a utility corridor. With the development of the proposed site, invasive plants are being removed and replaced with a fenced equipment area and a wood laminate utility pole. The utility pole will blend in with the other utility poles in the area, and the equipment cabinets will be screened with a six foot cedar fence, which will be a significant improvement to the fencing in the surrounding area. 7. All antennas and ancillary facilities located on buildings or structures other than towers shall be of a neutral color that is identical to or closely compatible with the color of the supporting structure so as to make the antenna and ancillary facilities as visually unobtrusive as possible. Response: As noted on submitted plans, antennas on the proposed replacement pole will be painted brown to match the color of the pole, and mounted close to the pole in order to make the antennas as visually unobtrusive as possible. 8. Towers shall not be artificially lighted unless required by the FAA, FCC, or other applicable authority. If lighting is required, the Planning Commission shall review the lighting alternatives and approve the design that would cause the least disturbance to the surrounding areas. No strobe lighting of any type is permitted on any tower. Response: Lighting is not required by the FAA for the proposed facility. 9. No advertising is permitted at wireless communication facility sites or on any ancillary structure or facilities equipment compound. Response: No advertising is proposed on the subject structure, in accordance with the regulation. 10. Equipment Enclosure: Each service provider shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential, or institutional building. Standards related to transmission tower collocation encompassed in TMC 18.71.100 are not applicable to this request. Standards related to collocation on existing WCF towers encompassed in TMC 18.71.110 are not applicable to this request. Standards related to Concealed Building Mounted antennas collocation encompassed in TMC 18.71.120 are not applicable to this request. Standards related to Non -Concealed Building Mounted antennas collocation encompassed in TMC 18.71.130 are not applicable to this request. The following describes the proposed facility's conformity with TMC 18.71.140, Utility Pole Collocation: 1. Height: The height of a utility pole collocation is limited to ten feet above the replaced utility pole and may not be greater than 50 feet in height in residential zones. Response: The existing pole is 33 feet one inch in height; the replacement pole will be 43' in height, in accordance with the regulation. 2. The replaced utility pole must be used by the owner of the utility pole to support their utility lines. Response: As the utility pole is owned and operated by Seattle City Light, its primary use is to provide service to their customers. T -Mobile's proposal to install antennas on the pole is secondary to Seattle City Light's use. Please also refer to the attached email and letter from June Jacobsen, Wireless Communications Program Manager with Seattle City Light confirming that the Seattle City Light owns the subject pole and that electrical distribution is the primary use of the pole, in accordance with the regulation. Response: In accordance with the regulation, the proposed pole material is wood laminate, (trade name "Gluelam"), which is fabricated of wood strips and adhesive. While the replacement pole will be somewhat bulkier than surrounding electric distribution poles, the additional width is necessary for conforming with the regulation relative to hiding coaxial cables (as listed in 4 below) 4. Coax cables limited to one-half inch in diameter may be attached directly to a utility pole. Coax cables greater than one-half inch must be placed within the utility pole. Response: As shown on submitted plans, the coaxial cables proposed for the subject site are 7/8" in diameter, and thus must be hidden inside the pole. The coax lines will be located within a routed cable chase capped with a wood shroud. This will hide the coax from public view in conformity with the City's regulation. 5. The proposal shall not result in a significant change in the pedestrian environment or preclude the City from making pedestrian improvements. If a utility pole is being replaced, consideration must be made to improve the pedestrian environment if necessary. Response: Replacing the existing utility pole with a taller pole to support the antennas will not affect the pedestrian environment, other than during the construction phase. The replacement utility pole will actually be moved out of the SPU right of way and on to a privately owned utility property which will increase the pedestrian access in the immediate area. 6. Cabinet equipment: All cabinet equipment and the equipment enclosure must be placed outside of the City right of way. Response: The associated cabinet equipment will be located on the adjacent vacant property belonging to Seattle City Light. Setbacks: Any portion of the wireless communication facilities located within City right of way does not have to meet setbacks. The City will evaluate setbacks on private property under the criteria in 18.71.175. Response: Because the subject site has frontage on two separate rights of way (51st Ave East and Beacon Ave.), the setbacks would be 20 feet for one frontage, 10 feet for the other frontage, and five feet on the side. However, the proposed equipment location is a vacant, irregularly shaped Seattle City Light property that is surrounded by utility corridors on two sides (the west and the south). The property dimensions are approximately 30' wide at the north line; 20 feet wide at the south line, and 79 feet in length, running north -south. In addition, the proposed replacement pole is being relocated out of the existing Beacon Ave. right of way at the specific request of SPU in order to provide adequate clearance between the proposed pole replacement and existing major water transmission lines within the Beacon Ave. right of way. Because of the proposed location's irregular shape, and the necessity to maintain adequate separation between the pole and water facilities, T -Mobile requests a waiver to allow a reduction of the front setback on the east frontage (facing 50 Ave. S) from 20 feet to 14 feet. A reduction of the west front setback from 10 feet to 0 feet is also being requested, and a side setback reduction to 0 feet on the north side is also being requested. By placing the equipment at this location on the subject parcel, T -Mobile's fence can achieve the maximum setback from 51st Ave. South, a major arterial. This location is also necessary for maintaining clearances from other above ground utilities within the utility corridors in the area . south of the subject tract, thus allowing the least visually intrusive facility to be developed in the subject area. TMC Sections 18.71.190 and 18.71.200 address issues related to expiration of permit applications and removal of abandoned facilities. T -Mobile understands and accepts responsibility for constructing and managing the site in accordance with the applicable provisions. With this submittal, T -Mobile West Corp. has demonstrated that the site will meet the spirit and intent of relevant portions of TMC Section 18.71 relative to development of a wireless communication facility on a replacement utility pole as defined by the ordinance. The subject site meets all applicable provisions related to the facility's height and appearance. A waiver of the front setbacks and one of the side setbacks is requested based on the irregular shape of the subject property and the site's location within a corridor dominated by numerous utility structures that must be avoided. The proposed facility will provide improved service to homes and businesses in the vicinity, and more importantly, improved triangulation for the provision of Wireless E911 emergency services. There are typically three reasons to add a new facility: extending coverage to new areas, increasing the capacity of the system within the current service area, or improving quality. Some sites do all three. Coverage: Coverage can be defined as having a certain level of signal strength in a particular area. T -Mobile's target is to provide —76dBm of signal strength to our customers in all areas. This level of coverage guarantees reliable signal strength inside buildings to provide excellent voice quality in residential neighborhoods and commercial areas. In today's competitive marketplace, T -Mobile requires adequate coverage to be competitive and to fulfill our responsibilities under our FCC license. Existing and proposed coverage is demonstrated by use of propagation maps. The propagation maps are computer simulations of wireless signal coverage in a given area. One map shows the predicted coverage as it exists without the proposed facility. The other map shows the predicted coverage that would be obtained at the subject site. Capacity: Capacity is the number of calls that can be handled by a particular antenna site. When we make phone calls, our mobile phones communicate with a nearby antenna site that then connects to land based phone lines or other wireless phones. Ongoing phone calls occupy the resources of the serving site, which can handle only a limited number of calls. When a particular antenna site is handling a sufficient number of calls the available RF channels assigned to that site are used up. The call traffic of antenna sites is continuously monitored and analyzed so that overloading of sites is prevented. Careful projection allows sufficient lead time to design, permit, and construct the wireless facility prior to exceeding the capacity of surrounding sites. Capacity cell sites are typically required in areas that currently have insufficient coverage. The objective for a capacity site is to handle increased call volume rather than increase a coverage area. Interference: In areas with good coverage, phone calls may still have poor quality that the caller hears as warbled voices or temporary loss of communication. This is often caused by interference. Wireless telephone systems reuse specific radio frequencies at different cell antenna locations. When frequencies are reused at nearby sites, interference may result. Engineers work to achieve the most efficient use of limited frequency resources and reduce interference. Unfortunately, there are still areas where interference is nearly unavoidable. This typically occurs in areas where one antenna site is having trouble handing off calls to another. On a freeway or busy roadway, for example, the network juggles a call between competing antenna sites, seeking to find the best one. When this occurs, the solution is often to locate a new antenna site as close to the location where the bad handoff is occurring. Interference is documented by measuring received call quality (RxQual) during a drive test similar to that performed to measure coverage. RxQual is a measurement of the bit errors on the radio link as the result of interference between adjacent cell sites using the same radio frequencies. Site Selection Process for this Location For this project, a coverage gap was shown to exist in the vicinity of Beacon Ave. South between approximately S. Avon Street and S. 107th Street And between 51st Ave. S. and 59th Ave. S. This determination was made based on the following data: Prelimary design analysis/propagation — Attachments lA and 1B. Data regarding the terrain within the service area is entered into a computer modeling program along with a series of variables, such as proposed antenna height, available radio frequencies and wireless equipment characteristics. From this information, T -Mobile's RF Engineers determined an area for the optimum location and height of the Wireless Communication Facility (WCF) antenna to maximize the coverage objective. Mobile.® USA 19807 North Creek Parkway North Bothell, WA98012 The specific location and design of the proposed site has been selected to maximize coverage while conforming with the antenna height requirement of the City of Tukwila. The required antenna height is the minimum acceptable to provide the needed coverage with respect to coverage provided by neighboring cell sites. Lower antenna height will result in reduced effectiveness, including possible invalidation of the candidate. In some cases, an increased antenna height is possible which can allow some greater flexibility in location placement. However, too much antenna height is unacceptable as it creates interference conditions that degrade performance of one or more other existing cell sites in the T -Mobile network. When this technical analysis was completed, a search area map and other requirements were provided to T -Mobile's real estate and zoning specialists. With this information in hand, T - Mobile ranked potential sites. Whenever feasible, T -Mobile strives to acquire property that is properly zoned and adjacent to compatible land uses. T -Mobile attempts to select a location that minimizes or limits any negative visual impacts on adjacent or nearby residential areas to the greatest extent possible. Sites adjacent to existing tall power lines, antenna facilities, water treatment facilities, and on the tops of buildings are selected when they meet the other technical requirements of the system. To the maximum extent possible, new freestanding towers are avoided, as are locations adjacent to schools, preschools and view corridors or where demolition is required that would be detrimental to the existing character of the neighborhood. Rooftop and utility pole applications are favored where the design can be screened or incorporated into the existing structure and mechanical equipment can be placed out of view. Sites where zoning ordinances prohibit the location, insufficient room for mechanical equipment is available, required setbacks cannot be achieved or landowners are not interested in leasing property are eliminated from consideration. The subject area is within a major utility corridor (water and electric transmission lines)and surrounded by residential development, with some nonconforming commercial development to the north, at the intersection of Beacon Ave. South and S. 107th Street. Predicted Coverage for this Location Propagation Studies Two coverage plots, known as "propagation maps" and labeled Attachments 1A and 1B, are attached to this analysis. Attachment lA demonstrates the predicted level of existing service. Attachment 1B demonstrates the service that will be provided by the new location at a height of 40 feet, 9 inches (antenna center line). A lower height will not provide coverage or operate effectively because of the undulating nature of the terrain. The colors on the map indicate the different levels of coverage. The legend of the prediction plot shows several different classes of "best servers". The various colors of the plot indicate where a T -Mobile handset can be reliably used to make and receive telephone calls in the presence of varying received signal strength. The terrain, foliage, nearby structures, and WCF location are taken into account. The further away the mobile user is from the WCF and with additional / abundant local clutter (trees, buildings, etc.) between the WCF and the mobile user, the weaker the received signal strength will be. White: No coverage or unreliable coverage The various parameters of the RF prediction model include terrain and clutter and are modified to more accurately reflect the actual terrain and topography of the specific location on the radio coverage predictions. Other factors, not represented on the plot, include the ability of the site to handle the required call capacity or volume of calls and to provide the extent of data and other services required by T - Mobile customers. This site has been designed to provide coverage consistent with these factors. Finally, T -Mobile RF Engineers have determined that this height and location is necessary for the effective functioning of the minor communication utility. Enhanced 911 (E911) Requirements In addition to providing improved service to T -Mobile customers, the proposed antenna location is needed to meet Federal Communications Commission (FCC) requirements for Enhanced 911 (E911) service. The wireless E911 program is divided into two phases. Phase I requires wireless carriers, upon request from a local Public Safety Answering Point (PSAP), to report the telephone number of a wireless 911 caller and the location of the antenna that received the call. Phase II of the E911 program requires wireless carriers to provide far more precise location information, within 50 to 100 meters in most cases. The FCC established a four-year schedule for Phase if It began on October 1, 2001 and was to be substantially completed by December 31, 2005. Provision of E911 service in accordance with FCC requirements is a major component of the demand for additional cell sites. In addition to providing greater signal strength for in -building coverage that will provide better service to residential customers in the area, the proposed WCF will provide more precise triangulation for providing E911 service as required by the FCC. This will allow a person who is using E911 because of an emergency to be found more quickly because their location will be more easily determined as this and other antenna sites are added to the wireless network. Conclusion T -Mobile Engineers have carefully designed this site to maximize quality of service to our customers, which can best be accomplished at a height of 40 feet, 9 inches (antenna center line). All cell antenna sites are radio frequency (RF) transmission towers operating at different frequencies. Each wireless carrier is assigned a very limited amount of frequency, which is divided into certain number of RF channels. RF Channels are assigned to each of the cell sites for communication with our handheld wireless phones. Since the number of channels is very limited, they have to be reused at different cell sites. The problem with reusing RF channels is the potential for interference. When a cell site is using the same RF channel as another cell site nearby this can cause interference. Sometimes when you use a cell phone you may hear a metallic sound or wobbling. This is probably caused by interference. In order to minimize the interference from one site to another site that are using the same RF channel, all cell sites transmit at very low power level. The output of the wireless antenna sites is typically about 20 Watts. The RF emissions from a wireless antenna site are very minimal compared to the output power of other RF equipment. For example, TV antenna towers power output is in excess of 1000 Watts. Due to the low-level power output of wireless antennas, each cell site covers only a very limited area. In order to provide consistent, homogenous, quality wireless service, cell antenna sites is normally less than one mile apart. The exact distance required between cell antenna sites is determined by terrain, blockage from structures, call volume and antenna height. How does a wireless antenna work and what is its function? Wireless antennas send and receive radio signals. The RF carries the phone call to or from a wireless base station antenna that then connects your phone with the phone you are calling or with the phone calling you. Engineers carefully design each antenna to make sure it sends signals in precisely the right direction and at the right power level to provide the best calling quality to its coverage zone or "cell area." It is important to note the difference between antennas, towers and base stations. Cells, or coverage areas, come in all sizes — they may be as small as a single building (like an airport or an arena), as large as a rural area of 20 miles across, or any size in between — and each cell has its own base station. When you place a wireless call, your phone uses low-power radio signals to send your voice to an antenna at a base station. The base station sends your call to a switching center where it is connected to the landline phone network and delivered to the phone you called. When you approach the boundary of one cell while using your wireless phone, the wireless network senses that the signal is becoming weak and automatically hands off the call to a base station in the next cell and your call continues uninterrupted. An antenna distributes radio waves throughout its cell much like a lamp distributes light throughout a room. A light bulb can provide light evenly throughout a room if it's located in the right place. In the same way, a properly located antenna can provide high- quality calling throughout its cell. That's why they're usually found above the ground on towers, poles, and buildings. Apart from improving service to T -Mobile's existing customer base, T -Mobile has experienced phenomenal growth in the last few years, with an average national customer growth rate of almost 40% per year. Tukwila has two design review processes, one for projects that require a public hearing before the Board of Architectural Review and one for smaller projects that are approved administratively by the DCD Director. This application packet is for administrative design review. REQUIREMENTS: Administrative approval is required for the following types of development: A. New Development or Redevelopment beyond the Existing Exterior Walls 1. Multi -family or hotel/motel building additions up to 1,500 s.f.. 2. All commercial and industrial development in various zones, when up to a certain size as follows: • MUO, 0 and RCM zoned buildings between 1,500 and 5,000 s.f. • In the Tukwila International Boulevard corridor RC zoned structures up to 1,500 s.f., outside of the TIB corridor RC zoned structures between 1,500 and 5,000 s.f. • TUC zoned buildings between 1,500 and 2,500 s.f except those with multi -family units • NCC and RCC zoned developments up to 1.500 s.f. • C/LI and TVS zoned buildings between 1,500 and 10,000 s.f. 3. All development in LI, HI, MIC/L, MIC/H and TVS located within 300' of a residential zone. 4. All development in LI, HI, MIC/L, MIC/H and TVS located within 200 feet of the Green River. B. Exterior Repair, Reconstruction, Cosmetic Alterations or Improvements 1. Any exterior repairs, alterations or improvements, if the cost of that work is between 10 and 25% of the building's assessed value: • in the MUO, 0, RCC, NCC, RC, RCM, TUC and C/LI districts, for sites with more than 10,000 g.s.f. of building area and • all sites in the Tukwila International Boulevard corridor zoned NCC, MUO or RC. 2. Developments with a previous approved design may make minor changes with Department approval. All other changes require new design review. C.Proposed Development Standard Waivers The DCD Director may reduce landscape and building setbacks for Projects in the Tukwila International Boulevard corridor, in the MUO, NCC, and RC zones. PROCEDURES: At the time you submit your application you must have all of the items listed on the attached "Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to your project. Please discuss this waiver request with City staff either at a pre -application meeting or at the time of application submittal. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached checklist. If not complete City staff will mail you a letter outlining what additional information is needed. If you do not submit requested materials within 90 days from the City's request for additional information the City may cancel your application. Staff will meet with you as needed, to help achieve project goals, and formulate a recommendation to the Director. Once all design issues have been resolved we will issue a Notice of Decision. This approval will expire unless construction begins within three years of the decision. Please contact each Department if you feel that certain items are not applicable to your project and should be waived. Application review will not begin until it is determined to be complete. ADDITIONAL MATERIALS MAY BE REQUIRED. The initial application materials allow project review to begin and vest the applicant's rights. However, the City may require additional information as needed to establish consistency with development standards. Mailed notice is not required. PROJECT DESCRIPTION AND ANALYSIS: 8. Concurrency test notices for water, sewer, surface water and traffic unless the project is exempt from SEPA (see SEPA Application Packet). 9. Sewer and water availability letters are required from the provider district if additional plumbing fixtures are proposed and the area is not serviced by the City of Tukwila. Forms are available at the DCD office. 10. A written discussion of project consistency with decision criteria. (See Application) 11. Provide two copies of sensitive area studies such as wetland or geotechnical reports if needed per Tukwila's Sensitive Areas Ordinance (TMC 18.45). See Geotechnical Report Guidelines and Sensitive Area Special Study Guidelines (online at www.ci.tukwila.wa.us/dcd/dcdplan.htm) for additional information. SITE PLAN: 12 (a) The site plan must include a graphic scale, north arrow and project name. Maximum size 24" x 36". (b) Existing and proposed building footprints. LANDSCAPE PLAN: 13 (a) If the landscaping will be altered or the existing landscaping does not meet current standards (TMC 18.52) provide a landscape planting plan by a Washington State licensed landscape architect. One set of all plans and analyses shall have an original Washington State registered Landscape Architect stamp and signature. Plans must include the type, quantity, spacing and location of all plantings. Maximum size 24" x 36". (b) Show all existing trees to be retained and any tree protection measures required (for example fencing at drip line). SENSITIVE AREAS PLAN (If the project will affect any sensitive areas): 14 (a) Location of all sensitive areas (e.g. streams, wetlands, slopes over 20%, coal mine areas and important geological and archaeological sites). For stream frontage provide existing and proposed top of stream bank, stream bank toe, stream mean high water mark, and base flood elevation (i.e., 100 yr. flood). Maximum size 24" x 36". (b) Location of all required sensitive area buffers, setbacks tracts and protection measures. (c) Show all significant trees (4" or more in diameter measured 4.5 feet above grade), indicating those to be retained and those to be removed. A tree permit will be required for removal of any significant trees within a sensitive area or its buffer. (d) Existing and proposed building footprints. CIVIL PLANS (If utility or site work is proposed): 15 (a) One set of all civil plans and analyses shall be stamped, signed and dated by a licensed professional engineer. Include a graphic scale and north arrow. Maximum size 24" x 36". (b) Vertical datum NAVD 1988 and horizontal datum NAD 83/91. Conversion calculations to NGVD 1929, if in a flood zone or flood -prone area. (c) Existing (dashed) andproposed (solid) topography at 2' intervals. (d) Total expected cut and fill. (e) Existing and proposed utility easements and improvements, on site and in street (water, sewer, power, natural gas, telephone, cable).
