The City has completed its review of the above BLA application.
In order to complete the BLA process the City needs the final BLA map. The following items
need to be revised and or included on the final drawing:
1. The original notarized signatures of all individuals who have an ownership interest in the
property need to be on the face of the plat.
2. Include the file number of L06-090 on the plat documents.
3. Include the revised legal descriptions on the plat.
4. The original lot line that will be relocated needs to be shown as a dashed line. The new
lot line needs to be listed as "relocated lot line".
5. Due to the slope issues on the property, the following note needs to be placed on the face
of the plat, "Any proposed structures on either parcel "A" or parcel "B" of this BLA may
be required to have a fire sprinkler system due to access restrictions".
Once you have made the necessary revisions to the plat map please provide four copies, with one
copy containing all original signatures. Please ensure that the plat map meets the size standards
for recording. Do not fold or bend the plat map which will be recorded with the County.

Request for Exception from Minimum Lot Width
Issue
Majestic Homes has submitted a Boundary Line Adjustment (BLA) application to
rearrange the lot configuration of two lots located off of S. 126th Street As part of the
application, the applicant requests that one of the lots be permitted to have an average lot
width of 45 feet.
Background
The BLA application consists of two parcels:
Parcel A is 2.31 acres and is irregularly shaped. Parcel A was surplus WSDOT right of
way for SR 599. WSDOT declared the parcel to be surplus in 1978.
Parcel B is also irregularly shaped and is currently 2,414 square feet. Parcel B is part of
the Squire Re -plat. This re -plat consisted of six lots that are less than the minimum lot
area 6,500 square feet for the LDR zone.
Both Parcel A and Parcel B are bordered by 4151 Ave S which is unimproved City right of
way. 41st Ave South prevents Parcel B from being able to fully extend to parcel A.
The applicant had submitted to build one home on parcel B and had submitted to do a
BLA in order to have sufficient building area (D06-378 and L06-070). However, the
submitted BLA application did not create a lot which met minimum lot area
requirements. Planning noted to the applicant that parcel B must be at least 6,500 square
feet.
The applicant's new proposal is for parcel B to be 6,595 square feet. However, the parcel
will only have an average lot width of 45 feet.

TMC 18.70.030 requires that an applicant comply with all basic development standards
with the exception of minimum dimension standards (lot width). Typically the City
requires that a lot that is part of BLA comply with all design standards for a lot. Yet, the
subdivision Code (Title 17) allows the City to grant exceptions to certain standards when
"undue hardship may be created as a result of strict compliance with the provision of this
code (TMC 17.28.010)".
The City shall consider the following when granting an exception:
1. There are special physical circumstances or conditions effecting said property,
such that the strict application of the provisions of this code would deprive the
applicant of the reasonable use or development of his land; and
Staff's Response:
The applicant's proposed lot configuration is to extend east property line of parcel B
directly north at 90 degrees until parcel B meets minimum lot area. 26.19 feet of the
east property line of parcel B is separated from Parcel A by the presence of a
triangular portion of 41St Ave South. This triangular portion of 41st Ave South
prevents the east property line to be extended 15 feet in order to meet the City's
average lot width requirement within the LDR zone.
2. The exception is necessary to insure such property rights and privileges as are
enjoyed by other properties in the vicinity and under similar circumstances; and
Staff's Response:
TMC 18.70.030 does not allow a lot which is less that the minimum lot area standards
of the applicable zoning from being developed unless that lot is combined with
adjacent lots in order to create a lot which complies with basic development
standards, except for minimum dimension standards (lot width). Without approving
the lot width exception the applicant would not be able to construct a home on the lot
due to the code requirement listed above.
3. The granting of the exception will not be detrimental to the public welfare or
injurious to other property in the vicinity.
Staff's Response:
Any construction on either parcel A or parcel B will require compliance with all
development standards and permitting requirements. The applicant is proposing to
construct one home on parcel B. Single family homes are a permitted use within the
LDR zone. Fire Department has noted that they have some concerns with accessing
the rear of the house due to slopes on the property. Any future structures on parcel B
may be required to have sprinklers installed.

Recommendation
The applicant's proposed BLA will allow parcel B to comply with minimum lot area
requirements. Due to City's right of way and two irregularly shaped lots it is
impossible for parcel B to meet the City's average lot width standards.
