Shawn: I have reviewed the short plat documents and have the following corrections that are needed:
1. Insert the short plat number in the spaces indicated on both pages.
2. the heading is DECLARATION (not Dedication)
3. You are missing some of the language that is required for the Declaration. The Declaration in its entirety should read as
follows:
"Know all men by these present that we, the undersigned, owner(s) in fee simple of the land herein described to hereby
make a short subdivision thereof pursuant to RCW 58.17.060 and acknowledge that said subdivision shall not be further
divided in any manner within a period of five years from the date of record without the filing of a final plat. The
undersigned further declare this short plat to be the graphic representation of said short subdivision and the same is made
with the free consent and in accordance with the desire of the owner(s)."
In witness whereof etc.
4. the word "Acknowledgment" is missing as the heading for the notarization of the owner's signatures that follows the
Declaration above.
5. On Sheet 2, please indicate the location of the parking easement area and add a notes that says "Parking Easement,
Rec# for the benefit of Lots 1 and 2 of SP L06-091." Or language to this effect.
Dave McPherson had one correction to the metes and bounds descriptions that needs to be reflected on two of the
easements. I can't make this notation to the document since they are in PDF format, so I will need to fax it to you. You do
not need to record the easements ahead of when you go to record the short plat - you can record the easements first and
then hand write in on the short plat the recording number prior to recording the short plat.
I am out of the office this morning for a meeting in Seattle - I dont expect to be back until 1:30 or so. If you want to come
pick up the marked up documents, let me know and I will leave them for you in our "Will Call" drawer up front.

Dear Carol:
Thank you very much for your approval regarding my response for the city review comments for
the preliminary short plat.
Attached are the maintenance agreement and the associated on-site Ingress/Egress and Utility
Easement across lots 1 & 2. We have also included the parking lot easement to the west and the
offsite Ingress/Egress access easement to the south of the short plat for the use of the Fire
Department and emergency vehicles, etc.
Per our previous conversation, I am sending the agreement and the easements to you to be
reviewed and approved. Upon your approval, we will have the easements recorded and then come to
you with the copies of the final plat and the recorded easements. We will then provide you with
the recording number which can be placed on the final plat.
In order to meet our client's schedule, we must receive the City of Tukwila final short plat
approval by March 28, 2007 including all the necessary signatures. That means that we will have
to receive your approval of the easements and the draft of the final short plat by Friday,
March 16, 2007. We will send you the PDF of final plat via e-mail by Noon tomorrow.
We plan to bring all final documents and recorded easements to you by no later than March 20,
2007. This will provide you with one week to get us the final approval for the short plat. This
is how our client sees the schedule in order to obtain the loan. Would you please advise us if
this is doable and meet the city's schedule?

Background
Grantor, the Housing Authority of the County of King, a body
corporate and politic formed under Washington law, is the owner of that
certain parcel of King County, Washington, real estate that is legally

described on Exhibit A, which is attached hereto and is incorporated herein
by this reference (the "Subject Property"). Grantor intends to subdivide the
Subject Property by short subdivision into two lots, to be known as "Lot 1"
and "Lot 2," the legal descriptions of which are set forth on Exhibit B, which
is attached hereto and .is incorporated herein by this reference.
Grantor intends to impose by inclusion on the face of the short plat a
22 -foot -wide Private Non-exclusive Ingress, Egress & Utility Easement
across the Subject Property, the legal description of which is set forth on
Exhibit C, which is attached hereto and is incorporated herein by this
reference (the "Easement Area"). The purpose of that easement is to provide
ingress and egress for emergency vehicles, e.g. fire trucks, ambulances and
other emergency equipment along the existing roadway from the North
property line of Lot 1 to the South property line of Lot 2. Additionally, the
easement will protect and ensure the safety and structuralintegrity of the
existing improvements such as surface, above- and underground utilities
currently located in the area described in Exhibit C.
By executing and recording this Covenant, Grantor intends to
maintain the existing improvements and to fix and impose upon the Subject
Property covenants establishing the rights and obligations of the present
owner and future owners and occupiers of Lot 1 and Lot 2 for the installation,
maintenance and repair of the roadways, storm drainage facilities, sanitary
sewer facilities, water, electrical, gas, cable and any other utility facilities
located in, on, under or above the Easement Area. Therefore, Grantor
declares as follows:
Covenants
Grantor hereby executes this covenant to provide for the repair and
maintenance of the roadways for ingress and egress, and for the repair and
maintenance of storm drainage facilities, sanitary sewer facilities, water,
electrical, gas, cable and any other utility facilities located in, on, under or
above the Easement Area. This covenant shall run with the land for as long
as the ingress and egress and utility systems are used to serve either Lot 1 or
Lot 2.
The roadways and utility facilities located in, on, under or over the
Easement Area shall be maintained in good repair and operable condition
consistent with good property management standards and all applicable laws
and regulations. Where any question exists as to the standards to be applied,

the owners of Lot 1 and Lot 2 may obtain a recommendation from the City of
Tukwila, a licensed professional civil engineer practicing in the State of
Washington, or any other agency having jurisdiction aver the Subject
Property.
Either the owner of Lot 1 or Lot 2 may initiate necessary repair or
maintenance. The owners of Lot 1 and Lot 2 shall share the cost of
maintenance and repair in the following proportions: sixty percent (60%)
shall be paid by the owner of Lot 1 and the remaining forty percent (40%)
shall be paid by the owner of Lot 2, unless the parties shall subsequently
agree between themselves as to a different allocation for any particular item
of expense.
In the event that an owner does not pay its share of such a cost when
due, the aggrieved owner may initiate an action to collect the funds and shall
be entitled to costs andaOreasonable attorneys' fee upon recovery.
This covenant shall be binding upon the owners of Lot 1 and Lot 2 and
their successors in interest and assigns, and if either parcel be transferred,
the successor in interest will be liable for any unpaid charges due hereunder
that were not previously paid by the transferor.

Per our meeting dated 03-07-07, CTS provides the following responses pertaining the short plat review
comments item number 1-11:
Item #1: The proposed property line between Buildings H & F is now revised so that it will comply with the
International Building Code for fire wall rating. We now maintain a distance of 11.70 feet from the most outside
face of the wall for each building to the proposed property line. This will require 0 -hour of fire resistance rating
for the referenced buildings per IBC Codes.
Item #2: The revised drawing on the preliminary plat of Building F will show the location of the decks and the
distance of 11.70 feet as identified in #1. This distance is now referenced from the outside of the deck. The
yard setback is 11.70' instead of the approximate 10 -feet as indicated previously.
Item #3: Per our discussion on March 7, 2007 , the offsite parking area is available for the use of all tenants
and is not exclusively dedicated for the use of Senior Housing Building. We believe no further clarification or
action is required for this item.
Item #4: Per your request, Parcel C is now part of the short plat and will add 3 -feet to the north and south
property lines.
Item #5: We will provide a separate offsite legal description along with a sketch drawn up to scale to indicate
that an access is now legally available for the use of emergency vehicles. This easement is identified as
"Private Non -Exclusive Ingress/Egress Access Easement".
Item #6: We will provide a 22 -foot wide "Private Non -Exclusive Ingress, Egress & Utility Easement" on the face
of the plat along the existing roadway. Additionally, we will provide a legal description for this easement as a
separate document to be attached to the "Private Ingress, Egress and Utility Easement and Maintenance
Agreement". The 22 -foot now includes the additional 3 -feet wide parcel.
Item #7: There is a parking easement on the Title Report submitted to you previously. Our surveyor has
prepared a legal description for this easement so that it can be recorded with other easements. Please let me
know if you need to review this easement prior to being recorded.
Item#8: This easement is no longer needed since there is going to be a language for utility easement in the
Agreement.
Item # 9: This easement is no longer needed since there is going to be a language for utility easement in the
Agreement which includes all utilities, such as water, sanitary sewer, storm sewer, gas, cable, etc. The storm
sewer which drains to the east between buildings E & F along with other utilities are now contained in the Utility
Easement.
Item#10: We will provide you with a draft copy of "Private Non -Exclusive Ingress, Egress & Utility Easement"
for on site as well as offsite "Private Non -Exclusive Ingress, Egress Access Easement" legal descriptions. The
language document for the Maintenance Agreement will include the legal description for "Private Non -
Exclusive Ingress, Egress & Utility Easement" for the platted portion of the property ONLY per discussion with
Dave McPherson, Public Works Department.

Staff has had an opportunity to review the proposed short plat for Riverton Terrace and has
the following comments:
1. The proposed short plat places a property line between two buildings. Please have
an architect review whether there are any openings or fire rated walls that need
protection as required by the International Building Code.
2. The drawing on the preliminary plat of building F does not show the decks off the
back of the building. These should be noted as they affect set backs. These decks
are considered part of the building structure, and as such the rear yard setback must
be measured from the deck. The rear yard setback is 10 feet, which means the
proposed property line must be adjusted to provide 10 feet between the structure and
the property line.
3. I am unclear why the parking calculations include Building E, which is off-site of
the proposed short plat. Are some of the parking stalls south of Building F used by
the tenants of Building E? If so, an easement will be needed to permit the use of this
area for parking for these tenants and the stalls will need to be identified on-site as
well as on the plans. Parking in the area covered by off-site parking easement is
signed on-site as restricted for use by the senior housing development, so cannot
count towards meeting the parking requirements of other buildings.
4. Parcel C (004000-0197) is three feet wide and appears to be incorporated into the
driveway .providing access to Buildings H and F, and to some extent Buildings E
and G, located on parcel 004000-0240. This parcel should be consolidated with Lot
D to eliminate a parcel that does not conform to the City's standards.
5. Fire Department Access: The Fire Department is concerned about ensuring
emergency access from 144th Street through to S. 146th Street for the remaining
multi -family structures. An easement as noted in #6 below is needed to ensure this
access, or a turn around meeting Fire Department standards must be provided. If
you have questions about this requirement, please contact the Tukwila Fire

COUNTY HOUSING AUTHORITY- RIVERTON TERRACE APARTMENTS
I met with Ms. Carol Lumb, Senior Planner, City of Tukwila, Department of Community
Development on October 28, 2006. We discussed King County Housing Authority's
(KCHA) intention to split Parcel -D of the Riverton Terrace site at 14440 41st Avenue
South into two lots and submit a short plat application.
There are two existing multi -family buildings, Building "H" and Building "F" currently
situated on Parcel -D (Parcel No. 0040000205), Adams Homes Tracts, Lot 16. Per our
survey records, the total area for Lot 16 is 39, 853 -square feet. Building "11" with three
stories has 30 (1-BR)dwelling units, and houses exclusively elderly and disabled
residents. . Building "F" with two stories has 6 (2 -BR) -dwelling units.
The short plat will create a separate lot and legal description for Building "H".KCHA
will transfer ownership of Building "H" via a long-term lease to a Low -Income Housing
Tax Credit partnership Leasing the building requires that it have its own legal lot and
description.

Per attached King County Assessor's Map, KCHA currently owns the parcel with tax lot
numbers 0040000199 (The South 12 -foot of Lot 15), 0040000205 (Lot 16), 0040000197
(The East 3 -foot of Lot 15), 004000240 (Lot 21) and 0040000244 (The East -Half of Lot
22). KCHA owned tax lot number, 0040000198 (Lot 15), the adjacent vacant property to
the West until it was sold to the City of Tukwila in May of 2001. The total area of the
referenced five parcels remaining in KCHA ownership is 100544 -square feet, or 2.30 -
acres.
Per discussion with Ms. Lumb, the four areas to be addressed in the preliminary Short
Plat Application are:
1) Density
2) Parking
3) Sensitive Areas Special Studies
4) On -Site Public Improvements
Item #1: Density
Per the attached City of Tukwila Comprehensive Plan Map, the Riverton Terrace
apartment complex is located in the High Density Residential (HDR) zone. Per the City
of Tukwila Municipal Code (TMC), the HDR zone allows60-dwelling units per acre for
multi -family housing and 22- dwelling units per acre for Senior Citizen housing. This
would translate into 30 -dwelling units on a 0.50 -acre lot and 11 -dwelling units on a 0.5 -
acre of lot for Senior Citizen and Multi -Family Housing, respectively.
Per the enclosed preliminary short plat, CTS Engineers has proposed to subdivide parcel -
D into two lots, Lot 1 and Lot 2. Lot 1 contains Building "11" and has a proposed area of
0.55 -acre and Lot 2 contains Building "F" and has a proposed area of 0.36 -acres.

The proposed Lot 1 for senior citizen building is in compliance with the required
minimum of 0.5 -acre since 0.56 -acre is provided on the plat. The proposed Lot 2 for
multi -family building is also in compliance with the minimum required 0.27 -acre (6 x
0.5/11) since 0.36 -acres is provided on the plat. As indicated on the plat, the existing
Buildings "H" and "F" meet the building setback line requirements.
Item #2: Parking
Per TMC HDR zone, Figure 18-7, the following number of parking spaces for
automobiles and bicycles are required:
Senior Citizen Building "H" (30 -Dwelling Units): 30 DU>15 DU 15+15/2= 22.50
Multi -Family Building "F" (6-2BR-Dwelling Units): 6 X 2= 12
Multi -Family Building "E" (4-4BR-Dwelling Units): 4 X 3= 12
Total Required Parking Spaces = 46.5
Per enclosed boundary and topographic survey of the referenced property for Riverton
Terrace apartments, the following parking stalls are provided for the use of each building:
Building "H": 6 -Handicapped & 4 -Standard Parking Stalls = 10
Building "F": 1 -Handicapped & 18 -Standard Parking Stalls =19
Offsite Parking —Statutory Warranty Deed -Exhibit -A: 18- Standard Parking Stalls =18
Total Parking Spaces Provided = 47
As indicated, the proposed short plat for Riverton Terrace apartments, meets the City of
Tukwila HDR zoning requirements for parking as 46.5 -stalls are required and 47 -stalls
are currently available and provided for parking.
The offsite parking is easily accessible via existing pedestrian sidewalks, driveway access
off of 144th Street and signage. King County Housing Authority reserved a parking
easement for the use of the tenants for the entire development in 2001. As noted in the
attached Warranty Deed, the purpose for the easement is described for the benefited
property.
CTS Engineers will prepare a legal description to describe the boundary of the current
18 -space parking area as noted on EXHIBIT "C". This easement was previously recorded
but no legal description is available per the attached Title Search Report. The parking
easement is part of Lot 15 and as mentioned previously, it is owned by the City of
Tukwila. KCHA will obtain the necessary signatures from the City of Tukwila prior to
release of the parking easement for recording.
Item #3: Sensitive Areas Special Studies
Dr. Kenneth E. Neiman, a Certified Senior Ecologist conducted a reconnaissance of the
wetland and the water course on November 11, 2006 and the following documents his
findings:
In order for King County Housing Authority to short plat the above referenced tax parcel,
there is a requirement that wetlands and watercourse sensitive areas be identified
(Tukwila Sensitive Areas Ordinance — Municipal Code 18.45.040).
There are no wetlands or watercourses on the subject property. A wetland and a storm
water drainage ditch are located on private property immediately to the east of the
Riverton Terrace apartments. While at the site Dr. Neiman, spoke with Ms. Bui, the
owner of the adjacent property. She stated that she would not give permission to
delineate and survey sensitive areas on her property.

Prior to speaking with the property owner, Dr. Neiman performed a reconnaissance of the
wetland and watercourse. The delineation standards within the Washington State
Wetlands Identification and Delineation Manual (DOE Pub. 96-94) were used to identify
the northern and western wetland boundary. He determined that the City of Tukwila GIS
database map is inaccurate along the northwestern boundary of the wetland. A sketch of
his findings is attached.
The wetland is approximately 10,000 square feet (1/4 acre) in size. It supports both
Palustrine Scrub/Shrub and Palustrine Forested wetland types. Vegetation in the
wetlands had numerous wetland species: Oregon ash, red alder, black cottonwood, spirea,
sedges, lady -fern, and horsetail to name a few. Upland vegetation was primarily
Himilayan blackberry and assorted other invasive species with an overstory of big -leaf
maple. Soils in the wetland were fully saturated to the surface so identification of soil
series was difficult, assumption from characteristics observed indicate the Seattle muck
Series of hydric soils. Adjacent upland soils appeared to be a variant of Alderwood soils
known as Arents, Alderwood material.
Based on City of Tukwila Municipal Code 18.45.080.B., this is a Type 3 wetland
requiring a 50 -foot buffer. The nearest the wetland comes to the King County Housing
Authority property is 43 feet. As no disturbance is currently proposed within the seven
feet of buffer that overlaps the King County Housing Authority property, no further
investigation of this sensitive area was deemed necessary.
An 18" concrete storm water drain enters the neighbor's property to the east at the
northern property boundaries between the two properties. The source of water is
drainage ditches to the north of S. 144th Street. As this watercourse is the result of man-
made conditions, it is not a regulated sensitive area.
Dr. Neiman is of the opinion that the proposed short plat and the existing in-place
improvements will have no impact on the wetland located to the east or to its buffer
vegetation.
Item #4: On -Site Public Improvements
Per the attached boundary and topographic survey for Riverton Terrace Apartments, all
infrastructure improvements including driveway access, pedestrian sidewalks, fire truck
access, fire hydrant, water, sanitary sewer, storm drainage system, other utilities such as:
gas, cable TV, phone are currently in-place and provided by KCHA. The two buildings,
"H" & "F, are also existing on Parcel -D, the parcel which is proposed to be short platted.
The buildings are wood -frame, constructed in 1969. The gross and net square footage for
these two buildings are 24,663 and 21,111, respectively. Parcel -D contains additional
amenities such as: landscaping, fencing and parking. Buildings "H" & "F" do not have
sprinkler systems. . However, KCHA intends to provide fire sprinkler for Building "H" in
2007. Additionally, a separate water meter will be installed for building "H" as the results
of the short plat. CTS Engineers will coordinate, as necessary, with Water District #125
and the City of Tukwila, Department of Public Works for the installation of a new service
line for domestic and fire protection at the time KCHA is prepared to install the fire
sprinkler system for Building "H". CTS Engineers have obtained Water & Sewer
Availability Certificates from Water District #125 and Val-Vue Sewer District for
Riverton Terrace. Copies of the certificates are attached for your review.
CTS Engineers met with the Fire Battalion Chief, Mr. Don Tomaso on 12-06-06 to
discuss fire sprinkler requirements for the referenced buildings "H" & "F". Mr. Tomaso
indicated in this meeting that no fire sprinkler system is required for these buildings. We

discussed the issue of the installation of the fire sprinkler system for the senior housing
building "H" next year. He indicated that a street restoration permit form the City of
Tukwila, Department of Public Works and a tapping connection permit from Water
District #125 will be required for the future installation of the sprinkler system.
CTS Engineers met with Mr. David McPherson, The City of Tukwila, Department of
Public Works to discuss the storm drainage requirements for Parcel -D on 11-07-06. Per
attached letter, a Technical Information Report for on-site storm water analysis is not
required for the site at this time. As mentioned previously, storm drainage system is
available on-site. The existing storm drainage system intercepts the storm water runoff
from the parking and roof areas and coveys it to the south to the existing storm drainage
system on 146`h Street. To the best of our knowledge, there are no reported flooding or
drainage problems on the referenced site.
Based upon the documents provided with this application, CTS Engineers believes that
the proposed Short Plat for Riverton Terrace apartments is in conformance with the
Tukwila Comprehensive Plan, Municipal Codes for Title 17, Subdivisions & Plats, Title
18, Zoning and requests that the City of Tukwila approve the preliminary Short Plat
Application as submitted.

Dear Ms. Lumb:
In the process for King County Housing Authority (KCHA) to short plat the above
referenced tax parcel within the City of Tukwila jurisdiction, there is a requirement
that wetlands and watercourse sensitive areas be identified (Tukwila Sensitive Areas
Ordinance — Municipal Code 18.45.040). This letter documents my findings
following a site visit on November 11, 2006.
There are no wetlands or watercourses on the subject property. A wetland and a
storm water drainage ditch are located on private property immediately to the east of
the KCHA property. While at the site I spoke with Ms. Bui, the property owner of
this land. She stated that she would not give permission to delineate and survey
sensitive areas on her property.
Prior to speaking with the property owner I did perform a reconnaissance of the
wetland and watercourse. The delineation standards within the Washington State
Wetlands Identification and Delineation Manual (DOE Pub. 96-94) were used to
identify the northem and western wetland boundary I determined that the mapping
found in the City of Tukwila GIS database is inaccurate along the northwestern
boundary of the wetland. A sketch of my findings is attached.
The wetland is approximately 10,000 square feet (1/4 acre) in size. It supports both
Palustrine Scrub/Shrub and Palustrine Forested wetland types. Vegetation in the
wetlands had numerous wetland species: Oregon ash, red alder, black cottonwood,
spirea, sedges, lady -fern, and horsetail to name a few. Upland vegetation was
primarily Himilayan blackberry and assorted other invasive species with an overstory
of big -leaf maple. Soils in the wetland were fully saturated to the surface so
identification of soil series was difficult, assumption from characteristics observed
indicate the Seattle muck Series of hydric soils. Adjacent upland soils appeared to be
a variant of Alderwood soils known as Arents, Alderwood material.
Based on City of Tukwila Municipal Code 18.45.080.B., this is a Type 3 wetland
requiring a 50 -foot buffer. The nearest the wetland comes to the KCHA property is
43 feet. As no disturbance is currently proposed within the seven feet of buffer that
overlaps the KCHA property, no further investigation of this sensitive area was
deemed necessary.

A 18" concrete storm water drain enters the neighbor's property to the east at the
northern property boundaries between the two properties. The source of water is
drainage ditches to the north of S. 144th Street. As this watercourse is the result of
man-made conditions, it is not a regulated sensitive area.
It is my opinion that the proposed short plat and any future proposed activity that
takes place within the existing limits of building and parking lot boundaries will have
no impact on the wetland located to the east or to its buffer vegetation.

EXHIBIT A
RESERVATION OF PARKING EASEMENT
Grantor, The Housing Authority of the County of King, a municipal
corporation, hereby reserves unto itself the following described perpetual
easement upon, over and across the Property ("Parking Easement"):
1. Benefited Property. The Parking Easement is for the benefit of
all and every portion of other real property owned by Grantor adjacent to the
Property and commonly known as the Riverton Terrace Apartments located
at 14440 and 14410 41st Avenue South, Tukwila, Washington 98168 and
legally described on the attached Exhibit B ("Benefited Property").
2i Purpose and Scope of Parking Easement. The Parking
Easement is for the following purposes: eighteen (18) contiguous permanent
full size (i.e , not compact) parking spaces ("Parking Spaces") Located on the
Property for the exclusive use of the Benefited Property together with
nonexclusive rights of ingress and egress over the Property to provide
pedestrian and vehicular access to the Parking Spaces to and from the
Benefited Property .and any public rights of way, and for ancillary purposes
-� including, but not Limited to parking signage.
3. Location of Parking Spaces. Pedestrian Access and Signage.
ser The Parking Spaces shall be located together on the Property in an area in
close proximity to the Benefited Property. The Parking Spaces are presently
cc located approximately as shown on the sketch attached as Exhibit C. The
owner of the Property may relocate the Parking Spaces on the Property upon
(., reasonable written notice to the owner of the Benefited Property so long as
• o use of the Parking Spaces for the benefit of the Benefited Property is not

matenalli impaired by the relocation. Pedestrian access over the Property to
the Parkihg Spaces shall be located and configured m such a manner as to be
reasonably suitable for use by elderly people. Signage shall be installed m
the vicinity of the Parking Spaces indicating that the Parking Spaces are for
the exclusive use of the tenants and invitees of the Benefited Property.
4. Maintenance of Parking Easement Area. The Parking Spaces
and all other portions of the Property subject to this Parking Easement shall
be maintained at the sole expense of the owner of the Property and at no
expense to the Benefited Property or the owners and tenants of the Benefited
Property. The Parking Spaces and all other portions of the Property subject
to this Parking Easement shall be maintained m a condition at least as good
as its existing condition and in a condition reasonably adequate for use of the
Parking Spaces for parking purposes. The owner of the Benefited Property

EXHIBIT A
RESERVATION OF PARKING EASEMENT
Grantor, The Housing Authority of the County of King, a municipal
corporation, hereby reserves unto itself the following described perpetual
easement upon, over and across the Property ("Parking Easement"):
1. Benefited Property. The Parking Easement is for the benefit of
all and every portion of other real property owned by Grantor adjacent to the
Property and commonly known as the Riverton Terrace Apartments located
at 14440 and 14410 41st Avenue South, Tukwila, Washington 98168 and
legally described on the attached Exhibit B ("Benefited Property").
2. Purpose and Scope of Parking Easement. The Parking
Easement is for the following purposes: eighteen (18) contiguous permanent
full size (i. , not compact) parking spaces ("Parking Spaces") located on the
Property for the exclusive use of the Benefited Property together with
nonexclusive rights of mgress and egress over the Property to provide
pedestrian and vehicular access to the Parking Spaces to and from the
4.0 Benefited Property and any pubhc rights of way, and for ancillary purposes
sclo including, but not hmited to parking signage.
3. Location of Parking Spaces. Pedestrian Access and Signage.
The Parking Spaces shall be located together on the Property in an area in
close proximity to the Benefited Property. The Parking Spaces are presently
CO located approximately as shown on the sketch attached as Exhibit C. The
owner of the Property may relocate the Parking Spaces on the Property upon
cv reasonable written notice to the owner of the Benefited Property so long as
Nuse of the Parking Spaces for the benefit of the Benefited Property is not
material* impaired by the relocation. Pedestrian access over the Property to
the Parkthg Spaces shall be located and configured in such a manner as to be
reasonably suitable for use by elderly people. Signage shall.be installed m
the vicinity of the Parking Spaces indicating that the Parking Spaces are for
the exclusive use of the tenants and invitees of the Benefited Property.
4. Maintenance of Parking Easement Area. The Parking Spaces
and all other portions of the Property subject to this Parking Easement shall
be maintained at the sole expense of the owner of the Property and at no
expense to the Benefited Property or the owners and tenants of the Benefited
Property. The Parking Spaces and all other portions of the Property subject
to this Parking Easement shall be maintained m a condition at least as good
as its existing condition and m a condition reasonably adequate for use of the
Parking Spaces for parking purposes. The owner of the Benefited Property

shall maintain related parking signage and may repair, modify and replace
such signage.
5. Reservation of Easement. Grantor is the owner of the Benefited
Property and is reserving this Parking Easement for the benefit of the

6. Covenant Runnma with Land. This Parking Easement and all
the covenants and agreements herein shall run with the land and be binding
on and inure to the benefit of all future owners of the Property and the
Benefited Property

The following terms and conditions apply to the attached Val Vue Sewer District ("District")
Certificate of Sewer Availability/Non-Availability ("Certificate").
1. This Certificate is valid only for the real property referenced herein ("Property"), which is in
the District' s service area, for the sole purpose of submission to the King County Department of Development
and Environmental Services, King County Department of Public Health, City of Seattle, City of Tukwila, City
of Burien and/or City of SeaTac. This Certificate is between the District and the applicant only, and no third
person or party shall have any rights hereunder whether by agency, third -party beneficiary principles or
otherwise.
2. This Certificate creates no contractual relationship between the District and the applicant and
its successors and assigns, and does notconstitute and may not be relied upon as the District's guarantee that
sewer service will be available at the time the applicant may apply to the District for such service.
3. As of the date of the District's signature on this Certificate, the District represents that sewer

The District makes no other representations, express or implied, including without limitation that the applicant
will be able to obtain the necessary permits, approvals and authorizations from King County, City of Seattle,

4. If the District or the applicant must extend the District's sewer system to provide sewer
