The Short Subdivision Committee has completed review of your short plat application
(File #L06-094), and determined that it complies with all applicable City code requirements. Based
on the submittal, preliminary approval is granted subject to the conditions stated below. The City
SEPA Responsible Official has previously determined that this application does not require an
environmental determination because it is categorically exempt.
This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project
submittal, preliminary approval is granted subject to the conditions stated below.
There are three basic steps in the short plat approval process:
I. Preliminary Approval
This letter constitutes your preliminary approval. The application was reviewed by the
Tukwila Short Subdivision Committee and approved with conditions. The conditions
imposed are to ensure the short plat is consistent with the Criteria for Preliminary Approval
listed at TMC 17.12.020 C in the Tukwila Subdivision Code.
This short plat approval decision is appealable to the Hearing Examiner, and any appeal
must be filed before the end of the 21 day appeal period on August 8, 2007. For additional
appeal information, contact the Project Planner.

PRELIMINARY APPROVAL CONDITIONS
Boundary Line Adjustment
1. Boundary Line Adjustment #L06-028 affects Short Plat #L06-094 and must be recorded
with King County. A copy of the approval letter and map are included for your use.
Please note that the Boundary Line Adjustment will expire on July 27, 2007, one year
after approval. If necessary, you may request an extension of up to one year from the
initial,expiration date of July 27, 2007.
Review and, if necessary, revise the site survey for L06-094 to ensure that any changes ..
resulting from Boundary Line Adjustment #L06-028 are incorporated in the survey.
Correct the inconsistency between the lot area shown for Short Plat L06-094 (13, 040
square feet), and for the lot as indicated in Boundary Line Adjustment #L06-028 (13,060
square feet.)
3. Review and if necessary revise the Utility Easement to include any changes that result
from Boundary Line Adjustment #L06-028.
Prior to Final Short Plat, the following conditions shall be met:
1. Incorporate all comments relating to Boundary Line Adjustment #L06-028 above.
2. All improvement shall be installed, including paved 15' access and underground water,
sewer, storm, power, utilities to property line of Lgt 2, and a final Public Works
inspection held.
3. Three sheds shall be demolished as shown on civil plans.
4. Private Driveway Easement shall have the title revised to include utilities. (Refer to
attached easement document.)
5. Easement documents shall be recorded prior to the recording of the Final Short Plat Map,
and the recording numbers be shown on the short plat map.
Other Comments
1. Public Works recommends a graphic sketch showing the easement location for each of
the easement documents.

2. The applicant shall apply for Public Works and Building permit approval(s).
3. An infrastructure design and construction standard manual, is available at the Public
Works Department or on the City of Tukwila web -site.
4. All utilities including power are required to be underground, per City of Tukwila
ordinance.
5. Street Use as part of the Public Works Permit, requires a Bond and Insurance for work
within City right-of-way.
6. Pavement mitigation fee may apply to this permit, if street pavement is open cut.
7. Transportation Impact Fee applies to the future Building Permit(s).
8. Transportation Concurrency Test Fee applies to the future Building Permit(s).
II. Final Approval
Install all required site improvements, including those proposed in the short plat application and
those identified above as conditions of approval. You will need to provide signed, complete civil
plans prepared by a licensed civil engineer.
Prior to Final Approval and recording, you will need to submit a copy of the short plat map
and easements per the conditions mentioned above. The short plat map shall have original
signatures (owner) and signatures and seals (surveyor, notary). The map shall include the
short plat number, the word "Declaration" (not "Dedication") and the Assessor's number as
noted. Do not fold the original short plat map.
The next step is to install the required site improvements, comply with the conditions of
approval and submit the necessary short plat documents (survey, legal descriptions, and
other required paper work). You may apply to delay installation of the site improvements up
to six months beyond final approval subject to the approval of the Public Works Director. A
fmancial guarantee must be provided to ensure installation.
All taxes and fees assessed against the property must be current prior to final approval.
Please check with the King County Assessor's Office and the City of Tukwila Finance
Department prior to submitting final documents. After the documents have been found to
be in order, and the all of the requirements of the short plat have been met, you will bring the
documents in to the Tukwila Department of Community Development. The Chair of the
Short Subdivision Committee will then sign your short plat. This constitutes a grant of final
approval.

Expiration
1. The final approved short plat must be filed with the King County Department of Records by July
18, 2008, one year from the date of this preliminary approval or the application will expire. The
City may grant a single one year extension if requested in writing prior to the expiration date.
III. Recording
The signature of the Chairman of the Short Subdivision Committee certifies that your short
plat application is ready for recording. It is your responsibility to record the City approved
short plat documents with the King County Department of Records. You will need to pay the
recording fees and submit your approved original short plat to King County, see the
Recording Procedures handout. The short plat is not complete until the recording occurs and
copies of the recorded documents are provided to the Department of Community
Development.
After recording, the County returns the recorded original to the City of Tukwila within 4-6
weeks, at which time your short plat is considered complete. You can shorten this
processing time by hand -delivering a copy of the recorded short plat to the project planner.
In many circumstances, building permits on the short platted property may not be issued
until a copy of the recorded short plat (or original) is returned to the Department of
Community Development.

The Department of Community Development has received your letter of July 15,
2008, requesting an extension to finish the improvements required as a condition
of the preliminary approval for the two -lot short plat located at 14759 62nd Avenue
South, Tukwila, WA. In light of the extenuating conditions that you describe, the
Department of Community Development will allow the preliminary approval to be
extended until July 18, 2009.
All conditions that were required in the enclosed preliminary approval must be
completed, and the short plat must be recorded with the King County Assessor
by July 18, 2009 (i.e. one year after the original deadline). No additional
extensions can be authorized.

The City has completed its review of your Boundary Line Adjustment application.
At this time please submit an original and a copy of the Survey Map with your
notarized signature and the signature and stamp of the surveyor. When the signed
Survey Map is submitted, it will be routed to the Chair of the Short Subdivision
Committee for final approval. Once your Boundary Line Adjustment has received
final approval I will return the originals to you to be recorded at the King County
Administration Building, 500 4th Avenue, Seattle WA. 98104.
If you elect to hand carry the documents to the County office you should be aware
of the following steps:
1. Take the documents to be recorded to the Assessor's office on the 7th floor
for review and signature. The county has specific document format
requirements that can be found at their web page:

them to the Recorder's office in Room 311 (31d floor) to be recorded. The

We are writing this letter to ask for an extension on our final approval short plat
for the Behnke property.
This has taken us more time than we expected due to some difficulties, one being
our son and his medical treatments and his ongoing behavior issues at school and at
home. The other being a financial burden we are now rising above since we are finally
being paid the monies due to us by builders and others over the last year. We are now in
the position to be able to put in our road for this short plat by mid August to September.
We are really looking forward to completing this project, soon.
We hope you consider extending our final approval for the Behnke Short Plat.

access shall not be provided via flag lots. Please reconfigure the lot to provide a
joint driveway on an easement along the east side of the lot, rather than with a flag
lot. Revise drawings accordingly and provide easement documents.
Public Works
Contact Joanna Spencer, Development Engineer at 206-431-2440 if you have
questions regarding the following comments. Once the lot has been reconfigured
per #1 above, provide the following:
1. On sheet 1 of 2, please provide the following:
a) Full meets and bounds legal descriptions for both newly created lots.
b) Full meets and bounds legal descriptions for proposed private drainage easement and
sanitary sewer easement.
c) Show the nearest fire hydrant and distance to the west property line measured by
means of vehicular travel. Check with the Fire Department to see if the existing
hydrant provides adequate coverage or if a new fire hydrant shall be installed.
d) Tax Parcel Number shall be next to the existing legal description and not below new

2. A separate storm drainage easement shall be executed and recorded with final short

1. DEFINITIONS
(a)"Mortgage" means mortgage, deed of trust or other security instrument.
(b)"Public Records" means title records that give constructive notice of matters affecting the title
according to the state law where the land is located.
2. LATER DEFECTS
The Exceptions in Schedule B - Section II may be amended to show any defects, liens or encumbrances
that appear for the first time in the public records or are created or attached between the Commitment
Date and the date on which all of the Requirements (a) and (c) of Schedule B - Section I are met. We
shall have no liability to you because of this amendment.
3. EXISTING DEFECTS
If any defects, liens or encumbrances existing at Commitment Date are not shown in Schedule B, we may
amend Schedule B to show them. If we do amend Schedule B to show these defects, liens or
encumbrances, we shall be liable to you according to Paragraph 4 below unless you knew of this
information and did not tell us about it in writing.
4. LIMITATION OF OUR LIABILITY
Our only obligation is to issue to you the Policy referred to in this Commitment, when you have met its
Requirements. If we have any liability to you for any loss you incur because of an error in this
Commitment, our liability will be limited to your actual loss caused by your relying on this Commitment

PRIVATE DRIVEWAY EASEMENT AGREEMENT
KNOWN ALL MEN BY THESE PRESENTS that the undersigned, are the owners in fee
simple ("Grantor" herein), of the real property described in the attached Exhibit A:
WHEREAS Grantor intends to establish an easement across its land for driveway access,
underground utilities, and drainage facilities for the benefit of the fee simple owners of the
real property described in the attached Exhibit B ("Grantee" herein).
WHEREAS Grantee intends that all improvement costs and maintenance costs of the
driveway access, utilities, and drainage facilities within said easement will be borne solely
by Grantee.
NOW THEREFORE, Grantor hereby declares, grants and conveys to Grantee, a non-
exclusive, perpetual private driveway easement, over, under, across, along and through the
real property described in the attached Exhibit C, subject to covenants, reservations and
conditions described as follows:
1. This easement is for the sole purpose of ingress, egress, utilities, and drainage
facilities.
2. Said easement includes the right of ingress, egress, regress for the purpose of
construction, use, and maintenance of a private driveway, public or private utilities
and storm drainage facilities.
3. All costs for construction of the driveway and other improvements within said
easement shall be borne by Grantee. The driveway (when constructed) shall have a
smooth paved surface.
4. Said easement is subject to a utilities easement in favor of any electric, telephone,
television cable, gas, water, or sewer company, public or private, or their permittees
or assigns to install, construct, operate, maintain, alter, and repair their respective
utilities for servicing grantee properties, together with the right of ingress and
egress for said purposes.
5. The private driveway described by this declaration, shall include the additional right
to make all necessary slopes for cuts and fills: and the right to continue to drain said
roads and ways over and across Grantors real property where the water might take a
natural course upon reasonable grading pursuant to improvement of the roads and
ways.
6. Maintenance costs of the driveway constructed within said Easement shall be borne
solely by Grantee, their heirs, successors or assigns.
7. The amount and type of maintenance to be performed on the private driveway shall
be determined by Grantee.

CERTIFICATE OF SEWER AVAILABILITY/NON-AVAILABILITY
The following terms and conditions apply to the attached Val Vue Sewer District ("District")
Certificate of Sewer Availability/Non-Availability (` te' ).
1. This Certificate is valid only for the r referenced herein ("Property"), which is in
the District's service area, for the sole purpose of submission to the King County Department of Development
and Environmental Services, King County Department of Public Health, City of Seattle, City of Tukwila, City
of Burien and/or City of SeaTac. This Certificate is between the District and the applicant only, and no third
person or party shall have any rights hereunder whether by agency, third -party beneficiary principles or
otherwise.
2. This Certificate creates no contractual relationship between the District and the applicant and
its successors and assigns, and does not.constitute and may not be relied upon as the District's guarantee that
sewer service will be available at the time the applicant may apply to the District for such service.
3. As of the date of the District's signature on this Certificate, the District represents that sewer
service is available to the Property through sewer systems that exist or that may be extended by the applicant.
The District makes no other representations, express or implied, including without limitation that the applicant
will be able to obtain the necessary permits, approvals and authorizations from King County, City of Seattle,
City of Tukwila, City of Burien, City of SeaTac or any other governmental agency before the applicant can
utilize the sewer service which is the subject of this Certificate.
4. If the District or the applicant must extend the District's sewer system to provide sewer
service to the Property, the District or applicant may be required to obtain from the appropriate governmental
agency the necessary permits, approvals and authorizations. In addition, the governmental agency may
establish requirements that must be satisfied as a 'condition of granting any such permits, approvals or
authorizations, which may make impractical or impossible the provision of sewer services to the Property.
5. Application for and possible provision of sewer service to the Property shall be subject to and
conditioned upon availability of sewer service to the Property at the time of such application, and compliance
with federal, state, local and District laws, ordinances, policies, and/or regulations in effect at the time of such
application.
