(Attachment C) On March 5, 2007, the City Council held a public meeting on this proposal and referred it to the Planning Commission for a hearing and recommendation. Vicinity/Site Information The applicant proposes to redesignate approximately .63 acres of a 1.35 acre property from Residential Commercial Center (RCC) to Low Density Residential (LDR) at 14427 51st Avenue South. The site is part of the Bonsai Northwest nursery operation, and is immediately south of the Bonsai Northwest retail store. It contains a large plastic greenhouse in the northeast portion of the property closest to the Bonsai Northwest business. The rest of the property is vacant. The Citrus Longhorned Beetle quarantine was recently lifted in the area. The Sensitive Areas Overlay shows that approximately 40% of the entire site is located within a Class 2 area of potential geologic instability. (Attachment D—Sensitive Areas Map) Class 2 areas are those where "landslide potential is moderate, which include areas sloping between 15 and 40 percent and which are underlain by relatively permeable soils." Geotechnical review was not prepared for this application since the requested designation is less intensive than the current designation (i.e. downzone). A geotechnical study will show what portion of the area proposed for Comprehensive Plan/Zoning Map change includes environmentally sensitive steep slopes. (Attachment E) Geotechnical studies will be required for any future development, including a short plat. The applicant proposes to connect future residential development directly to 51st Avenue South and to the adjacent South 146th Street cul-de-sac via an existing easement with adjacent property owners. If the issue is not adequately addressed, is there a need for it? Providing housing and strengthening neighborhoods is an important goal of the Comprehensive Plan. Goal 3.1 (Housing) Continue to provide the City's fair share of regional housing Policy 3.1.1 (Housing) Provide sufficient zoned housing potential to accommodate future single- and multi family households Policy 7.6.4 (Residential Neighborhoods) Support single-family residential in -fill housing that is in harmony with the existing neighborhood as a means of achieving adequate, affordable, and/or diverse housing. 2) Impacts The property is currently Residential Commercial Center (RCC), a district that is "intended to create and maintain pedestrian -friendly commercial areas characterized and scaled to serve a local neighborhood." Characteristic permitted uses in RCC include beauty shops, laundries, small offices, selected retail, multi -family units above retail/office and nurseries. One single-family unit is permitted per lot in the RCC. LDR is considered to be a less intensive zone than RCC. If a portion of the property were redesignated to LDR, future housing development would have less impact than other potential RCC uses. The requested Comprehensive Plan map change would potentially make several lots available for residential development by reducing the RCC zone and extending adjacent Low Density Residential zone (LDR) zone north and east. No development is proposed at this time. Specific lot layout would be worked out during a future short plat process. 3) Is the proposed change the best means for meeting the identified public need? What other options are there for meeting the identified public need? The subject property abuts LDR to the west and south, and RCC on the north and east. Future RCC use and development of the property is limited by access and topography. The proposed change to LDR would allow single-family residential use to extend east from the existing Foster Heights development via the cul-de-sac on South 146th Street, as well as along 51st Avenue South. If not, what result can be expected and why? The proposed change would reduce the amount of property for commercial use, but redesignating the property for future residential development could benefit the community with additional single-family housing. Future residential development potential could be limited by site considerations including steep slopes and potential geological instability. The property lies in an area with moderate potential for geologic instability, so any construction would require extra care. At present, there is no access to the site from S. 146th Street, a public roadway that ends in a cul-de-sac. In order to connect to S. 146th Street, the applicant would use existing easements from adjacent property owners. Alternately, if the applicant wanted to use 51st Avenue South to access one or more lots, it would be necessary to address steep slope issues. Slope, access and lot layout details would be worked out during future short plat review. The request divides the property's Comprehensive Plan designation and zoning into two portions, and would result in "split" Comprehensive Plan and zoning on the same property. This could potentially allow incompatible residential and commercial uses on the same property. It is not City practice. CONCLUSIONS In reviewing Comprehensive Plan criteria, staff concludes that: 1) The proposed change is consistent with the community goal of providing housing; 2) Impacts of future housing development are potentially less than the impacts of future commercial development that is presently allowed on the site; 3) The site is adjacent to low density residential development, and redesignating the property for future single family development would benefit the community by extending a residential neighborhood. 4) The request covers only a portion of the property, and splits the property into two separate Comprehensive Plan/Zoning designations. It is not desirable to allow two Comprehensive Plan designations/zones on the same property. RECOMMENDATION Staff recommends approving the applicant's request to redesignate Comprehensive Plan for a portion of the property located at 12247 51St Avenue South from Residential Commercial Center (RCC) to Low Density Residential (LDR) subject to the following condition: • the applicant shall complete a boundary line adjustment separating the RCC portion of the property from the LDR portion within three months of City Council approval of the request. The proposed amendment to the zoning map is consistent with the goals, objectives and policies of the Comprehensive Plan Per the discussion of Comprehensive Plan Criteria (above), providing housing and strengthening neighborhoods is an important goal of the Comprehensive Plan. The proposed rezone/Zoning Map change from Residential Commercial Center (RCC) to Low Density Residential (LDR) is consistent with this goal and accompanying policies. 2. The proposed amendment to the Zoning Map is consistent with the scope and purpose of this title and the description and purpose of the zone classification applied for. Per TMC 18.10.010 Purpose, the Low Density Residential (LDR) district is "...intended to provide low-density family residential areas together with a full range or urban infrastructure services in order to maintain stable residential neighborhoods, and to prevent intrusions by incompatible land uses." The proposed rezone from Residential Commercial Center (RCC) to Low Density Residential (LDR) would fulfill this purpose by allowing single family, detached housing to be built. 3. There are changed conditions since the previous zoning became effective to warrant the proposed amendment to the Zoning Map Since the site was zoned RCC in 1995, the neighborhood near the property has become more residential in nature. A cul-de-sac allowing residential access has been constructed on S. 146th. Utilities are now also available, and residences have been built adjacent to the site. 4. The proposed amendment to the Zoning Map will be in the interest of furtherance of the public health, safety, comfort, convenience and general welfare, and will not adversely affect the surrounding neighborhoods, nor be injurious to other properties in the vicinity in which the subject property is located Downzoning from a more intensive, commercial zone (Residential Commercial Center—RCC) to a less intensive residential zone (Low Density Residential—LDR), would benefit the surrounding neighborhood. Removing vacant commercial property from a residential neighborhood reduces potentially adverse impacts on the adjacent properties, and constructing housing would enhance the overall residential feel of the area. RECOMMENDATION Staff recommends approving the applicant's request to change the Zoning Map to rezone a portion of the property located at 12247 51st Avenue South from Residential Commercial Center (RCC) to Low Density Residential (LDR). The approval of the rezone is subject to the approval of the Comprehensive Plan map change and accompanying condition for a boundary line adjustment, as discussed above. We propose converting a commercial property abutting a residential cul de sac to residential property to be developed with homes compatible with the neighborhood. Current zoning is commercial. Due to the slope in the center of the property, the flat area on the southwest side of the property where we propose the rezone is only accessible through the cul de sac on South 146th Street. According to Tukwila Municipal Code 9.28.020 . Commercial vehicles are prohibited from using this road; therefore the commercial uses of this property are severely limited. This rezone will also complete the residential development of the cul de sac on South 146th Street. A.3. Why will the proposed change result in a net benefit to the community? If not, what type of benefit can be expected and why? We believe replacing commercial property with residential lots promotes the city's stated goals of: "A land use pattern that encourages a strong sense of community by grouping compatible and mutually supportive uses and separating incompatible uses". Comprehensive Plan Amendment Criteria TMC18.80.010 B.1. A detailed statement of what is proposed and why. 2 • We are proposing changing the zoning of a portion of an RCC zoned lot to LDR, allowing the property to be developed for single family residences. We are doing this to maximize the use of the property and to enhance the residential nature of the cul de sac. B.2. A statement of the anticipated impacts of the change, including the geographic area affected and the issues presented by the proposed change. Infrastructure is already in place and currently abutting the commercial property; we anticipate no adverse impact to the neighborhood. B.3. An explanation of why the current comprehensive plan or development regulations are deficient or should not continue in effect. Current zoning retains commercial property on a residential cul de sac. Washington State Growth Management Act RCW 36.70A.020 Planning goals. (1) Urban growth. Encourage development in urban areas where adequate public facilities and services exist or can be provided in an efficient manner. (2) Reduce sprawl. Reduce the inappropriate conversion of undeveloped land into sprawling, low-density development. RCW 36.70A.070 Comprehensive plans — Mandatory elements. The comprehensive plan of a county or city that is required or chooses to plan under RCW 36.70A.040 shall consist of a map or maps, and descriptive text covering objectives, principles, and standards used to develop the comprehensive plan. The plan shall be an internally consistent document and all elements shall be 3 • consistent with the future land use map. A comprehensive plan shall be adopted and amended with public participation as provided in RCW 36.70A.140. (2) A housing element ensuring the vitality and character of established residential neighborhoods that: (a) Includes an inventory and analysis of existing and projected housing needs that identifies the number of housing units necessary to manage projected growth; (b) includes a statement of goals, policies, objectives, and mandatory provisions for the preservation, improvement, and development of housing, including single-family residences; (c) identifies sufficient land for housing, including, but not limited to, government -assisted housing, housing for low-income families, manufactured housing, multifamily housing, and group homes and foster care facilities; and (d) makes adequate provisions for existing and projected needs of all economic segments of the community. B.5. A statement of how the proposed amendment complies with applicable Countywide Planning Policies The Countywide Planning Policy as with the Growth Management Act and the Tukwila Comprehensive Plan share the goals of simultaneously reducing urban sprawl, increasing the number of residences to accommodate future population growth, and maintaining the quality and vitality of neighborhoods. We believe converting the zoning from commercial to residential will aid in these goals. B.6. Exhibit 1 Planning Commission Staff Report March 15, 2007 FINDINGS AND CONCLUSIONS BACKGROUND: Project History The applicant John Muth proposes to amend the Comprehensive Plan (Attachment A) and Zoning map (Attachment B) to redesignate a part of his property at 14427 51m Avenue South, Tukwila from Regional Commercial Center (RCC) to Low Density Residential (LDR) (Attachment C). On March 5, 2007, the City Council held a public meeting on this proposal and referred it to the Planning Commission for a hearing and recommendation. Vicinity/Site Information The applicant proposes to redesignate approximately .63 acres of a 1.35 acre property from Residential Commercial Center (RCC) to Low Density Residential (LDR) at 14427 51m Avenue South. The site is part of the Bonsai Northwest nursery operation, and is immediately south of the Bonsai Northwest retail store. It contains a large plastic greenhouse in the northeast portion of the property closest to the Bonsai Northwest business. The rest of the property is vacant. The Citrus Longhomed Beetle quarantine was recently lifted in the area. The Sensitive Areas Overlay shows that approximately 40% of the entire site is located within a Class 2 area of potential geologic instability. (Attachment D—Sensitive Areas Map) Class 2 areas are those where "landslide potential is moderate, which include areas sloping between 15 and 40 percent and which are underlain by relatively permeable soils." Geotechnical review was not prepared for this application since the requested designation is less intensive than the current designation (i.e. downzone). A geotechnical study will show what portion of the area proposed for Comprehensive Plan/Zoning Map change includes environmentally sensitive steep slopes. (Attachment E) Geotechnical studies will be required for any future development, including a short plat. The applicant proposes to connect future residential development directly to 51St Avenue South and to the adjacent South 146th Street cul-de-sac via an existing easement with adjacent property owners. There are changed conditions since the previous zoning became effective to warrant the proposed amendment to the Zoning Map Since the site was zoned RCC in 1995, the neighborhood near the property has become more residential in nature. A cul-de-sac allowing residential access has been constructed on S. 146t. Utilities are now also available, and residences have been built adjacent to the site. 4. The proposed amendment to the Zoning Map will be in the interest of furtherance of the public health, safety, comfort, convenience and general welfare, and will not adversely affect the surrounding neighborhoods, nor be injurious to other properties in the vicinity in which the subject property is located Downzoning from a more intensive, commercial zone (Residential Commercial Center—RCC) to a less intensive residential zone (Low Density Residential—LDR), would benefit the surrounding neighborhood. Removing vacant commercial property from a residential neighborhood reduces potentially adverse impacts on the adjacent properties, and constructing housing would enhance the overall residential feel of the area. Paul Cornish from Sound Transit used a Powerpoint presentation to convey the history behind decisions made regarding the station, maintenance and management, and a projected schedule for completion of the permanent station in 2011-2012. Barbara Bader, 13660 Military Road South, commented that it seems unreasonable for it to take 12 years to build a permanent station. She also conveyed a sign that says "Tukwila" stuck in cement buckets is embarrassing. Betty Gully, 13017 Macadam Road South, indicated that she has been to the station and finds it embarrassing and not depicting the correct image for Tukwila. The Councilmembers discussed this issue at length and offered the following comments and concerns: the possibility that necessary improvements to parking may not be finished prior to completion of the permanent station; the criteria regarding signage and artwork is too vague; the temporary station should be outfitted with LED lighting to alert riders of necessary announcements; the need to assure full compliance with the Americans with Disabilities Act (ADA); the necessity for greater safety and security measures such as handrails on both sides of the platform and a telephone at the station; assurance that the temporary facility projects a quality image of the City; and further information regarding funding from other areas of Sound Transit projects that could possibly be utilized for the Tukwila station. 8:47:45 p.m. Mayor Mullet closed the public hearing. b. The City Council was briefed on November 26, 2007 to review the proposals and the Planning Commission's recommendations. A public hearing is scheduled for December 3, 2007 to receive input. After the public hearing, the City Council will make its final decision whether or not to adopt individual proposed amendments. Process to date: The City of Tukwila received three applications for annual Comprehensive Plan amendments for consideration in 2007. Two applications were received by the December 31, 2006 deadline. They were reviewed by the City Council at a public meeting in March, 2007, and passed along to the Planning Commission. The Planning Commission held a public hearing and made recommendations on March 22, 2007. A third application was received in August, 2007 with the request that it be considered as an "emergency" in 2007. The City Council forwarded this to the Planning Commission. The Planning Commission hearing was held on October 25, 2007. After its public hearing, the Planning Commission made recommendations regarding the proposed amendments. Staff met individually with CAP members on November 7, 2007 and November 19, 2007 to provide a briefing in lieu of the November 13, 2007 CAP meeting that was canceled. At each stage in the process, staff has tried to encourage public involvement. All public meetings and hearings were advertised in the paper. Staff exceeded statutory notification requirements in providing mailings to owners and occupants within 500 feet of the proposed map changes. An additional informational meeting was held for the public on November 29, 2007. In addition, sites with potential changes which would impact adjacent properties were posted. The City Council may: o Adopt a proposed amendment; o Adopt a modified version of a proposed amendment; or ® Reject the proposed amendment. Consideration of these proposed amendments is a legislative action. Contested decisions are appealed to Superior Court. The applications are as follows: 1) Modify Policy to Expand Area for Locating Transit Center-- Applicant: Tukwila Department of Community Development (File #L06-093) The proposal seeks to modify existing policy 13.4.8 to incorporate current information from the Tukwila Transit Plan and the Tukwila Transit Center Design Report. The current policy states that a future Transit Center should be sited on Andover Park East between Baker Boulevard and Strander Boulevard. The policy change was proposed in order to provide greater flexibility in selecting a location for the transit center. The change will enable the analysis contained in the Tukwila Transit Plan (4/05), and issues raised by property owners, Metro Transit and the City of Tukwila to be more fully addressed in a siting decision. Staff Recommendation: Policy 13.4.8. "Support forming a partnership with Metropolitan King County, in the area north of Minkler, in the Tukwila Urban Center, in order to locate a pedestrian - friendly transit center and related amenity." Planning Commission Recommendation: The Planning Commission expanded the area in which the future transit center could be located by recommending that the future transit center site be located in the Tukwila Urban Center, north of Minkler Boulevard, as follows: Policy 13.4.8. "Support forming a partnership with Metropolitan King County, Westfield Mall at Southcenter, and surrounding businesses to locate a pedestrian friendly transit center on Andover Park West, between Baker Boulevard and Strander Boulevard." 2) Redesignate property from Regional Commercial Center (RCC) to Low Density Residential (LDR) at S. 144th and 51S1 Avenue S.)—Applicant: John Muth (Comprehensive Plan File #L06-095 and Rezone File #L06-096) – Rf 2 i 1/29/2007 Q:\COMP PLAN AMEND 2006-2007%CCMemo1 1.29.07#6.doc The applicant seeks to redesignate approximately .63 acres of a 1.35 acre site from commercial (RCC) to single-family residential (LDR). The property is vacant nursery property adjacent to and associated with the Bonsai Northwest nursery property. Recommendation: The staff and Planning Commission recommended approval of the Comprehensive Plan map change and rezone from RCC to LDR on the condition that the applicant applies for a boundary line adjustment within 90 days after rezone becomes effective. 3) Redesignate property from Manufacturing/Industrial Center -Heavy (MIC/H) to Light Industrial (LI) south of Boeing Field —Applicant:Mikel Hansen/Sabey Corporation (Comprehensive Plan Amendment File #L07-066 and Rezone File #L07-067) The applicant requests to redesignate approximately 34.5 acres of land in the Tukwila Manufacturing/Industrial Center from MIC -H to LI. Located immediately south of Boeing Field, the Associated Grocers warehouse and distribution center currently occupies the site. The entire 64 acre Associated Grocers project area is split between Tukwila and Seattle. Once Associated Grocers' lease ends, the applicant intends to redevelop the site into a mixed use development, most likely including hotel/lodging, office, retail and entertainment uses. By changing the designation from Manufacturing/Industrial Center - Heavy (M/IC-H) to Light Industrial (LI), property would be removed from the Manufacturing Industrial Center, but could be developed in a wider range non- industrial/manufacturing uses. Recommendation: The recommendation was developed between the staff and applicant, and approved by the Planning Commission. The recommendation was to approve a Comprehensive Plan map change and rezone from Manufacturing/Industrial Center - Heavy (MIC -H) to Light Industrial (LI). The rezone shall have the following specific combination of rezone conditions and City Action: 1) Development exceeding 640, 000 s.f. for retail/restaurant/entertainment uses, and 700, 000 s.f. for office uses shall be reviewed administratively by the Community Development Director according to the procedure established for a Type 2 decision. 2) Design review shall apply according to the standards for the Commercial/Light Industrial zone (TMC 18.30.070). Design review procedure shall be followed according to the requirements of the Board of Architectural Review as described in TMC 18.60. Provided that the above conditions are approved, the Planning Commission recommends the following action in support of the rezone: Rf 3 11/29/2007 Q:\COMP PLAN AMEND 2006-2007\CCMemo11.29.07#6.doc • • 3) The City of Tukwila shall amend Figure 18-3, as referred to in TMC 18.50.030, to allow a maximum building height of 10 stories at the site, subject to development and height limitations required by TMC 18.50.045, King County International Airport, and the Federal Aviation Administration. Cumulative Effects of Recommended Amendments The likely impacts of recommended amendments are varied. There is no discernable pattern or nor clear cumulative effect. In general, the effects of the proposed changes are the following: 1. Expanding the area that can be considered for locating a future transit center will potentially allow greater flexibility in finding a site for the facility within the Tukwila Urban Center. (L06-093) 2. Changing the Comprehensive Plan map (L06-095) and Zoning map (L06-096) from Regional Commercial Center (RCC) to Low Density Residential (LDR) is a "downzone," and will enable additional housing to be built. 3. Changing Manufacturing/Industrial Center—Heavy (MIC -H) to Light Industrial (LI) will permit a range of non -industrial uses to be developed at a large site that is split between Tukwila and Seattle, and currently houses a warehouse and distribution center. BACKGROUND This memo will provide background information on the Planning Commission's recommendations and the status of this year's review process. After holding a public meeting on March 5, 2007, the Tukwila City Council forwarded Comprehensive Plan amendment and rezone requests to the Tukwila Planning Commission for consideration. The Planning Commission held a public hearing on March 22, 2007, and made recommendations to be forwarded back to the City Council. Draft Planning Commission minutes are included as Attachment A. DISCUSSION/ANALYSIS/ALTERNATIVES The applications and Planning Commission recommendations are as follows: • Transit Center—Modify Wording. Applicant: Tukwila Department of Community Development (File #L06-093) — The proposal seeks to modify existing policy 13.4.8 to provide greater flexibility in finding a location for a future Transit Center. The current policy states that a future Transit Center should be sited on Andover Park East between Baker Boulevard and Strander Boulevard. In making its recommendation, the Planning Commission wanted to: 1) remove references to specific businesses, including Westfield Southcenter Mall; 2) to enlarge the possible geographic area for siting a Transit Center. The area under consideration as a site for the future Transit Center was expanded considerably to include the entire Tukwila Urban Center north of Minkler Boulevard, rather than focusing on two blocks along Andover Park West corridor in the general vicinity of the mall. The applicant would prefer to apply directly for a Short Plat. Staff therefore would like uphold the Planning Commission's recommendation to approve changing a portion of the property from RCC to LDR, but to modify the condition by requiring a complete Short Plat application, within 90 days of Council approval, rather than a Boundary Line Adjustment application. If the applicant does not submit a Short Plat application within 90 days, the City would draw the boundary between RCC and LDR as per that shown in the application materials. Attachment C shows the subject area.. ACTION Staff requests that the CAP forward this issue to the COW for a briefing at its meeting on May 14, 2007, and to the Regular Meeting on May 21, 2007 for a public hearing. After the hearing on May 21, the City Council will decide whether to approve, modify or reject the requests. RF 2 04/12/2007 Q:\COMP PLAN AMEND 2006-2007\CAPinfomcmo4.24.07.doc • • PLANNING COMMISSION PUBLIC HEARING MINUTES MARCH 22, 2007 The Public Hearing was called to order by Chair Malina at 7:00 PM Present: Chair George Malina, Vice Chair Chuck Parrish, Commissioners Allan Ekberg, Bill Arthur, Henry Marvin, and Lynn Peterson Absent: Margaret Bratcher Representing City Staff: Jack Pace, Rebecca Fox and Wynetta Bivens COMMISSIONER EKBERG MADE A MOTION TO ADOPT THE PUBLIC HEARING MINUTES FROM FEBRUARY 22, 2007. COMMISSIONER ARTHUR SECONDED THE MOTION; THE MOTION WAS UNANIMOUSLY APPROVED. Chair Malina swore in those wishing to give public testimony. PLANNING COMMISSION CASE NUMBER: L06-093 APPLICANT: City of Tukwila REQUEST: Revise existing policy pertaining to the location of a future Transit Center to include Andover Park West and vicinity LOCATION: Andover Park West and vicinity Rebecca Fox, Senior Planner, Department of Community Development gave the presentation for staff. She explained the review process for considering changes to the Comprehensive Plan and Zoning Code Map. The process is legislative and the proposed amendments are only reviewed and adopted once a year unless it is an emergency. The deadline for submitting applications is December 31st. On March 5, 2007 the City Council held a public meeting on applications submitted in 2006 and forwarded them to the Planning Commission for their recommendation. After the City Council receives the Planning Commission's recommendation, another public hearing will be held and a decision will be made. Ms. Fox also gave an overview of the criteria for making Comprehensive Plan amendments and Zoning Map changes. Summary was provided on the proposed change to the Comprehensive Plan Amendment. Staff finds that all criteria were met and recommends approving the amendment as proposed. Bonnie Hanson, Regis Real Estate Services, Development Management, for Open Frame LLC, introduced Christopher Brown, Transportation Engineer. Mr. Brown stated he has taken a look at the Comprehensive Plan and done analyses to the area on the Andover Park West site. Christopher Brown explained what he looked at, why he looked at it, and what his conclusions were relating to the Comprehensive Plan. He stated that the policy plan has already been addressed in policy 13.48 and he does not see any need for change in the policy as it presently exists. He said from his review that he believes it will cause a severe conflict. He stated in his judgment that the Public Works Department has not done a serious study of potential conflict and adverse circumstances. Mr. Brown listed what he considers several conflicts, some of which were pedestrian safety, vehicular safety, sight distance issues at intersections, and transportation Attachment A Planning Commission Minutes ,March 22, 2007 Page 2 of 5 • • efficiency. In conclusion, Mr. Brown said he would like to recommend that the Comprehensive Plan remains as is and not be changed. Commissioner Arthur made a declaration that he has had a past customer, client, consultant relationship with Mr. Brown and Mr. Browns' firm. Commissioner Arthur stated he could be objective. Chair Malina asked for clarification from Jack Pace on the declaration. Mr. Pace stated the Comprehensive Plan Amendment is a legislative decision and that the Planning Commission is only making a recommendation to the City Council. Therefore, there is no conflict of interest. The Commission asked Mr. Brown several questions. Bill Williamson, Attorney, Open Frame LLC, pointed out information concerning a study in documentation that he distributed to the Commission prior to the public hearing. Mr. Williamson said he has not heard anything new from the City on why the policy needs to be changed. He said the City has not identified what land use impacts will happen as a result of the change in policy. He said that the correct means were already decided by the City when the Comprehensive Plan Policy was adopted. It was well thought out, and should not be changed. He stated, based on the Comprehensive Plan criteria that a recommendation of denial should be sent to the City Council. It was described as grossly unfair that one public hearing was being held on this matter. He stated that his clients requested a staff report binder that the Tukwila City Council had in their hands on 2/12/07, and they did not receive a copy until 1 %2 days prior to the public hearing. Mr. Williamson said if the Planning Commission is uncertain, he would ask for more hearings, have more postings, mailings, and get some more comments on the proposal before they make a decision. During his testimony Mr. Williamson made several negative comments about the City's ethics. Mr. Williamson made some comments pertaining to a memo listing the name of a particular City staff, which he said was addressed in the documentation provided to the Commission. Upon questioning from Commissioner Arthur, he agreed that some of the comments made and names mentioned in reality were not included in his documentation. Commissioner Ekberg stated that he wanted everyone to be aware that there are other options for consideration, including broadening the geographic range to include the entire north portion of the Tukwila Urban Center. He said that personally he has heard disconcerting comments about City staff, which he does not appreciate. He also said he does appreciate Mr. Williamson coming forth with information that has been collected in such a short period of time. It was suggested that a look be taken at broadening the cope of where the transit center should be located. He stated he would like to look at it more geographically, requesting staff's thoughts. Mr. Williamson stated that if he has disparaged staff, that it was not his intent. He responded to Commissioner Ekberg's comment regarding opening up to something larger then identifying a single boulevard. Mr. Williamson said his clients would welcome opening this up if the 2005 Transit Plan no longer works or is no longer relevant, and that it really was intended to support the Tukwila Urban Transit Center sub -area. In this case, Mr. Williamson's clients would encourage the City to undertake a complete study, including other parallel arterials. If it's going to be taken as part of a bigger puzzle, then we have to look at the bigger puzzle. He said he would agree that would be the appropriate way to do it. He pointed out that his clients are upset because they have relied upon the policy. Planning Commission Minutes March 22, 2007 Page 3 of 5 • • Commissioner Peterson asked Mr. Williamson if they feel like they have been targeted because the City is requesting a 32.5 ft. dedication of frontage along Andover Park West. Mr. Williamson responded that his clients do feel targeted. He also mentioned correspondence his client received from the City, as well as, verbal statements that tied the project to the 32.5 ft dedication request. Jack Pace clarified that staff's final comment letter made no mention of a requirement for 32.5 ft. Mr. Pace said the City's official record has not requested 32.5 ft. to move the project along. He informed Mr. Williamson he could provide him with a copy of the letter. Mr. Pace asked Mr. Williamson if he would agree that the letter from the City did not request 32 ft. dedication. Mr. Williamson replied that he would agree. Chair Malina stated that the conversation needed to be cut off at this point. Don Malstream, General Manager, Accura, stated he sees it as a benefit to everyone for the City to expand their horizons as to where they are going to place the bus stop. He said he wanted to be on the record and the City understand that is exactly how they feel and they appreciate it ir, fact. REBUTTAL: None Rebecca Fox said she appreciated the comments. She stated that staff did not have the opportunity to see the documentation presented by Mr. Williamson. She stressed that the proposal is to change a policy to give added flexibility rather than selecting a location for the Transit Center. She said information related to selecting a location would probably be helpful when there is full discussion on the site for the Transit Center. Ms. Fox provided some clarification. She said that the public notice that went out exceeded the requirements of the State. The information on the hearing was published in the Seattle Times on March 8th, 2007, and a mailing went out to individuals whom had attended workshops on the Transit Center Design. Regarding the request for the staff report binder, it was made to Jane Cantu, City Clerk, for public records. On March 1, 2007 Rebecca received the request for the materials that were provided to City Council and any communications. She responded by preparing the materials. She stated that she does not know what the process was but regrets that material was not received earlier. In conclusion, Ms. Fox stated that it is common practice that professional City staff prepares the application and the staff report, using professional judgment on the appropriate course of action. It is then presented to the City Council and the Planning Commission considers staff input in developing a recommendation. Ms. Fox also stated in response to questioning from Commissioner Peterson that she is not wearing two hats. She explained that she makes a proposal to amend the policy of the Comprehensive Plan based on her professional judgment. Jack Pace provided some information on what's next in the process if the City Council makes the proposed change based on the Planning Commission's recommendation. There will be an opportunity for Open Frame to present their findings again. Commissioner Ekberg asked for clarification regarding the northern site of the Tukwila Parkway. Commission Arthur called it poor practice and, under the circumstances of their, nor others, not having time to do homework, commented on whether that was fair. He said his most compelling argument, other than what staff presented was clear, logical, testimony and records from Acura. The proposal is consistent with the community goal to provide housing and improve neighborhoods, which is a key goal for Tukwila. The impacts are potentially fewer than what would be allowed currently. The community would benefit from the proposed changed. Ms. Fox explained that the request only covers a portion of the property and it splits the properties into two separate Comprehensive Plan and Zoning designations. One property with two potential designations is not a desirable thing on the same property. Staff recommends approval with the following condition: 1. "The applicant shall complete a Boundary Line Adjustment separating the RCC portion of the property from the LDR portion within three months of City Council approval of the request." Commissioner Ekberg asked for clarification regarding the proposed street location listed on page two of staff's findings in the staff report. Ms. Fox stated the street location should be 145t1i. City review is required to ensure that development and infrastructure requirements are satisified, the action is consistent with the Tukwila Comprehensive Plan, and the plat is properly recorded. REQUIREMENTS: Short plats are administratively approved and do not require a public hearing. However, short plats of 5-9 lots are required to provide public notice, environmental review and to meet the development standards specified for subdivisions (creating over nine lots). PROCEDURE: At the time you submit your application you must have all of the items listed on the attached "Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to your project. Please discuss this waiver request with City staff either at a pre -application meeting or at the time of application submittal. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached checklist. If not complete City staff will mail you a letter outlining what additional information is needed. If you do not submit requested materials within 90 days from the City's request for additional information the City may cancel your application. The short plat process consists four steps: 1. Preliminary approval: Approval of lot patterns, access and infrastructure schematic design. 2. Infrastructure permit approvals: Approval of detailed construction drawings (when applicable). 3. Construction of required infrastructure such as access roads and utilities. 4. Final approval and recording: Final City approval of all construction, City Council acceptance of any infrastructure or property to be turned over to the City and recording with King County. Final documents must meet the King County Recorder's Format requirements. PRELIMINARY APPROVAL: Once the application is complete it will be reviewed by the Short Subdivision Committee, made up of representatives of the Fire, Public Works and Community Development Departments. The Committee will issue a decision to approve, modify or deny the application based on the review criteria. (TMC 17.12.020.C) CRITERIA FOR PRELIMINARY APPROVAL OF SHORT PLATS: The Short Subdivision Committee shall base its decision on an application on the following criteria: 1. The proposed Short plat is in conformance with the Tukwila Comprehensive Plan and any other such adopted plans. 2. Appropriate provisions have been made for water, storm drainage, erosion control and sanitary sewage disposal for the short plat, which are consistent with current standards and plans. 3 Appropriate provisions have been made for road, utilities and other improvements, which are consistent with current standards and plans. 4. Appropriate provisions have been made for dedications, easements and reservations. 5. The design, shape and orientation of the proposed lots are appropriate to the proposed use for which the lots are intended and are compatible with the area in which they are located. Steve Lancaster, Director of Department of Community Development; Mon Wig, and Leshya Wig, Wig Properties; Diane Jenkins, Administrative Assistant to the Council; and Chuck Parrish, community member. Business Agenda: A. Southcenter Square street names Mr. Lancaster indicated that two public streets are being built as a result of the Southcenter Square development. In naming streets, the city has had a history of recognizing former city leaders. Two suggestions are former mayor and council member Ed Bauch and former staff member and council member Mae Harris. Mr. Wig requested that one of the two streets be named "Wig Blvd": after his company. He highlighted his development activities and noted that his family develops and retains property. He further explained his plans to do other development activities in Tukwila. Mr. Wig conveyed that the street located on the north end could be named "Wig Blvd." and suggested that a donation could be made to the city. Mr. Lancaster noted that there is time to process the naming of these streets. Mr. Robertson suggested that committee wait to forward this information onto council and revisit this issue when Ms. Linder is present at the next CAP meeting on February 13. Mr. Robertson noted that a donation could be made to a local charity; the naming of a street would not be contingent on a charitable donation. Ms. Carter further suggested that a "name bank" be developed which could be accessed when future streets need to be named. A developer could also indicate a preference. Mr. Robertson and Ms. Carter both supported naming one of the two streets "Wig;" discussion will continue whether it will be street, boulevard, or drive. Issue to be brought back to February 13 Community Affairs and Park Committee for additional discussion. B. 2007 Comp Plan Amendments Mr. Lancaster reviewed the two amendments being submitted to the 2007 Comp Plan. The first amendment would provide greater flexibility in the siting of a future Transit Center. The second amendment seeks to redesignate .63 acres of a 1.35 acre site from commercial (RC) to single-family residential (LDR). This was only a briefing to the committee; he reviewed the next steps of the process. At the February 12 Committee of the Whole, the council would be briefed and a public meeting held at the March 5 regular council meeting. Following the March 5 public hearing, the council would decide whether to forward these amendments to the Planning Commission. Ms. Carter suggested that pictures of other transit centers be taken; transit centers could range from a bus stop to a large, facility such as those located at Burien or Northgate.
