Vacant structures and premises thereof or vacant land shall be maintained in a clean, safe, secure and sanitary condition as provided herein so as not to cause a blighting problem or adversely affect the public health or safety. On December 4, 2017, I observed two structures; the one in the back which appears to be a two-story, 'mothers-in-law' apartment and the main, two-story structure is the primary residence. Upon inspection of the two structures, the following was observed: Back structure: • All entry points are open. •• Drug paraphernalia observed. • Fire place appears to be heavily used. • One of the bedroom closets had the carpet pulled back and evidence of a small fire had been ignited in this closet. • Human waste on the floor in several rooms. Main Structure: • Rear door has been kicked in. • The other two doors have not been kicked in, but were open to entry. • Obvious signs someone is staying in this structure; bedding, mattress, grooming items. • Drug paraphernalia observed. • Oven was on upon entering the structure. Garbage is defined as the animal or vegetable waste resulting from the handling, preparation, cooking and consumption of food. Rubbish is defined as combustible and noncombustible waste materials, except garbage; the term shall include the residue from the burning of wood, coal, coke and other combustible materials, paper, rags, cartons, boxes, wood excelsior, rubber, leather tree branches yard trimmings, tin cans, metals, mineral matter, glass crockery and dust and other similar materials. On December 4, 2017, I observed 5 -gallon buckets, trash receptacles, garbage bags, and plastic tubs filled to overflowing with rubbish and garbage. Also, rubbish and garbage were strewn on the ground. Corrective Action: Remove rubbish and garbage from the property and dispose of properly. Once the 5 -gallon buckets, trash receptacles, and plastic tubs have been emptied of rubbish and garbage, store these items in an enclosed structure or remove from the property to prevent future illegal dumping. Compliance Date: December 17, 2017 Violation it 3 NUISANCES Code Reference: 8.28.010 Declaration of Nuisance B. The following are declared to be public nuisances: buildings and structures that are determined by the City's Building Official to be vacant and so old, dilapidated or have become so out of repair as to be dangerous, unsafe, unsanitary, or otherwise unfit for human habitation or occupancy, and such that it is unreasonable to repair the structure (collectively referred to as a "Vacant Building"). 8.28.030 Vacant Buildings, Structures and Premises D. Declaration of Nuisance. Abandoned premises, chronic nuisance buildings or premises, vacant nuisance buildings, and vacant nuisance properties are found and declared to be public nuisances. As detailed above, both structures and the premises are unsecured and accessible to unlawful entry. Tukwila Police records reveal there have been six requests for police assistance within the last six months. Several incidents involved people illegally squatting on the property or in one of the structures. Corrective Action: Per TMC 8.28.030(6)(2), board up or otherwise secure all entry points, including all doors and windows, with plywood or other materials for the purpose of preventing entry into the structures by persons or animals.
