SLOPE, GUARDRAIL AND PEDESTRIAN PATHWAY EASEMENT
This slope, guardrail and pedestrian pathway easement is made and given this 2F
day of �1 01-- 1 1 1995, by Fred N. Kruger, as his separate estate (GRANTOR), to and for the
benefit of the CITY OF TUKWILA, a Washington municipal corporation (the 'City').
FOR ONE DOLLAR (S1.00) and other valuable consideration, the receipt and sufficiency
of which is hereby acknowledged, Grantor hereby conveys and quitclaims to the City without
warranties of title, non exclusive easements for the purpose of construction and maintenance
C of slopes for cuts or fills upon the property, construction and maintenance of guardrail, and for
0 construction and maintenance and use by the public of public pedestrian pathway over that
a"'i property more particularly described and shown on Exhibit A attached hereto and

0 incorporated herein by reference (the 'Slope, Guardrail and Pedestrian Pathway Easement')
which is a portion of that property known as that portion of the SE 1/4 S 23 -T 23- R04E, records
of King County, Washington, more particularly described as parcel number 222304- 9019 -03, as
shown on Exhibit B attached hereto and incorporated herein by reference.
The right of the public to use the easement granted herein shall be subject to the
reasonable right of the Grantor to regulate or control any activities which may, in the Grantors
reasonable discretion, present a threat of harm to persons or property, nuisance, annoyance,
disturbance, or breach of the peace on the adjoining property owned by the Grantor.
The terms and conditions of this Easement shall be binding upon and inure to the
benefit of the City, Grantor, and their respective successors and assigns. The easement
conveyed herein is for the benefit of the public, and the burden of the easement conveyed

shall run with the title to the property, and be binding upon the Grantor and their successors
and assigns

Tree Point Road and easterly of the following described line:
Beginning at the east quarter corner of said Section 22;
thence north 88 °11'04" west along the east -west centerline of said Section, a
distance of 520.50 feet';
thence south 0 °53'58" west 329.33 feet;
thence south 83 °15'01" East 248.50 feet to the TRUE POINT OF BEGINNING of said
