Council President Bohrer explained that Councilman Van Dusen is
out of town and Councilman Johanson is working. Councilman
Hill said Mayor Todd is ill and unable to attend the meeting.
MOVED BY HARRIS, SECONDED BY HILL, THAT THE MINUTES OF THE
DECEMBER 10, 1979, COMMITTEE OF THE WHOLE MEETING BE APPROVED
AS PUBLISHED. MOTION CARRIED.
Councilman Hill asked to have someone explain the location of
Upland Drive. It was noted that the cul -de -sac runs west off
of Andover Park West, south of Minkler Boulevard. Councilman
Hill noted the street is only 40 feet wide but that Council
can accept it as long as utility easements are adjacent to the
street. Mr. Phil Fraser, Public Works Department, offered to
provide Council with a map and back up material for the next
meeting.

Council President Bohrer called the Tukwila City Council Committee
of the Whole Meeting to order at 7:00 P.M.
MOVED BY HARRIS, SECONDED BY SAUL, THAT THE RESOLUTION OF
ACCEPTANCE BE PLACED ON THE AGENDA FOR THE REGULAR CITY COUNCIL
MEETING OF JANUARY 7, 1980. MOTION CARRIED.
Mr. Kjell Stoknes, OCD Director, explained that the property
proposed for rezone is currently zoned single family. The
property is located west of the railroad tracks behind the
Carriage House Furniture Store. The owner wishes to construct
a parking facility on the site as the Boeing Facility in
Parkway Plaza needs additional parking area. Councilman Saul
asked if it would disturb the hillside and was told, no.
Councilman Hill asked if this is the area where Council allowed
the toe of the hill to be cut. Mr. Stoknes said the cut is
on the northeast corner of this site. Councilman Saul asked
if there is a creek running through the property. Mr. Stoknes
said he believes this falls under LID #27. It is a ten foot
covered creek along the south side. The only place it is
open is adjacent to the freeway right -of -way. Then, there is
a drainage ditch on the eastern end of the site. Phil Fraser,
Public Works Department, said they are requiring on site water
retention in that area. Mr. Stoknes noted that if this property
was not included in the LID it should be made a condition of
the ordinance. The intent of the LID was that all property
zoned R -1 would not participate in the LID but, at such time as
it was rezoned, the owners would be required to pay their share.
He suggested Staff prepare a report for the next Council Meeting.
Councilman Bohrer asked if the stream is within the boundaries
of the property and was told, yes. He clarified that the rezone
does extend up on the hillside. He asked to have a map at the
next meeting showing the boundaries.
Councilman Bohrer asked if it is the intent of the developer to
move the earth from the northwest side off of the site. Mr.
Stoknes said they haven't been notified. Mr. Fraser said they
have submitted construction plans. They show the earth being
moved around on the site to get good drainage and a connection
to the existing storm system. Along with this they would provide
a retention facility. Councilman Saul said he would like to
know the provisions of the LID. Councilman Hill asked to have
grades on the site. Council wants to prevent any danger to
the rest of the development in the area by prohibiting excavation
on the toes of the slopes. Councilman Harris said, when LID
27 was formed the R -1 property was excluded but it definitely

indicated that when any of the property was rezoned they would
then participate.
MOVED BY HILL, SECONDED BY SAUL, THAT THIS ITEM BE PLACED ON
THE AGENDA FOR THE JANUARY 7, 1980 REGULAR MEETING PROVIDED
THE ADDITIONAL INFORMATION IS AVAILABLE BY THE WEEKEND. MOTION
CARRIED.

Councilman Bohrer reviewed the three items to be brought back
to the next meeting: 1) Staff report on drainage which should
consider the impact on the LID or the alternative of a separate
storage facility; 2) A detailed map of the site showing elevations;
3) The grading plan.
Councilman Bohrer referred to a letter from Mr. E. C. Robinson
of the Ad Bank, Printing and Publishing. Mr. Robinson question
the procedure used in awarding the contract for printing the
preliminary and final budgets. Councilman Bohrer explained
that bid solicitation was at the discretion of the Finance
Director who requested telephone bids from three separate
companies. He supplied this information to the Mayor who
then selected the Company. This company was the second low
bidder. The RCW states that where the cost exceeds two thousand
dollars there shall be a call for bids. The amount involved
here is approximately five hundred dollars for each publication.
Mr. Robinson asked why he was even asked to bid if the RCW
doesn't require it. I have bid for the past seven years.
Sometimes I've been under and I've lost and sometimes I've
been over and I've got the bid. This is a political year and
I think that had a lot to do with it. This year I didn't get
it even though I was $100 below the next bidder. The last
minutes show the Mayor's reasons but not the ones I gave. They
should both be in the minutes. Basically, if it doesn't have
to go out for bid why is it given out for bid. My feeling is
that it was strictly political.
Councilman Bohrer, in answer to the question, speculated that
there was an uncertainty as to what the total might be. All
the bids received were under $2,000. In many cases, where
the city spends money it is good practice to find where the
best price is. The ex Mayor made his statement on December 17 as to
why he made the award.
Mr. Robinson said that he has compared past budgets he printed
and those printed by others and there is no difference. The
Mayor gave the reason as scheduling and quality of work. If
there is any question on quality of work, then I shouldn't even
be asked to bid. I think it is strictly political. I can get
enough facts together to indicate what went on here. This is
why I call foul and feel I am entitled to get the funds I lost.
Councilman Bohrer noted that a legal claim against the City
should be done through the Claim for Damage procedure. He
said it is his impression, in reading the state law, that the
procedure was within the law.
Councilman Hill said that there is nothing Council can do. We
passed the ordinance on the amount to be spent, it is up to
administration as to how it is spent. If there is a legal
question, he suggested Mr. Robinson proceed that way.
Councilman Harris noted that even Council has the right to
reject any and all bids- -even if it's the low bid.
Councilman Bohrer noted that the Flood Insurance Ordinance is
in the Public Works Committee and the revisions to the Fire
Sprinkler Ordinance in the Public Safety and Health.

Other Councilman Bohrer noted that Renton has signed the joint
Resolution concerning the Grady Way Bridge Project.
