Council President Bohrer called the Tukwila City Council Committee of
the Whole Meeting to order at 8:43 P.M.

Kjell Stoknes, OCD Director, explained Formal Council Motion No. 80 -1
had been prepared for Council action. The Council Motion recommended
a procedure for use in approving the Chartwell Development final
waiver that includes reconfirmation of the preliminary site plan for
the development of the entire site after publication of the final
environmental impact statement, and action on the final waiver with the
first building permit application. A design theme and timing schedule
for work on the pond should be submitted with the final waiver.
The Council Members agreed they did not want to deal with each
building, they were interested in the overall development. Mr. Stoknes
said the pond and the changes that might be made to it require the
waiver from Ordinance No. 1035. Councilman Phelps asked the status
of the environmental impact statement. Mr. Stoknes said closing date
for comments is January 21, 1980. Then there will be a 15 to 20 day
period in which the replies will be prepared. The final EIS should
be published in mid February. It should be about March 1, 1980 when
action for reconfirmation of the Chartwell Development comes to the
Council.
Mr. Graham Braham, architect for Chartwell Development Company, with
the overhead projector, showed the plans to preserve the pond and
keep it for wildlife. He pointed out the islands that would be created
to encourage wildlife. In response to a question from Councilman
Harris, Mr. Braham stated they had not determined the depth of the
reconstructed pond, but it would be sufficient to accommodate a 100
year flood. Mr. Braham said they had conferred with Dr. Erickson,
University of Washington, and he had stated the wildlife, including the
more exotic and unusual species, would return to the pond even though
it is drained and reconstructed with islands to attract the wildlife.

Councilman Saul asked where the reconstruction of the pond would be
on the schedule of development? Mr. Ken Chauncey, Chartwell Development,
said the pond will be dealt with on a progressive schedule. That will
be most advantageous because of the parking structure under the
entire project. Councilman Van Dusen asked if the pond would be elim-
inated and then rebuilt? Mr. Chauncey replied that the pond is only
3 to 4 feet deep in the summer. The best way will be to drain the pond
and then reshape it. The draining and reshaping would not be done
during the nesting period, and it would be done just once.
Council President Bohrer said he has been eager to see this development
go forward, but he has some problems with the plans and how they
address Resolution No. 656. The Environmental Impact Statement talks
about several areas. The past few weeks the water in the pond has
been high and it has been covered with wildlife. The site plan as
presented by Chartwell says to him that no part of the pond will be
kept natural, it will be totally reconstructed. Resolution No. 656
says one -third of the area shall remain in the natural state. Item 7
says the area retained in the natural state shall be in the southeast
portion of the pond. In the Chartwell site plan the pond is retained
in the southwest portion. Section 9 says visual access to the pond
and natural area from Strander and Andover Park West will be encouraged.

In the current proposal you cannot see it from either street. Council
President Bohrer said there are several alternatives. Construction of
certain buildings and certain parts of the pond could go on simultan-
eously so the entire pond would not have to be drained completely.
This would keep a portion of the natural grassland and dead trees
and shrubs that are covered intact and would keep visual access to
Andover Park West. There are other alternatives that could be inves-
tigated. He said he wished to have the wildlife disturbed as little
as possible. He said he would like to talk to Dr. Erickson about the
wildlife, there may be other ways to do this.
Councilman Harris said perhaps the Council should take a look at
Resolution No. 656 and the requirement that the pond and wildlife be
visible from both of the streets. She felt it is a traffic hazard
to have people sightseeing as they drive along Strander or Andover
Park East. To enjoy the pond you have to be either shopping, eating,
or walking along the street. She said she had been told the wildlife
will come back after the pond is reshaped. In the summer ponds dry
up, the wildlife leaves, and in the fall as the ponds fill they return.
She thought Resolution No. 656 should be reviewed and possibly amended.
Mayor Todd said an example of how wildlife returns has been shown
down where the City Shops are located. It was bare and the wildlife
has returned. He said he did not see how these people could excavate
without disturbing the natural habitat. Mr. Braham, Chartwell
Development, said they could bring Dr. Erickson to the Council to
answer questions they might have.
MOVED BY COUNCIL PRESIDENT BOHRER, SECONDED BY SAUL, THAT SECTION 2
OF FORMAL MOTION NO. 80 -1 BE AMENDED TO ADD THE FOLLOWING: SUPPORTING
DATA REQUIRED FOR THIS CONFIRMATION SHALL INCLUDE: (a) A SITE
CONCEPT PLAN MAP THAT EXPLICITLY ADDRESSES THE REQUIREMENTS OF
SECTIONS 6 THROUGH 9 OF RESOLUTION NO. 656. (b) A SCHEDULE THAT
SHOWS THE PHASES OF DEVELOPMENT OF THE COMMERCIAL STRUCTURES AND OF
THE POND /NATURAL AREA. (c) THE MEASURES TO BE TAKEN TO ASSURE
RETENTION OF THE POND /NATURAL AREA AS A VIABLE WILDLIFE HABITAT DURING
AND AFTER CONSTRUCTION.
Kjell Stoknes, OCD Director, said the questions seem to be whether
it is reasonable to expect this type of information prior to the
publication of the final EIS and if it is reasonable to assume that
the scheduling can be accommodated in the preliminary phases. They
are separate issues that may or may not be in the EIS. Subsections
(a) and (c) of Section 2 suggested by Council President Bohrer will
be answered in the EIS.

Councilman Van Dusen said the proposed ordinance had come out of the
Public Safety and Health Committee. Council President Bohrer asked
if the fire administration supported the revised
ordinance. Fire Marshal Jim Hoel replied that he was aware of no
objections and felt the ordinance would improve safety and control
fire service cost.

in 1979 be presented at the Council Meeting when the proposed resolution

Bob Richards, Council Analyst, presented a written report on his
activities since becoming the policy analyst last May and future
tasks.

Mr. Richards said in addition to the three major assignments on the
council /manager form of government, child discrimination, and the
development of a central file, he has researched and analyzed the
following topics: Mayor's salary, revision of open space ordinance,
playground equipment, block grant money, Valley communications, City
Attorney, executive sessions /open public meetings, and canine force.
A great deal of time has been expended on research and data collection
in support of the City's labor negotiations. He has provided extensive
data for the Firefighters, Public Works, and Teamster union negotiations.
Mr. Richards reported that he worked for several weeks last summer
with Ron Swanson, Finance Director, on an analysis of the City's
Six -Year Transportation Improvement Program. He is currently
working on a plan for a liaison to the 1980 Legislature and a
proposed City -wide survey.
Mr. Richards said with respect to future projects he had two
suggestions that would be done in conjunction with his academic
degree project. One would be to develop an approach for determining
optimum manning levels for the police, fire, and public works depart-
ments. This study could establish a procedure that could be followed
on a year -to -year basis. The other proposal would be an economic
analysis for annexation areas. This study would be aimed at determining
possible expenditures the City would incur via the annexations.
It was determined by the Council that the manning level project would
possibly be most useful to the Council, since information regarding
the economic analysis of annexation areas has been requested from
the Department Heads. Mr. Richards said he would do the manning level
project for his degree and assist on the economic analysis. Mr.
Richards said some of his research would be done away from the City
Hall. The Council agreed that President Bohrer could change the
Policy Analyst's compensation to an hourly rate based on the current
half -time salary.
Councilman Saul requested that the Council and Department Heads meet
in a retreat. After much discussion February 2, 1980 from 1:00 p.m.
through dinner was selected for the time. The location will be
announced at a later time.
Council President Bohrer announced there would be a meeting of the
AWC on February 15, 1980 at 8:30 a.m. in Olympia regarding the
changing legislation and how it will affect local cities. The meeting
will include lunch and continue into the afternoon. Councilmen Saul,
Harris, Bohrer, and Phelps indicated they wished to attend.
