Signature of Requesting Party Note to submitter: Do not sign above nor pay additional $50 fee if the document meets margin/formatting requirements SEWER LINE EASEMENT GRANTOR, Houghton Harbor LLC, for and in consideration of One Dollar ($1.00) and other valuable considerations, the receipt of which is hereby acknowledged, grants and conveys to GRANTEE, CITY OF TUKWILA, King County, Washington, a municipal corporation, an Easement over, across, along, through, and under the real property situated in King County, Washington, as described on Exhibit A, attached hereto (the "Property"). The Easement granted herein shall be for the purposes of constructing, installing, reconstructing, replacing, repairing, maintaining and operating sewer pipeline(s) and all other lines and necessary connections and appurtenances thereto, together with the right of ingress and egress therefrom for the purpose of enjoying the Easement, and also granting to Grantee and to those acting under or for Grantee the use of such additional area immediately adjacent to the above Easement as shall be required for the construction of the sewer pipeline(s) in the Easement (collectively, the "Easement Area"); provided, the Easement Area shall be held to the minimum size necessary for achieving the purposes set forth herein. Further, immediately after the completion of the construction and installation, or any subsequent entry upon the Easement Area or work therein, Grantee shall restore the Property as near as may be to its condition immediately before such construction or entry. Grantor reserves the right to use the Easement Area for any purpose not inconsistent with the rights herein granted, and Grantee's use of the Easement Area shall not adversely affect Grantor's use of the building or buildings located on the Property. Grantee shall maintain the sewer pipeline(s) and all necessary connections and appurtenances thereto located within the Easement Area in good condition and agrees to indemnify, defend and hold Grantor harmless from and against liability incurred by Grantor as a result of the negligent or wrongful conduct of Grantee, its agents, employees, licensees and contractors in the exercise of the rights herein granted to Grantee and/or the use and/or operation in the Easement Area, but nothing herein shall require Grantee to indemnify Grantor for that portion of any such liability attributable to the negligence or wrongful conduct of Grantor.
