This covenant shall run with the land for as long as the private road is used to serve the lots described below. Owners: The owners of Lot 1 of the City of Tukwila Short Plat No. L04 -065 private road system within the said City of Tukwila Short Plan; AND The owners of Lot 2 of the City of Tukwila Short Plat No. 104 -065 for the private road system within the said City of Tukwila Short Plan Private Ingress /Egress and Utilities Easement: All that portion of Lots 13 and 14, Block 1, Robbins Spring Brook Addition to Riverton, according to plat recorded in Volume 16 of Plats, Page 57, in King County, Washington, EXCEPT the North 25 feet of Lot 13, described as follows: Commencing at the Southeast corner of said Lot 14, said point being also on the West margin of 37th Avenue South, as now established and also on the North margin of an alley, as now established; thence North 01 34'20" East, along the East line of said lot and along said West margin, a distance of 43.31 feet to the TRUE POINT OF BEGINNING; thence South 85 59 57" West, a distance of 55.64 feet; thence South 82 32'03" West, a distance of 18.52 feet; thence North 88 25'40" West, a distance of 29.65 feet; thence North 07 29'31" East, a distance of 20.11 feet; thence South 88 25'40" East, a distance of 26.00 feet; thence North 82 32'03" East, a distance of 17.55 feet; thence North 85 59'57" East, a distance of 58.20 feet to a point on said East line and West margin; thence South 01 34'20" West, along said line and margin, a distance of 20.10 feet to the TRUE POINT OF BEGINNING. The owner(s) of Lot 1 shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation, operation and maintenance of easement usage. The private road shall be maintained as an operable asphalt surfaced road, and any future utilities placed within the private road easement shall be installed, repaired and maintained to acceptable standards. Where any question exists as to the standards to be applied, the owners may obtain a recommendation from the City of Tukwila or its successor agency and /or a licensed engineer. A minimum of both owners may initiate an improvement or repair action. All owners shall share all associated costs on an equal basis, with no fees allowed for administration by one or more of the owners. All funds shall be due at the time that the work is billed by the respective contractor or professional. Independent payment schedules may be used if agreed upon by the majority of the owners. In the event that funds are not paid when due, the aggrieved owner(s) may initiate an action to collect the funds and shall be entitled to costs and a reasonable attorney's fee uppm recovery. This covenant shall be binding upon all owners, their heirs, successors or assigns.
